Document (item) - The prison letters of George Bateson
In Victoria’s State archives there is a remarkable cache of letters written by George Bateson, who was arrested and convicted of sodomy in late 1860. There are some 200 letters addressed to notable Victorians including the governor, premier, inspector-general of penal establishments, members of parliament, and lawyers. These rare documents provide powerful evidence of homosexual life and the impacts of mid-nineteenth century laws relating to sodomy. The story begins on an evening in November 1860, when 19-year-old William Gardner went to the police to complain that the previous evening, when he was staying at a city hotel with George Bateson, he had been subjected to Bateson’s sexual advances. The police asked Gardner to meet with Bateson again the following evening and when their sexual connection was sufficiently advanced, Gardner should cough twice. He agreed to the plan, and when Gardner coughed the police emerged from a closet in the hallway, catching the two men in the act. Bateson was convicted of sodomy in 1860, but his death sentence was recorded rather than pronounced. In due course the Governor of Victoria commuted the sentence, as was usual for the crime, and instead sentenced Bateson to 15 years’ hard labour, with the first three years to be spent in chains. In 1871, Bateson was released, having spent four years less in prison than his original sentence. During and after his time in prison, Bateson wrote letters to the authorities to assert that he was innocent, falsely accused and the victim of a conspiracy. He demanded that this terrible miscarriage of justice should be reversed and a pardon granted to him. Bateson was not the first man in Victoria to be convicted and sentenced in this way; nor was he the first to petition for redress. But the extent of his letters and the scope of the issues raised in them offer a remarkable insight into homosexual life in the mid-nineteenth century, such as how men might meet each other, and approaches to police and punish homosexual behaviour. Bateson’s letters provide crucial evidence to expand our understanding of Victoria’s queer past. Shire of Eltham Archives: Series 69, Item 4 This video was produced for the Shire of Eltham by IMP Productions and provides a description of the shire, 277 square km on a north/northeast axis, some 25 km northeast of the centre of Melbourne with a population of around 40,000. Scenes include Yarra River, rural settings and urban settings, housing estates, Shillinglaw Cottage, Pigeon Bank at Kangaroo Ground, the Eltham Railway Trestle Bridge with reference to the fight by locals in the 1970s to save it from replacement, Montsalvat, mudbrick making and its use as a building material, the use of mudbrick in the Eltham Community Centre blending harmoniously with the environment. Emphasises people living in the area due to the qualities of life provided. Also the Living and Learning Centre, St Andrews Markets and other local markets, the Eltham Leisure Centre, cricket and horse riding at Eltham Lower Park, the Infant Welfare Centre (part of the Eltham War Memorial), how residents are mindful of protecting their historical heritage, the CBA bank and Allwood House at Hurstbridge, Tracey Naughton about the Eltham "As we are" Community Banner project and the “River of Life banner”, the Parks and Gardens office in the former Police Residence building (now the Local History Centre), Alistair Knox Park, road planning and types of roads, tree canopy, Peck's Dam, green carparks, road drainage, Gordon Ford's garden and natural landscapes, and Were Street shops in Montmorency. Planning for shopping facilities and carparks with a population of 40,000 growing to 55,000, Arthur Street Mall and carpark, local village feel in the shopping centre. Councillors and Council staff featured include Mary Grant, Bob Manuell, Rodney Roschellor, John Cohen, Alan Baker. Minutes of the Kangaroo Ground War Memorial Bazaar Committee, 1922-1926 EDHS Newsletter No. 123 November 1998 PRESIDENT'S REPORT ACQUISITION FROM NILLUMBIK SHIRE'S MEMORABILIA Recently found in a storage box of old Shire of Eltham items was a school size, blue lined black covered writing book. It is recognized as the minute book and cash receipt book of the period 1922-1926 when the Memorial Park Committee, who it seems were part of the Shire of Eltham Soldier's Memorial League, was requested to raise funds for building the Shire of Eltham War Memorial Tower at Kangaroo Ground. History tells us that the tower, which is currently being refurbished, was officially opened by the Governor General of Australia, Lord Stonehaven on 11.11.26. The ladies invited to the first meeting at the Shire Hall did so on 21st September 1922. The minutes book reads: Present: Mesdames Bell, Bourchier, McMahon, Gosling, Cockcroft, Wraight, E Coutie, R Rogers, A Jones, AH White, Davies, Everitt and the Misses Lacey, Harris, N Weller, Gosling, Bell and D and G J Bourchier. These people became the Kangaroo Ground Memorial Bazaar Committee along with others named at further meetings. They conditionally accepted the role of raising funds, their condition being that the Bazaar Committee be given representation on any committee empowered to deal with the memorial in proportion to the amount of money raised by the bazaar'. A large lot of papers, including this and other telegrams, were apparently found in the ceiling cavity of the Sandy Creek/Tarnagulla Post and Telegraph Office in the later 20th Century, during building works. Donald Clark Collection. Telegram sent from Sandy Creek / Tarnagulla Telegraph Office. From John Papineau (on behalf of E.N. Francis) to Mrs Giradini, Sandhurst. Text reads 'Your brother and his mate bought a horse at Cochrane's Diggings which had been stolen and the police found it in their possession. They are innocent but I have to bring witnesses a long distance. I shall defend them in expectation of securing the five pounds from you'. -

