This small bronze statute depicts Neville Howse rescuing a soldier from the battlefield during the Boer War. In 1900 while accompanying a group of infantry at Vredefort, Howse noticed a British trumpeter fall. As the soldier lay injured under heavy fire, the surgeon galloped to his rescue. His horse was horse shot dead from under him but undeterred, he continued on foot until he reached the man. The soldier had been shot through the bladder so Howse dressed his wounds and carried him to safety. For this brave action, Howse was awarded the Victoria Cross, the first medical person to achieve this honour. The son of a doctor who served in the Crimean war, Neville Howse (1863-1930) was born in Somerset, England. He migrated to Australia and set up medical practice in Newcastle and later, in Taree, NSW. Upon deciding to become a surgeon, he returned to the UK to undertake Fellowship of the Royal College before travelling back to NSW in 1899. In the same year Great Britain went to war with the two Boer Republics of South Africa and Howse volunteered for service. From the Argus, Friday 18 July 1879:- SAFETY MINING CAGES. The report of the board on safety mining cages was laid on the table of the Legislative Assembly fortnight The board, which has tested the following inventions Nances, Williams patent, Jackson and Middleton's patent Sesmours patent, Allans patent, and Hassan a patent, reports as follows - 1. That the preponderance of evidence given by miners and others qualified to form an opinion is strongly in favour of the adop-tion of a safety cage for general use in the mines of this colony, provided that a reliable invention can be brought forward, and its practical utility satisfactorily determined 2. That in view of the rapid increase of cage accidents, and supported by the evidence before them, the board are of opinion that some special provision should be made to check such a prolific source of danger as is shown to exist in the working of the shaft and machinery employed for winding purposes. 3. That this check could be imposed by means of such a regulation as that at present contained in the statute, i e -" Every cage used in a mine shall be fitted with special and suitable appliances to prevent its sudden fall down a shaft and also to prevent its coming into contact with the poppet heads." The board, however, consider that mine proprietors should be permitted to exercise their own discretion in the selection of safety cages, but safety hooks and balance catches must be used in connexion with every case 4. The peck has been in use since the early 14th century when it was introduced as a measure for flour. The term referred to varying quantities until the modern units of measurement were defined in the 19th century. Cities in England used to have official standard weights and measures for that city or area. These containers were marked with the city's name and emblem, merchant’s weights and measures would then be checked against this to make sure they weren't trying to cheat their customers. The item in the collection is a standard measure approved by Bristol City and used by that City’s grocers to measure dry goods such as peas, beans, sugar, flour, meal etc., and its metal banding ensures that the measure cannot be reduced in size to cheat customers. Additional Information: The British Imperial System evolved from the thousands of Roman, Celtic, Anglo-Saxon, and customary local units employed in the middle Ages. Traditional names such as pound, foot, and gallon were widely used, but the values so designated varied with time, place, trade, product specifications, and dozens of other requirements. Early royal standards were established to enforce uniformity took the name Winchester, after the ancient tenth century capital of Britain. King Henry VII reaffirmed the customary Winchester standards for capacity and length and distributed royal standards throughout the realm. This process was repeated about a century later in the reign of Queen Elizabeth I. In the 16th century, the rod (5.5 yards, or 16.5 feet) was defined (once again as a learning device and not as a standard) defined by the length of the left feet of 16 men lined up heel to toe as they emerged from the church. By the 17th century usage and legal statute had established the acre, rod, and furlong at their present values together with other historic units such as the peck. Establishment of the System: The Weights and Measures Act of 1824 and the Act of 1878 established the British Imperial System based on precise definitions of selected existing units. The 1824 act sanctioned a single imperial gallon to replace the wine, ale, and corn (wheat) gallons that were in general use. The new gallon was defined as equal in volume to 10 pounds avoirdupois of distilled water weighed at 62°F with the barometer at 30 inches, or 277.274 cubic inches (later corrected to 277.421 cubic inches). The two new basic standard units were the imperial standard yard and the troy pound, which was later restricted to weighing drugs, precious metals, and jewels. In 1963 an act of parliament abolished archaic measures as the rod and chaldron and a metric system was adopted. An early example of a dry measuring container giving a snapshot of how imperial weights and measures developed in England to evolve the British measurement system into the metric arrangement that most countries have adopted today including Australia. It has social significance as an item that was in everyday use by grocers and other merchants to measure dry goods in the late 18th to early 19th centuries and used specifically in