This is a framed photograph showing a key event in Warrnambool's history - the proclamation by Sir Arthur Stanley of Warrnambool as a city in 1918. Warrnambool was the fifth non--metropolitan town in Victoria to be declared a city and a large crowd gathered outside the Town Hall to see this event. Sir Arthur Stanley (Lord Stanley of Alderley) was an English nobleman, Parliamentarian and soldier who was the Governor of Victoria from 1914 to 1920. The photographer was Arthur Jordan who, like his father Joseph, was a prominent photographer in Warrnambool at the end of the 19th and the beginning of the 20th centuries and took many official photographs of civic affairs. The donor of the photograph, probably immediately after the event to the Warrnambool Museum at the time under the auspices of the Warnambool Mechanics' Institute, was George Mackay, a prominent Warrnambool lawyer, Councillor and Mayor. He worked at the McGillivray farm, Byaduk. Enlisted 8th January 1917 and served with the 38th Battio - 7th Reinforcements and embarked on the HMAT A70 Ballarat. These labels come from the Warrnambool chemist business of John Sambell/Sambell and Son/Sambell, Son and Granddaughter. John Sambell opened the Hall of Pharmacy in Fairy Street, Warrnambool about 1890. He was a chemist and dentist with previous business experience in Great Britain and Victoria. By 1919 John Sambell’s son, Herbert had joined the business, trading as Sambell and Son (though John Sambell died in 1906) and the shop was located at 151 Fairy Street. In the late 1930s Sambells moved to 90 Fairy Street and was known as Sambell, Son and Granddaughter. Herbert Sambell died in 1943. These labels show some of the many products sold by the Warrnambool chemist business of John Sambell/Sambell & Son/Sambell, Son and Granddaughter, a prominent 20th century Warrnambool business. The Loyal Victoria Lodge was established in Warrnambool in1862. It was a Lodge connected with the Friendly Society Manchester Unity Independent Order of Oddfellows. Friendly Societies were established to give members assistance in times of illness and hardship and to offer insurance against such events. The MUIOOF had its origins in Manchester, England. The Warrnambool Lodge built the Oddfellows Hall in Koroit Street in 1869 and in 1872 it joined with other friendly societies and established the Friendly Societies Park in Koroit Street. The MUIOOF joined with the Australian Natives Association and today the new name in Australian Unity. No details are available on W. A. McLean but the certificate indicates that he served his country during World War Two.This certificate is of considerable interest as the Loyal Victoria Lodge was a pioneer friendly society in Warrnambool with its history going back to 1862. It is also a good example of the certificates given to Warrnambool residents who had rendered significant war time service in World War Two.Framed Certificate featuring text and a coloured picture. The picture includes: a dove, five scrolls, a laurel wreath surrounding a globe, three women in long dresses, three young children, two stylised flower beds, rays of light, a hill and four coats of arms. This cap belonged to Mark Pullen, a cub scout from Highton, Geelong, Victoria. No information is available on Mark Pullen. In Warrnambool there are three scout groups – Allansford, Norfolk (scout hall at the corner of Raglan Parade and Kepler Street) and Tooram (scout halls at the corner of Timor and Banyan Streets and in Otway Road). Cub scouts in Victoria are aged between 8 and 10. This cap has no known local provenance but is a useful item for display.This is a cap made of dark green wool with narrow gold braid dividing the crown into six sections. A button is missing from the top. The badge on the cap is a circular patch with the scout emblem in yellow and green. Reverts to black and white in the 1950s where the Brigade joins forces with the Diamond Valley Community Hospital for a Gala Day on the Diamond Creek Oval. Dart throwing, pony rides. Scenes with Dr Don Cordner, Gus Lyons, Vic Cohn (?) and spinning wheel and Diamond Creek School children entertain a large crowd with Maypole dancing. Movie Two (1950s): 13:25 – 19:00 This black and white film was taken by a TV film crew in the 1950s depicts a typical call out for the Diamond Creek Fire Brigade. In this case the careless action of a member of the public throwing a lighted match from a car, which can cause extensive damage. Footage features the Shire of Eltham War Memorial tower at Kangaroo Ground before it was modified with a fire spotter’s