Tait collection: item 42 of 62 This is a document giving details of the Will and Probate of Patrick White, a farmer from Codrington who died in 1883. He left personal estate to the value of £316, with the beneficiaries being his wife, Eleanor and his son George. The lawyer concerned with this document was Ernest Chambers who had legal offices in Port Fairy, Koroit and Warrnambool at the end of the 19th century and the beginning of the 20th century. He had possession of this document and it was passed down to successive lawyers occupying the legal premises in Kepler Street, Warrnambool and located in this Kepler Street building in 2014. This document is of minor significance as Patrick White was not a resident of Warrnambool. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. Elizabeth Avis- Box 1835-1913 was born in Sussex, married William Box in 1854 and arrived in Melbourne in 1855. William’s parents George and Mary Box and his siblings sailed with them. William & Mary at first leased land in the area of the ‘Dendy Special Survey Brighton 1841’ and then purchased the property with the pioneer cottage 1868 & 1869. William & Elizabeth established a market garden and raised 13 children. 1888 they built a larger 2nd house in front of the original cottage. William died in 1902 and Mary sold 9 acres in 1908 to W. .Snowden Anderson – it later became Joyce Park where the reconstructed Box Cottage Museum now stands. After Elizabeth died her daughters Ada and Violet lived on the 1 acre property until 1917 when August Reitman, a potter and monumental mason, leased the house and land. He established his pottery business and purchased the property in 1935. The business moved in 1953 but continued to use the cottage as a workshop/ storeroom until it was sold to Lewis Timber P/L in 1970. Elizabeth & William Box settled in the pioneer Cottage in Jasper Road East Brighton 1868 and established a market garden whilst raising their 13 children. This Cottage was reconstructed in Joyce Park, Ormond 1984 and is the home of City of Moorabbin Historical Society. Tait collection: item 45 of 62 This is a document giving details of the Letters of Administration following the death of Jessie Wall (nee Wood) who died intestate in Warrnambool in 1897 at the age of 53. She lived in the area in north Warrnambool known as Spring Gardens and left real estate to the value of £400 and personal estate to the value of £484. The estate was granted to her husband, Joseph Wall. The lawyer concerned with this document, Ernest Chambers, had legal offices in Port Fairy, Koroit and Warrnambool at the end of the 19th century and the beginning of the 20th century. Tait collection: item 57 of 62 This document gives details of the Will and Probate of Thomas Sleeman, a Nirranda farmer. He died in 1900 at the age of 85 and left real estate to the value of £600. The main beneficiaries were his sons and £30 was left to Mary Le Couteur, his daughter. He also bequeathed to the Wesleyan Church the half acre of land that the church was on at that time (presumably in the Nirranda district). The document has been drawn up by the law firm of O’Mahony and Murray which operated in Warrnambool early in the 20th century. The document has been passed down to successive lawyers occupying the legal premises in Kepler Street and located there in 2014 in the same building, the premises last occupied by the law firm of Mackay Taylor. This document is of some interest as it gives details of the Will and Probate of Thomas Sleeman, a farmer from Nirranda.This is a piece of white paper folded in two to make four pages. These are personal documents that belonged to Henry Roberts Parrington. They include statements regarding his preliminary and final examinations that qualified him as a lawyer in England (1867, 1873), annual certificates of registration as a lawyer in New Zealand (1876-1886), personal affidavits presented to the Supreme Court of Victoria and permission to practise as a lawyer in Victoria (1886). Henry Roberts Parrington qualified as a lawyer in England in 1873 and worked as a barrister and solicitor in New Zealand from 1876 to 1886. He then came to Australia and worked for the legal firm of Messrs Higgins in Geelong and Bayly and Higgins in Warrnambool. The business in Kepler Street, Warrnambool later became known as Higgins and Parrington and, in 1900, as Parrington and Tait (partner John Sym Tait). When John Tait retired in 1901 Henry Parrington was the sole proprietor of the practice. He died in Melbourne in 1926. These documents have some significance as they are original papers documenting Henry Parrington’s early years as a lawyer. He was a prominent lawyer in Warrnambool in the late 19th and early 20th centuries. These sixteen paper documents relate to the lawyer, Henry Roberts Parrington. They are all original documents from England, New Zealand and Australia (Victoria). Most have printed material on them. All have statements and information handwritten in black ink and many have stamps relating to the country concerned. Some are foolscap size and are printed on blue paper. This certificate, drawn in a very elegant hand, contains the biographical information of Wilfred Busse. It is assumed to be a funeral or memorial card. Born in Chiltern in 1898, Wilfred Clarence Busse was educted at Wesley College and then the University of Melbourne. He became a barrister and through his time at the University of Melbourne studied with future Chief Justice and Governor of Victoria Sir Henry Arthur Winneke (1908–1985), as well as spending time in the chanbers of Sir Leo Finn Bernard Cussen (1859-1933), who was a judge of the Supreme Court of Victoria. Busse also wrote two novels, 'The Blue Beyond' and 'The Golden Plague'. In 1931, 'The Golden Plague' was awarded the T. E. The Working Men’s College was founded in 1881 by a prominent grazier and philanthropist, The Hon. Francis Ormond, who donated £5000 towards the establishment of the college. The Council of the Melbourne Trades Hall then matched Ormond's initial donation by rallying its members. On 4 June 1887, the college opened in its purpose-built building on the corners of Bowen Street and La Trobe Street in Melbourne, with a gala ceremony. It became the third official provider of higher education in the new Colony of Victoria (the Melbourne Athenaeum was founded in 1839 and the University of Melbourne in 1853). The college was the predecessor to the current-day Royal Melbourne Institute of Technology (RMIT University). Adjoining the college in the 1890s were the Supreme Court of Victoria (later the Melbourne Magistrates' Court) and the Melbourne Gaol - both which are now part of RMIT today. This is an 1877 document, the Letters of Administration in connection with the will and probate of William Ellis, a veterinary surgeon from Wimmera Street, Stawell. He died after an altercation with W. Richards, the landlord of the Post Office Hotel, where he was knocked against the wall of the verandah of the hotel. He left a small estate, with his property valued at under £107. This document is only of interest in that it came from the former legal offices of Mackay Taylor in Kepler Street, Warrnambool. It originally came from Thomas Goodall, a legal clerk in the office of lawyer Ernest Chambers who passed it on to George Mackay, the lawyer in the forerunner firm of Mackay Taylor where it remained until the firm of Mackay Taylor ceased to exist and the buildings were cleaned out. This is a piece of parchment folded and sealed at the bottom edge with a seal of the Supreme Court of the Colony of Victoria. The material in the document is handwritten in black ink.
