Tait collection: item 19 of 62 This is an 1899 document giving Will and Probate details of William Cox who died in Warrnambool in March 1899. He was a farmer residing in Moore Street Warrnambool at the time of his death at the age of 83. He left real estate to the value of £425 and personal estate to the value of £412 to Gwenllian Williams who may have been his sister or niece. A Mr and Mrs Williams were also living in the Moore Street house at the time of Cox’s death. His executors were Thomas Goodall, a law clerk who managed the office of the lawyer Ernest Chambers in Warrnambool and John Ward, a pioneer settler in Warrnambool and a shopkeeper in Jamieson Street in 1899. No other details are available on William Cox. This is an interesting document as it gives details of the Will and Probate belonging to a local Warrnambool person, William Cox. The lawyer dealing with the document was Ernest Chambers who had legal offices in Warrnambool, Port Fairy and Koroit at the end of the 19th century and the beginning of the 20th century. This document has been passed on to successive lawyers occupying legal chambers in the Kepler Street building and that is where the document was held until passed on to the Warrnambool and District Historical Society in 2014.This is an 1899 piece of parchment paper folded in two with handwritten material on three sides of the paper. The seal of the Supreme Court of the Colony of Victoria is attached with blue ribbon and there are two stamps, one blue one of the Colonial Bank in Warrnambool and the other a red one of the Master in Equity of the Supreme Court in Melbourne. Two of the pages have ruled black lines. This is an 1886 certificate admitting George Mackay to practise as an attorney, solicitor and proctor in the courts of the colony of Victoria. George Sutherland Mackay (1850-1926) was born in Scotland and educated at the University of Glasgow. He came to Australia in 1884. In 1891 he came to Warrnambool and established a legal practice in Kepler Street. In 1893 he bought the practice of the late James Fletcher and the firm was then known as Fletcher and Mackay. It changed to Mackay and Taylor (later Mackay Taylor) when J.D. Taylor became his partner in the 1920s. In 1999 Tait Solicitors and Mackay Taylor amalgamated to form Tait Taylor and in 2010 the firm’s name became Tait Legal. This certificate is of considerable importance as a significant memento of George Mackay, a prominent lawyer in Warrnambool from the 1890s to 1926.This is a paper certificate pasted on board and set into a brown cardboard frame. The certificate has brown or gold handwriting with some calligraphy, three or four stamps (mostly obliterated), a green duty stamp and the remains of a signature. These are the Probate papers for Patrick Mahony, a farmer from Wangoom who died in 1894. He left an estate of £995 and personal effects worth £138. The estate was to be administered by the two sons, William and Timothy in trust for another son, Michael Mahony. The wife Margaret was granted three acres of land, £25 a year and ‘the choice of two cows out of my stock’. The daughter Johanna was to receive the same benefits after the death of her mother. Patrick Mahony, being illiterate, signed his will with a cross. The latter had a practice in Warrnambool for the best part of seventy years, firstly in Timor Street and then in Kepler Street. He was a prominent resident in Warrnambool. The document was originally in the hands of the law clerk, Thomas Goodall and it was passed on to lawyers occupying the Kepler Street premises until it was found in the buildings once used by the law firm of Mackay Taylor. This document shows that Mary Irwin of Peterborough, Victoria, died in April 1892 without making a will and the Letters of Administration were granted to her husband, William Irwin. However he died in 1901 without having fully administered Mary Irwin’s estate. In turn the estate administration was passed over to Charles McGillivray of Peterborough and one of Mary Irwin’s sons, William Irwin, residing in New Zealand. This document was drawn up in 1907, fifteen years after Mary Irwin’s death. She left property to the value of £100. No other details on Mary Irwin are available. Nurse Sarah Procter stretched the limits by enlisted on 12 August, 1915 at 45 years of age, the maximum acceptable age. A sister, Mrs J H Treloar (Amelia) in Hamilton was given as next of kin. Her Attestation shows she had 13 years nursing experience, having earned her Certificate at Stawell Hospital, served for one year with the Women's Hospital with the balance with private amenities. The Embarkation Roll lists her residential address simply as Brunswick - there is no Attestation or other material surviving to suggest a more specific address. She embarked from Melbourne on board RMS Morea on 24 August, 1915 and like many the served in Egypt in 1915, her record is a little hazy, but it appears at in January, 1916 after serving with No. 2 AGH, she was promoted to Nursing Sister and returned on HMAT Ulysses transporting wounded back to Australia. Nurse Procter embarked again on 4 April, 1916 to re-join her unit. She arrived in England 30 December after further service at Alexandria and was initially assigned to No. 2 A.A.H, then at Southall, She was transferred just a few weeks later to No. 1 AAH at Barefield where she remained until February, 1918. She proceeded to join No.5 AGH at Rouen, France in May, 1918; she returned to England on 23 November, 1918 after spending a month off duty with general debility and on return was admitted to South Kensington hospital with rheumatism. She was released around a fortnight later and at the same time promoted to the rank of Sister. Perhaps because of her age, she embarked for Australia soon afterwards and was assigned to No. 11 AGH at Caulfield from 9 February, 1919 until her appointment was terminated on 3 May. Born Stawell, Protestant, Sarah Jane Procter died at 75 years of age in a private hospital in St. Kilda, on 6 July, 1945 as the result of an accident and was interred in Eltham Cemetery. Her National Archives are held as Procter, AWM files as Proctor, the former is correct. (Brian Membery for Wikinorthia) Sarah Jane Procter never married and served in WW1. She enlisted at 45, but said she was only 40 on the enlistment papers. Sarah is buried in CE Monumental Section Grave 182. She was born in Stawell in 1869 and died accidentally in Heidelberg 1945. Thomas Jefferson Connelly (1858-18/10/1892) Son of Thomas James Connelly a well known JP at Inglewood. Admitted as a solicitor in the Supreme Court in 1880. Started own business as a solicitor in 1883 at Albion Chambers, View Street. By 1887 he had joined with George Henry Tatchell and in 1889 they moved their firm to Williamson Street. On 8th Jan 1885 he was elected to the Bendigo Council and was elected as Mayor 16th Aug 1887. He was the first Bendigo born Mayor and the youngest. He served on the committee of the Bendigo hospital and the Mechanics Institute and was a prominent member of the ANA. He was also a Captain of a local militia force. He married Frances Cresswell Reynolds and they had 3 children who were very young when they were left fatherless in 1892. Thomas died in Kerang, following an epileptic fit. He was attending a case at the time. He is buried at the Bendigo Public Cemetery. George Henry Tatchell was the son of Thomas Tatchell JP of Inglewood. He was admitted as an attorney by the Supreme Court in 1887 and formed a partnership with Thomas Jefferson Connelly 22/9/1887. By 1894, their practice had been joined by Adam George Dunlop. In 1904 he was elected president of the Bendigo Bar Association. George was a very bowler and was part of an Australian team that travelled to Britain in 1930, where he won the Veteran Pairs Competition competing with his brother William. He retired to “Woodford”, Toorak. Adam George Dunlop (1864 – 28/2/1921) Son of Andrew McBride Dunlop. He married Marion Ethel Nicholls, a widow in 1905. Admitted as a solicitor, proctor and conveyancer in 1892. When Thomas Connelly died, his will stated that his share in the law firm was to be sold and if it was sold to Dunlop, he would have 3 years to pay for. This clearly happened and by 1894 the firm was known as Connelly, Tatchell and Dunlop.He continued to work for the firm Tatchell, Dunlop, Smalley and Balmer for 25 years and retired several months before his death, to “Milltara”, Glyndon Ave., Brighton. He was heavily involved in the Sandhurst Mechanics Institute and served as president in 1899 and 1901. He was treasurer of the Zenith Lodge of Masons in 1907. He was president of the ANA in 1896 and president of the Bendigo Law Association in 1907. Whilst in Bendigo, the family lived in “Millewa”, Kangaroo Flat. Jonathon Smalley (1873-21/8/1961) Son of Peter, a mining investor and his wife Ellen. 