The Eltham Obelisk was originally located at the corner of Bridge and Main Roads in 1919. In 1943 (WW2) the local community commenced plans to establish the Eltham War Memorial, a living memorial to benefit the children as opposed to a one in stone as per the obelisk. The Eltham War Memorial Trust was established in 1945. In 1947 the Trust intended for the Obelisk to be relocated from Bridge Street and Main Road to the Garden of Remembrance which was planned as part of the Baby Health Centre which was to be the first of three buildings of the Eltham War Memorial to be built in 1951. In 1951 the Eltham RSL was invited to be represented on the Eltham War Memorial Trust. Around this time, with pending roadworks, the obelisk was relocated to the front garden of the Eltham RSL sub branch on Main Road for safe keeping. In 2007, a suggestion was proposed by Harry Gilham (President, EDHS) to John Cohen (ERSL) to claim a special site along with the historic Shillinglaw trees on the now vacant former Eltham Shire Office site adjacent to the Eltham War Memorial precinct for relocation of the obelisk. In 2010 following the financial collapse and sale of the Eltham RSL Sub-Branch property and amalgamation with the Montmorency Eltham RSL sub-branch, the location of the obelisk was again in immediate jepoardy and in conjunction with Nillumbik Shire Council, the obelisk was relocated in front of the Eltham War Memorial buildings in preparation for the Dawn Service on Anzac Day 2012. Produced by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Pty Ltd as part of the planning process for redevelopment of the former Eltham Shire Office site at 895 Main Road. In 1963 the Shire of Eltham purchased the Shillinglaw property of approximately 2 acres in Main Road, Eltham for the widening of Main Road and as a site for new Council offices. This land, which contained the Shillinglaw Cottage (c1878-80), was the remaining section of the Shillinglaw family holding that originally comprised 30 acres, being Lot 90 of Holloway's 1851 subdivision. Eltham Council intended to demolish this cottage, but through extensive community action it was saved, funds were raised, and it was relocated to the current site adjacent to the Eltham Library. The new Eltham Shire Offices opened in 1965 were designed to ensure retention of the three Italian Cypress trees that were located outside the Shillinglaw Cottage. In 1971 the building was extended at the southern end to provide additional space, including for the Eltham Library and Council's Engineering Department. Renovations were undertaken to the offices during 1987. The Victorian State Government commenced to restructure local government in 1994, which resulted in the establishment of the Shire of Nillumbik and the cessation of the Shire of Eltham. This new Nillumbik Shire Council was headed by government appointed commissioners, who decided in 1995 to put the former Eltham Shire offices on the market. Eventually in June 1996 the property was sold for $1.1 million and the building was subsequently demolished. A planning application for the site was then submitted to Nillumbik Shire Council in September 1996 for construction of a 24-hour service station, convenience store, cafe/takeaway food premises, a retail facility and community facility. There were many objections to this proposed development and in controversial circumstances a planning permit was granted by the Nillumbik Shire Council commissioners. After protracted actions involving a planning panel and a planning advisory committee, established by the Minister for Local Government, the proposal was eventually rejected as not satisfying the requirements of the planning scheme. In December 1997 the purchaser withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract. While there have been a number of possible development proposals considered by subsequent Nillumbik Shire Councils, this site has remained vacant since July 1996. TIMELINE (Prepared by Jim Connor, Eltham District Historical Society- March 2018- Based on press, council and personal records) June 1996 - Eltham Shire offices sold to Dallas Price Homes for $1.1 million. July 1996 - Shire office building demolished against community's wishes. Council claimed building riddled with asbestos. September 1996 - Planning application submitted to Nillumbik Shire Council to construct on the site a 24 hours Shell service station, convenience store, Hungry Jacks café/takeaway food premises, a retail facility and community facility. 