The offer was accepted and the contract for the sale was drawn up ...These documents concern the 19th century proposed sale of the legal practice of Henry Parrington of Warrnambool to Samuel Backhouse of Collins Street, Melbourne. Samuel Backhouse came to Warrnambool to inspect the Parrington practice and offered £750 for the practice. The offer was accepted and the contract for the sale was drawn up. Henry Parrington then withdrew from the sale and was sued by Backhouse for breach of contract. Backhouse was wanting £150 compensation. The outcome of this case is not known. Henry Roberts Parrington qualified as a lawyer in England in 1873 and worked as a barrister and solicitor in New Zealand from 1876 to 1886. He then came to Australia and worked for the legal firm of Messrs Higgins in Geelong and for Bayly and Higgins in Warrnambool. The business in Kepler Street, Warrnambool later became known as Higgins and Parrington and, in 1900, as Parrington and Tait (partner John Sym Tait). When John Tait retired in 1901 Henry Parrington was the sole proprietor of the practice. He died in Melbourne in 1926. These documents are of considerable interest as they outline an episode in the life of Henry Parrington, a well-known lawyer in Warrnambool in the late 19th century and the early 20th century. These are eleven documents pertaining to the Warrnambool lawyer, Henry Parrington. There are four single-sheet letters – two have blue typing and two have handwritten material in black ink. There is one telegram with both printed and handwritten material and a Post Office stamp. There are two envelopes which have been sent by mail and which have mauve Victorian twopenny stamps. These envelopes are torn at the top. The first President was declared to be Ernest James Andrew, Honorary Secretary, A.J. Morse, Honorary Treasurer, Charles Robert Nicholls and the first elective committee to be Thomas Nunn Jewell, William John Pasco, George Burchall, William James Burgess, John William Cox, Ernest James Andrew, John Michael Ryan, Frederick William Gillespie Didfield, Charles Harold Williams, Joseph Banks, Laurence Bourke, Charles Robert Nicholls, William James Capewell and James Pascal. This committee was appointed until the Annual meeting of subscribers held in January 1923 at which point all could stand for re-election (held annually). The Trust Deed was signed by Ernest James Andrew, William James Capewell and George Harrison in the presence of John Michael Ryan, Builder of Eltham, 5 August 1922. Originally purchased in 1856 from Thomas Roberts, Yeoman of Little Eltham, for £10 for use by the Wesleyan Chapel, represented by indentured Trustees, Rev. Barnabas Shaw Walker, Minister of the Pentridge Circuit, Francis Thomas, Farmer of Keelbundora, William Harriman, Blacksmith of Nillumbik, Nicholas Rodda, Farmer of Nillumbik, Aaron Grimshaw, Farmer of Greensborough, Joseph Cooper, Gardener of Keelbundora, Peter Dredge, Scholmaster of Jika Jika and Samuel Jeffrey, Farmer of Jika Jika. Lot 20 of Subdivision of Portion 13, Section 4 of the Parish of Nillumbik in the County of Evelyn was located on the southern side of Henry street in Little Eltham North, where the current Our Lady Help of Christians Catholic Church is situated. It became the location of the Eltham Rechabite Hall. In 1893 a new hall was built and further enlarged in 1919. At the commencement of 1922, the property was purchased from the Independent Order of Rechabites with publicly subscribed funds and a new hall built at a cost of £750 and improved road access constructed to reduce the grade, running from Dudley Street to Henry Street. This hall was eventually replaced with the new Shire Offices and Hall built on the corner of Arthur Street and Main Road, which was opened in 1941. In 1963 the Shire of Eltham purchased the Shillinglaw property of approximately 2 acres in Main Road, Eltham for the widening of Main Road and as a site for new Council offices. This land, which contained the Shillinglaw Cottage (c1878-80), was the remaining section of the Shillinglaw family holding that originally comprised 30 acres, being Lot 90 of Holloway's 1851 subdivision. Eltham Council intended to demolish this cottage, but through extensive community action it was saved, funds were raised, and it was relocated to the current site adjacent to the Eltham Library. The new Eltham Shire Offices opened in 1965 were designed to ensure retention of the three Italian Cypress trees that were located outside the Shillinglaw Cottage. In 1971 the building was extended at the southern end to provide additional space, including for the Eltham Library and Council's Engineering Department. Renovations were undertaken to the offices during 1987. The Victorian State Government commenced to restructure local government in 1994, which resulted in the establishment of the Shire of Nillumbik and the cessation of the Shire of Eltham. This new Nillumbik Shire Council was headed by government appointed commissioners, who decided in 1995 to put the former Eltham Shire offices on the market. Eventually in June 1996 the property was sold for $1.1 million and the building was subsequently demolished. A planning application for the site was then submitted to Nillumbik Shire Council in September 1996 for construction of a 24-hour service station, convenience store, cafe/takeaway food premises, a retail facility and community facility. There were many objections to this proposed development and in controversial circumstances a planning permit was granted by the Nillumbik Shire Council commissioners. After protracted