On August 12, 1902, appearing before T. Smallman, Esq,. Police Magistrate, and Messrs. W. Duncan and W.J. Taylor, Justices of the Peace is Luther Haley, baker. Wilfred Henry Johnston, by his agent Stanley Ernest Elder had applied for a warrant of ejectment under the Landlord and Tenant Act 1890 against Luther Haley from the bakery premises at the corner of Main Road and York Street. From the evidence presented it is made known that Mrs Burgoyne of Eltham had purchased the property some months earlier from Mr Johnston, which consisted of a store and bakery establishment at Eltham occupied by Mr. Luther Haley, and whose lease expired some little time back, and up to the present time, Mr. Haley was not prepared to leave. He informed the court that he was unable to secure at Eltham a suitable house in which to carry on his business, but he was building a place near the railway station which he expected to be done in about three weeks time, at which time he would give up possession of the bakery. Mr Smallman informed the defendant, Luther Haley, that he would have to quit the premises in three weeks from the present date, and that a warrant of ejectment would be issued. However he also informed Mr Haley that he would order the warrant to lie in the office for three weeks from that date. The premises under construction refered to by Luther Haley in court were situated on the western side of Main Road, near the railway station slightly opposite present day Arthur Street. It was opened around September 1902 as a General Store, Bakery and Tea Rooms. In June 2024 Annie Hackrath shared a memory of living in the old bakery: "My husband and I lived in the old bakery for 18 months in 1978-9 , husband Geoff used the old bakery out the back as a wood workshop, making turnery and handcrafted furniture. The front shop was operated as a “sometimes” art gallery which we called “Gouge and Grain”. There were old sheds against the back fence which we thought were probably stables from the bakery days. Lovely memories of the old place which had so much character and seemed to attract a multitude of interesting creative people! Sad that it was pulled down; a friend salvaged some of the lead light glass in the old doors and included it in a new door panel for us."main road, eltham, property, shops, businesses, eltham bakery, burgoyne family, joh ebeli, alistair knox, harry burgoyne, john james thomas neville burgoyne, one tree hill mine, stan bone miner, bill wallace miner, russell yeoman, henry rech, ausminde pty ltd, john street, bridge street, judy paynter, art gallery, gouge and grain, annie hackrath, geoff hackrath -

ELTHAM HERITAGE TOUR The Society excursion on 24th May 1992 was arranged by David Bick, leader of the team carrying out the Shire's heritage study. David selected a number of sites or buildings identified in the study, some of them lesser known components of the Shire's heritage. The tour commenced at the Eltham Shire Office at 10.00 am. Travel was by private car and mini-bus with stops at about twelve locations for commentary by David. It included a short walk in Hurstbridge and lunch at Kinglake. Highlights of the tour included: - 10 am Leave from Shire Offices - 3 Important Trees - A Physical Link to Eltham's First Settlers - Toorak Mansion Gates - A Surviving Farm House - An Intact Circa 1900 Main Street - First Settlers - Gold Miners, and Timber-getters - An Early Hotel - A Pioneering Homestead - Changing Eltham Shire - 20th Century - 4 pm Afternoon Tea and Finish Tour Extract from ELTHAM CULTURAL HERITAGE TOUR (Newsletter No. 85, July 1992, by Bettina Woodburn) "At St Andrews we noted the old and new schools, the Anglican Church, the Hall, the Bakery and the pub – still a popular watering and eating place. Climbing towards Panton Hill the soil was not rich and supported only scarce growth. Perfunctory prospecting and mining had taken place in this area, though not with the diligence applied at Research. Again we saw the ingredients of a settlement, this one organised by Government, the Hotel, the Store, the School. Down from Memorial Park the School grounds had original tree planting and the School Bell dedicated to Maud Rattray who died in 1922. There is a new Hall and opposite in the grounds of the Church and Sunday School a modest Memorial Cross of granite with inscriptions and in memory of four 'fallen comrades'. This small section of the main road retained the small village atmosphere; although the population had increased there had been little alteration."Record of the Society's history and activities and highlighting various aspects of the Heritage Study undertaken by David Bick used to create the future heritage overlay for the Shire of Eltham and later Nillumbik Shire.Roll of 35mm colour negative film, 4 stripsKodak Gold 100 5095shire of eltham historical society, activities, heritage tour, st andrews -

Baker and Grocer store, cnr. Main Road and York Street, Eltham, early 1900s. Sign on side of building "Baker, Grocer & Summer Drinks" This image appears to be of the baker/grocery store after it was purchased in 1902 by Mrs Sarah Burgoyne and her husband, John James Thomas Burgoyne. It is possible that Mrs Sarah Burgoyne is the lady in front of the store with her eldest daughter, Charlotte and youngest son, James. Another daughter (Frances) and the family dog are watching from the doorway. In 1902 Mrs Sarah Burgoyne purchased from Wilfred Henry Johnston, the property on the southern corner of Main Road and York Street, Eltham, which consisted of a store and bakery establishment occupied by Mr. Luther Haley whose lease had expired around the same time. Mr. Haley had not been prepared to leave as he was unable to secure at Eltham a suitable house in which to carry on his business. Wilfred Johnston applied for an eviction of Hayley, which was heard at Eltham Courthouse in August 1902. Hayley advised he was building a place near the railway station which he expected to be done in about three weeks’ time. The court gave him the three weeks to vacate. Hayley’s new premises near the station became the present shopping district’s first shop and he ran it successfully till 1917 when the family moved to Clifton Hill, and he became a publisher. Document, Colony of Victoria, Gold License, 1852