cabin. Discusses fire spotting operations from the tower. Shows a fire spotter walking around the top of the tower. A fire is detected, and the information is relayed to the nearest fire station, in this case, Diamond Creek. The telephone call is received, and the alarm sounded. Captain Clarrie Stone and firemen May and Shaw leave their workplaces and prepare for action. Scenes of running across the Main Hurstbridge road showing the shops (Shell service station and Chemist prominent). Scenes entering the fire station which has a pictorial warning covering the entire door “Only you can prevent forest fires – If you’re careless – we’re homeless!” Eric Holt pinpoints the location of the fire while Captain Clarrie Stone and Fireman Shaw take note. The advance vehicle (an FE Holden ute, rego GTE-696) leaves to assess the extent of the fire. Having assessed the fire, Fireman Shaw communicates with base showing radio with call sign VL3JZ. Eric Holt takes the call. In the meantime, Captain Clarrie Stone and Fireman Shaw undertake some limited action to address the fire. Firemen Bill May, Jim Bates and Hugh Bar (?) man the tanker. A photo portrait of Queen Elizabeth is visible hanging on the wall. They are later joined by Firemen Jim Cox, Eric DeBuse (?) and Jack Marks. The tanker is seen departing the station and diverging off before the bridge. Captain Clarrie Stone and Fireman Shaw are seen pumping water on the flames with hand pumps when the tanker arrives. The hose is unreeled, and water turned on the flames. Jack Sinclair joins the action. Jim Cox directs water to the high stuff. The fire put out, Jack Marks and Eric DeBuse wind in the hoses and the team head back to town. It’s peaceful again at the memorial tower. Movie Three (1969-1987): 19:14 – 34:34 Colour film “Fired with Dedication”, Country Fire Authority Victoria, produced by I.L. Wadeson, Commentary by A.M. Hem. Credits with CFA Victoria emblem and then placed over a view of an old-style ladder engine. Opens with the scene of a fire engine outside the Diamond Creek Fire Station then various trophies reflecting the competition success of the brigade in various track and disciplined events. Two trophies shown of particular pride to the brigade were for first place in the Torchlight Procession at the State Championships in Mildura in 1986 and also at Swan Hill in 1981. Still photo scenes of ex Captain Clarrie Stone, Brigade Captain for 21 years; ex Captain Jack Marks, 10 years; ex Captain Ian Douglas, 10 years. Cuts to scene of radio control room, January 1969, and news of a fire on the northern side of the township of Diamond Creek. With scenes of flames in bush, the narration explains that until the early 1960s the area was an orchard district which protected the town against the savagery of bushfires. But due to competition from other areas more suitable for orcharding and easier transport to Melbourne the district could no longer remain competitive, and orchards were replaced by grassed areas, which together with the bush areas were a feeding ground for fire. On 8th January 1969, high temperatures and strong north winds, were, with the carelessness of some individual all that was necessary to produce the worst fire the district had seen. Cuts to scene of blackened fields and cattle - Hundreds of hectares of grass land were blackened, and cattle had to be transported to other areas for agistment. Scene of destroyed buildings in the township – 13 houses and the public hall in the town were destroyed as was the theatre equipment which was owned by the fire brigade. The Church of England Hall and bell tower were badly damaged. The whole town could have been burnt out but for the determination, skill, and courage of the Diamond Creek Fire Brigade. Scenes of all that was left of the home on the hill on the west side of the Church of England. Also, the remains of the old Pisy (?) home on the top of the same hill near Lambert Street, and the ruined Crocker home. Cuts to a scene in the mid-1970s to mid-1980s of a house fire in Haley Street attended by the Diamond Creek Fire Brigade. Although the house was severely damaged, it was saved. Mentions that whilst assistance is appreciated, in some circumstances, those doing so are not properly dressed for fighting fires. Breathing apparatus is a must in structure fire attack. Next scene (either on Mangarook or Coventry oval) showing off four Diamond Creek Fire Brigade efficient and very expensive firefighting units. Features a forward control vehicle Toyota 4WD used for conveying task force personnel to the required areas; a Hino