The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. History of Saint Margaret's Church Eltham beginnings to 1888. Throughout this foundation period the community grew in numbers and influence within the developing district of Eltham. The minister's and lay readers appointed to Saint Margaret's are indentified and their contribution discussed. The significant events of the establishment of a temporary chuch and then a permanent church, the opening and closing of a denominational school, the construction of a parsonage, libraries and Sunday school are all examined. The key to the success of this faith community during its foundation years was the initiative and resourcefulness of its laypersons. - back cover. The early beginnings of the church included congregations at St Helena, Greensborough and Diamond Creek. People described in the book are listed as subjects in this description. Denis Gibbons (1937 – 2011) Trained with the Australian Army, before travelling to Vietnam in January 1966, Denis stayed with the 1st Australian Task Force in Nui Dat working as a photographer. For almost five years Gibbons toured with nine Australian infantry battalions, posting compelling war images from within many combat zones before being flown out in late November 1970 after sustaining injuries. Photograph of soldiers taken circa 11 October 1914 All enlisted on the 17th of August, 1914 at Wangaratta unless stated otherwise, assigned to the 7th Battalion C Company and identified as follows:- Colour Sergeant William Baker 290 - Prior to enlistment at Essendon was serving with the 58th Battalion. He embarked Australia on the 21/10/14. Brothers Charles POWLEY 347 and John Hall POWLEY 348 from Boweya - Embarked 19/10/14 on HMAT Hororata. Charles aged 21 years KIA 25/4/15 at Gallipoli and John returned to Australia on 31/10/15. Charles attended Wangaratta High School. John Crocker 346 was born at Clunes and enlisted at Broadmeadows. He was 36 years old, a butcher by trade and served with the 2nd Scottish Horse in the Boer War. His mother was listed as next of kin residing in Bracknell Tasmania He was wounded at Gallipoli and discharged on 19/1/1917 Nelson Albert Hardy 363 Born in England and a butcher by trade .KIA 23/8/1915 at Gallipoli aged 22 Edward Fahey 364 Ovens Street Wangaratta, Aged 29 years, a Painter by trade. He returned to Australia in December 1915 and appointed a Recruiting Sergeant. He resigned from this position on 8/5/1916, went AWOL and on 21/7/1920 discharged due to desertion. Joseph Cowham 360 enlisted at Broadmeadows on 19/8/1914. Thomas Peter Williams 404 - Aged 24 and a Blacksmith. He received a gunshot wound to the wrist on 26/5/1915 and returned to Australia.
