Correspondence held by the library has John Denniston Wood (1829-1914), a barrister and politician, presenting the portrait to the Library Committee in 1867. Wood hopes that the painting will "hang there [in the Court] in like manner as the portraits of many of the sages of the law are held in the Courts at Guildhall". Wood also provides information about the painter, Mr Mosely "now deceased", but who was "selected by Sir WIlliam himself" to undertake the commission. Early accounts have the painting hanging in a prominent position in the 'old' Court house at La Trobe and Russell Streets; the portrait was moved down to the library in 1884, when the portraits of Barry, Stawell and Molesworth were also commissioned. Sir William a'Beckett was the first chief justice of the colony of Victoria, having previously had a busy career at the Sydney bar. The portrait is of historic signifcance because of its subject Sir William a'Beckett and its long association with the Court. The portrait was commissioned after Higinbotham's death in 1893. A committee was appointed to investigate the making of a portrait and they appointed Mr L Bernard Hall, instructor and later director of the National Gallery of Victoria. George Higinbotham (1826-1892) had a distinguished career as a newspaper editor and politican before becoming a Judge of the Supreme Court in 1880 and the third Chief Justice in 1886. Higinbotham was a long serving attorney-general in the 1860s colonial administration. Higinbotham was active in the education, land and constitutional debates of his time. He played a prominent role through his chairmanship of the of the Royal Commission into Public Instruction with regard to the introduction of the free and secular primary school education.The portrait of George Higinbotham is of historic significance as the depiction of an important public figure in 19th Century Victoria. The Argus reports that “In 1916 the members of the bar took the opportunity afforded by his [a’Beckett’s] 80th birthday, and the completion of 30 years on the bench to present to the judges of the Supreme Court, with his permission a portrait of himself, to be placed in line with portraits of other judges in the Supreme Court library. The portrait which depicts Sir Thomas a’Beckett in his robes, was an excellent piece of work of Mr Max Meldrum. The unveiling was made the occasion of a little demonstration at which some congratulatory speeches were made." Sir Thomas a'Beckett arrive in Melbourne as a teenager with his parents in 1851. His uncle was the former Chief Justice, his father a well known solicitor. At the Bar Sir Thomas mainly worked in the Equity jurisdiction, which he took as a specialisation with him to the bench. This is an early work of Meldrum, he won the Archibald prize for portraiture in 1939 and 1940.The portrait is of interest for whom it portrays and as the early work of a well known artist.A full length portrait in oils of Justice Sir Thomas a'Beckett. Sir Thomas is seated, his feet placed on a plush red foot stool. He is dressed in his red judicial robes with white fur trimming and black trousers and a full bottomed wing. Justice a’Beckett has a white beard and moustache, he was 80 years of age when this portrait was painted. In his hand he holds a rolled document. At his elbow, there are books upon a table. He sits in a fine carved wood and leather chair, in the background a gold frame is just visible. A line in the canvas indicates that the size of the painting was expanded. This portrait was presented by the Victorian Bar to the Library in 1917 to commemorate Schutt’s fifty years as the Supreme Court Librarian. The portrait was presented at a ceremony presided over by Mr Mitchell KC who noted the “unanimity with which the members of the profession had adopted the suggestion that the eminent services of Mr Schutt should be recognised in this way.” Chief Justice Madden also spoke on this occasion and there were a number of judges and members of the legal profession present. John Schutt had been born in England in 1831 and migrated to Victoria as a young man, initially working as a school teacher he was appointed librarian, during Redmond Barry’s time in 1866. He started work in the Old Court in Russell street and would have supervised the move of the library to its new and greatly expanded premises in William Street in 1884. As well as secretary to the Library committee, he also acted as the Secretary of the Board of Examiners on occasion. After his death in 1919 in its obituary, the Williamstown Chronicle noted that Schutt was regarded as a Solon, an ancient greek law giver who gave wise advice. Away from the Court he was a councillor of many years standing in Williamstown, representing the Victoria Ward, what is now the suburb of Newport, it would appear Schutt street in Newport was named after him. His eldest son William Schutt was