Model 3.2 tanker, diesel powered and carries 3,000 litres of water and has a 16 HP petrol driven pump which delivers 900 litres of water per minute; an International tanker (registration TCM-418) which carries 3,000 litres of water with pumping capacity of 600 litres per minute. The Ford diesel powered pumper (registration MXE-754) is a well-equipped vehicle with a water capacity of 1,000 litres and capable of pumping 1,900 litres of water per minute from the main pump, has many lockers which hose equipment such as breathing apparatus and various types of hose nozzles and foam making equipment. The vehicle carries 360m of 64mm diameter hose which can be laid out from the rear lockers and a portable lighting plant, an Oxy Viva resuscitator to revive smoke inhalation victims and forcible entry tools to gain access to structure fires. Views of the main pump and control panel on the vehicle. As well as the main pump, the vehicle is equipped with an auxiliary pump which allows the facility to pump whilst moving. Fire fighters must undergo constant training and hone their skills, Scenes of a training exercise using the pumper to pump from static water. First, the short lengths of suction hose are coupled, a strainer fitted to ensure debris does not foul the pump. Gauges must be constantly monitored to ensure manageable water pressures are maintained. Pressures are normally controlled to allow two fire fighters to work at each nozzle outlet. Two nozzles are tested, one adjustable jet fog type which is used on flammable gasses or within a structure fire to absorb heat. A straight jet nozzle to project water long distances to protect exposed surfaces close to a fire radiated heat. The pumper is quite a versatile vehicle in handling structure fires, but it also carries specialist equipment needed in containing hazardous chemical incidents. Cuts to scene of parade – the Diamond Creek Fire Brigade has with other neighbouring brigades participated in most town fairs and earns the respect of the watching public. It can be seen why this brigade has been so successful at disciplined contests. Views of Plenty Fire Brigade Road Rescue unit which is equipped with the “Jaws of Life” Scenes of athletic competitions – many neighbouring brigades indulge in friendly but keen competition at the Diamond Creek Town Fair. The young are also encouraged to participate in all aspects of Junior Fire Brigade activities and become tomorrow’s generation of volunteer fire fighters. Scene of the 1986 Diamond Creek Town Fair which was the last time veteran Captain Clarrie Stone BEM marched with the brigade. St Margaret’s Church of England was officially opened on December 12, 1861. It is the oldest intact church building in Eltham. At the time it was known as Christ Church until its consecration in 1871, when it was completely free of debt (£1,700 for the church and parsonage) despite the district’s poverty. This was largely due to the free labour and materials, including locally made bricks donated by local artisans and others. The church is historically significant because it is the oldest church in the former Shire of Eltham and has associations with the philanthropist and founder of Brighton, Henry Dendy (who donated the land on which the church is built), the architect Nathaniel Billing and the prominent local builder, George Stebbing. The church is architecturally and aesthetically significant because it is constructed in the Gothic Revival style with several stained-glass windows of various dates and is also a very early use of polychromatic brickwork in Victoria. Billing was one of the first Melbourne architects to employ polychromatic brickwork and an important early architect. The rear wall was intended to be temporary. A major feature of the design is the large buttresses with long, steeply graded upper faces. The overall design is well proportioned with the surface brick patterns relieving an otherwise austere design. The church is spiritually and socially significant because it has been an important place of worship for the people of Eltham for almost 150 years. The land on which the buildings stand was donated by Henry Dendy. Dendy arrived in Melbourne in 1841 after purchasing in England eight square miles at Brighton under the system of "special surveys". After this land passed out of his hands, Dendy moved about Victoria, visited England, then returned to settle in Eltham where he purchased a flour mill. Dendy chaired the meeting held in 1860 “for the purpose of devising such means as may be expedient for the establishment of a Church of England