This cup was awarded to Kenneth Darnton Watson when he was a boarder and competitive rower whilst completing his secondary education. Kenneth Darnton Watson was born at Bendigo on 24 May 1893 to George Darnton Watson and Adelaide Nora Holmes. He was educated at Melbourne Church of England Grammar School, being selected as School Captain in 1913 and a member of the Head of the River rowing team. After finishing school, he worked as a jackaroo on Wanganella Station and later at Mt. Widderin, Skipton, Victoria. When WW1 was declared, Kenneth enlisted and after initial training at Maribyrnong, Victoria he left Australia as 2nd Lieutenant with 7th Australian Field Artillery Brigade, to disembark at Plymouth on July 10, 1916. He took part in the Battles of Messines, Menin Road, Polygon Wood and Passchendaele Ridge in 1917. For his efforts in Passchendaele Ridge on 17th December he was awarded the Military Cross "for conspicuous gallantry and devotion to duty." In 1918 he took part in the Battles of Villers-Bretonneux, Hamel and Amiens. He returned to Australia in November 1919 and was discharged on 20th January 1920. In 1922, Kenneth Darnton Watson came to Wodonga where he purchased de Kerilleau Homestead, consisting of 2,500 acres, from Mr George Gordon. The two storey brick homestead had been built by William Huon in 1870. On 30th May 1924, he married Phyllis Emily Lenore Austin and they had four children, Ian Darnton 1925, Robert Darnton 1926 Rosemary McPherson 1929 and Faith Holmes 1931. On the land Kenneth worked hard, building fences, cattle, sheep and horse yards, and farmed Corriedale sheep, Shorthorn cattle and horses. he was an innovative farmer, introducing modern methods of top dressing at de Kerilleau by means of an aircraft. He was also a dedicated community man. He was a member of both Albury and Wodonga Show Committees, Murray Valley Development League, No.1 Region, Graziers' Association of Southern Riverina, Albury Legacy Club, Wodonga RSL, and Wodonga Turf Club including terms as President on several of these organisations. Kenneth was also a Warden of St. Luke's Church of England, Wodonga. Kenneth served as Wodonga Shire President from 1929 to 1931, and was again elected to Council from 1943 to 1945. A most respected and valued member of the local community, Kenneth Darnton Watson died on the 4th of October 1951, aged 58. Lenore Watson lived at de Kerilleau until her death on 15th June 1984. Black and white photocopies of articles and information about the first Blamey House owned by Legacy between 1947 and 1956. It includes articles about the opening in November 1949 with Sir Thomas Blamey in attendance. It shows the property was described as "a home, a huge rambling weatherboard house with a swimming pool, flood-lit tennis court, and four acres of beautifully kept lawns and gardens." The title deed was handed over to Legacy by Sir Robert Knox, the chairman of trustees of Blamey House, Melbourne (the servicemen hostel that had been operating during the war). Other pages show the property had been built in 1930 as a holiday home for Toorak business man Mr Arthur Jack and his wife Ms Langlands-Jack. It was sold to James Picken by 1941 and it was known as 'Mossgiel'. The Pickens remained owners until 1947 when it was purchased on behalf of Legacy with money donated by the Blamey House Trustees (the servicemen hostel that operated during the war) to be used as a toddlers and childrens' home. When Legacy no longer required the property it was sold to the Beaumaris RSL (or it's precursor RSSALIA) as its clubrooms. There was controversy in 2015 when it was sold to developers for housing. The Spring Gully Gold Mining property consists of Gold Mining Lease No. 2986, Castlemaine, of about 21 acres situated on the Emu Reef, in Spring Gully Fryers. There are two shafts, distant about 300 feet from each other. From one of them large quantities of gold were obtained in former years by previous companies. John Hartley Roberts was born in England and migrated to Australia with his parents in 1853, when he was fifteen. He married Mary Ann Ellis in 1863. He was Head Teacher at Linton State School from 1867-1877. He became Victorian Inspector of Schools and later went to Tonga to establish the educational system there. Robert Samuel Valentine Cocking (1882 - 14/5/1945) Born in Bendigo, Val Cocking began hi retail career at Myer Bendigo before opening his own draper shop c. 1912 in the lower block Pall Mall. In 1914 he moved his stock into temporary premises while he renovated his new shop, which combined the former Post Office Hotel and adjacent grocery and stationary shops. The new emporium