1899 married Catherine Horsemann Manning with whom he had four children. Jonathon proved proficient in sign language when he stepped into a court case where the defendant was hearing impaired. In 1904 he was the president of the Eaglehawk Mechanics Institute. Other community postings included Vice President of Bendigo Football Association (1909), President Bendigo ANA (1899), Councilor for Eaglehawk Borough (1904- ), elected Mayor of Eaglehawk (1909),and President of Bendigo Law Association (1910). Jonathon and his wife resided at “Overton”, View Street, Bendigo (now Harry Little Childcare Centre). Jonathon was a champion Lawn bowler, winning the Country Singles Championship in 1913. He is buried at the Bendigo Cemetery. Sydney Raeburn Balmer (1869 – 24/11/1938) Sydney was the son of Robert and Elizabeth Balmer. He married Catherine HAswell McDonald in 1905 and they later lived in Lily Street, Bendigo. After qualifying as a barrister and solicitor, he was initially employed as a barrister for Mr Cussen (later a judge) for 2 years. It’s hard to find a park. Cars are banked up along the narrow road and crammed in a nearby parking area. Yet, at the market, people look relaxed and happy amongst the yellow box gums on the site where the Wurundjeri people used to gather. Stone artefacts unearthed there by Koorie researcher, Isabel Ellender, indicate the site was once a Wurundjeri meeting place, according to Aboriginal Affairs Victoria. Acoustic sounds mingle with quiet conversations. A guitarist blows a mouth organ while his bare toes tickle chimes. A tiny busker, perhaps five years old, plays a violin while sounds of a harp emerge from the hall. One stallholder, selling delicious-looking pastries, chats to another in Spanish, then to me in broad Australian. ‘I was born in Fitzroy but my mother came from Mexico and my dad from Serbia,’ she smiles. A New Zealander fell in love with Mongolia and now imports their hand-made embroidered clothes and Yurts (tents) and runs adventure tours. A young woman visited Morocco and when friends admired the shoes she bought, she decided to import them and sell them at the market. Oxfam sells Fair Trade toys and clothes and displays a petition to Make Poverty History. Other stalls sell Himalayan salt, jewellery made from seeds from northern Australia, glass paper-weights from China as well as locally grown vegetables, flowers and organic freshly baked bread. A woman sits in a state of bliss under the hands of a masseur. Another offers Reiki or spiritual healing. A juggler tosses devil sticks – ‘not really about the devil,’ he smiles. This skill was practised thousands of years ago in Egypt and South America he says. At the Chai Tent people lounge on cushions in leisurely conversation. The idea for the market was first mooted among friends over a meal at the home of famous jazz and gospel singer Judy Jacques.2 Jacques remembers a discussion with several local artists including Marlene Pugh, Eric Beach, Les Kossatz, Ray Newell and Peter Wallace. ‘We decided we wanted a meeting place, where all the different factions of locals could meet on common ground, sell their goodies and get to know one another,’ Jacques recalls. They chose the site opposite another meeting place, St Andrews Pub. A week later Jacques rode her horse around the district and encouraged her neighbours to come along to the site to buy or sell. On February 23, 1973, about 20 stallholders arrived with tables. They traded ‘second-hand clothes, vegetables, meat, cheese, eggs, chickens, goats, scones, tea, garden pots and peacock feathers’. Now around 2000 people visit each Saturday. People usually linger until dusk. The market – with around 150 stalls of wares from a wide variety of cultures – stands alongside Montsalvat as the most popular tourist attraction in Nillumbik. By the 1990s St Andrews Market was in danger of being loved to death, as the site was becoming seriously degraded. The market was spreading in all directions and the degradation with it. A local council arborist’s report in 1994 noted exposed tree roots from erosion and compaction. The Department of Sustainability and Environment threatened to close the market if the degradation was not rectified. After many months of research, discussions and lobbying by a few residents, the council formed a Committee of Management, with an Advisory Committee, and introduced an Environment Levy. The State Government, the council and the market, funded terracing of the site to stop erosion, and retain moisture and nutrients. Vehicles were excluded from some sensitive areas and other crucial zones reserved for re-vegetation. Volunteers planted more than 3000 locally grown indigenous species. The old Yellow Box trees fully recovered and are expected to give shade for many years to come.