Murray Comrie Collection. Murray Comrie, born in Tarnagulla in 1912 also became a policeman and later a Chief Superintendent, retiring in 1972 and passing away in 1983 after a long illness. Murray Comrie's son Murray Jnr., to avoid confusion became known by his middle name, Neil. Neil Comrie also joined Victoria Police and rose through the ranks to become Chief Commissioner of Victoria Police from 1993 to 2001. Blue-grey archive box containing research notes of Murray Comrie. Murray Comrie Collection. A letter written by Constable Whyte of Llanelly Police Station on 15th August 1872. Concerns a man named Jacob Shied / Struid / Sluid (?), a Frenchman who speaks English and who has previously been arrested for being 'of nuisance mind' and may have come from 'the asylum at Melbourne' He is described as a 'lunatic at large'. The man apparently escaped supervision and ran into the bush. Two colour prints (Copies 1 and 2) of the scene at the Hospital Corner, Drummond St. Sth and Sturt St. after the running of the last tram from Sebastopol prior to running into the depot on 19 Sept. 1971. Shows one bogie tram No. 40 (from the advertising boards) with many people at the corner, a few cars and a police car leading the tram through the people standing around. Has the liquor store on the south west corner of the intersection in the background. Tram is heavily loaded with passengers. Copy 1 on Fujicolour Crystal Archive Paper is the better exposed and larger print and has been used in the scanned image.. Copy 2 another print off the same negative but with a smaller photograph area. Original film image scanned at 3200dpi 12/5/2020 and record revised. Document, The First Legacy Children's Picnic
An description of the first picnic for 260 war orphans (boys) and their mothers at Ricketts Point (Black Rock) in 1926, who were transported in two charabancs by Legatees, some of whom were in fancy dress. Pages 5-16 recounts anecdotes of Syd Birrell unrelated to the picnic. The writer is anonymous but by the hand writing it is possibly L/- Frank Doolan, a founding member of Legacy, who was part of a committee to capture the history of Legacy and create an archive of material.First hand account by a participant on the trip, which details some highly irresponsible activities which were seen as perfectly acceptable at that time. Document, The Work of 1941, 1941
The document covers the year of 1941. Mention is made of the restrictions and difficulties (petrol rationing, scarcity of paper to name some) that occurred with running a wartime economy, and trying to implement the social welfare programme of Legacy. In particular, The Welfare Committee. Despite the difficulties of the time, Legacy not only continued its work but expanded the programme e.g. the establishment of a Legacy Dental Clinic in Collins St, Melbourne. The document also notes with some sadness the death of some Junior Legatees due to war service, and the realisation that the work of Legacy will need to be expanded due to World War 2. Legacy Probation Officers paid tribute to the never failing support of the Police department. To quote, "In all cases the Police were just as anxious as we to save the boys from the Reformatory of Gaol." There are many documents styled as 'The work of 19XX' so it was a way legatees reported the main events of the year. Many were put into the original archive started by Frank Doolan and were labelled with the letter 'H' to signify History.A record that Legatees were recording the major events of the year in a report for future reference. Significant in that the Law Courts valued the work Legacy was doing to reform their Junior Legatees who had appeared before the courts.White quarto paper, black type. Murray Comrie Collection. The house in this photo was the residence of the town police officer. The town block where the house was located was the base for policing in Tarnagulla from 1878 until the 1990s. At the time of this photo (1924), the father of these children, Angus Comrie Snr was the constable for Tarnagulla. Adjacent to this house was a lockup, office and stable (shown in THA-2019.0031). Behind the residence and outbuildings (in background of this photo) was an adjoining paddock for the police horses. This house was sold for removal in in the 1960s and replaced with a prefabricated residence and small office from Bealiba. These as well as the lockup are still in place (as of 2019), but are no longer used. There are now private residences built on the former police horse paddock. A later image of this house is THA-2019.0032. For almost 100 years the Comrie name has been involved with the Victoria Police. Angus Comrie Snr, joined the force in 1899 and served as constable in Kaniva and Avoca and then in Tarnagulla from late 1909 until 1927. His son Murray Comrie, born in Tarnagulla in 1912 also became a policeman and later a Chief Superintendent, retiring in 1972 and passing away in 1983 after a long illness. Murray Comrie's son Murray Jnr., to avoid confusion became known by his middle name, Neil. Neil Comrie also joined Victoria Police and rose through the ranks to become Chief Commissioner of Victoria Police from 1993 to 2001. Murray Comrie Collection. Albert Clement (or Clements) Theobald was born in Tarnagulla in 1887, and married Laura Battye in Tarnagulla in 1908. He joined the police force on 21 June, 1913 and died in Warburton in 1962. He was also known as Clem or 'Catty'. Monochrome photograph depicting Albert Clement 'Clem' Theobald, wearing police uniform, and standing in front of a log lockup, place unknown.