appointed a Supreme Court judge in 1919. The portrait of Schutt is a companion piece to the Sir Thomas a’Beckett picture painted shortly before the Schutt portrait and for the same client, they share the same frame design with gum leaf motif. This portrait was undertaken early in Meldrum’s career and before he had fully developed his theory of painting. Duncan Max Meldrum (1875-1955) was a controversial figure in his later years as he strongly opposed modernism and non-figurative art. His works are found in most of the state galleries, including a wide selection at the National Gallery of Victoria. This portrait is of interest for whom it portrays and as the work of a well known artistFull length portrait in oils of John Schutt. Schutt is standing up looking out the to the viewer. His hand rests on a small pile of books. He is dressed soberly in a three piece black suit. His white beard and hair all meticulously trimmed and realised. The props used in this painting provide the main colour as the background has become dark over the years. The books sit atop of a red and gold draped table. Behind Schutt is what appears to be a crimson velvet chair and he gives every appearence of having just arisen from the chair to engage with the viewer. The painting has an unusual light source at the foot of the painting with Schutt's legs providing shadows. Signed Meldrum lower right hand corner. Plaque inscription is John Schutt, Esq. Tait collection: item 27 of 62. This document contains details of the Will of William Stacey Spencer, formerly of Stanstead, Mount Fitchet but late of Birchanger, Essex, England. He was a corn merchant and malster and died in England in October 1897. He left an estate with a gross value of £4973, with the beneficiaries being his wife and children. Three codicils were added to the will, one being caused by the death of an executor, William Spencer’s brother. The English lawyers involved in drawing up this will were Richardson, Foxwell and Hart of Much Hadham, England. As this document is an Exemplification of the Will and was drawn up in the colony of Victoria it is presumed that one or more of the beneficiaries was a resident in Victoria and possibly in the Warrnambool district. The Warrnambool lawyers, Henry Parrington and Con O’Mahony have their names in the document. The document has been, with others, passed down to successive lawyers occupying legal premises in Kepler Street, Warrnambool and located in that building in 2014. Unless some local connection can be found to William Spencer, this document is of interest only in that it was drawn up by local Warrnambool lawyers in 1899.This is a cream-coloured document consisting of five double parchment pages bound together with green cord and including a folded-over inset piece of paper on the front page. Nine of the pages have ruled black lines on the edges and there is handwritten material in black ink on nine pages. The document gives details of the will and codicils of William Spencer of Essex, England who died in1897. The document has the seal of Her Majesty’s High Court of Justice, Probate Division, attached with white binding and a stamp for three pounds attached with a metal insert. Warrnambool and District Historical Society Inc.Certificate - Invitation to the opening of the Parliament of the Commonwealth of Australia, 1900
This certificate is an invitation to the opening of the first Parliament of Australia on January 1st 1901 in Melbourne. On this date the six Australian self-governing colonies were federated to become the six states of Australia. The designers of the certificate were Norman Lindsay and John Longstaff. This particular invitation was sent to George Rolfe and his wife and two of his stepdaughters, Annie and Florence. George Rolfe (1836-1919), a tea merchant from Melbourne, began buying blocks of land near the mouth of the Hopkins River in Warrnambool in the 1870s. By the early 1880s Rolfe owned 50 acres in the town, including farming properties and used the buildings near the mouth of the Hopkins as holiday accommodation. He called his property Lyndoch which he improved with the addition of stables, chaff and bone sheds, jetty, boathouse, reservoir, water well and windmill and extensive gardens and he spent most of his later life in this Warrnambool area. Lyndoch today is the site of an aged care facility. This certificate is of considerable importance for two reasons: 1. It is an important memento of a signal event in Australia’s history - the Federation of the States in 1901. 