Document - Charles Spencer Letters of Administration 1898, 1899
Tait collection: item 47 of 62 This is a document giving details of the Will and Letters of Administration following the death in 1895 of Charles Spencer of Brooklands, Birchanger, Essex, England. It is not known why the document has been drawn up in Melbourne and also makes reference to Warrnambool lawyers but it is presumed that some or all of the beneficiaries of the will lived in the Warrnambool district at the time. Charles Spencer left personal estate to the value of £689 to his wife, Emily, and children. Mentioned in the document are the lawyers J.S.Tait and Henry Parrington who were partners in a law firm in Warrnambool at the end of the 19th century (going under the name of Higgins and Parrington). The document has been passed down to successive lawyers occupying legal premises in Kepler Street and it was located in this building in 2014. The Letters of Administration for this estate was granted to Henry Parrington. The personal estate comprised £689 which had been lent to Spencer Smith on the security of land in the Parish of Wangoom, County of Villiers the repayment of which is secured by an indenture of mortgage dated 1st June 1892. [Ref: PROV. VPRS28/P0002, 73/750 Charles Spencer Grant of Administration] This document has no known local relevance except for the involvement of two Warrnambool 19th century lawyers. Further investigation has shown the personal estate mentioned in this will comprised £689 as a mortgage secured loan to a local resident, Spencer Smith.This is a cream-coloured piece of parchment paper folded in two and containing handwritten material on four pages which have black ruled lines on the edges. The 1899 document gives details of the Will and Letters of Administration of Charles Spencer, of Brooklands, Birchanger, in the County of Essex in England. The blue seal of the Supreme Court of Victoria is attached with a green ribbon and there are two red stamps of the Master in Equity of the Supreme Court. Tait collection: item 45 of 62 This is a document giving details of the Letters of Administration following the death of Jessie Wall (nee Wood) who died intestate in Warrnambool in 1897 at the age of 53. She lived in the area in north Warrnambool known as Spring Gardens and left real estate to the value of £400 and personal estate to the value of £484. The estate was granted to her husband, Joseph Wall. The lawyer concerned with this document, Ernest Chambers, had legal offices in Port Fairy, Koroit and Warrnambool at the end of the 19th century and the beginning of the 20th century. He was in possession of this document and it was passed down to successive lawyers occupying legal premises in Kepler Street. It was located in this building in 2014.This document is of some significance as it contains details of the Letters of Administration of Jessie Wall who was a 19th century resident of Warrnambool. Document - George Murray Letters of Administration 1883, 1885
No information is available on George Murray except that he was a Melbourne accountant and died intestate in 1885. He left property to the value of £91 and the lawyer, Ernest Chambers, who was at that time at 12 Chancery Lane, Melbourne, was directed to list the creditors of George Murray and distribute the estate accordingly. Mr Chambers was one of George Murray’s creditors. Ernest Chambers later had a legal practice with offices at Warrnambool, Koroit and Port Fairy with the known dates 1897 to 1910. Thomas Goodall was the manager of the Warrnambool office and he was the one who had this document in his possession at that time and it was passed down to succeeding lawyers in the Kepler Street building. Tait collection: item 7 of 62This document is of interest in that it was originally issued by the lawyer Ernest Chambers who later had an office in Warrnambool. This is a piece of parchment containing the 1885 Letters of Administration in the estate of George Murray, a Melbourne accountant. The document is white with black ruled lines and has handwritten material in black ink. The document is folded at the lower edge with a seal of the Supreme Court of the Colony of Victoria. The seal is attached to the document by a green ribbon. There is also a blue stamp of the Master in Equity of the Supreme Court. Tait collection: item 34 of 62 This is a document giving the details of the Letters of Administration following the death of Helen Robertson, a spinster from St. Kilda, Melbourne. She died intestate in November 1881 and left property to the value of £363. This property reverted to her sister Agnes Thomson in 1889. No other details have been found on Helen Robertson. The lawyer in the case was George Skinner of Melbourne but the document was one of several stored in legal premises in Kepler Street, Warrnambool and passed on to successive lawyers occupying these premises. Booklet, The Warrnambool Woollen Mill, 1888/9