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. David STRACHAN (1919–1970) Born 25 June 1919 at Salisbury, Wiltshire, England Arrived 1920 Adelaide, Australia: 1921 Creswick, Victoria David Strachan attended Creswick State School and Geelong Church of England Grammar school. By the age of 16 he wanted to be an artist. Accompanying his mother to London in 1936, he enrolled at the Slade School of Fine Art, where he met Godfrey Miller. In 1937 he attended the Académie de la Grande Chaumière, Paris, and painted at Cassis on the Mediterranean Sea. He returned to Australia in April 1938 and studied at the George Bell School, Melbourne. He had a growing interest in classicism blended with a fascination for the dream-state which was reinforced in his work after he moved to Sydney in 1941. There he was befriended by Jean Bellette and her husband Paul Haefliger, who were to be driving forces behind the Sydney Art Group (founded 1945). He lived on the top floor of the Haefligers' house at Double Bay, and together the three artists drew from models whom the Haefligers hired. In this period Strachan painted and exhibited some of his most poetic works—mainly figurative and landscape subjects, and still-lifes of haunting beauty. His flowers, bowls of fruit, birds, and angelic figures glimmered out of the darkness as things not of this world, evoked faintly, like mythological personages in a gently spoken narrative. He 'spent an erratic war' painting camouflage at Bankstown aerodrome with other artists, among them (Sir) William Dobell, and dancing minor roles with Hélène Kirsova's ballet company. In 1948 Strachan settled in Paris. His paintings, included by Peter Bellew in an exhibition at the Musée National d'Art Moderne, had been well-received by French critics two years earlier. In 1950 he began tentative experiments in etching. These led to the formation of the Stramur-Presse, a business venture which published etchings and lithographs of leading French and English artists. His most important project was a series of twenty-two colour etchings illustrating Alister Kershaw's book of poems, Accent & Hazard (Paris, 1951). Strachan continued to exhibit in Australia and maintained a lively social life with Australian friends. From Paris, he went for weekend painting trips with Moya Dyring in her car and, after 1957, visited the Haefligers on Majorca. He lived in London in 1955-57. His paintings became progressively less soft in effect, his palette brightened, and his forms, especially the still-lifes, became spikier. In the late 1950s his attention drifted towards the study of Hindu philosophers and Jungian psychology. For most of 1957-58 he was enrolled at the C. G. Jung-Institut, Zürich, Switzerland. In 1959 he worked in Silvio Daneo's silkworm factory at Bricherasio, Italy. In May 1960 Strachan returned to Sydney. He lived at Woolloomooloo before buying a house at Paddington in 1963. Over the ensuing years he involved himself energetically with the art scene, exhibiting, teaching (1960-65) at East Sydney Technical College, fund-raising for memorials for Thea Proctor and Dyring, and as the last president (1965) of the Society of Artists. His paintings were out of harmony with the prevailing fashion for abstraction, but he won the Wynne prize for landscape painting in 1961 and 1964 (shared). Perhaps the most moving works of Strachan's last ten years were the mining landscapes, including those he painted near Hill End, leading up to his vast canvas, 'Lewers Freehold Mine'. This was a history picture, depicting the mine as it might have appeared in 1874. He presented it to the Creswick Historical Museum in 1970 in memory of his father. Field Marshal Viscount Kitchener of Great Britain was invited by Prime Minister Deakin in 1909 to visit Australia and advise on the best way to provide Australia with a land defence. Kitchener’s report echoed the bill, introduced to Parliament in 1909 and supported by the Opposition Labor Party at its 1908 conference, to introduce compulsory military training in peace time (referred to as universal training). On 1 January 1911, the Commonwealth Defence Act 1911 (Cth) was passed as law and all males aged 12 to 26 were required to receive military training. Men were divided according to age, with junior cadets comprising boys 12-14 years of age, senior cadets comprising boys 14-18, and young men aged 18-26 assigned to the home militia defence. The support of schools was vital to the success of the scheme, since the system of cadet training began in the primary schools, with physical training prescribed by military authorities. Junior cadet training was entirely in the hands of school teachers, who had first been trained by military officers. This early training was less military in nature than focused on physical drill and sport. It also acted to inculcate boys with the notions of loyalty to country and empire. At this age, uniforms were not worn, although there were schools with pre-existing uniformed cadet units, who continued to do so. Senior Cadets were organised by Training Areas, administered