The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. In 1868, with the laying of the foundation stone, a time capsule was placed containing four newspapers of the day (Saturday 25 January, 1868 - The Age, The Argus, The Sun and The Telegraph: St Kilda, Prahran and South Yarra Guardian), the first Annual report of the Victorian Asylum and School for the Blind (1867), 11 coins from the Victorian regency and an illustration of the proposed building at St Kilda Road. An undated note also describes a piece of parchment in the time capsule, which contained a list of names of committee members and relevant people involved in the construction of the building, such as Crouch & Wilson; however no image of this has been located. In 1991, this time capsule was opened as part of 125 year celebrations and the contents were put on display. The capsule was the size of a house brick and buried underneath the foundation stone. It was made of metal and had to be sawn open to reveal the contents. These images are of the items found inside the time capsule. Additionally there are low res images of these items plus some photographs taken on the day: Brian Howe, Minister for Health, holds the time capsule whilst Trent Willard and Janice Johns, current RVIB students, stand by during the raising ceremony; Miss Molly Miller, the oldest surviving student, and Mr Percy Raufer, great grand nephew of Mary-Ann Raufer who was pupil number 6 and enrolled in the school in January 29th, 1866 look at the items found in the time capsule. William James Trembath (13/4/1877-27/3/1930) was a draper who lived with his wife Mary Florence (nee Ellis) ( 1877 -29/7/1932) at 521 Hargreaves Street. They had married in 1901. Mr Eric Sumsion was the gardening curator for Wodonga Shire in 1956. He had previously operated a bootmaker’s shop in High Street, Wodonga for many years. Eric saw the potential of the area in Wodonga now known as Belvoir Park and asked permission to work on part of the area. He eventually purchased a house adjoining the area giving him more time and easy access to work on it. The Lagoon, Lake Huon, Belvoir Lagoon, Belvoir Park and Sumsion Gardens are all names used over time for what is today one of Wodonga’s favourite recreation and picnic spots. In the 1800s river boats could enter Lake Huon from Wodonga Creek. There was a jetty south of where the water fountain is today. In later years, this jetty was used by the Clay Bird Shooting Club. From the early 1900s football and cricket were played there, and some mining leases were also allowed. At one time there were open gravel pits between House Creek and the main lagoon, and these were subsequently filled with town garbage collected by the Council. In the late 1940s, Wodonga Golf Club took over part of Belvoir Park for a 9-hole golf course with sand greens. The Golf Club House was built in 1946. The Club extended the course to 12-holes when the football ground moved to Martin Park and the course later extended to 18 holes. Under Eric Sumsion’s care the area became a magnificent area of parkland and curated gardens. After he had retired in 1961 his work was acknowledged by the Shire Engineer, Mr Bill Page, when the Sumsion Gardens were named in his honour. He was also responsible for the design and curating of many other gardens in Wodonga, including those at Sarah Coventry and Richardson Park. This image is one of a series of photographs taken by Melbourne based photographers Stevenson and McNicoll who visited Bacchus Marsh and its nearby districts between September and November 1883. William Marshall opened his new premises in Main Street in June 1869. In the following November he opened a wheelwright shop adjacent to his smithy. Mr T. Carlton was the wheelwright. The Marshall Blacksmith building was located next to the ANA Hall in Main Street. It was demolished in 1910 to make way for a new building known as the Chambers Building. In the nineteenth and early twentieth centuries, the blacksmith played an essential role in the functioning of the whole community. Before the industrialisation of manufacturing, all metal objects, including farm implements, building requirements and domestic utensils were made by hand. As mechanisation of industry increased, the smith commonly performed the role of farrier in the times when horse power was pivotal to all aspects of society. Complementing this work, the forge was often allied with a wheelwright's shop. These premises also acted as a meeting place for the men of the town, where news was shared and friendships forged. William Marshall opened his new premises in June 1869, and in the following November opened a wheelwright shop adjacent to his smithy. Mr T. Carlton was the wheelwright. The photograph shows a brick building with two gables and two large doors, indicating that a second workshop has been added to the original building. Parts of a picket fence and two cartwheels lean against the wall. Three men stand at the front, two wearing the distinctive farrier’s apron slit between the knees. The third man is wearing more formal clothing. Two of the men hold the reins of two horses. A picket fence runs along the front of a spare block at the side of the building. Members of the Presbyterian faith were among the first settlers in the North-east of Victoria, and in the year 1842 the Presbytery of Melbourne requested the Rev. Peter Gunn, Minister of the Gaelic Church, Melbourne, to visit Presbyterians along the Murray River. This was the first of a series of annual visits, and was of a missionary nature. In May 1851, the Rev. David Hunter Ballantyne was appointed to the Wodonga district based out of Albury. In 1860 the Presbytery of Beechworth was formed, and from it two large presbyteries have grown - Wagga Wagga and Beechworth. In the early days the services at Wodonga were held in the old court house, which still stands. Wodonga Presbyterian Church continued as part of the Parish of Albury until the end of 1887, when it was placed under the administration of the Session of the Beechworth Church, with a home missionary in charge. Mr William Cooper was placed in charge for the first months, then Mr William Smith, a city missionary who had recently arrived from Scotland, was appointed. Mr Smith conducted a cordage factory at Stonleigh. He remained as missionary in charge for the next 10 years, and in that time the church steadily progressed. Plans were made for the erection of the building which now stands in High Street, Wodonga. Mr John Whan was a Founding Member of the Church and was appointed Sunday School Superintendent, an office which he held for 46 years, rendering extensive and valued service to the church and congregation. With a growing congregation and realising the challenges presented to the Church by changing conditions, land for a new church was sought. In September 1950 property was purchased in Nilmar Avenue in Wodonga and the new Presbyterian Church St Stephens became their new home. With the amalgamation of the Presbyterian and Methodist Churches, the new Church became the Uniting Church.
