The small building on the left is the Farmers Inn, and was built about 1849, when James Brown became the first licensee. In 1854 John Walwyn Taylor moved from the Sally Ann to take over, and remained there until 1857, when he moved to his new hotel The Star of the West built on the old Sally Ann site. John Wall then became the new licensee of the Farmers Inn. In 1876 his wife Bridget made an application for the license to be transferred to her as “her husband suffered from rheumatism, and there were certain other reasons why the license should be transferred to her hands”. The Bench wondered about creating a precedence of granting a license to a married woman, who was living with her husband, (licenses were only granted to the widows of licensees at that time), so the application was postponed for 14 days, but eventually Mrs Wall won her case. In 1882 Patrick Tennyson took over the lease of the Farmer’s Inn and applied to change the name to Tennyson’s Hotel. In 1885 he bought the freehold in the Great Land Sale for £780. 12s. 8d., and in December, carried out extensive renovations. The local press reported that “the rooms were quite tasteful, the Billiard room commodious and well ventilated, and that the old hotel had not looked so good for years”. The double storied part of the hotel was added in 1893. Patrick Tennyson had a colourful career. He was born in Charlemont, County Armagh in 1846. When he was 21, he served as a papal guard at the Vatican for 2 years and then entered the Marist Brothers novitiate in Beauchamps. In 1872 he was one of three brothers to accompany Brother Ludovic to Sydney; he was then aged 23. After 5 years he withdrew from the Congregation and moved to Victoria, where he took up teaching, first at Rosedale near Sale, then at Crossley, by which time he was married to Anne White. They had eight children, three dying in infancy. Eight months after he took over the Farmers’ Inn, he was elected to the Borough Council, and served as Mayor in 1897. His great interest was sport, was Secretary of the Race Club for 20 years and supported the local Football Club by donating a silver cup for local competitions. Patrick Tennyson died in 1904. The hotel continued under various licensees until it burned down in 1977 under the name of “The Fishermen’s Arms”. State Electricity Commission (SEC) outlined details of a site available for the development of a Tourist Hotel Project in Falls Creek in late 1962/3. SEC estimated that by the winter of 1963 Falls Creek Village would be able to accommodate 500 persons. The site for development was up to 2½ acres adjacent to the Upper Kiewa Valley Road. It envisaged a building able to accommodate about 100 guests. The successful developer would be granted a lease for 45 years at a rent of £300 per annum. Written applications for the lease were to be submitted by 31st March 1963.This item is significant because it documents plans made by the State Electricity Commission to develop the Falls Creek Tourist Area. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. Minutes of the Kangaroo Ground War Memorial Bazaar Committee, 1922-1926 EDHS Newsletter No. 123 November 1998 PRESIDENT'S REPORT ACQUISITION FROM NILLUMBIK SHIRE'S MEMORABILIA Recently found in a storage box of old Shire of Eltham items was a school size, blue lined black covered writing book. It is recognized as the minute book and cash receipt book of the period 1922-1926 when the Memorial Park Committee, who it seems were part of the Shire of Eltham Soldier's Memorial League, was requested to raise funds for building the Shire of Eltham War Memorial Tower at Kangaroo Ground. History tells us that the tower, which is currently being refurbished, was officially opened by the Governor General of Australia, Lord Stonehaven on 11.11.26. The ladies invited to the first meeting at the Shire Hall did so on 21st September 1922. The minutes book reads: Present: Mesdames Bell, Bourchier, McMahon, Gosling, Cockcroft, Wraight, E Coutie, R Rogers, A Jones, AH White, Davies, Everitt and the Misses Lacey, Harris, N Weller, Gosling, Bell and D and G J Bourchier. These people became the Kangaroo Ground Memorial Bazaar Committee along with others named at further meetings. They conditionally accepted the role of raising funds, their condition being that the Bazaar Committee be given representation on any committee empowered to deal with the memorial in proportion to the amount of money raised by the bazaar'.