opened in Aug 1918 selling drapery and soft goods. Mr Cocking was a champion rifle shooter; President of the Bendigo Chamber of Commerce; President of the Sandhurst Football Club for 18 years and President of the Bendigo Cricket Club. Bennetts Hardware shop was in Hargeaves St near the entrance to Allan's Walk in the 1950's. Beehive buildings. This was originally the Sandhust Mining Exchange and as such was the oldest purpose built exchange in Australia and was one of only two in regional Australia. It was initially established in the 1850's to service the miners of the area. It's first double story incarnation as the Bendigo Stock Exchange, contained up to 2000 stockbrokers and 5000 shareholders. In 1871 the building burnt to the ground and the new and current building was completed in 1872. This photograph is of Tom Pearce, one of only 2 survivors from the shipwreck LOCH ARD. Loch Ard was bound for Melbourne in 1878 loaded with passengers and cargo when it ran into a rocky reef at the base of Mutton Bird Island, near Port Campbell. Of the 54 crew members and passengers on board, only two survived: an apprentice, Tom Pearce and a young woman passenger, Eva Carmichael, who lost all of her family in the tragedy. Coleman Jacobs composed the music “The Young Hero Schottische” and dedicated it, by permission, to Mr. Thomas R. (Tom) Pearce. The sheet music was published in 1878 by the Messieurs Roberts, professors of dancing etc. Melbourne. It was on sale for 3/- (3 shillings) and in aid of the “LOCH ARD” fund. [This is Coleman Jacobs’ only surviving musical work Coleman Jacobs, accomplished pianist, musical performer, singer, composer, professor of music and music teacher, was born in 1827 and died on 4 July 1885, aged 58 years. Coleman Jacobs was buried in the Melbourne Cemetery (grave 461, Church of England section).] The wreck of Loch Ard still lies at the base of Mutton Bird Island and much of the cargo has been salvaged. Some was washed up into what is now known as Loch Ard Gorge following the shipwreck. Cargo and artefacts have also been illegally salvaged over many years before protective legislation was introduced. The photograph is significant for its association with the wreck of the Loch Ard. This wreck has been protected as a Historic Shipwreck since 11 March 1982, under the Commonwealth Historic Shipwrecks Act (1976) Flagstaff Hill’s collection of artefacts from Loch Ard is significant for being one of the largest collections of artefacts from this shipwreck in Victoria. It is significant for its association with the shipwreck, which is on the Victorian Heritage Register. The collection is significant because of the relationship between the objects, as together they have a high potential to interpret the story of the Loch Ard. The Loch Ard collection is archaeologically significant as the remains of a large international passenger and cargo ship. The Loch Ard collection is historically significant for representing aspects of Victoria’s shipping history and its potential to interpret sub-theme 1.5 of Victoria’s Framework of Historical Themes (living with natural processes). The collection is also historically significant for its association with the Loch Ard, which was one of the worst and best known shipwrecks in Victoria’s history. The Loch Ard collection meets the following criteria for assessment: Criterion A: Importance to the course, or pattern, of Victoria’s cultural history. Criterion B: Possession of uncommon, rare or endangered aspects of Victoria’s cultural history. The Pentland Hills Estate property shown in this auction plan was put up for sale in 1904. It was a deceased estate sale. The property had been owned by Peter Grant who died in 1899. Peter Grant had worked and farmed in the Myrniong area for many years and had also been a Councillor on the Bacchus Marsh Shire for a number of terms. A property sales report in the Express newspaper recorded that the land for sale comprised 500 acres of the old Pentland Hills Estate. It was subdivided into three lots, all of which were sold at good prices. Lot l, 212 acres was sold to Messrs Thomas and Robert Lidgett of Myrniong, at £11/15/ per acre, lot 2, 200 acres, to Mr David Robertson, of Bacchus Marsh, at £9 17/0 per acre, and lot 3, 38 acres, was sold to Mr James Norton, jun at £11 per acre. On 15 December 1994 the former Shire of Eltham ceased to exist following the Liberal Kennett Government local council amalgamations. A new Nillumbik Shire Council was established with unelected commissioners appointed. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. An Advisory Committee consisting of Dimitry Reed and Margaret Pitt was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. The Recommendations of the Advisory Committee were: i. The cafe and take away food premises are as of right uses and are therefore allowable, but that shop and petrol station are unacceptable uses. A community facility is a discretionary use and is acceptable. ii. A development of the type and scale proposed is totally inappropriate for this land and that the Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, café/takeaway food premises, a retail facility and a community facility, with associated advertising signs, be refused. iii. The land should be rezoned for public purposes and should remain in the community's ownership for community use. Following this, the Minister for Planning and Local Government, the Hon. Robert Maclellan, appointed Mr. Paul Jerome as an Advisory Committee under section 151 of the Planning and Environment Act 1987 to consider a Convenience Centre and an alternative proposal by Iha Shire of Nillumbik being the Eltham Gateway Community Precinct Concept Plan for the site of the former Shire of Eltham municipal offices at 895 Main Road, Eltham. In summary, the terms of reference for the Advisory Committee required it to: • consider the merits of the Council proposal • examine the merits of both proposals in terms of net community benefit • address the report of the previous Advisory Committee on the Convenience Centre proposal The Advisory Committee inspected the site and considered all the material before It including submissions made by all parties to the previous Advisory Committee and correspondence received by the Department of Infrastructure both before and after that Committee submltted its report. The Advisory Committee also held discussions with the following people: • Cr. Robert Marshall • Cr. Margaret Jennings • Cr. Lex de Man • Mr. Dallas Howgate of Dallas Price Properties, also Dallas Price Homes • Mr. Barry Rochford, CEO, Shire of Nillumbik • Ms. Yvonne Rust, Planning Officer, Shire of Nillumbik • Mr. Gregory Burgess, Architect of the Eltham Library and of Council’s Community Precinct Concept Plan • Mr. Jim Connor representing Mrs Thelma Barkway of the Eltham Senior Citizens Club Having considered all the material before it, the Committee arrived at two basic conclusions. First, the DPP proposal should be rejected because, on its merits, It does not sufficiently satisfy the requirements of the planning scheme which is a statutory document. The planning scheme requires that, before making a decision on the permit applications for the DPP proposal, a range of matters must be considered. It follows that consideration of these matters should Influence the decision. These matters include local policies relating to character and amenity. In particular, these policies seek • to conserve and enhance the bushland/country atmosphere, artistic heritage and strong sense of community of the Eltham Town Centre by ensuring that the design and height of any new development is sympathetic to existing buildings • to achieve a pleasing physical environment within the Eltham Town Centre by encouraging a high standard of architecture and urban design • to encourage Improvement to pedestrian amenity through such facilities as open and shattered rest areas and meeting places, crossing facilities, pedestrian arcades, pedestrian links to car parks and pedestrian weather protection • to reduce conflict between vehicular traffic and pedestrian flows, and • to encourage pedestrian thoroughfares It is submitted, as set out In the main body of this report, that the DPP proposal fails substantially to meet these policies and In so doing does not merit the exercise of discretion In Its favour with the Issuing of a permit. This finding is not offset by the investment and employment attributes of the proposal. They do not override the need to comply with the planning scheme. Second, the Council proposal, on Its own merits, substantially meets all statutory requirements applicable to this site with a possible reservation about car parking and traffic management which need further definition and assessment as the concept is refined. The Council proposal, however, has a serious weakness in that Its financial viability has not been adequately tested. The Committee refers to 'financial' rather than 'commercial' viability in recognition that Council owns the land and may enter into a range of agreements and partnerships to realise its concept some of which may be truly commercial and some of which may involve an element of subsidy arising from Council's involvement as a public body acting on behalf of its community.
