These books contain reports of the Supreme Court of Victoria in 1960 and 1961. They came from the Ardlie family, members of which have been associated with Warrnambool and legal affairs since the early 1850s. John Ardlie came to Warrnambool in 1852 as the Clerk of Courts and his son William Ardlie was a prominent lawyer in Warrnambool for over 60 years. If it is this William Ardlie’s stamp in these volumes then it was used after his death. The signature is of John Ardlie, also a lawyer in Warrnambool and Port Fairy in the later decades of the 20th century.These volumes are of interest as they are connected to members of the Ardlie family, prominent lawyers and community members in Warrnambool in the 19th and 20th centuries.These are two volumes of law reports of the Supreme Court of Victoria– hard cover books with dark green covers and spines with red and gold bands and gold print. Tait collection: item 25 of 62 This is a 1904 document containing information on the Will and Probate of William Charlesworth. He died in September 1904. He was a chimney sweep and nightman who came to Warrnambool in 1854 and married Sophia Ingham in 1855. They had six children but their married life was stormy because of Sophia’s problem with alcohol. She became notorious for her court appearances and gaol terms and her erratic behaviour in public. William Charlesworth was not able to control the situation and tried several times to get her to leave the town. Sadly she committed suicide in 1891 by throwing herself off the Hopkins River Bridge. William Charlesworth left real estate to the value of £650 and personal estate to the value of £194. The main beneficiaries were Charlesworth’s son, Alfred, his daughter Amelia Charlesworth and his grandchildren, George and Alice Tait. Ernest Chambers, the lawyer concerned with this document, had legal offices in Warrnambool, Port Fairy and Koroit in the late 19th century and the early 20th century. The document was passed down to successive lawyers who occupied the legal premises in Kepler Street and located there in 2014 when it was passed on to the Warrnambool and District Historical Society. This document is of considerable interest as both William and Sophia Charlesworth were well-known residents of Warrnambool in the 19th century. It will be useful to researchers.This is a piece of cream-coloured parchment paper folded in two and containing handwritten material on four sides of the paper. This is a brochure commemorating the arrival in Australia of John and Isabella McLeod and the unveiling of a plaque at the Immigrants Wall in Portland in 2015. The Immigrants Wall is located in Bentinck Street in Portland, Victoria and was a Glenelg Shire Bicentenary Project to enable descendants of those who first set foot on Australian soil at Portland to commemorate this event by placing a memorial plaque on the wall. John and Isabella McLeod were two of these immigrants to come to Portland in 1854. This letter book was used by George Barber to produce letters to send to clients and to retain a copy of this correspondence. Barber was a prominent Warrnambool lawyer in the 19th century. English-born George Barber (1814-1897) came to Warrnambool from Port Fairy in 1853, making him one of the earliest lawyers in the town. In 1867 he formed a partnership with William Ardlie, and this partnership continued until Barber retired in1879. Barber was active in community affairs, being involved with such institutions as the Warrnambool Cricket Club, the Warrnambool Hospital, the Warrnambool Gas Company and the local Horticultural Society. This letter has a connection to one of Warrnambool's important early lawyers and will be useful to researchers if the handwriting can be read.This is a letter book of 750 pages with a hard grey-coloured cover and black taping on the spine. The front cover has a paper label with a handwritten title on the outside and a signature on the inside cover The cover is partly detached from the spine. This small shoe (or boot) was found at Rosebrook, a small settlement between Warrnambool and Port Fairy, after the 1946 Western District floods. These floods are regarded as the worst in the history of European settlement in the Western District. At least five lives were lost, many small settlements and towns were isolated resulting in food shortages, onion and potato crops were ruined, 20 bridges were destroyed or damaged, roads were swept away, hundreds of farm animals perished and road and rail services were disrupted. The floods were the result of a very high rainfall in five successive days (658 points of rain in one 24 hours) and there was more flooding a week after the first major impact of the rains. This medal was made by Stokes and Martin. Thomas Stokes established a medal-making business in Melbourne in 1856 and from 1867 to 1893 he had a partner, George Frederick Martin. In 1962 the Stokes business became a public company and operates today in Melbourne. The medal was awarded at the Annual Show of the Villiers and Heytesbury Agricultural Association in 1877. One of the earliest agricultural associations in Victoria, the V.