actions involving a planning panel and a planning advisory committee, established by the Minister for Local Government, the proposal was eventually rejected as not satisfying the requirements of the planning scheme. In December 1997 the purchaser withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract. While there have been a number of possible development proposals considered by subsequent Nillumbik Shire Councils, this site has remained vacant since July 1996. TIMELINE (Prepared by Jim Connor, Eltham District Historical Society- March 2018- Based on press, council and personal records) June 1996 - Eltham Shire offices sold to Dallas Price Homes for $1.1 million. July 1996 - Shire office building demolished against community's wishes. Council claimed building riddled with asbestos. September 1996 - Planning application submitted to Nillumbik Shire Council to construct on the site a 24 hours Shell service station, convenience store, Hungry Jacks café/takeaway food premises, a retail facility and community facility. 213 objections and petition of over 1400 signatures received. Minister for Planning and Local Government orders an independent investigation into valuation and sale. 9 October 1996 - Permit granted by Nillumbik Shire Council commissioners, in controversial circumstances. A Planning Special Committee consisting of 3 commissioners and 3 community representatives considered 32 community objections. One commissioner declared a potential conflict of interest so only 2 commissioners were able to vote. After hearing all objections, the community representatives moved a foreshadowed motion to refuse a permit. The commissioners then closed the meeting, formerly opened a council meeting (for about a minute) and approved the application. October 1996 - Community members appealed planning decision to Administrative Appeals Tribunal. November 1996 -Minister for Planning and Local Government Robert McClelland calls appeal in and directs MT to refer this 'major policy issue' to the Governor in Council. February 1997 - Planning panel (Dimity Reed and Margaret Pitt) established to consider submissions. March 1997 - New council elected with five councillors. April 1997 - Three of the five new councillors vote to fight Commissioner's decision to grant a permit. April 1997 - Planning panel (Dimity Reed and Margaret Pitt) conducts hearings at Nillumbik Shire offices. June 1997 -Planning panel rejected Dallas Price Homes proposal as being 'totally inappropriate' for the site and recommends the site be rezoned for 'public purposes'. July 1997 - Dallas Price Homes threatened to sue Council and individual councillors. October 1997 - Report released of an Advisory Committee (Paul Jerome) established by the Minister for Planning and Local Government. Committee considered Dallas Price Homes proposal and an alternative concept plan proposal by Council for a gallery, workshop, offices and cinema community-based development. Advisory Committee recommended Dallas Price Homes proposal be rejected as not satisfying the requirements of the planning scheme and recommended further testing of the financial viability of Council's proposal. December 1997 - Dallas Price Homes withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract, which expired on 28th November and was not renewed by either side, after previously being extended twice pending a decision by the Minister. Council had to pay developer $58,000 for demolition costs. February 1998 - Dallas Price Homes application rejected by Planning and Local Government Minister. October 1998 - Nillumbik Councillors suspended and an Administrator appointed (until March 1999). The demolition of the former Shire of Eltham offices and proposed sale and development driven by the Commissioners for Nillumbik Shire Council brought the community together in substantial protest at the infrigement of ratepayers democratic say in local government and ciommunity assets combined with protests about inappropraite development of Eltham's Gateway. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. The City of Boroondara has found an environmentally sustainable solution for the works at local heritage icon, the Kew Police Station and Court House. Council used an organic based paint stripping alternative as part of the repairs to the rendering on the building facade. Over nearly three months, the damaged and unsound render was removed, the paint was stripped and the render was repainted. Usually, paint is removed via high pressure water cleaning or sandblasting. This is a harsh method and involves combining extreme high amounts of pressure, water and sand and is highly toxic. It also creates high noise levels. In this 'green' project, Council used a soy bean paint stripper. The process uses a paste-like substance, which is highly effective, non toxic and biodegradable, and applied by hand. Initially, a bandage is applied (much like a leg waxing strip) over the top of paste. It is allowed to dry and then the bandage is stripped off. Noise was kept to a minimum by using the paint stripping alternative. Scrapings and bandages are then bagged and sent to the tip as landfill, so it does not end up in our water supply. The waste and debris don’t run-off into drains, and the bags and bi-products are biodegradable. Studley Ward Councillor Phillip Healey explained that soy bean paint removal is not greatly used in Melbourne or the local government sector. As well as intimate theatre, there will be provision for the staging of instrumental and choral performances before an audience of 40 to 50 