These documents concern a legal case involving the Town Of Warrnambool, Elizabeth Granter and James Harris. The lawyer in the case was William Ardlie. The son of John and Mary Ardlie, pioneer settlers in Warrnambool, William Ardlie was a prominent lawyer in Warrnambool from the late 1860s to the early 1930s and was active in community affairs. Elizabeth Granter, involved in the financial side of the legal case, was the wife of James Granter, another prominent Warrnambool identity of the 19th century. Granter was a quarryman and a road contractor and he and other members of his family seem to have been involved in other legal battles with James Harris, an employee of the Warrnambool Tramway, also involved in the financial aspects of the legal case. These three documents are of minor interest as an example of the legal cases undertaken by the well-known Warrnambool lawyer, William Ardlie. These are three 1888/1889 documents related to the legal practice of William Ardlie. Item One is a document listing the details of a court case involving Elizabeth Granter, James Harris and the Town Council of Warrnambool and is a sheet of paper with the details of the case written on both sides of the paper in black ink. The back page has a green stamp to the value of one penny. Item Two is a letter from Charles Hider, the bookseller, in regard to an item received by H.A.C. Macdonald, the Town Clerk of the Town of Warrnambool. The handwriting is in black ink. Item Three is a letter from the Warrnambool Tramway Department to Mr Ardlie regarding the request of James Harris for a small sum of money. This letter is a sheet of paper folded in two and written in black ink on one of the four sides. Tait collection: item 37 of 62 This is a document giving details of the Will and Probate of Caroline Manton who died in 1889 and was the wife of Frederick Manton and lived at ‘Tenilba’ in Domain Street, South Yarra. She left personal estate to the value of £536 for the benefit of her husband and children but no other details on her life have been found. The lawyer in the case was Ernest Chambers who had legal offices in Port Fairy, Koroit and Warrnambool at the end of the 19th century and the beginning of the 20th century. Tait collection: item 44 of 62 This document gives details of the Will and Probate of William McJannet, a Warrnambool carpenter who died in 1898 at the age of 80. He and his wife and two of his children came to Australia from Scotland in the 1850s and at the time of his death he was living in Raglan Parade. He left real estate to the value of £400 and the beneficiaries were his children. The lawyer concerned with this document, H. Parrington, had legal offices in Kepler Street with the firm known as Higgins and Parrington but Mr Parrington was in partnership with Mr J.Tait when this document was drawn up. The document has been passed down to successive lawyers occupying the Kepler Street premises and located in this building in 2014. This document is of some importance as William McJannet was a well-known resident of Warrnambool in the 19th century. The document will be useful to researchers. Document - Thomas Oakley Letters of Administration 1898, 1893
Tait collection: item 39 of 62 This document gives the details of the Will and Probate of Thomas Oakley who died in Warrnambool at the age of 75 in 1893. He had come with his first wife to Australia in 1852 and was a Customs Officer in Warrnambool, in charge of the signals and premises, living in Merri Street. Later after the death of his wife (they had ten children) he married Eliza McKeeman in 1870 and they lived at ‘Oakbank’ near the Warrnambool Cemetery where Oakley pursued farming interests. They had a further eight children, many of them making their mark in the business and community life of Warrnambool and further afield. Thomas Oakley left real estate to the value of £900 and personal estate to the value of £1251, with the beneficiaries being his wife, his daughters, Elizabeth and Mary Anne from his first marriage and the eight children of his second marriage. The lawyers concerned with this document, O’Mahony and Murray, had offices in Warrnambool in Kepler Street at the end of the 19th century and the beginning of the 20th century. This document was in the possession of Ernest Chambers, a Warrnambool lawyer during the same period. These documents relate to the sale of land in Merri Street Warrnambool in 1959 by Swintons Pty Ltd of Warrnambool. The buyer of the land was George O’Grady, a Warrnambool baker. The land sold for £4000 and there was a shed on the land (called the ‘Office’) which George O’Grady indicated he wished to be included in the sale. William and Ann Swinton migrated to Australia in 1854 and for a decade William Swinton worked as a builder and carpenter in the Warrnambool area, erecting many buildings, including the Wangoom Presbyterian