in the township of Eltham”. He became chairman and treasurer of the church committee. Unlike the establishment of many early churches in Victoria where a vicar was appointed to a parish and later a permanent church was constructed, the population at Eltham initiated action to build a church. The nearest church at that time was at Heidelberg and the Eltham settlement was part of the parish of St Johns Heidelberg. Isolation and the tedious, time consuming journey between Heidelberg and Eltham resulted in the Eltham community taking its own action. The original vicarage (Dendy House) at the rear of the church is also an important part of the cultural significance of this place because it is connected to the church and the development of the Eltham area. Together, the church and the vicarage are aesthetically significant because they form a significant streetscape feature. The mud-brick community hall designed by Robert Marshall was added in 1978. In 2014 the original temporary rear wall was removed as part of a modern extension designed by Architects Atelier Wagner and constructed by Conrad Construction and Management. The building was designed by Charles Maplestone of Heidelberg, son-in-law to Anthony Beale of St Helena. Maplestone was a prominent architect who came out to Australia with his family in 1852. The foundation stone was laid by Mrs Isabella Maplestone on 11th November 1867. The bricklayers for the church were George Stebbing, H Limmer, H Spicer and a Mr Timm while Thomas Day was the stonemason. Another three years were to pass before sufficient money could be raised for its completion. It was opened by Bishop Perry on 1st November, 1870. The church bell which hung under a tree for 50 years until it was incorporated in the parish hall was brought out from England and presented by Charles Orme. In 1916, the estate of George Martin Pizzey left sufficient money to build the red brick hall, which still stands today (2023) though in January 1969 the hall and bell tower were badly damaged by bushfire. Coincidentally the former home of benefactor, George Pizzey was destroyed in the same fire. Of particular significance are the interior and exterior of the church, the Sunday school and hall with emphasis on pre-World War I fabric (excluding the 1990s additions) and the three coloured glass windows currently suspended in the 1990s entry foyer. In 2011 further alterations were made to the front of the Church. The church is historically significant because it was the oldest public building in the former Diamond Valley Shire, is amongst the oldest buildings in the Shire of Nillumbik and is associated with the early settlement of the Diamond Creek district. The church is historically, socially and spiritually significant because it has been a place of worship for over 150 years and continues to be, an important meeting place in the Shire. The church is aesthetically significant for the three stained glass windows executed by the noted stained glass manufacturers, Ferguson & Urie, as well as the supporting coloured glass windows in the church. The Sunday school & parish hall is architecturally significant because the hall is a well executed and preserved example of the work of noted church architects, North & Williams. It is historically significant because it is connected with local parishioner and Melbourne industrialist, George Pizzey, who bequeathed funds for its construction. George Knapman was born c.1851 in Ashburton, Devon, England, the son of George Knapman and Elizabeth Grant nee Wyatt. George, his mother and three sisters arrived in the Port of Melbourne, 28 Jul 1857 aboard the ship, Mindoro from Plymouth, his father having preceded them some eighteen months earlier. George married Mary Jane Williams in 1877 and they settled in Eltham where they had five children; Percival George (1878), Florence Maud (1880), Laura Blanche (1882), Alfred Edgar (1886) and Gladys Victoria (1897). In 1879 George was elected a vestryman for St Margaret’s Church, a position he would be re-elected to for many years. Both he and Mary were active members of the church and social activities. In 1884 George was also engaged in collecting funds for the renovation of the St Helena church George was also a member of the Eltham Cricket Club. In May 1884 following completion of the cricket season, several players banded together to form a group holding fortnightly meetings for the purpose of giving readings, recitations, etc to relieve the dullness of the long winter evenings. Charles Wingrove was elected President, Rev. J.B. Gason Treasurer and