Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. The photo depicts men dressed in formal suits and in bowler hats walking out the front of the Beechworth Court House. Beechworth became known as the legal headquarters of north-east Victoria after the establishment of the Circuit Court in 1857. This was later known as the Court of Assize and dealt with cases surpassing the reach of the General Sessions and County Courts. The Court House was built a year after for these proceedings and was extended in 1865. As the image is undated the year is not known, however it can be assumed it was taken after 1857 as the Court House is pictured.The photograph holds historic significance as it contributes to an understanding of the legal systems in Beechworth at that time. The photograph was submitted to the Indigo Shire Photo Competition by Kathy Adamo in the 1980s. The photo depicts two old gas lamps outside the Court House in Beechworth. The Court House was built in 1856 after Beechworth became known as the legal headquarters in northeast Victoria. Blackwood Decagonal Table
The Government Gazette of January 18, 1888 advertised the acceptance of a contract of 149 pounds for a "Table for central library, New Law Courts, Melbourne". The table was purchased four years after the Court had moved to the William Street address.The table is not of state significance in its own right, but it is a high quality piece of Australian furniture. Its significance rests on its importance on the overall decorative scheme of the library and the fact that it was designed for this specific space.Blackwood, decagonal (10 sided) table, with 10 carved scroll and griffin supports, moulding and blue leather inserts. -

He was appointed ...The portrait was presented by the legal profession ot the Court in 1946. It would appear to have been commissioned at the time of Chief Justice Mann's retirement. Charles Wheeler, had won the Archibald prize in 1933 and was the head of the art gallery schools during World War two. Chief Justice Sir Frederick Mann (1869-1958) studied the law and worked at the Crown Law Department before his stint in the Army during the Boer War. After the war, he practised as a barrister, mainly working in the common law and equity area including appearences in the High Court on constitutional matters. He was appointed to the bench in 1919 along with William Schutt, to help remedy a shortfall in the number of judges on the Bench, after measures of economy during World War One. He became Chief Justice in 1935 following the retirement of Sir William Irvine, and retired in 1944.The portrait is of interest because of whom it portrayed, it is a well executed work by a well known artist of the period.Half Length portriat painting in oils of Sir Frederick Mann, seated and balancing a book on his knee. ... , son of the Justice Henry Bourne Higgins of the High Court ...Library Committee minutes from 1920 discuss the placing of an Honour Board in the Library, there was obviously some discussion from the Ballarat and Bendigo Law Associations about whom should be placed on the board and whether it was appropriate that it be located in the library. The board was donated by the Committee of Counsel, from the Bar and so only commemorates barristers. It is curious that this was not placed in Selborne Chambers where many barristers had rooms including one of the men on the Board (Higgins). This board joined the much bigger LIV memorial board that celebrates all Victorian lawyers who served during WWI.While memorial boards are a common addition to many public and civic building after World War One. This memorial board is the only one that commemorates members of the Bar, in that sense it is of great significance to the legal community. Two of the men commemorated on the board were sons of judges (Higgins, son of the Justice Henry Bourne Higgins of the High Court and Hodges, son of Justice Henry Hodges of the Supreme Court). Franc Carse was related by marriage to the a’Beckett family (also judges of the Court) and his father in law was on the Supreme Court Library committee in 1914. Eric Connelly and Murdoch Mackay shared rooms in Selborne Chambers. Connelly died in late 1918 in France, a member of General Pompey Elliott’s staff. Connelly had previously taken part in the Gallipoli landings in April 1915. This document contains details of the Will of William Stacey Spencer, formerly of Stanstead, Mount Fitchet but late of Birchanger, Essex, England. He was a corn merchant and malster and died in England in October 1897. He left an estate with a gross value of £4973, with the beneficiaries being his wife and children. Three codicils were added to the will, one being caused by the death of an executor, William Spencer’s brother. The English lawyers involved in drawing up this will were Richardson, Foxwell and Hart of Much Hadham, England. As this document is an Exemplification of the Will and was drawn up in the colony of Victoria it is presumed that one or more of the beneficiaries was a resident in Victoria and possibly in the Warrnambool district. The Warrnambool lawyers, Henry Parrington and Con O’Mahony have their names in the document. The document has been, with others, passed down to successive lawyers occupying legal premises in Kepler Street, Warrnambool and located in that building in 2014. Unless some local connection can be found to William Spencer, this document is of interest only in that it was drawn up by local Warrnambool lawyers in 1899.This is a cream-coloured document consisting of five double parchment pages bound together with green cord and including a folded-over inset piece of paper on the front page. Nine of the pages have ruled black lines on the edges and there is handwritten material in black ink on nine pages. The document gives details of the will and codicils of William Spencer of Essex, England who died in1897. The document has the seal of Her Majesty’s High Court of Justice, Probate Division, attached with white binding and a stamp for three pounds attached with a metal insert. Mt Beauty's Swimming Pool was built by Alpine Shire and included a Squash Court. October 1986. Previously the community swam in the West and East Kiewa Rivers. This is a picture of the original Town Hall building built in High Street in the 1890's. It was designed by renowned Bendigo Architect W.C .Vahland. This picture was taken in 1979 when the Echuca Library was housed there. The Echuca Library operated out of this building from 1965 up to 2013 when the new library was built. In this photograph there are two people standing in the doorway and two cars parked in the street.This photograph is significant because it shows the first Town Hall building built in High Street in the late 1890's. The building was designed by W.C Vahland and was also used as the Law Courts before the Law Court building was built in Law Court Place. This building has also been used as the High School, while the Echuca High School was being built in the 1920's it was also used as a Kindergarten and the town Library operated there from 1965 to 2012 when the new Library was built. The Court House opened as a court of petty sessions in 1890 and closed as a court in the early 1980s. It is now a 'Place of Deposit' for paper based products, maps, documents and photographs, and the home of the Wycheproof and District Historical Society Inc. The local Craft Group met at the Court House between 1982 and 2010. The Buloke Shire Council oversees the maintenance of the building.The Court House is No H 1656 on the Victorian Heritage Register. It is the one of only two buildings with this listing in Wycheproof, and characteristic of the type of building constructed in the early days of settlement in Wycheproof. The architecture is of aesthetic value and although some restoration work has taken place to maintain the structure, it remains in good condition and with some of the original furnishings intact.Sepia print of the Wycheproof-Court-House. It was constructed during 1889/90 and commissioned on September 23,1890 as a court-of-petty-sessions. A simple form of Court House built of red-face-brick but embellished by stepped brick work in the principal gable and by the traverse veranda with elaborate frieze and gabled pavilions that protect the street facade. The Wycheproof Court House Opened 24-9-1890.The Law Department Closed the Court House during the 1980s. The building became the home of the Wycheproof Craft Group and then the Wycheproof And District Historical Society. Financial support from Heritage Victoria enabled interior renovations to be completed in 2007.This is the only known photo of the Opening of the Wycheproof Court House.