& H.A.A., the forerunner of the Warrnambool Agricultural Society, was established in 1854 and the first Warrnambool Show was held in 1855 at the first Royal Archer Hotel in Koroit Street. The Warrnambool Agricultural Show is still held annually. The medal, first prize for the best horse hay rake, was awarded in 1877 to the brothers, Thomas and William Rutledge, sons of Eliza and William Rutledge. The latter was a pioneer settler who came to the Warrnambool/Port Fairy district as the purchaser of the Special Survey, Farnham Park in 1841. His land stretched from Tower Hill to Dennington. William Rutledge Senior was a pioneer breeder of a Lincoln sheep stud, the owner of a mercantile business in Port Fairy, a member of the Legislative Council of Victoria and the pioneer developer of farming land around Tower Hill. His son Thomas (1846-1918) was a Warrnambool Shire Councillor who farmed in the Farnham Survey, living at Werronggurt . He went to the Geelong area at the end of the 19th century. His brother William (1849-1935) also farmed in the Farnham Survey, living at Farnham Park, He later lived at Airlie in Henna Street, Warrnambool and Sherwood on the Hopkins River and had land in the Otway Ranges. These are three volumes of Peloubet’s Select Notes. The book contents are described as ‘Inductive, Suggestive, Explanatory, Illustrative, Doctrinal and Practical’. The books were issued as curriculum material for Sunday Schools and were first published in the mid 1870s and continued to be published for the next 100 years. These three volumes belonged to M. P. McMeekin and this is presumed to be Margaret Parker McMeekin (1868-1948), the daughter of John McMeekin and Isabella Parker of Warrnambool. John McMeekin was the Rate Collector and Inspector and then the Valuer for the Warrnambool Shire in the 1860s, 70s and 80s. Two sons, William and James, operated a produce export business in Kepler Street under the name of McMeekin Brothers and another son, Charles was an auctioneer in Warrnambool. It is surmised that Margaret McMeekin was a Sunday School teacher either in Warrnambool or Port Fairy. These books are of interest as examples of what was taught in Sunday Schools in the late 19th and early 20th centuries. They are also of interest because they belonged to Margaret McMeekin, a member of a prominent family in Warrnambool at that time. These are three books of a religious nature written by F. and M. The local photograph shows the original footbridge across the Merri River near its mouth, the Viaduct road and the Warrnambool Breakwater with the Titan crane on it. The breakwater's construction was completed in 1890, the year this photograph was taken. The Viaduct has since been filled in to prevent water passing through the pylons, and the footbridge has been replaced. The photograph was presented to Flagstaff Hill on the centenary of South Warrnambool Primary School, 1877 to 1977, by the school's Warrnambool South Primary School Centenary Committee. The centenary was celebrated during August 12-13-14. The school was decommissioned in the 1990s.The photograph is locally significant for recording the completion of the Warrnambool Breakwater, for showing the original design of the Viaduct and for a clear view of the original footbridge across the Merri River. This map was printed in 1925 and contains the Warrnambool Harbour alterations proposed by the Warrnambool Harbour Committee incorporating the original designs of Captain Menzies, the Warrnambool Harbour Master and the City Engineer, Mr A. Lavercombe. The main features of the proposal were the extension of the Eastern Wall to almost enclose the harbour and a basin in Lake Pertobe. The design was to be placed before the Victorian Royal Commission on the Outer Ports which was established partly to examine the allegations of unsatisfactory work carried out in Warrnambool when the Breakwater was extended 300 feet in 1914 and also to make recommendations regarding all regional ports. The Warrnambool Breakwater was completed in 1890 but failed to provide the shipping conditions needed to continue Warrnambool as a viable port. Many plans and proposals for port improvement such as this one were produced in the late 19th century and the first half of the 20th century with the port officially closed in the 1940s. Still today the Breakwater and Warrnambool Harbour conditions remain a source of contention.This map is significant as it shows a 1925 design for Warrnambool