George along with Messrs Evans, Bourke, D. McColl, C. Jarrold, George Hill and William Brown, members of the Committee. In 1885, George advertised two horses had strayed from his premises (reward £2) and in 1891 he had a cultivator for sale (price £7/10/-). In 1902 he was treasurer of the Eltham Rifle Club. His children attended Eltham Primary School. In 1904 he was a member of the school's Board of Advice and addressed children at an Arbor Day planting activity. In 1907 he was elected president of the Eltham Progressive League, calling for public toilets to be erected at a local picnic spot. George along with William John Taylor and Isaac Hill was also appointed a Trustee of the Eltham Rechabite Hall in Henry Street on behalf of the Hope of Eltham Tent No. 195 Victoria District Independent Order of Rechabites from December 1901 until its sale to the community in December 1921 for use as a public hall. George ‘Snowy’ Knapman was a blacksmith by trade. He owned and operated a shoeing forge and wheelwright workshop, known as Snowy Knapman’s Forge, in Main Road Eltham, next door to the Eltham Court House. The location was well chosen. Mail coaches from Melbourne passed through Eltham enroute to Christmas Hills and Yarra Glen, with another heading to Kingstown (now Panton Hill). It was common practice for horses to be changed at Eltham. Two photos taken June 4, 1907, captioned ‘Election Day Eltham’, show a large crowd of men assembled in Main Road outside Knapman's premises. They are waiting to vote at the Court House. There are no women in the crowd; they were not empowered to vote. George's brothers William and John were also blacksmiths at Heidelberg, continuing the business established by their father George, who had died in 1900. After William died in 1909, George moved to Heidelberg to take over from him. George died at his residence, ‘Devon’, Yarra Street, Heidelberg on March 16, 1923, and is buried in Eltham Cemetery with his wife Mary who died July 16, 1935, at Kew. Their former house at Eltham was located near where the WW1 Monument was erected in 1919, after they had moved to Heidelberg, at the corner of Bridge Street and Main Road and occupied by Mr. R. Trevena at the time of Mary’s death. Mary was sister to E.J. Williams, W. Williams and Mrs Fawkner, all residents of Eltham. Charles Gordon Watts-Phillips was born in 1849 at Forest Hill, Surrey, England, the son of Dramatic Author, Watts Phillips, and Lily Mariner. He departed England for Australia around 1874. His sister Roland was a favourite Australian actress of the early 1900s. Gordon as he was known, whilst residing in Goolwa, South Australia and working as a clerk met and married a widow, Jane Luxon (nee Miller) on the 7th August, 1876 at the Wesleyan Church in Strathalbyn, South Australia. Jane, Gordon’s elder by some 11 years was born in Ireland in 1838, the daughter of Robert Joseph Miller, a carpenter and Jane Miller. She had previously married Captain William Luxon in 1861 at Encounter Bay, South Australia at age 22 and they had four children: William (1864), George Robert (1865), Miriam Louisa (1867) and Harriet Jane (1869), all born at Encounter Bay. Gordon and Jane had two further children together: Caroline Roland Watts-Phillips (1877 Islington S.A.) and Charles Gordon Watts-Phillips (1879 Yatala, S.A.). At some stage, Jane then deserted her husband. Gordon obtained a master's certificate and was a part owner of a small trader. He had also been captain of one of the passenger boats on the Darling River. He was reputedly a popular coastal skipper. By 1891 Gordon was the Captain of the S.S Omeo operating around Sale, Victoria. In August of that year some of the heaviest flooding of the Thomson River ever experienced in twenty years occurred over the 3rd and 4th of August. Gordon, and others, rescued the lives of many families over that period for which he was awarded a Bronze Medal by the Royal Humane Society. By 1892 the S.S. Omeo had passed to another Captain and Gordon subsequently retired from the sea and moved to Melbourne. Whilst residing in Coburg, Victoria, Gordon met Mary Hilda Harvey Huxley who was living in Brunswick. Mary was born in Horsham, the daughter of George Harry Huxley, a miner, and Emma Deane. Having not heard from Jane for some years and believing her dead, Gordon and Mary marry at Carlton on Christmas Eve, 1900. Interestingly, an announcement of the marriage was not placed in The Age newspaper until September 1903, nearly three years after the event by which time Gordon and Mary had a son, Victor Gordon Watts-Phillips, born 8 