the Bristol region of England as an officially recognised measurement.Wooden measurement container with iron banding and hand made rivets container is a Quarter Peck official measurement container. TROVE : The Age (Melbourne, Vic. : 1854 - 1954) Tuesday 13 December 1887 p 5 Article " ROUGH ON RATS" POISON.' . PROSECUTION UNDER THE POISONS ACT. At the St. Kilda police court, on Friday, W, A. Stokes, chemist, Carlisle-street, Balaclava, was prosecuted under the Poisons Statute on the charge of selling to one Mrs. Hannah Charlton a poison without having made and signed the entry required by the act. A second charge of selling to Mrs, Hannah Charlton a poison without having obtained the signature of the purchaser to an entry as required by the act was also preferred against the defendant. Both cases were taken together. Mr, Donovan appeared to prosecute, and Mr. Cole for the defence. Senior-constable Connell deposed that he knew the defendant. On the 24th of October last an inquest was held at East St. Kilda relative to the cause of the death of a man named Charlton. A packet bearing the label " Rough on Rats," which was found. in the deceased's bedroom, was produced at the inqiry, and afterwards handed over to Mr. Blackett, Government analytical chemist for analysis. The verdict of the jury was that the deceased died from the effects of arsenical poisoning. The mayor announced that there was a doubt in the minds of the magistrates as to whether the defendant could be held guilty under the law, but they thought the prosecution had attained its object by making known the fact that "Rough on Rats" is a poison. The Sulieman Pasha is possibly named after the most important Sultan of the Ottoman Empire, Suleiman One, or Suleiman the Magnificent, when the Ottoman Empire was at its peak. Or potentially a number of Ottoman governors, statesmen and military commanders with the same name after, however the spelling is slightly different to the mine name. No Turkish connection was found relating to the formation of the company, and remains unconfirmed. The mine operated from two shafts; No. 1 near the corner of Humffray and Mair streets, and also near where the Welcome Nugget (2217 ounces) was found years earlier; and the controversial No. 2 shaft several blocks south bordering the northern side of the main highway through Ballarat. The company produced 62 666 ounces of gold, the twelfth highest quartz reef gold production for any mine on the Ballarat goldfield. Some crushing figure examples are January-June 1881: 3674 tonnes 1085 ounces; January-June 1885: 2949 tonnes 1281 ounces; July-December 1885: 4459 tonnes 1119 ounces; January-June 1887: 1869 tonnes 730 ounces; July-December 1892: 1450 tonnes 771 ounces; July-December 1896: 4365 tonnes 1372 ounces. Like many mines in the area, gold grades were low. John Watson was noted as mine manager in the 1880s, and John Williams 1890s. The company was re-organised twice increasing the number of shares from 4000 to 24 000, and increasing the capital available. The Sulieman Pasha Company was formed in 1878. David Fitzpatrick was given the honour of turning the first sod of both the No.1 and later No. 2 shafts. The first dividend was given to shareholders in July 1881. The company obtained a prospecting vote (government grant) to start, and was very proud to be the first Victorian gold mining company to pay the funds back to the government. The event was marked by a lavish banquet laid out for ministers and government officials by the company. Leases were purchased to the south in 1885 to the Llanberris Mine boundary, after poor results began accumulating from the small No. 1 shaft. To take advantage of this new land the company planned to sink a second shaft. Initially this was to take place on government land, but the uproar from nearby residents caused the company to purchase land along the Main Road (now Western Highway), and the old Yarrowee Hotel which had occupied the site since the alluvial digger days of the 1850's was demolished. The area had since those days become heavily occupied with a number of shops, houses, a post office, church and two schools in the immediate area. The thought of an underground mine next door drew considerable opposition. The company (before the days of public relations departments) wrote 'most people would have thought that progress as vital as mining would be supported by tradesmen whose business rely on the mining industry. It seems when it comes to mining they are bereft of their senses, and considering the low ebb of mining in Ballarat East, the action of our opponents are unaccountable. (Sarcastically) There are certain engineering difficulties in moving the quartz reefs to a new location, but if we could to appease our opponents we would'. The company also wanted to take over 4 acres of the St Paul's school oval for machinery, but accused the St Paul's Church of wanting extortionate amounts of money upfront, and on a yearly basis for the privilege. It stated the church could not be opposed to mining when several years earlier it had formed its own company to mine the land, only for shareholders to lose their money. In 1886, the company approached the Minister for Mines, and attended heated public meetings on the matter. The local residents, shop owners, and church submitted a 60 person petition to the local council and government authorities. They stated the shaft contravened the mining statutes, which stating no mining could take place within 150 yards of a public building or church. A speech by a resident stated 'mining always comes with glorious pictures of the great