2. The certificate was an invitation to the family of a prominent Warrnambool person – George Rolfe of Lyndoch.This is a piece of thick paper with illustrations and decorations in brown, red, blue, yellow and green tonings. The lettering is in white with coloured capital letters. The images include the shields of the six Australian States, the Coat of Arms of Britain and Australia, outlines of two trees (gum tree and oak tree) and three symbolic female figures representing Justice, Britannia and Australia. The top border decoration represents the waratah flower. The original Shire of Eltham was founded in 1871. Prior to its founding, the district was managed by the Eltham District Road Board, which was established in 1856. The initial rate assessment commenced in 1857 for the year ending October 14, 1858. The honour of being recorded with the first assessment went to a farm of 110 cultivated acres at Lower Plenty, owned by John Porter and occupied by Albert Baines. It was assessed at 6d/acre providing for a rate income of £2 15s. In July 2017, officers at Nillumbik Shire Council discovered some early Eltham Road District Assessment books and donated them to the Eltham District Historical Society. The seven volumes were the district’s first six years of rate assessments. This was a unique and significant record of early settlers in the pre-Shire of Eltham. They immediately became one of the oldest and most valuable items in our collection. An article on page 5 in the Eltham and Whittlesea Shires Advertiser, Friday, 21 November, 1941 titled: ‘District’s Early History‘ states: “The first rate book which is still in existence at the Shire Office is for the year ending October 14, 1858 and is probably the best record possible to indicate the development of the district. At the time properties were rated as follows: Cultivated land. 6d. per acre; pasture land, 1d. per acre: estimated annual value of buildings, etc., 6d in the (pound). The total amount of rate recorded for the year was £153/14/8. Properties were described as being situated at Lower Plenty, Yarra Yarra, Eltham, Lower Eltham, Kangaroo Ground, Yarra Flats, Diamond Creek and the Yarra.” Given the precious nature of this collection, priority was given to digitise the rate books and place them in suitable archival storage to minimise further handling. Subsequent discussion amongst our Collections team arrived at the conclusion that the most appropriate home for this valuable record was the Public Record Office Victoria (PROV), the archive of the State Government of Victoria and who are charged with archiving and caring for all Government related records. An approach was made to PROV who confirmed these records would complete their collection of rate assessment books for Eltham. At a small ceremony held Friday, April 20 at the Local History Centre, Eltham, members of the Society and our Collections team, along with Ms. Vicki Ward, MP for Eltham, presented the seven volumes for 1858-1863 along with the complete set of digital files to Mr. David Taylor, Community Archives Manager and Mr. Charlie Farrugia, Senior Collection Advisor, Public Record Office Victoria.Born Digitalassessment ledger, donation, eltham courthouse, eltham road district, local history centre, public records office victoria (prov), rate books, eltham district road board -

On August 12, 1902, appearing before T. Smallman, Esq,. Police Magistrate, and Messrs. W. Duncan and W.J. Taylor, Justices of the Peace is Luther Haley, baker. Wilfred Henry Johnston, by his agent Stanley Ernest Elder had applied for a warrant of ejectment under the Landlord and Tenant Act 1890 against Luther Haley from the bakery premises at the corner of Main Road and York Street. From the evidence presented it is made known that Mrs Burgoyne of Eltham had purchased the property some months earlier from Mr Johnston, which consisted of a store and bakery establishment at Eltham occupied by Mr. Luther Haley, and whose lease expired some little time back, and up to the present time, Mr. Haley was not prepared to leave. He informed the court that he was unable to secure at Eltham a suitable house in which to carry on his business, but he was building a place near the railway station which he expected to be done in about three weeks time, at which time he would give up possession of the bakery. Mr Smallman informed the defendant, Luther Haley, that he would have to quit the premises in three weeks from the present date, and that a warrant of ejectment would be issued. However he also informed Mr Haley that he would order the warrant to lie in the office for three weeks from that date. The premises under construction refered to by Luther Haley in court were situated on the western side of Main Road, near the railway station slightly opposite present day Arthur Street. It was opened around September 1902 as a General Store, Bakery and Tea Rooms. In June 2024 Annie Hackrath shared a memory of living in the old bakery: "My husband and I lived in the old bakery for 18 months in 1978-9 , husband Geoff used the old bakery out the back as a wood workshop, making turnery and handcrafted furniture. The front shop was operated as a “sometimes” art gallery which we called “Gouge and