213 objections and petition of over 1400 signatures received. Minister for Planning and Local Government orders an independent investigation into valuation and sale. 9 October 1996 - Permit granted by Nillumbik Shire Council commissioners, in controversial circumstances. A Planning Special Committee consisting of 3 commissioners and 3 community representatives considered 32 community objections. One commissioner declared a potential conflict of interest so only 2 commissioners were able to vote. After hearing all objections, the community representatives moved a foreshadowed motion to refuse a permit. The commissioners then closed the meeting, formerly opened a council meeting (for about a minute) and approved the application. October 1996 - Community members appealed planning decision to Administrative Appeals Tribunal. November 1996 -Minister for Planning and Local Government Robert McClelland calls appeal in and directs MT to refer this 'major policy issue' to the Governor in Council. February 1997 - Planning panel (Dimity Reed and Margaret Pitt) established to consider submissions. March 1997 - New council elected with five councillors. April 1997 - Three of the five new councillors vote to fight Commissioner's decision to grant a permit. April 1997 - Planning panel (Dimity Reed and Margaret Pitt) conducts hearings at Nillumbik Shire offices. June 1997 -Planning panel rejected Dallas Price Homes proposal as being 'totally inappropriate' for the site and recommends the site be rezoned for 'public purposes'. July 1997 - Dallas Price Homes threatened to sue Council and individual councillors. October 1997 - Report released of an Advisory Committee (Paul Jerome) established by the Minister for Planning and Local Government. Committee considered Dallas Price Homes proposal and an alternative concept plan proposal by Council for a gallery, workshop, offices and cinema community-based development. Advisory Committee recommended Dallas Price Homes proposal be rejected as not satisfying the requirements of the planning scheme and recommended further testing of the financial viability of Council's proposal. December 1997 - Dallas Price Homes withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract, which expired on 28th November and was not renewed by either side, after previously being extended twice pending a decision by the Minister. Council had to pay developer $58,000 for demolition costs. February 1998 - Dallas Price Homes application rejected by Planning and Local Government Minister. Rededication of Memorial Tower on its 75th anniversary to those who served in Armed Conflicts between 1948 and 1972. Harry Gillham, President of the Eltham District Historical Society and Convenor of the Nillumbik Shire Council's Advisory Committee for the War Memorial at Kangaroo Ground was for some years working on the refurbishment of the Shire of Eltham War memorial tower of rememberance and the surrounding Memorial Park. The Committee arranged to produce plaques to commemorate the armed conflicts in Korea, Malaysia, Borneo and Vietnam. The plaques were funded by public donations and cost $10,000. The community donated via donation boxes placed at Eltham Library. NL 140 Sept 2001 Governor John landy and other digniaries attended the event for the unveiling of the plaque. Eltham Courthouse Officially Reopened (Jim Connor, EDHS Newsletter No. 263 April 2022) In the Conservation Management Plan prepared in 2006 for the Eltham Justice Precinct there is mention that more than 350 court houses have been built by the Public Works Department since 1856, when the Department was established. It also states Eltham was in an early group of 'Victorian Free Classical' structures, featuring a projecting entry porch and gabled roof. Characteristically, this group shares a simple, rectangular shape, central placement of the court room with smaller-scale offices set back at the sides or rear of the court room, arched openings, and decorative string courses. The Statement of Significance listed in the Victorian Heritage Register states: ‘The Eltham Court House dates from the time when the town was largely self-contained. It was initiated in response to itinerant gold prospectors who turned to crime when their quest was unsuccessful. This type of localised solution is characteristic of the self reliance preserved in Eltham today. The court house is an important symbol of the spirit which makes Eltham distinctive as a community.’ It also states: ‘The Eltham Court House, built in 1860, is one of only two intact examples in the state of this simple design with projecting entry.’ So with this background it is most appropriate this valued historic building has recently been the subject of a total restoration, as detailed in previous newsletters. This was a major project undertaken by Nillumbik Shire Council. At a small function in the Eltham Courthouse, on 23rd March 2022, Nillumbik Shire Council Mayor Fran Eyre declared the fully restored building officially reopened. In doing so the Mayor spoke about the earlier law and order function of the court and the importance of this building to the Eltham community. Wingrove Ward Councillor Geoff Paine then highlighted the importance of historical societies and groups within the shire and their valued activities in recording and preserving their local history. EDHS president Jim Connor thanked everyone involved with the project and provided an overview of the history of the courthouse. Michael Ioannides, Council’s project manager, spoke about how the restoration process proceeded and those involved in undertaking the works required. Cr. Natalie Duffy, various council officers, EDHS executive committee members, as well as representatives of the head contractor Ducon Building Services and the heritage advisors, RBA architects and Conservation Consultants, were also in attendance, as was a representative of Nillumbik U3A. After the formal part there was some light hearted interpretation of how past legal proceedings may, or may not have, occurred within this courthouse, before some refreshments were shared in the former second courthouse at the rear, which is now utilised by Nillumbik U3A. On 15 December 1994 the former Shire of Eltham ceased to exist following the Liberal Kennett Government local council amalgamations. A new Nillumbik Shire Council was established with unelected commissioners appointed. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. The Advisory Committee was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. The Recommendations of the Advisory Committee were: i. The cafe and take away food premises are as of right uses and are therefore allowable, but that shop and petrol station are unacceptable uses. A community facility is a discretionary use and is acceptable. ii. A development of the type and scale proposed is totally inappropriate for this land and that the Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, café/takeaway food premises, a retail facility and a community facility, with associated advertising signs, be refused. iii. Nillumbik Shire Council transferred to the former Diamond Valley Shire Offices in Greensborough after municipal restructuing. The offices became the official Nillumbik Shire Council Offices on 16 October 1995. The former Shire of Diamond Valley Civic Centre or Shire Office building was officially opened on 26th February 1972. Archtiects were A.K. Lines, McFarlane & Marshall and it was built by L.U. Simon Pty Ltd, The Diamond Valley Shire had been created in 1964 from part of the City of Heidelberg. On December 15, 1994 the Shire of Nillumbik was established. Under the Council amalgamations imposed by the Kennett government, the Shire of Eltham, Shire of Diamond Valley and City of Heidelberg ceased to exist with the establishment of Nillumbik Shire Council and the City of Banyule.The new Nillumbik shire surrended the west riding from Eltham to Banyule but in place gained parts of the former Diamond Valley Shire which itself had been created in 1964 from parts of the City of Heidelberg. Three unelected and non-local Commissioners were put in place by the government bringing democracy into question by many members of the local community. The Commissioners determined to abandon the former Shire of Eltham offices located in Main Road, Eltham and in turn occupy the former Shire of Diamond Valley offices located at the boundary of the new shire with Banyule, in Civic Drive, Greensborough. In July 1996 the Commissioners sold the former Eltham Shire Offices and had them bulldozed leading to many years of communiity protest over the process and future development applications. The site has remained vacant ever since. In 1853 a committee was formed to improve the rough roads, some in Kangaroo Ground being almost impassable in winter.1 The committee fundraised by voluntary levies and grants to improve in particular, the main road between Kangaroo Ground and the Plenty River. From this committee arose the Eltham District Road Board, in 1856, which was the precursor to the Eltham Shire Council. The Board’s first chairman was Kangaroo Ground farmer, John Barr. Secretary was the former committee’s secretary, Andrew Ross, Kangaroo Ground’s first school teacher, and founder of the district newspaper, The Evelyn Observer.2 Most of the board’s income came from a toll-house north of the Lower Plenty Bridge, which funded such projects as a road from Kangaroo Ground to the Caledonia Diggings. In 1871 the Shire of Eltham was proclaimed, with its boundaries the same as those of the Road Board, and Councillor A Donaldson of Kangaroo Ground was the first president. Eltham was at the southern tip of the shire, which extended north to Kinglake and east beyond Yarra Glen. In 1878, part of Kinglake was added to the shire, while the area east of Watts River, near Healesville was removed. In 1912, then again in 1958, the shire was further reduced. Yarra Glen, Steels Creek, Tarrawarra, parts of Healesville and Christmas Hills, were transferred to the Shire of Healesville. In 1972 a smaller area, at Kinglake, was transferred to the Shire of Yea, leaving 277 square kilometres in the Eltham Shire. Perhaps no other Victorian municipality has had so many meeting places. Although from 1858 to 1904, the council convened at the office in the home of Secretary Charles Wingrove, the board, and later the council, also met at other more central locations.3 The board moved from the Fountain of Friendship Hotel to the Eltham Courthouse, to the Kangaroo Ground schoolhouse. It then met at the Kangaroo Ground Hotel, which some considered put it in danger of interruptions by people ‘the worse for liquor’.4 In 1885 the council met at the hall on Mr J Donaldson’s land at Kangaroo Ground. After Wingrove’s retirement, the