Harbour hitherto little-known. It also has markings showing land sites of the time (BayView Hotel, Woollen Mill etc.)This is a map made of thick yellow paper pasted onto a cloth backing. No information is available on George Murray except that he was a Melbourne accountant and died intestate in 1885. He left property to the value of £91 and the lawyer, Ernest Chambers, who was at that time at 12 Chancery Lane, Melbourne, was directed to list the creditors of George Murray and distribute the estate accordingly. Mr Chambers was one of George Murray’s creditors. Ernest Chambers later had a legal practice with offices at Warrnambool, Koroit and Port Fairy with the known dates 1897 to 1910. Thomas Goodall was the manager of the Warrnambool office and he was the one who had this document in his possession at that time and it was passed down to succeeding lawyers in the Kepler Street building. Tait collection: item 7 of 62This document is of interest in that it was originally issued by the lawyer Ernest Chambers who later had an office in Warrnambool. This is a piece of parchment containing the 1885 Letters of Administration in the estate of George Murray, a Melbourne accountant. The document is white with black ruled lines and has handwritten material in black ink. The document is folded at the lower edge with a seal of the Supreme Court of the Colony of Victoria. The seal is attached to the document by a green ribbon. There is also a blue stamp of the Master in Equity of the Supreme Court. This original tunic or jacket is part of the full dress uniform of the pre-Federation Victorian Permanent Artillery regiment. Its owner had the rank of Sergeant, as indicated by the three inverted chevrons. The Artillery design of the badges and buttons indicate the date of the tunic to be from 1893 to 1903. However the maker of the tunic, W. Moncton, began manufacture in Melbourne in 1899, so this the tunic can be dated between 1899 and 1903. The donor's grandfather was given this tunic but not the name of the original owner. It has since been suggested to the family that the tunic was worn by a local Western District Light Horse member. This could very well have been the case because mounted troops were officially referred to as the Light Horse in the late 19th to early 20th century. Several local men were involved in the Light Horse during the First World War. The donor's grandfather wore this tunic in the local district when riding a penny farthing bicycle. The donor's father also wore the tunic when dressed as a 'Captain' hosting a local disco dance. BRIEF MILITARY HISTORY- The Crimean War began In 1854 and many people in colonial Australia were afraid of a Russian attack. Volunteer forces were established to strengthen the British Imperial troops posted here. A battery of artillery was raised in Victoria as well as in other Australian states. In 1870 Australia became responsible for its own naval and military defence. The Volunteer Corps and Victorian Navy shared the responsibility of defending the existing forts, assisted by volunteer coastal and mobile field batteries. The Permanent Victorian Artillery force was established. It was disbanded in 1880 then re-formed in 1882 as the Victorian Garrison Artillery Corps. In 1895 the Geelong, Warrnambool, Port Fairy and Portland Batteries became part of the Western District Garrison Artillery. Many of the volunteers who served in the Artillery were from rural areas. They belonged to rifle clubs and were experience horsemen as well. Australia's defence at this time relied on these mounted troops, or Light Horse men. In 1899 the Victorian Garrison Artillery Corps amalgamated with the New South Wales and Queensland Permanent Artillery to become the Victorian Regiment of the Royal Australian Artillery (RAA). Then prior to Federation, the RAA and the Permanent Artillery of South Australia, Western Australia and Tasmania all combined, becoming the Royal Australian Artillery Regiment with two Batteries of Field Artillery; Battery A from Sydney and Battery B from Melbourne.This original uniform tunic of the pre-Federation Victorian Permanent Artillery is significant for its association with Australia's military defence and the fortifications of our district, state and country. Original, single-breasted tunic of dark blue wool, red piping trim, black cotton lining in body. Sleeves lined with blue striped, white cotton. Front closure has eight brass buttons. Red band-style collar with hook-and-eye closure has gold bullion braid trim and a brass badge pinned each side at the front. Upper right sleeve has three inverted chevrons on red fabric with gold bullion braid trim (rank of Sergeant). Both sleeves have gold bullion braid 'Austrian knot' emblems stitched onto lower arm, with ends finishing on the inner