Grain”. There were old sheds against the back fence which we thought were probably stables from the bakery days. Lovely memories of the old place which had so much character and seemed to attract a multitude of interesting creative people! A letter from Mrs M Ring to the Caulfield Historical Society, dated 14/03/1986, conveying gratitude for the information provided about the house Crotonhurst located at the corner of Hawthorn Road and Glen Eira Road, Caulfield North, and requesting information about the Langdon and Webb families and the property Lirrewa. Enclosed with the letter is a copy of a two page report on the Life of George Frederick Webb. The file also includes a seven page report conducted by Irene Victoria Anderson in 1982 on the history of the Langdon and Webb families and the house Crotonhurst. In February 1965, Staffs Railway Store, the oldest business premises in the Eltham shopping district was demolished. Formerly a self-service grocery, restaurant and electrical repair shop, the building for many years housed Eltham’s only ‘family’ grocer and feed store. Earlier it had appeared to have been the town’s bakery. The building had been purchased in late March 1939 by Mr Eric N. Staff. At the time of E.N. Staff’s purchase there were huge bakers’ ovens located at the rear and the building also had a well and four toilets for employees. When the ‘pictures’ came to Eltham with the opening of the Eltham Public Hall across the road in 1941, Mr E.N. Staff extended the business and opened a milk bar and sweet shop. Further extensions re-established the tea rooms of days gone by. Mr E.N. Staff conducted business for about 15 years before handing over the reins to his son, Ray Staff. When his son Ray took over, the milk bar and tea rooms were closed for several years but the milk bar and was later re-opened and subsequently became a greengrocers and later again, a restaurant. The tea rooms section was converted to an electrical repair shop about 1955. Electoral Roll records for 1967 record Raymond Charles Staff at 929 Main Road, Eltham, grocer, and in 1968 at Lot 4, Hillcrest Avenue, Eltham, taxi truck operator. So it would appear that Ray continued to run the business for approximately two years after the original store was demolished and a new supermarket was built. Today, 929 Main Road is the Nongkhai Thai Restaurant and is precisely where the original Staffs store stood. Even though the facade has been modified at eye level with new larger windows, the upper facade is identical to that of the new Eltham Big Star Food Centre of 1965/66. But how did the original building, the oldest premises in the 1965 era shopping centre come about? On August 12th, 1902 at the Eltham Courthouse, appearing before T. Smallman, Esq,. Police Magistrate, and Messrs. W. Duncan and W.J. Taylor, Justices of the Peace is Luther Haley, baker. Wilfred Henry Johnston, by his agent Stanley Ernest Elder had applied for a warrant of ejectment under the Landlord and Tenant Act 1890 against Luther Haley from the bakery premises at the corner of Main Road and York Street. From the evidence presented we learn that Mrs Burgoyne of Eltham had purchased the property some months earlier from Mr Johnston, which consisted of a store and bakery establishment at Eltham occupied by Mr. Luther Haley, and whose lease expired some little time back, and up to the present time, Mr. Haley was not prepared to leave. He informed the court that he is unable to secure at Eltham a suitable house in which to carry on his business, but was building a place near the railway station which he expected to be done in about three weeks time, and he is then prepared to give up possession of the premises he now occupies. Mr Smallman informed the defendant, Luther Haley, that he will have to quit the premises in three weeks from the present date, and that a warrant of ejectment would be issued. However he also informed Mr Haley that he would order the warrant to lie in the office for three weeks from that date. The premises under construction referred to by Luther Haley in court were situated on the western side of Main Road, near the railway station slightly opposite present-day Arthur Street. It was opened around September 1902 as a General Store, Bakery and Tea Rooms. This was the original building in the present-day shopping precinct. At the time the only thing nearby was the railway station. Luther Haley’s business appeared to prosper and he would have catered to not only the locals abut also day visitors by train on Sundays coming up from Melbourne, offering fresh baked produce, tea rooms and summer drinks. The fields across Main Road running between present day Arthur Street and Luck Street were known as Haley’s Paddock and at times were used for community festivities and picnics. A newspaper report on the annual State schools picnic held at Haley’s Paddock on March 11, 