February 1903 in Carlton. Within months of the placement of this marriage announcement, his former wife, Jane, makes a reappearance but apparently does not interfere and Mary and Gordon continue to live together as husband and wife. Around the same time in late 1903, Gordon’s brother, Basil Watts Phillip wrote from London to the Victoria Police seeking assistance to locate his brother. He had last heard from him in a letter dated Cunninghame, Gippsland, 1891. He indicated that about 1893 Gordon and Jane and their two children were living at Beaconsfield Parade, Albert Park but the whereabouts of all was now unknown. He mentioned Gordon had also been awarded 21 guineas by Judge Boucaut on the 26th February 1884, also a silver medal, for arresting two ruffians who had brutally assaulted a jockey (in South Australia) and that he had been awarded the Royal Humane Society's medal, London, and in 1891, was presented with the Royal Humane Society's certificate of merit (Victoria). Basil also stated his brother had lost the sight of one eye through a stab he received in New York and had a scar on his temple, one on the wrist, two under the shoulder blade, and one on the thigh, and two bullet wounds in the leg. Basil’s quest was published in the Melbourne Herald and assistance was soon forthcoming to the Police. In June 1906 Gordon made his Will, leaving all his estate to his youngest son Victor. Mary was appointed Executrix and it was witnessed by Olive Huxley, married woman, and James Huxley, a pottery maker. James was subsequently killed in France in May 1918. Gordon and Mary have a second son, Basil Douglas born in Carlton in 1911 but he dies as toddler in 1913. At some point Gordon and Mary made their home at Eltham though official electoral roll records record them at Little Flinders Street Melbourne, employed as a caretaker and from 1906 in Brunswick as a decorator then painter. Eltham may have been a ‘holiday’ home but it seems Mary was actively engaged in the community as a newspaper report in the Advertiser in 1922 not long after Gordon’s death indicates Mary was one of the best known and best liked ladies of the Eltham district. She was actively engaged in all matters, tending towards the welfare of the district. At the time of Gordon’s death Mary was president of the Ladies' Public Hall Committee, responsible for the conduct of numerous, and successful entertainments. Gordon’s first and only legal wife, Jane Luxon Watts-Phillips nee Miller, died 6 November 1921 and was buried 8 November 1921 at Springvale Cemetery. Jane had lived 34 years in South Australia and 30 years in Victoria. With Jane now dead, Gordon was now officially a widower and just three weeks later, the retired master mariner of Eltham at age 55 remarried Mary, 42, of 174 Hickford Street, East Brunswick on the 29th November 1921 in the Parish of St Cuthbert, East Brunswick. Gordon died at their home, ‘The Rest’, at 174 Hickford Street, East Brunswick on February 9, 1922 and was buried at Eltham Cemetery on February 11. An interesting link is established with the heavy floods of August 1891 by the erection of a tombstone in the Eltham cemetery. The stone bears the inscription: - “In loving memory of (Captain) Gordon, dearly beloved husband of Mary Watts Phillips. Died 9th February 1922, aged 62 years." Beside the stone is a replica, carved in a marble scroll, of the Royal Humane Society of Australia's Certificate of merit. Part of the wording of this certificate is as follows:- “At a general court of directors holder at the offices of the society at Melbourne on the 6th day of September 1891, it was resolved that the courage and humanity displayed by Gordon Watts Phillips aged 30-years captain of S.S. Omeo, Sale, in rescuing many families from drowning during the heavy floods on Thomson River on 3rd and 4th of August 1891 call for the admiration of the court, and justly entitles him to the certificate of merit of this society, which is hereby awarded." Unbeknownst to Gordon, his second and subsequent legal marriage to Mary initiated a revocation of his Will of 1906, which had solely benefited his son Victor. Consequently, Mary had to apply for Letters of Administration and the only legal beneficiaries would be Mary and his two children by Jane. On June 18, 1940, at age 61, Mary married 70-year-old Arthur Ernest Fenn in Melbourne. Unfortunately for her, Arthur died a year later in July 1941 and was buried in the Cohuna Cemetery near Echuca. Mary lived a further 8 years, passing away suddenly July 4, 1948 in Carlton, and was buried July 7 with her beloved husband