sleeve. Shoulder epaulettes have red piping and smaller brass buttons. Closed back vent has vertical scalloped design with six brass buttons, in two columns of three, and red piping trim. Brass belt hook is attached to the left back waist, close to the seam (right side has a mark indicating a previous similar clip). Inside left breast is a concealed pocket. Tunic has both machine and hand stitching. All brass shank-style buttons have matching Artillery emblems with inscriptions on the back. The two brass collar badges have additional artillery emblems of exploding grenade and star as well as an inscription. Buttons were made for W. Moncton, of Melbourne and marked with his name. The photograph, taken in the 1890s, shows sailing ships and a wreck in Lady Bay, Warrnambool. Lady Bay was once a very busy port of trade in Warrnambool and was also called the Port of Warrnambool or Warrnambool Harbour. ENTERPRISE (1847-1850) NOTE: The “Enterprise” wrecked in 1850 in Warrnambool should not be confused with John Pascoe Faulkner’s ‘Enterprise’, which was wrecked in NSW in 1847. The 58-ton schooner Enterprise was built by David Hay in Waiheke, New Zealand in 1847 and registered by owners John Watson and Edward Byam in Melbourne, Australia. She was a single-deck sailing ship with two masts, used for carrying cargo such as local agricultural produce and general commodities between Melbourne and other colonial ports. On September 14th, 1850 the Enterprise had sailed from Melbourne under the control of the ship’s Master, James Gardiner Caught, and was moored in at the Tramway Jetty in Lady Bay, laden with wheat and potatoes. The vessel rode out a south-easterly gale but eventually dragged anchor and was beached, bow first and then broadside. Buckwall, a local indigenous man, braved the heavy surf and reached the stricken vessel with a rescue line, saving all five crew on board. There were no passengers on board. The Enterprise wreck was in an area called Tramway Jetty in Lady Bay. Since then the area has become the location of Lady Bay Hotel and now, in 2019, it is in the grounds of the Deep Blue Apartments. In fact, with the constantly changing coastline through built-up sand, the wreck site is now apparently under the No 2 Caravan Park on Pertobe Road, perhaps 150 metres from the high tide. Its location was found by Ian McKiggan (leader of the various searches in the 1980s for the legendary Mahogany Ship). The Warrnambool Wreck Enterprise is listed on the Victorian Heritage Database VHR S238. DIFFERENTIATING the New Zealand Schooner “Enterprise” from John Fawkner’s “Enterprize“ Dr Murray Johns, Melbourne, says in his article The Mahogany Ship Story, “…the Enterprise, wrecked in Lady Bay, Warrnambool in 1850 ... was soon covered by sand but was exposed again after several storms in 1887. “Samples of timber were then cut from the wreck, which would then have been buried for 37 years. In November 1887 the Warrnambool Standard reported that “the timber looks sound and hard, a penknife scarcely making any impression.” “For many years there was confusion about the identity of that ship in Lady Bay. Most people believed it was the wreck of John Pascoe Fawkner’s Enterprize, which had sailed from Tasmania to Victoria bringing the pioneer settlers to Melbourne in 1835. “In fact, as I documented in 1985, the Warrnambool wreck was of an entirely different ship, also called Enterprize [Enterprise], but built in New Zealand in 1847. Fawkner’s ship had already been sold to Captain Sullivan in 1845 and was wrecked on the Richmond Pier in northern New South Wales early in 1847. “In 1985 a piece of timber from the local Enterprise, which had been kept at the Warrnambool Museum since 1892, was identified histologically as a New Zealand timber, not Tasmanian timber such as blue gum, from which Fawkner’s Enterprize would have been built in 1830. This confirmed the identity of the Warrnambool Enterprize.”[Dr. M.W. Johns later wrote an article called “The Schooner Enterprise: A Final Word on a Historic Wreck.”] ABOUT THE S S EDINA The three-masted iron screw steamer SS Edina was built in Glasgow, Scotland, in 1854 by Barclay and Curle. She was adorned with the figurehead of the ‘fair maid of Judea’. The many years of service made SS Edina famous worldwide as the longest-serving screw steamer. (The term screw steamer comes from being driven by a single propeller, sometimes called a screw, driven by a steam engine.) SS Edina’s interesting history includes English Chanel runs, serving in the Crimean Ware carrying ammunition, horses and stores to the Black Sea, and further service in the American Civil War and later, serving in the western district of Victoria as well as in Queensland and carried gold, currency and gold prospectors Australia to New Zealand. SS Edina had the