1904 described it as “quite close to the railway station, and is quite capable of holding comfortably 10,000 people. With its ample shade and hilly surroundings, it is an ideal place for any gathering.” Luther Haley successfully ran his general store, bakery and tea rooms until 1917 when he and his family departed the district and moved to Westgarth Street in Northcote where he changed careers and became a publisher. It was then taken over by Hannah Lloyd and became known as Lloyd’s Railway General Store from 1917 to 1920. From then it had a succession of owners, one as short as two months until March 31, 1939 when the Grocery Business formerly carried on by Mr. T.K. White of Eltham for the previous eight years was purchased by Mr Eric N. Staff of Research and became known as E.N. Staff’s Railway Store. Man in photograph has been incorrectly identified as Frederick John Barton. Francis Adam Barton was the son of Thomas John Barton. Thomas John Barton was born in 1836 in Gloucestershire and after his father died in 1850 arrived in Melbourne in 1852 along with his mother, adult sisters, younger brothers, his uncle, his uncle's wife Suzanna and their family. Thomas tried gold mining at Woods Point but found it too difficult. He then partnered with Ewen Hugh Cameron to provide the miners with meat. In 1864 they purchased a plot of land in Marysville and set up a butchers/abattoirs and from there began their business of taking supplies to the miners at the nearby Woods Point and Jamieson goldfields. In 1865 the business was firmly established and Thomas married Selina Croker at Heidelberg and brought her back to Marysville. Their first home was 'The Chestnuts', which included the store, and was situated on the town side next to the Steavenson River. Sadly, in 1876 Selina died of complications after giving birth to their sixth child. Thomas was in need of a nanny to care for his six children, including the newborn baby, and so he employed Emily Ada Sparke, who is the eldest daughter of the local school teacher. Thomas and Emily subsequently marry in 1878 and they go on to have a further 10 children over the next several years. Thomas assisted in the establishment of the first school in Marysville in 1870 and remained a very active member of the community including as a Councillor for the Shire of Healesville, Shire President and he was also appointed as a Justice of the Peace. Thomas died in Carlton in 1911. After their father's death, his sons Fred and Frank took over the family business, which was then known as Barton Bros Store which continued to operate until sometime in the 1970's.Mr F.J. John Cleeland JP of Newhaven, 1826-1914, a native of County Down, Ireland, came to Victoria in 1840 with his parents and settled at Darebin Creek. After a few years spent there he went to sea in his schooner yacht of 200 tons, the Harriet, visiting the South Sea Islands and the west coast of South America. In 1859 he took the well known Albion Hotel, Bourke-street east, Melbourne, the starting place for all Cobb and Co's lines of up-country coaches, and kept it for 22 years, marrying whilst there Miss Blake, of Mornington. Shortly before leaving the hotel he purchased 7000 acres of land at Phillip Island for breeding purposes, and there bred Wollomai, who won the Melbourne Cup in 1875. In 1881 he retired to his magnificent estate, besides which he has another 1000 acres at Bass and other properties. He also once owned racing stables at Brighton, where he had Barwon (which won the Champion race) and other valuable horses. Mr Cleeland is a member of the Phillip Island Council and is a justice of the peace for the central bailiwick. Taken from Victoria and its Metropolis: past and present, 1888. The Album was compiled by Nancy McHaffie late 1990's, with the assistance of Edith Jeffery's, with her book "Garden of Memories" and extensive knowledge of Phillip Island. The Cemetery lies back from the road and is surrounded by Manna Gums, rare Peppermint Gums, Blackwoods and other native trees. In all 25 acres of land were set aside as Crown Land in the land settlement of 1868. There are 6.2 acres of wetlands near the cemetery entrance.466-34: Captain J. B. Lock. John Barnard Lock was associated with the trading vessels to operate from Phillip Island when the settlers had most of their goods brought from Melbourne. He died in 1908 and is laid to rest in the family grave. The grave is surrounded by metal railing and flowers. 466-35: David Charles Justice. David came to the Island in 1898. He was a blacksmith, coachbuilder, farrier, agricultural engineer, wheelmaker, shipbuilder and farmer. He purchased a farm from the Harbison Estate in 1911 in the Ventnor township. He assisted Mr Will Kennon in building a punt used to recover equipment from the wreck of the "Speke". "Dinny" as he was called, married Isabella Miller (an early settlers' family).