Church. In 1865 he opened a store in Timor Street Warrnambool, selling groceries, hardware, china and glassware. By 1888 the business was known as William Swinton and Sons. Branch stores were opened in Wangoom, Cudgee, Nullawarre, South Warrnambool and West Warrnambool. After William Swinton died his son Robert became the first managing director of Swintons Pty Ltd. In 1934 the business split with George Swinton and Sons selling clothing, furnishings and glassware and Swintons Pty Ltd selling seeds, produce and hardware. Today the Swinton family still operates a furniture and bedding shop in Timor St Warrnambool.These items are of some interest as being connected to the Warrnambool business of Swintons Pty Ltd. They will be of interest to researchers. Tait collection: item 46 of 62 This is a document giving details of the Will and Probate of Miles Staunton (called Miles Stanton in the Will and Myles Staunton in the official Victorian death records). He died at Tower Hill in 1898 at the age of 72. He was a farmer in the Koroit district and left real estate to the value of £2799 and personal estate to the value of £128. The chief beneficiaries were his wife and children. Miles Stanton was unable to write and signed his will with a cross. The lawyers involved, Fletcher and Mackay and Ernest Chambers, had legal offices in Warrnambool at the end of the 19th century. He was a farmer at Kirkstall but no further details on him have been found. He left real estate to the value of £100 and personal estate to the value of £5 to his wife Margaret Flahavin. She died in December 1889 but, as she died intestate, the Letters of Administration were not processed until 1911. Ann Doran left no real estate but left personal estate to the value of £116. This gladestone bag was owned by William Ardlie one of Warrnambool's longest serving solicitors. William Ardlie, the son of a pioneer Warrnambool settler, John Ardlie, began practising as a lawyer in Warrnambool in the mid 1860s and dominated the legal scene in Warrnambool, continuing on his practice until he was over 80. This item has strong provenance and its significance lies in it being owned by one of Warrnambool and the State of Victoria's longest serving solicitors.Brown leather gladestone bag with leather handle and silver metal lock and attachments. Document - George Weeks Order of Discharge 1876, 1883
Tait collection: item 60 of 62 This is a document giving George Weeks, a sawmiller from Invercargill in New Zealand, an order of discharge from his debts in 1883. In the Southland Times of March 1876 there is a notice of a meeting of creditors of George Weeks of Invercargill in the matter of his insolvency. It is not clear whether the document we have concerns that same insolvency or a further one. If it is the same one then it took seven years for George Weeks to gain his legal discharge from debt. It is not known how this document came to be in Warrnambool but it is assumed that it was in the possession of a Warrnambool lawyer, probably Ernest Chambers, who had legal offices in Warrnambool at the end of the 19th century and the beginning of the 20th century. It has been passed down to successive lawyers occupying legal offices in Kepler street, Warrnambool and was located in this building in 2014. This document has no known relevance to Warrnambool except that it was in the possession of a 19th century Warrnambool lawyer. Tait collection: item 29 of 62 This document contains information on the Will and Letters of Administration of James Jones, a gardener from Warrnambool. The document indicates that he died intestate in August 1896 at the age of 57 but details of a will are included in the document. The fact that this document was drawn up 14 years after his death indicates that there was a problem with the will. Tait collection: item 35 of 62 This is a document giving details of the Letters of Administration following the death of Alexander Gibson McPherson, a farmer of Rochester, Victoria, in December 1883. He died intestate and left an estate worth £215. The beneficiary was his sister, Mary Wright of Somerton. No other details are available on Alexander McPherson. The lawyer in the case was Ernest Chambers who had legal offices in Port Fairy, Warrnambool and Koroit at the end of the 19th century and the beginning of the 20th century. This document was in his possession at his Warrnambool office and passed down to successive lawyers occupying legal premises in Kepler Street. The document was found in the same building, the former premises of the legal firm, Mackay Taylor, where it was located in 2014 and handed over to the Warrnambool and District Historical Society.This document is only of interest as being originally in the possession of Ernest Chambers, a lawyer who was in Warrnambool for several years at the end of the 19th century. Tait collection: item 41 of 62 This document gives