privilege of being an escort vessel to H.R.H. the Duke of Edinburgh during his visit to Australia in 1867. In March 1863 SS Edina arrived in Port Phillip Bay, Melbourne and was bought by Stephen Henty, of Portland fame, to work the cargo and passenger run from Melbourne – Warrnambool – Port Fairy - Portland. After a short time of working the run from Australia to New Zealand, with passengers and cargo that included gold and currency, she returned to her Melbourne - Warrnambool – Port Fairy run, with cargo including bales of wool produced in the western district of Victoria. The Warrnambool Steam Packet Company purchased SS Edina in 1867; she was now commanded by Captain John Thompson and Chief Engineer John Davies. She survived several mishaps at sea, had a complete service and overhaul and several changes of commanders. In 1870 SS Edina was in Lady Bay, Warrnambool, when a gale sprung up and caused a collision with the iron screw steamer SS Dandenong. SS Edina’s figurehead was broken into pieces and it was not ever replaced. SS Edina was re-fitted in 1870 and was then used as a coastal trader in Queensland for a period. She was then brought to Melbourne to carry cargo and passengers between Melbourne and Geelong and performed this service from 1880-1938. During this time (1917) she was again refitted with a new mast, funnel, bridge and promenade deck, altering her appearance. In 1938, after more collisions, SS Edina was taken out of service. However, she was later renamed Dinah and used as a ‘lighter’ (a vessel without an engine or superstructure) to be towed and carry wool and general cargo between Melbourne and Geelong. In 1957, after 104 years, the SS Edina was broken up at Footscray, Melbourne. Remains of SS Edina’s hull can be found in the Maribyrnong River, Port Phillip Bay. This photograph is significant for its association with the screw steamer SS Edina, heritage listed on the Victorian Heritage Database VHR S199. She had endeared herself to the people of Port Phillip Bay as a passenger ferry, part of their history and culture. She played a significant role in the Crimean War, the American Civil War and the gold rush in New Zealand. She also served western Victoria for many years in her cargo and passenger runs. The SS Edina is famous for being the longest-serving screw steamer in the world. After spending her first nine years overseas she arrived in Melbourne and her work included running the essential service of transporting cargo and passengers between Melbourne and the western Victoria ports of Warrnambool, Port Fairy and Portland. The SS Edina was purchased in the late 1860s by the local Warrnambool business, the Warrnambool Steam Packet Co. and continued trading from there as part of the local business community. This ledger contains an Index to Drafts for Mortgages, Conveyances and Deed of Covenants etc (1896 to 1913) which was in use by the Warrnambool solicitor, Ernest Chambers. He had offices in Warrnambool, Koroit and Port Fairy in the late 19th century and early 20th century and Thomas Goodall was his manager in Warrnambool until 1899 when Chambers took up permanent residence in Warrnambool. The ledger was found in the old Mackay Taylor offices in Kepler Street and presumably came into the possession of this law firm at a later stage when Ernest Chambers was no longer operating in Warrnambool. The firm of Mackay Taylor was originally established in 1898 from the amalgamation of the law firms of George Mackay and James Fletcher. In the 1920s the firm became Mackay and Taylor when J. Taylor joined as a partner and this business was prominent in Warrnambool until the 1990s.This ledger has some significance as it contains the names of many Warrnambool and district residents of the late 19th and early 20th centuries and gives some indication of what type of legal transaction they were involved with. He was a contractor who died at the age of 46 leaving a widow, Margaret (nee Flahavin) and eight children. The two oldest boys took over the contracting business and Joseph’s brother, David, supported the family during their time of need. Joseph Kelson left personal estate to the value of £460 with the chief beneficiary being his widow Margaret. Ernest Chambers, the lawyer who drew up this document had a legal practice in Warrnambool, Koroit and Port Fairy at the end of the 19th century and the beginning of the 20th century. Colac was the centre of a spidery rail network over which were carted anything and everything by Victorian Railways, the common carrier throughout the area. The main line through the region was the 35 km rail route from Birregurra (and thence to Geelong) though Colac to Pirron Yallock (and thence to Warrnambool and Port Fairy) from March, 1877, to July, 1883. The first branch line ran from Irrewarra