In 1997, ATSIC released the discussion paper Our Culture: Our Future: Proposals for the Protection and Recognition of Indigenous Cultural and Intellectual Property, and invited public comment on the need for protecting and recognising Indigenous Cultural and Intellectual Property Rights. The report extracted here was developed in the light of over 70 submissions received on this discussion paper, and also in consultation with a National Indigenous Reference Group and other relevant individuals, communities and organisations. The Report details the types of rights Indigenous people seek in relation to their cultures and considers the application of current laws. Container - Metal Tin for holding documents, late 19th century
This tin or trunk came from the old Kepler Street, Warrnambol Tait legal offices. The tin originally held legal documents connected to John Hyland (1830-1908). Irish-born John Hyland came to the Warrnambool district in 1850 working as a mounted trooper and a rate collector. He then farmed in the Mortlake district for some years before returning to Warrnambool and setting up as an auctioneer and stock and station agent. He was a Warrnambool Councillor (1880s and 90s) and Mayor (1891-2). His trunk of legal documents was first held by the lawyer, Henry Parrington, operating in Warrnambool from 1888 to 1917 (1888-1900 Higgins and Parrington, 1900 Parrington and Tait, 1901-1917 Parrington). Following Hyland's death in 1908 Henry Parrington has used the tin to house his probate documents and when John Sym Tait purchased the Parrington practice in 1917 he has obviously taken over the Hyland trunk. This tin is of some considerable interest as a memento of past Warrnambool identities - John Hyland and Henry ParringtonThis is a metal tin, rectangular in shape. Whisky came in bottles sold at licensed premises either locally or in larger cities visited during shopping expeditions. The shape of bottles varied. Aesthetic: Display showing embossing and shapeClear glass whisky bottle with heavy embossing on one side where the maker's name and details is printed in capital letters longitudinally. Heavily embossed zig zag pattern at the top of straight sides that go three quarters of the way up. The sides taper to the neck which has straight sides to the screw top opening. The tapered section is grooved with ridges of straight lines to a lip which is between it and the neck. Side (longitudinally): 'This Bottle is the Property of / James Dickson & Co. Pickering's Dairy was located on the south Side of High Street, Kew, between Charles Street and Highbury Grove. Kew was a major milk producing district in the Nineteenth and early Twentieth centuries, with three major dairy farms lining the Yarra between Studley Park in the west and Burke Road in the east. In addition to these dairy producers, there were also a number of accredited dairy retailers in the suburb. The largest and most enduring of these was the Model Dairy founded by the Kew pioneer James Venn Morgan. Milk bottles that include the name of the producer or retailer are historically significant as they represent a period in Kew's history before the mass production of milk in the second half of the Twentieth Century. This book is a diary (1926 and 1927) which appears to contain summaries of letters written to clients of the Warrnambool legal firm, Mackay and Taylor. The summaries give the name of the recipient(s) and the content of the letter. The numbers next to the summaries may refer to the number of the client or the number in the letter book. George Mackay who died in 1926 set up the original legal firm in Warrnambool in 1891 and merged with James Fletcher in 1893 to form the Fletcher and Mackay business. In the early 1920s J. Taylor joined the business then known as Mackay and Taylor. This business with other partners survived in Kepler Street until the 1990s. This book has some significance as it contains the names of many residents of Warrnambool and district during the 1920s and gives some indication of their dealings with their lawyers. It also shows the system used at the time to record the transactions of law firmsThis is a ledger with a black cover and red binding (foolscap size). Document - Patrick White Probate 1897, 1897
Tait collection: item 42 of 62 This is a document giving details of the Will and Probate of Patrick White, a farmer from Codrington who died in 1883. He left personal estate to the value of £316, with the beneficiaries being his wife, Eleanor and his son George. The lawyer concerned with this document was Ernest Chambers who had legal offices in Port Fairy, Koroit and Warrnambool at the end of the 19th century and the beginning of the 20th century. He had possession of this document and it was passed down to successive lawyers occupying the legal premises in Kepler Street, Warrnambool and located in this Kepler Street building in 2014. This document is of minor significance as Patrick White was not a resident of Warrnambool. The interest lies in the fact that the lawyer, Ernest Chambers, practised in Warrnambool in the 19th centuryThis is a cream-coloured piece of parchment paper containing details of the Will and Probate of Patrick White of Codrington who died in 1883. The paper is folded in two and the edges of the pages have blue lines ruled on them. There is handwritten material (black ink) on three of the pages. The seal of the Supreme Court of Victoria is attached with olive-green ribbon and there are five red stamps of the Master in Equity of the Supreme Court. The writing is fading in places but the document is readable. Ledger – Deed Receipts, 1940s/1950s
This ledger contains information on deeds, wills and properties from many Warrnambool and district residents in the 1940s and 1950s. The ledger comes from the law firm of Mackay and Taylor of Warrnambool. Scottish-born George Mackay established a legal practice in Kepler Street, Warrnambool in 1891 and in 1893 bought the next-door practice of the late James Fletcher and the firm was then known as Fletcher and Mackay. In the 1920s George Mackay took John Taylor into partnership and the business then became Mackay and Taylor (later Mackay Taylor). In 1999 Taits Solicitors and Mackay Taylor merged to form Tait Taylor and today it is known as Taits Legal. This ledger is of some importance as it contains so much information on Warrnambool and district families and their property ownership in the 1940s and 50s and so will be of great use to researchers. This is a ledger with a grey cover with red binding on the spine. The cover has a white label pasted on, with printed and handwritten material. The pages have printed red lines but these have not been used. Instead the pages contain letters, typed sheets and receipts pasted in. The St Peter Chapel has been the site of many religious celebrations including weddings, funerals and baptisms. This register is a government produced document recording all the necessary information in order to legally register a marriage in the Commonwealth of Australia.Whilst this register details marriages conducted at the St Peter Chapel during the period 1954-1960, of particular importance is the marriage between Robin Alexander Kent and Beverley Langdon Oliver. Beverley is the daughter of Frank Oliver, who served as chaplain to the Mission for a period of 30 years.
