A class photo of a group of young legatees at a gymnastics class in Malvern. There are 43 boys, of various ages, in gymnastics gear. Legacy clubs ran classes for junior legatees for many years. It was part of providing for the children of their deceased comrades. The skills they learned were show cased in an annual demonstration usually at the Melbourne Town Hall. It appears to be photo taken professionally, as there are several photos of different classes (see 00862 - 00867) perhaps to record Legacy classes for promotion purposes. John MITCHELL (1837 - 14 July 1926) Born Woodside, Donside, Scotland John Mitchell attended evening classes under James Giles in Aberdeen, and was also taught by his uncle the Peterhead artist John Mitchell. After an apprenticeship at a local lithographic company (Keith and Gibb) John Mitchell went to London to study at the Slade under Legros. Returning to Aberdeen he painted many scenes around the city and Aberdeenshire, including Balmoral, under the patronage of Queen Victoria. John Mitchell gave lessons in painting to the Royal Family. His landscapes are highly coloured with dominant blues and purples in the hills and with vivid greens and yellows in the foreground, subtly fused and never garish. He lithographed sketches for John Stewart's 'The Sculptured Stones of Scotland', 2 vols 1856-57, illustrated 'Under Lochnagar' 1894. His landscapes of Aberdeenshire are highly prized especially in the area in which he lived. His painting in the Mearns is regarded by some as his best work. In 1875 he painted an interior of Culter Castle and its Chapel which was subsequently purchased by the owner and in 1883 showed a portrait of his mother. Lived latterly at 10 Gladstone Place, Queen's Cross, Aberdeen. This item is part of the Federation University Art Collection. On the 29th of May 1954, a local Eltham carpenter by the name of John Swallow, committed a double murder at his home on New Street. This happened on the same day as the federal election of that year. John 48, his wife Mary 47, and stepdaughter Patricia 25, all went to the Eltham Courthouse on Main Road to cast their vote in the election that Saturday. After voting they returned home to their New Street house around midday. Patricia would later recall to ambulance officers, that she was feeling unwell, and so went to lay down when she heard an argument erupt over voting between her mother Mary and stepfather John. A concerned neighbour heard loud thudding noises and yelling coming from John and Mary’s house, he went to investigate. When he arrived at the house he was met by John at the front door. He would later describe John as “having a frantic look upon his face, and manic eyes”. John must have been a sight, bleeding and clutching a cut throat razor by his side. He then announced to the neighbour, “they voted commie!” before turning and going back inside. The distressed neighbour immediately raced home to call the Police. When the police arrived, they found Mary dead on the kitchen floor from catastrophic head injuries; her daughter, Patricia, clinging to life, slumped on her bed. Both women had been attacked by the same weapon, a large hammer, or sledge hammer as reported by the newspapers. John was also discovered in the house, bleeding from self-inflicted wounds from the razor, and had attempted to ingest caustic soda. Patricia was taken to St Vincent’s hospital, but died the following day, the 30th of May. John was also taken to St Vincent’s, where he remained under constant police guard for several months while he recovered from his injuries, at least the physical. He was eventually well enough to be taken to the City Watch House and then Pentridge Prison before his trial in October of the same year. When it came time for John to face the courts, the Judge called a mistrial, the Crown would not prosecute on the grounds of insanity. John was led away from the dock of The Magistrates Court and taken directly to Willsmere, the Kew Mental Asylum. On the 9th of August 1962, John Mervyn Swallow died of heart failure, he was 57. He had been a resident of Kew for four years. John’s body was returned to Eltham Cemetery and buried in the same grave as Mary. There is no mention of his name on the head stone. Patricia’s grave is next to Mary and John. A sad irony has an angel upon her grave, “its head missing”, possibly vandals or just an accident of time and events. What became of the home where all of this took place on New Street shall remain a mystery but within six months of this horrific event, the street had been re-named to Lavender Park Road after the original property near the end of the road, Lavender Park. William Bateman Snr was born to parents Daniel Bateman and Patience Wilkinson in Bradford, Yorkshire, England in approx. 1794. He married Sarah Smith on 20th November 1815 in Bradford, Yorkshire, England. They had four children – Patience (Born abt 1817), Daniel (born abt 1819) William (born abt 1831) & James (born abt 1837)all born in England. William Snr and Sarah Bateman and two sons – William and James - arrived in Australia in approx 1853. They brought with them considerable capital/stock and bought into a business in Warrnambool in William Jnr’s name. Bateman & Co rapidly became the largst mercantile business in the area and did rather extensive business with the Banks of Victoria and Australiasia. It is thought that William Snr assisted in the business to some extent, expecially financially. His other son Daniel (who remained in England) is also thought to have had a financial interest in the business as a dormant partner. The business was so prominent, Bateman & Co issued round copper tokens as a Trade Token - value one penny. These were inscribed with the Business name and were limited in their use to the business. In Sept 1856 the business was transferred to a Mr. Thos W. Sellars (nephew of William Bateman Jnr) and shortly afterwards the store closed with an order for the sequestration of the insolvents estate, but was not made absolute until December 1856 when the Insolvency court ruled for the “compulsory sequestration” of the business due to fraudulent activities within the business. But in the meantime in early November fire completely destroyed the business which left only the insurance payouts. Both William Bateman Snr and William Bateman Jnr are listed on the Pioneers’ Honour Board in the foyer of the Warrnambool Library. It is reported William Bateman Jnr was a trustee of Christ Church, was a City Councillor, and was involved in many other community organisations. He also subscribed towards the cost of building a permanent Church which was opened in 1856. William Bateman Snr died in Warrnambool on 30/03/1868 and his wife Sarah died in August 1868. William Bateman Jnr presented to Christ Church, stained glass windows in memory of his parents William & Sarah Bateman. William Bateman Jnr died in June 1913. Four stained glass windows, three lancet and one circular. The theme of the lancet windows depicts the three occasions when the apostles Peter, James and John were Jesus' sole attendants: The raising of Jairus' daughter. On the Mount of Transfiguration. In the Garden of Gethsemane. The circular window in the gable of the wall represents "The Enthroned Christ".

The original Presbyterian church was in Rowan Street but the congregation outgrew it. In 1897 a new plot was purchased in Forest Street and a new church designed by Vahland and son was designed and then built by Fairbanks and Wilson. It was of a gothic design with incandescent gasburners for lighting. It was designed to comfortably seat 400 people and was opened 4/7/1897.Eight pages booklet.