to Beeac in 1889, which then extended in stages to Cressy and on the Ballarat. The second branch line was the 31 km long Birregurra to Forrest in 1891. The cost of building railways into mountainous terrain meant the third branch line was a narrow-gauge 2 foot 6 inch line, first of all to Beech Forest in 1902, and then to Crowes in 1911, for a total of 71 km. The final rail connection was the 16 km branch from Colac to Alvie to facilitate the transport of onions, opening in 1923. Each line had its own character and peculiarities derived from its foundation, geography and economic base. As a general rule, the loadings on the branch lines had greater output tonnage than inwards, the reverse of the main line. The lines traversed agricultural and timber areas where inputs like seed, grass, fertiliser and labour were minor, compared with the output, timber, wool, cream, butter, cheese fruit, potatoes, onion, grain and livestock.Rail Centre Colac. His death place is given as Tower Hill. A William Osborne is listed as a Wangoom farmer in 1856, a farmer at ‘Thompson’s Old Farm’ in Allansford in 1866 and a farmer at Winton Farm on the Allansford Road near Shipley in 1869 but these references may be to William Osborne’s father as there is mention of a William Osborne, Junior at that time. This is the whip's wheel that was on display for 40 years on the vessel SS Rowitta, installed on the lake at the Flagstaff Hill Maritime Museum and Village as an educational display and attraction. SS ROWITTA: - The 1909 steam ferry, SS Rowitta, was installed as an exhibit at Flagstaff Hill in 1975 and was enjoyed by many visitors for 40 years. Rowitta was a timber steam ferry built in Hobart in 1909 using planks of Huon and Karri wood. It was a favourite of sightseeing passengers along Tasmania’s Tamar and Derwent rivers for 30 years. Rowitta was also known as Tarkarri and Sorrento and had worked as a coastal trading vessel between Devonport and Melbourne, and Melbourne Queenscliff and Sorrento. In 1974 Rowitta was purchased by Flagstaff Hilt to convert into a representation of the Speculant, a historic and locally significant sailing ship listed on the Victorian Heritage Database. (The Speculant was built in Scotland in 1895 and traded timber between the United Kingdom and Russia. Warrnambool’s P J McGennan & Co. then bought the vessel to trade pine timber from New Zealand to Victorian ports and cargo to Melbourne. It was the largest ship registered with Warrnambool as her home port, playing a key role in the early 1900s in the Port of Warrnambool. In 1911, on her way to Melbourne, it was wrecked near Cape Otway. None of the nine crew lost their lives.) The promised funds for converting Rowitta into the Speculant were no longer available, so it was restored back to its original configuration. The vessel represented the importance of coastal traders to transport, trade and communication in Australia times before rail and motor vehicles. Sadly, in 2015 the time had come to demolish the Rowitta due to her excessive deterioration and the high cost of ongoing repairs. The vessel had given over 100 years of service and pleasure to those who knew her. The ship's wheel is an example of the equipment used on a steam ship for navigation. This wheel is connected to the history of the Rowitta, which was a large exhibit on display at Flagstaff Hill Maritime Village from the museum’s early beginnings until the vessel’s end of life 40 years later. The display was used as an aid to maritime education. The Rowitta represents the importance of coastal traders to transport, trade and communication along the coast of Victoria, between states, and in Australia before rail and motor vehicles. The vessel was an example of a ferry built in the early 20th century that served many different roles over its lifetime of over 100 years. Charles Wines was born in Somerset, England in 1832 and died in July 1900, residing in Lava Street East, Warrnambool, at the time. He and his wife came to Australia in 1852 and settled in the Woodford area, remaining there until about 1880 when they shifted to Mailors Flat. He was married to Hannah and they had a large family, with eleven surviving at the time of his death. He left real estate to the value of £1618 and personal estate to the value of £14 with the chief beneficiaries being his sons, Thomas and George and his wife, Hannah. After his wife’s death the estate was to be divided equally amongst the surviving children. The lawyer involved in drawing up this document was Ernest Chambers. He had legal offices in Warrnambool, Koroit and Port Fairy at the end of the 19th century and the beginning of the 20th century. The document was in his possession and was then passed down to successive lawyers occupying the legal premises in Kepler Street.
