The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. Kralcopic Pty Ltd, was a subsidiary of Bendigo-based company GBM Gold and had previously held mining licences around Bendigo, which incorporated sites including Kangaroo Flat, New Moon, Eaglehawk and the associated Woodvale Evaporation Ponds Complex. In August 2019, the Earth Resources Regulator decided not to renew Kralcopic’s three mining licences, due to the company’s inability to provide surety that it could finance its mining activities and site rehabilitation obligations. In October 2020, the company filed legal proceedings in the Supreme Court challenging the decision not to renew these licences. The Supreme Court later upheld the regulator’s decision not to renew the licences. On 23 April 2021, the Federal Court of Australia appointed KPMG as Kralcopic’s liquidators. On 14 May 2021, the liquidator lodged papers with the Australian Securities and Investment Commission (ASIC) to disclaim Kralcopic’s freehold land at Woodvale and parcels of land around the company’s former Bendigo sites, with the land to subsequently become Crown land. The Earth Resources Regulator has put a statutory exemption in place to preclude new mining licence applications on the sites while we undertake rehabilitation. The exemption also provides an opportunity for government to consider future uses of the sites in consultation with the City of Greater Bendigo and the local community. Harriet Cecilia Hordern Williams (1889 - 1968) was the grand-daughter of William Hordern (1830 - 1881) and Cecelia Monger (1830 - 1914). William Hordern was the sixth of seven children of Anthony Hordern Snr. who established the Anthony Hordern & Sons department store in Sydney which operated from 1923 to 1970. Harriet's mother Cecilia (1854 - 1934) was married to Christopher Williams. Harriet's uncle William was appointed commissioner of the Supreme Court of South Australia in 1903. Her cousin Doris Amelia Hordern (1889 - 1970), as Doris Blackburn won the Federal seat of Bourke in 1946 following the death of her husband who had previously held the seat. This branch of the Hordern family has a strong connection to Hawthorn through their home "Stramshall" in Auburn Road Hawthorn and also with the Auburn Baptist Church. Harriet Williams enlisted in the Australian Army Nurse in December 1916 and served as a Staff Nurse until her marriage in London in 1919. This certificate is significant to the history of Hawthorn and Australia through its connection with the Hordern family, the home Stramshall in Hawthorn and with the Auburn Baptist Church. It is significant to the history of the Royal Children's Hospital Melbourne as an example of early 20th century training protocol, in the persons who signed the certificate and the photographs of the hospital buildings of that time. Mount Pleasant Primary School 1435 was formerly known as Clayton's Hill, and evolved from a tent school, commenced in 1855 by William McIntosh. When changed from a Wesyleyan day school to a Common School it was given the number 424, received State funding and was conducted by William H. Nicholls. On 01 January 1873 the school became a non-vested school under control of the Education Department until 31 August 1873. The State then leased the school until 31 July 1874, with the current brick school, Mount Pleasant No.1436, opening on 01 August 1874. The Head Teacher of the new school was William H. Nicholls, remained at the school until 1887. His assistants were Thomas Gray, Jane Shaw, Jane Tratham, Catherine J. Berriman, John Blight, Herbert Berchaivaise and Annie Hicks, all who had worked at Mount Pleasant No. 424. William Nicholls and his assistant Gray established after school classes to enable students to gain Exhibitions and Scholarships to matriculate for the University of Melbourne, and courses enabling entry to teaching, pharmacy and civil service. Before the establishment of State Secondary and Technical Educaiton over 100 pupils from Mount Pleasant Primary School has matiriculated and entered the various professions. (Visions and Realisations, Vol. 2, pg 653 and 767) William Henry Williams became the first classifier of teachers for the Victorian Education Department. He died aged 51 while Head Teacher at Yarra Park Primary School on 01 April 1899. Some former students of this school include: J.G. Eagleston (County Court Judge); H.E. Went to Western Australia in 1897 and acted for a time as Deputy Master of Western Australia Supreme Court. In clothing, a collar is the part of a shirt, dress, coat or blouse that fastens around or frames the neck and may be permanently attached to the main body of the garment (e.g. by stitching) or detachable. These Moorabbin Mayoral Robe with Jabot are now displayed along with those of the former City of Chelsea Robe and the former City of Mordialloc Robe at Cheltenham . KCC possesses the original Mayoral Chains of each former Council and they are displayed on each Robe for the annual Opening Meeting of KCC in February. This set of a 'Jabot' style collar and cuffs was part of the ceremonial Mayoral Robes c1960- 94 for the City of Moorabbin 1934-94. This is the last City of Moorabbin Mayoral Robe and was worn by Mayor Ron Brownlees, (prior to amalgamation with the City of Glen Eira and City of Kingston in 1994), and donated to the City of Moorabbin Historical Society in February 2007 by the City of Kingston.