people. The Police Station will compliment the function of the Court House by providing a venue for artist groups to exhibit their work, for the Historical Societies of Boroondara to meet, and for study groups to meet, for activities such as play and poetry readings. In a joint statement with the Mayor of Boroondara, Councillor Jack Wegman, Mr Lenders said he was pleased that agreement had been reached and the contract of sale document finalised. “I welcome the Council making this step towards purchasing this property after recent negotiations,” Mr Lenders said. “The settlement date for the purchase of the property is March 2007. The State government sold the property to Council at a reduced cost of $825,000 for community use. The full value of the buildings on the commercial marketplace was estimated to be about $2million,” he said. Cr Wegman said the Contract of Sale provides that if the funds cannot be raised to restore the property for use as community buildings then they will be returned to the State government. In relation to this additional funding to restore and modernise the buildings, Council and the community will work together over the next eight months, with the encouragement of the State government, Cr Wegman said. Mr Lenders said both he and the Premier had advised the Council of fundraising opportunities to help the Council convert the property for its future use. A larger and more modern sawmill with drying kilns was erected at Eskdale in 1947. He was contracted to build Wodonga’s Municipal sale yards in 1935, followed by the Wangaratta sale yards. This created so many forward orders that he bought a large block of land on the corner of Beechworth and Tallangatta Roads and opened a timber mill and hardware store. The business stood on this corner for about 40 years. A large proportion of the company's timber output was processed at the Wodonga yards into flooring, weatherboards, mouldings etc. and practically the whole output was distributed locally and throughout the Riverina and eastern areas of New South Wales, and Canberra. At its peak Dunstan’s was one of the biggest sawmilling businesses in Victoria and in Wodonga employed 150 people and milled l6,000,000 super feet of timber annually. A super foot is a measurement for timber, equal to one foot square by one inch thick. Arthur Dunstan also built Tower Place in High Street. He died in Wodonga in 1963 and the business was continued on by his sons. Dunstan’s timber yards in Wodonga were sold to Ezerd Industries in 1987 with the retail section being bought by BBC Hardware.This photo collection is significant as it documents how the businesses and buildings in Wodonga have evolved and contributed to community throughout the 20th century.The first business at this location was a timber will and hardware store established by Arthur Dunstan in 1935. It operated there for about 40 years. These documents relate to the proposed 1896 sale of a legal practice by Henry Parrington, a solicitor from Warrnambool, to Samuel Backhouse, a lawyer from Melbourne and his brother, a Terang lawyer. The draft indenture papers were drawn up but, after some weeks of negotiations, Henry Parrington withdrew from the sale. He was then sued by Samuel Backhouse for breach of contract. The outcome of this case is not known but Parrington continued his practice in Warrnambool. Henry Roberts Parrington qualified as a lawyer in England in 1873 and worked as a barrister and solicitor in New Zealand from 1876 to 1886. He then came to Australia and worked for the legal firm of Messrs Higgins in Geelong and for Bayly and Higgins in Warrnambool. The business in Kepler Street, Warrnambool later became known as Higgins and Parrington and, in 1900, as Parrington and Tait (partner John Sym Tait). When John Tait retired in 1901 Henry Parrington was the sole proprietor of the practice. He died in 1926 in Melbourne. These documents have some significance as they relate to Henry Parrington’s legal career. He was a prominent lawyer in Warrnambool in the late 19th and early 20th centuries.This material is in three sections:- .1 Eleven pages of handwritten material on blue paper (draft indenture document). The last page is blank and the front section has the red stamp of the Melbourne firm of Backhouse and Mellor. These documents relate to the sale of land in Merri Street Warrnambool in 1959 by Swintons Pty Ltd of Warrnambool. The buyer of the land was George O’Grady, a Warrnambool baker. The land sold for £4000 and there was a shed on the land (called the ‘Office’) which George O’Grady indicated he wished to be included in the sale. William and Ann Swinton migrated to Australia in 1854 and for a decade William Swinton worked as a builder and carpenter in the Warrnambool area, erecting many buildings, including the Wangoom Presbyterian Church. In 1865 he opened a store in Timor Street Warrnambool, selling groceries, hardware, china and glassware. By 1888 the business was known as William Swinton and Sons. Branch stores were opened in Wangoom, Cudgee, Nullawarre, South Warrnambool and West Warrnambool. After William Swinton died his son Robert became the first managing director of Swintons Pty Ltd. In 1934 the business split with George Swinton and Sons selling clothing, furnishings and glassware and Swintons Pty Ltd selling seeds, produce and hardware. Today the Swinton family still operates a furniture and bedding shop in Timor St Warrnambool.These items are of some interest as being connected to the Warrnambool business of Swintons Pty Ltd. They will be of interest to researchers.