by Area Officers. If a school had at least 60 senior cadets, they could form their own units. Unlike their junior counterparts, Senior Cadets were issued uniforms, a rifle, and learned the foundations necessary for service in any arm of the defence forces. Boys and men could be exempted from compulsory training if they lived more than five miles from the nearest training site, or were passed medically unfit. Those who failed to register for training were punished with fines or jail sentences, and the severity of this punishment generated some of the strongest opposition to the scheme. While institutions such as the political parties and most churches generally supported universal training, some in the broader labour movement were less enthusiastic, as evidenced in the Daily Herald newspaper’s editorials and letters. Universal military training persisted after the conclusion of World War 1, with the Junior Cadet scheme the first to go, in 1922. Senior cadets and service with the militia was suspended in November 1929. Rees From the Ballarat School of Mines Magazine, 1916 "Our Competition Team, 1916 At a parade, held on the 25th August competition teams were called from from the three colleges - Ballarat College, St Patrick's College, and the School of Mines. In each case, a large muster was obtained, twenty-nine volunteering fro the School of Mines. On account of the number in a team being limited to 21, some had to be weeded out. The team decided to have a camp at Learmonth in the vacation for the benefit of training for the coming competitions. The tents, within our baggage, were brought to the Junior Technical School at 10 a.m. on Monday, 11 September. Everything was carted to the station on a lorry, which was very kindly lent by Mr C. Burrow. ... Arriving at our camp, which was in the Park, we first raised the tents. This was done in record time. Three large tents, A.B.C., were pitched one behind the other. We also pitched a smaller one to act as a provisions tent. The provisions supplied by each cadet were placed in this tent. Dinner was ready by 3.30, and was prepared by the three senior non-coms., who also acted as orderlies. Things went alright Monday night, the two senior non-coms. acting as sentries for the first two hours. On Tuesday morning Reville sounded at 7. There was no need for it, however, as nearly all the cadets were up before daylight, owing to their beds being too hard. After physical exercises were gone through we had breakfast. We then had rifle exercises until Messrs A.W. Steane and F.N. King arrived. The former put the team through the table of physical exercises set down for competition work, many valuable points being obtained. The visitors remained for dinner, afterwards returning to Ballarat. Wednesday was uneventful, until the soldiers arrived at about 11 a.m., stopping at the park for lunch. As we handed over the coppers, etc., to them, our lunch was delayed. Two more visitors arrived after lunch, and after taking a few photos returned home. That night we had a "Sing-a-long" in C Tent until "Lights out" sounded at 9.30. After physical exercises ad breakfast on Thursday, we went for a six mile route march round the lake, doing skirmishing on the way. In the afternoon we practised rifle exercises and the march past. A concert was arranged for that night, the chief singers being cadets H. Siemering and W. Shattock. Supper was served at the end of the entertainment. On Friday, Reveille sounded at 6.30 instead of 7, and, as usual, we had physical exercises before breakfast, after which the team went through skirmishing at the reserve. In the afternoon, section drill and the march past were practised. Friday night, being our last night in camp, leave was granted until 10 p.m., "lights out" sounding at 11. Reveille sounded on Saturday at 4.30, the reason being that all kits, tents, etc., had to be packed away ready to catch the 8.15 train to Balalrat. At 7.30 we were all ready to leave for the station. We had a very enjoyable time in the train, each cadet having a chip in at the patriotic songs. On arriving at Ballarat, we found the lorry awaiting us. The luggage was carted to the Junior Technical School, the team following. The team were here dismissed, everyone feeling that he had had a very good time. F.G. The Lasting Memories Mosaic Group Seat is part of Nillumbik Shire Council's Public Art. Following the Black Saturday Bushfire of February 7, 2009, which ravaged St Andrews and surrounding district, a group of bushfire affected women formed the Lasting Memories Mosaic group and created this concrete seat covered in mosaic as part of their healing process. It was completed in 2012.