From 1851 the Victorian government required all men on Victorian Goldfields to carry a Gold License. The fee was one pound per month, and was payable in advance. There was agitation surrounding the gold license which was thought to be an excessive fee and did not give the bearer right to representation. On 03 December 1854 the gold diggers on the Eureka Lead fought a short battle against the army and police troopers. A few months later a new system of taxing gold diggers was introduced - the Miner's Right. The Gold License c allowed the bearer to 'dig, search for, and remove gold on and from any Crown Lands' within the district specified on the license. The license was not transferable, and had to be produced on demand. This has resulted in most surviving licenses showing evidence of having been folded and kept in a pocket. The Victorian Gold Licence was issued from 1851 until early 1855. Every man on a Victorian goldfield had to carry a valid gold license, so few survived the harsh treatment of being carried around a working goldfield. There was much dissatisfaction about what was thought to be an unfair mining tax (or gold license). On 29 November 1854 Ballarat miners burnt their licenses on Bakery Hill. On 3 December 1854 the Eureka Stockade Battle took place, resulting in the Goldfields Commission. The first Miner's Right was issued in late June 1855, and in July the first Local Courts were elected by miner's right holders. This gold license was issued around one year after the issue of the first Victorian gold license in August 1851, making it a rare early survivor. This fold lines on this Gold License are evidence of being carried around by the bearer. A original Victorian paper gold license glued onto on old card poster. The original colour of the paper was pale blue. The license has undergone conservation treatment and has been removed from the card.'231', '9 Nov 1852', [name illegible], 'Lod dist [Loddon District?], [Commissioner illegible - probably M. Poster, Public Meeting at Ballarat to Fight TAFE Cuts, June 2012
In October 2011 the Ballieu Government announced funding cuts to public and private technical training organisations as a cost saving measure. The government reduced funding for seven subject areas including business and clerical, finance and hospitality, totaling $300 million across the state. During a visit to Ballarat on 15 June 2012 Premier Ted Ballieu was met by hundreds of protestors angry at the TAFE cuts. It was expected that the Ballarat TAFE sector would be cut by $20million (or 40%), and up to 60 TAFE programs would be cut. A report in 'The Australian' on 01 June 2012 projected the TAFE cuts would result in the loss of almost 2000 jobs across the state. 'If the projections are correct, Victorian college redundancies would dwarf those in manufacturing and aviation, matching the worst predictions of job losses across Australia's entire banking sector.' Ballarat's National Tertiary Education Union (NTEU) and the Ballarat Trades and Labor Council (BTLC) are following up their earlier protest campaigns with a monster meeting to be held at Ballarat Trades Hall, Camp Street on Sunday 8 July. The monster meetings will take place in close proximity to Bakery Hill where over 10,000 diggers protested against an the gold license system in 1854. .1) A brown and black Monster Meeting poster based on the Eureka Monster Meeting poster. The post uses text similar to the 1854 Eureka Poster to advertise a meeting to fight TAFE cuts as announced by the Victorian Government led by Premier Ted Ballieu. .2) A white hand flier with red text calling on the people of Ballarat to attend a meeting at Ballarat Trades Hall to fight TAFE cuts. Photograph - Colour, Pikeman's Dog Statue by Charles Smith and Joan Walsh-Smith, 21/05/2017
A sculpture unveiled on December 3rd 1999, the Anniversary of the Eureka Stockade Rebellion, in Ballarat, Victoria commemorates the Pikeman's Dog . The centerpiece of the sculpture is the bronze Irish Terrier. His stance, is a direct expression of his forlorn anguish, as he sits at the base of a symbolic bronze Pike, his head turned towards the place where once his master stood. The Pikeman's Dog statue was relocated from inside the Eureka Centre to a more prominent position within the Eureka Stockade Memorial Park. The new memorial was unveiled at a ceremony on December 3, 2014 - the 160th anniversary of the Eureka Stockade. The new memorial consists of 22 large golden stockade posts – representing the number of diggers killed in battle – erected in a triangle behind the statue of Wee Jock, on high ground outside the Museum of Australian Democracy at Eureka. The triangular shape of the monument is metaphorically symbolic. The V shape can be interpreted as symbolising victory, and the 22 golden posts represent the 22 diggers who were killed. The Pikeman`s Dog (known as Wee Jock), a little terrier, showed great devotion and bravery at the death of his master at the Eureka Stockade on 3 December 1854. As a result of the attack on the miners by Crown forces, five British soldiers and some thirty miners died. Among the miners lay a Pikeman, mortally wounded with some 15 wounds. Guarding his body throughout the hours it lay unclaimed at the battlefield, and later accompanying it on the death cart as the remaining bodies were transferred to the cemetery, was this small dog. According to reports the dog howled continuously and could not be separated from his master. The dog was awarded the RSPCA`s Purple Cross which Honours exceptional behaviour in serving humans in 1997.Colour photographs of the Pikeman's Dog statue in the Eureka Stockade Memorial Gardens. pikeman's dog, eureka stockade, statue, charles smith, joan walsh-smith -