the details of the Will and Probate of Henry Phillips who died in Warrnambool in 1895 at the age of 55. He came to Australia from England in 1861 and established a hay and corn store in Liebig Street, Warrnambool. He was a prominent member of the Congregational Church and lived at ‘Ilfracombe’ in Lava Street. He and his wife Emma had eight children, two of whom had businesses in Warrnambool. Henry Phillips left personal estate to the value of £521 and the beneficiaries were his wife, Emma and their children. This document came into the possession of a Warrnambool lawyer, Ernest Chambers and passed down to successive lawyers occupying legal premises in Kepler Street. The document was located in this building in 2014 in the former premises of the law firm of Mackay Taylor. This document is of considerable importance as it contains details of the Will and Probate of Henry Phillips. He was a prominent businessman in Warrnambool in the 19th century. The document will be useful to researchers. This book belonged to James and Catherine McGinness (both names are in the book). James McGinness (1842-1905) came to the Framlingham area in the 1870s and married Catherine Taafe in 1880. Members of the McGinness families had been involved in hotelkeeping in the Purnim district. James and Catherine McGinness had a farm at Framlingham (including the breeding of horses) with the property known as Riverview. The farm and derelict remnants of the house still exist today. The youngest son of James and Catherine was Paul McGinness, a hero of two World Wars and the founder of the airline Qantas. The original spelling of the surname was ‘McGuinness’ but James altered the spelling to avoid confusion over names with his brother John. This book is of interest because it belonged to the McGinness family of Riverview, Framlingham. Several of the names in the book are marked, especially those of ‘McGuinness’ showing that perhaps the McGinness family of Framlingham had expectations of claiming some of the money listed as unclaimed. This is a hard cover book of 472 pages. At the back of the book are several pages giving addresses of lawyers and opinions of the Press. The cover is red with an embedded pattern on the front cover and gold lettering on the front cover and the spine. The inscriptions are handwritten in blue and black ink. The book contains names of those deceased persons and/or their heirs who have appeared in advertisements regarding unclaimed money. There are several coloured insert sheets in the book with copies of letters of thanks sent by grateful readers. The cover is very stained and torn at the edges. ‘C. This book containing the 17 cantos of Don Juan, was owned by Con O’Mahony a lawyer who lived in Warrnambool at the turn of the 20th century He won the Bowen prize for essay writing in 1883. He operated from Royal Chambers in Kepler St Warrnambool for some time in partnership with Mr E W Klingender. These sheets contain photocopied information on Warrnambool streets and blocks – Allotment numbers and Section numbers, names of developers, date of street construction approval, names of lawyers, Titles Office information etc. They have been originally compiled by Warrnambool City Council staff and concern Warrnambool streets projects from the 1950s, 60s and 70s. This is photocopied material and therefore is of little historical importance. But the information contained therein will be useful for researchers. Tait collection: item 53 of 62This document gives details of the Will and Probate of Ann Wines, a widow, who died in 1904. She was previously from Woodford but was resident in Warrnambool at the time of her death. She left personal estate to the value of £772 with the chief beneficiary being her daughter, Jane. The Wines family was a well-known one in the Woodford/Mailors Flat areas with Charles and Hannah Wines arriving in the district in the early 1850s. The lawyer involved in drawing up this document was Henry Parrington who was in partnership with Jabez Higgins in the 1880s and 90s and from 1900 to 1901 in partnership with John Tait. From 1901 on Henry Parrington had a legal practice on his own account. The legal practice was in Kepler Street. Parrington died in 1926. This document was passed down to successive lawyers occupying the Kepler Street law premises and located there in 2014. This document is of some interest as it gives details of the Will and Probate of Ann Wines who was a resident of Woodford (19th century) and later Warrnambool (early 20th century). She was the daughter of Edmund and Jane Lord and came to Australia with her parents and some of her siblings aboard the Electric in 1869. He was a contractor who died at the age of 46 leaving a widow, Margaret (nee Flahavin) and eight children. The two oldest boys took over the contracting business and Joseph’s brother, David, supported the family during their time of need.