Gordon, at Eltham Cemetery. Robert David Taylor was a farmer who lived in Eltham all his life and died in 1934 at the age of 76. Mr and Mrs Bowman lived in York Street; Taylor was their neighbour. In 1933 he subdivided his land, the plan showing a proposed Grey Street flanked by residential blocks for sale. Mrs Bowman bought one: her family would be able to walk through it and along Grey Street to Henry Street, thus providing quicker access to the railway station. But Taylor retained ownership of Grey Street itself. He fenced it off at each end and charged the Bowmans with trespass when they used it. The matter went to Court. The ruling was that Mrs Bowman could use Grey Street, as she owned land in it, but her husband could not. (Taylor also accused the Bowmans of having broken the fences, but could not prove it.) Taylor had wanted to subdivide his land in 1914. Plans were submitted to Council and were approved, but the subdivision did not proceed. In 1919, Taylor doctored the plans to make it appear that a totally different subdivisional arrangement had been approved. The Titles Office immediately detected fraud, and the Crown charged Taylor with forgery and counterfeiting. But charges were later dropped (reason not recorded). He was an Eltham Shire Councillor between 1911 and 1920. In 1920, Council charged him with illegally felling 91 eucalyptus trees in Eltham Park (60% of them in a healthy condition), presumably to be sold as firewood. He was imprisoned pending trial. Taylor claimed that he had acquired from another man the right to remove timber and sued the Council for wrongful prosecution. The case eventually went to the State Full Court, with judgement given in favour of Council, on the grounds that any right acquired by Taylor covered only the removal of logs and refuse, not sound green timber. And his position as Councillor precluded him from acquiring the right anyway. Robert David Taylor was also a Trustee of the Wesleyan Church owned land at Lot 20 Henry Street, originally purchased in January 1855 for a chapel and from which David and Catherine Clark first ran their private school, the forerunner of the Eltham Primary School. The land was sold in November 1901 to the Hope of Eltham Tent No. 195 Victoria District Independent Order of Rechabites, for which his brother William John Taylor was a Trustee and became the home of the Eltham Rechabite Hall. In 1993 Eltham Shire Council issued a permit to Michael Muzur, Terry Lant and Andrew McMillan to redevelop the former Montmorency Theatre/Bingo Hall at 41-43 Were Street as an alcohol-free youth entertainment centre. Ron McCormack, retired former JP on behalf of 41 Joint Appellants consisting of local residents and traders successfully lobbied the community and won an Appeal to have the permit cancelled as unsuitable development. The Administrative Appeal Tribunal found that the proposed development came withing the Eltham Planning Scheme definition of an 'amusement parlour' and that the playing of pool an amusement machines would be the focus of the centre and unlikely to attract older age groups. The tribunal was not satisfied the applicants had sufficient knowledge or where with all required for the successful running of this type of operation. With respect to the objectors, the Tribunal did not accept that a responsibly managed and attractive amusement parlour could not coexist near the adjoining residential area and without detriment to the commercial centre. At a Council meeting on June 7, 1994 councillors requested a report outlining criteria to be used to assess planning applications for youth entertainment venues given the Tribunal's view that a poorly managed facility in a small neighbourhood shopping centre, particularly in such close proximity to a residential area would not only have the potential to increase perceived youth problems, but could jeopardise the prospects of future proposals. William James Sommerville (b.1856) married Jane Shillinglaw at Hawthorn, Victoria, June 2, 1887. He was ten years Jane's junior. It is possible that this may be a carte-de-visite of William presented by him to Jane during their courtship as it is dated at least two years prior to their marriage. Jane Shillinglaw was born at Merri Creek, Victoria, June 14, 1846. She had a son, Joseph Shillinglaw (1863-1865) with an unknown partner. Joseph died as a toddler. She subsequently had a second child, a duaghter, Jane Davidson born 1870 She married William James Sommerville, ten years her junior at hawthorn on June 2, 1887. Jane died at Balwyn, Victoria on June 26, 1893.