benefits which would accrue all parties concerned if their request is granted, but if property is destroyed or depreciated in value, no-one then comes forward and compensates them'. The No. 2 shaft was approved including taking over part of the school oval. In 1888, workers at the company's No. 2 shaft went on strike to try and bring their wages in line with other mines in the district (the No. 1 shaft was operated by tributers). William Madden (26) was killed from a fall of earth underground the same year, while a year later his father John Madden (70) was similarly killed in the Madame Berry Mine elsewhere in the district. In 1897 as the amount of gold being found fell away, it came to light part of the deal to purchase the Yarrowee Hotel site was a 5% royalty on gold found. Shareholders could not understand why they were paying a royalty to the former owners of the property. The mine closed in 1898 due to a lack of gold. In 1902 a boy (age unknown) called Charles Lee was killed from a fractured skull while working to dismantle the Sulieman Pasha plant. The fuss over the No. 2 shaft had a sequel. On the company winding up, the land was purchased by J.S. Trethowan who built a house next to the shaft. In 1907, the shaft caved-in creating a sinkhole immediately at the back of the house. A Mr Chamberlain heard a deep rumbling sound at 5am, and looked out the window to see his fowl house and thirteen chickens disappear down an expanding hole. He then went back to bed, and called the police later in the day. The shaft was 1050 feet deep, and the hole at the surface that developed was 20 feet by 17 feet across, and 20 feet depth. In 1930 it is reported a syndicate had been formed to clean out the old shaft, and re-open the mine. It is assumed this was the No. 1 shaft but no more was found. This painting was presented to the library in December 1930. The painting had been paid for through subscription from Judges of the High Court, the Supreme Court and the County Court as well as both branches of the legal profession. An almost identical portrait is held by both the Melbourne Cricket Club and the National Gallery of Victoria. This portrait is of interest for its subject and artist. Sir Leo Cussen (1859-1933) is probably best known for his role in two consolidations of the Victorian Statute books in 1915 and the mid 1920s. These were immense undertakings and included determining the application of English Law in Victoria. Sir Leo was appointed at Surpem Court Judge in 1906, he was at various times Acting Chief Justice of the Supreme Court of Victoria. In addition, he was trustee of both the Art Gallery (NGV) and the Melbourne Cricket Club, and held various positions with the Melbourne University Law Faculty and the Council of Legal Education. Sir Leo was regarded as one of the finest legal minds of his generation and at his death, Robert Menzies, at this time the Attorney General, said that Sir Leo was "one of the great lawyers of the english speaking world". Sir John Longstaff was one of Australia's best known and well regarded portraitist in the early 20th Century, he won the Archibald prize five times (1925, 1928, 1929, 1931 and 1935).3/4 Lenght portrait in Oils of Sir Leo Cussen, a judge of the Supreme Court, 1906-1933. As the award of the RASB is not governed by statute, it has been the practice of Australian Governments to determine conditions of eligibility for each conflict in accordance with the circumstances existing at the time. R.M. Serjeant was listed as a mining manager and Joseph Flude as a metallurgist. In 1875 they were both living in Ballarat. The patent number is A.D.1875, 4th March. No 2031. According to the patent the hearth of the furnace is in the form of a cone revolving horizontally. The feed is supplied to the apex of the cone by an archimedian screw. The crown of the furnace comprises a double covering or roof with an intermediate chamber for receiving heated air. The inner covering is pierced to admit of the heated air being brought into contact with the pyrites on the face of the revolving hearth. The discharge of the roasted substance is affected by means of a scraper at the base of the cone. It was claimed that this was a new mode of introducing heated air, and the exclusion of flame during the operation of roasting pyrites. The self-acting charge and discharge of the furnace and the peculiar construction of the hot air chambers, and the use of perforated bricks through which the supply of air is affected were also new. The extraction of the gold from pyrites and the utilization for commercial purposes of other substances connected with pyrites are peculiarly important to Ballarat, because were a simple and inexpensive method devised there are millions and millions of tons of quartz that would then be made remunerative. With this thought in their minds two scientific gentlemen invented the school of mines self-acting rotatory furnace. This, for lack of funds, has not been completed as yet, but the amount in hand for the purpose is daily increasing, and it will eventually be an accomplished fact. It is in contemplation also to erect machinery shops in connection with the school, and it is purposed to con struct a steam-engine to do at once the work of the pyrites treatment and the ma chine room. A model shaft and mine too are being prepared for on the reserve, so that practical mining of the most thorough character may be taught on the ground.'Letters Patent for an Invention for Roasting Pyrites to be called 'the Ballarat School of Mines Self-Acting Pyrites Furnace' to Robert Malachy Serjeant and Joseph Flude.