council rented space at the Kangaroo Ground General Store and Post Office. Then, in 1917, the council bought the former office of The Evelyn Observer, after its printing works transferred to Hurstbridge. In 1934, fire destroyed the shire office, which was temporarily relocated to the Kangaroo Ground home of Shire Secretary, Mr P J McMahon. In 1941, the shire office moved to a new building (which included a public hall) in Eltham, at the corner of Arthur Street and Main Road, where the Eltham Village Shopping Centre was eventually built. Growth required new offices, which opened in 1965, on the former Shillinglaw property in Main Road.5 In 1994, as part of municipal restructuring under the Jeff Kennett Liberal Government, most of the Eltham Shire formed part of the new Shire of Nillumbik. It joined with the north section of the Diamond Valley Shire and parts of the Healesville and Whittlesea municipalities. The Diamond Valley Shire had been created in 1964, from part of the City of Heidelberg. Turbulence followed Nillumbik Shire’s formation. Under the Commissioners the council transferred to the former Diamond Valley Shire offices in Greensborough, and the Eltham council offices were demolished. In March 1997 the first five-member Nillumbik Council was elected. But, in October 1998, the government suspended the council and appointed an administrator . Early in 1999, shire residents voted to increase councillors to nine: comprising five ward councillors and four shire-wide councillors. Elections were held in March 1999. Then, before the March 2002 elections, nine new wards were created.6 In 2008 these were reduced to seven. Today [2008] the council governs a varied population of more than 60,000 people living in townships and on bush properties in the green wedge.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. Robert Maclellan, appointed Mr. Paul Jerome as an Advisory Committee under section 151 of the Planning and Environment Act 1987 to consider a Convenience Centre and an alternative proposal by Iha Shire of Nillumbik being the Eltham Gateway Community Precinct Concept Plan for the site of the former Shire of Eltham municipal offices at 895 Main Road, Eltham. In summary, the terms of reference for the Advisory Committee required it to: • consider the merits of the Council proposal • examine the merits of both proposals in terms of net community benefit • address the report of the previous Advisory Committee on the Convenience Centre proposal The Advisory Committee inspected the site and considered all the material before It including submissions made by all parties to the previous Advisory Committee and correspondence received by the Department of Infrastructure both before and after that Committee submltted its report. First, the DPP proposal should be rejected because, on its merits, It does not sufficiently satisfy the requirements of the planning scheme which is a statutory document. The planning scheme requires that, before making a decision on the permit applications for the DPP proposal, a range of matters must be considered. It follows that consideration of these matters should Influence the decision. These matters include local policies relating to character and amenity. In particular, these policies seek • to conserve and enhance the bushland/country atmosphere, artistic heritage and strong sense of community of the Eltham Town Centre by ensuring that the design and height of any new development is sympathetic to existing buildings • to achieve a pleasing physical environment within the Eltham Town Centre by encouraging a high standard of architecture and urban design • to encourage Improvement to pedestrian amenity through such facilities as open and shattered rest areas and meeting places, crossing facilities, pedestrian arcades, pedestrian links to car parks and pedestrian weather protection • to reduce conflict between vehicular traffic and pedestrian flows, and • to encourage pedestrian thoroughfares It is submitted, as set out In the main body of this report, that the DPP proposal fails substantially to meet these policies and In so doing does not merit the exercise of discretion In Its favour with the Issuing of a permit. This finding is not offset by the investment and employment attributes of the proposal. They do not override the need to comply with the planning scheme. Second, the Council proposal, on Its own merits, substantially meets all statutory requirements applicable to this site with a possible reservation about car parking and traffic management which need further definition and assessment as the concept is refined. The Council proposal, however, has a serious weakness in that Its financial viability has not been adequately tested. The Committee refers to 'financial' rather than 'commercial' viability in recognition that Council owns the land and may enter into a range of agreements and partnerships to realise its concept some of which may be truly commercial and some of which may involve an element of subsidy arising from Council's involvement as a public body acting on behalf of its community.
