SEC Tram 17 and a former bus used as a food vendor stand, that has finished up in the front of S.E. Dickins Pty Ltd. (Grocers) store 1/10/1949. The tram derailed at the intersection of Sturt and Grenville St. collided with the bus and pushed it into the front of the store. Many people standing around the incident, including two trammies in front of the tram. Thought to be a Ballarat Courier Photograph. Wal Jack's caption advises the Bedford van was a doughnut kitchen. 1020.1 - added 3/06/2006 - small newspaper cutting with the same photo and a caption "While the driver was picking up lunch at Ashkar's pie shop, his tram ploughed into Dickin's grocery, on the present site of Norwich Plaza". Minnie PWERLE (c1910-2006) Atnwengerrp/Utopia Minnie Pwerle's Dreamings consist of elements of 'Bush Melon' and 'Awelye'. Awelys-Atnwengerrp' is depicted by a series of lines painted in varying widths and colours. These patters represent the lines painted on the top had of women's bodies during ceremonies in Minnie's country of Atnwengerrp. 'Bush Melon' is depicted using linear design of curves and circles in different colours creating a very loose and bold design. This dreaming tells the story of this lovely sweet food that comes from a very small bush and is only found in Atnwengerrp. Once very abundant and fruiting in the summer season, the Bush Melon is now hard to find. Minnie and other women used to collect this fruit (that was green in colour and then ripened to a brown colour) and scrape out the small black seeds. They would then eat the fruit straight away or cut it in pieces and skewer them onto a piece of wood to dry then to be eaten in the coming months when bush tucker was scarce. These artistic symbols carry potent spiritual meanings.. The physical creation of these Dreamings in an important part of the continuation of an ancient and rich cultural heritage. This item is part of the Federation University Art Collection. Stuchbery Farm was situated on the Plenty River bounded by Smugglers Gully to the north and La trobe Road, Yarrambat, to the east. Alan and Ada Stutchbery moved to the valley in 1890, first living in a tent where four children were born. Alfred built a home and outbuildings around 1896. They planted an orchard, then a market garden and developed a dairy. Published: Nillumbik Now and Then / Marguerite Marshall 2008; photographs Alan King with Marguerite Marshall.; p179 The dramatic steep-sided Plenty Gorge lies along the divide of two geological areas, and separates the Nillumbik Shire and the City of Whittlesea. On the Nillumbik side are undulating hills and sedimentary rock, and in Whittlesea, lies a basalt plain formed by volcanic action up to two million years ago. This provides the Plenty Gorge Park with diverse vegetation and habitats, making it one of Greater Melbourne’s most important refuges for threatened and significant species. The park, established in 1986, consists of around 1350 hectares, and extends 11 kilometres along the Plenty River, from Greensborough to Mernda. It provides a wildlife corridor for around 500 native plant and 280 animal species.1 The area’s plentiful food and water attracted the Wurundjeri Aboriginal people and then European settlers. By 1837 squatters had claimed large runs of land for their sheep and cattle. The Plenty Valley was among the first in the Port Phillip District to be settled - mainly in the less heavily timbered west - and was proclaimed a settled district in 1841.2 But by the late 1880s, the settlers’ extensive land clearing for animal grazing, then agriculture, depleted the Wurundjeri’s traditional food sources, which helped to drive them away. Many Wurundjeri artefacts remain (now government protected), and so far 57 sites have been identified in the park, including scarred trees, burial areas and stone artefacts. Pioneer life could be very hard because of isolation, flooding, bushfires and bushrangers. Following the Black Thursday bushfires of 1851, basalt was quarried to build more fire-resistant homes. Gold discoveries in the early 1850s swelled the population, particularly around Smugglers Gully; but food production made more of an impact. In the late 1850s wheat production supplanted grazing. In the 1860s the government made small holdings available to poorer settlers. These had the greatest effect on the district, particularly in Doreen and Yarrambat, where orchards were established from the 1880s to 1914. Links with a prominent early family are the remains of Stuchbery Farm, by the river’s edge bounded by Smugglers Gully to the north and La Trobe Road, Yarrambat, to the east. The Stuchberys moved to the valley in 1890, and the family still lives in the area. In 1890, Alfred and Ada first lived in a tent where four children were born, then Alfred built the house and outbuildings around 1896. They planted an orchard, then a market garden, and developed a dairy. The family belonged to the local Methodist and tennis communities. Their grandson Walter, opened the Flying Scotsman Model Railway Museum in Yarrambat, which his widow, Vi, continues to run. Wal was also the Yarrambat CFA Captain for 22 years until 1987. Walter sold 24 hectares in 1976 for development - now Vista Court - and in 1990, the remaining 22.6 hectares for the park. Remaining are an early stone dairy and remnants of a stone barn, a pig sty and a well.3 Until it was destroyed by fire in 2003, a slab hut stood on the Happy Hollow Farm site, at the southern end of the park. The hut is thought to have been built in the Depression around 1893. This was a rare and late example of a slab hut with a domestic orchard close to Melbourne. Emmet Watmough and his family first occupied the hut, followed by a succession of families, until the Bell family bought it around 1948. There they led a subsistence lifestyle for 50 years, despite encroaching Melbourne suburbia.4 The Yellow Gum Recreation Area includes the Blue Lake, coloured turquoise at certain times of the year. Following the 1957 bushfires, this area was quarried by Reid Quarries Pty Ltd for Melbourne’s first skyscrapers, then by Boral Australia. However in the early 1970s water began seeping into the quarry forming the Blue Lake and the quarry was closed. The State Government bought the site in 1997 and opened it as a park in 1999.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. Painted for the Shire of Eltham Historical Society by Audrey Cahn, a member of our Society for many years and Vice President till 1978. Audrey was the sister of the late Charis Palling, founding president of our Society. She had remained a member for many years although she had moved from her family home at Warrandyte to live with her daughter in New South Wales. Audrey had been blind for some years but maintained a local interest by having our Newsletter read to her. Audrey's associations with Warrandyte started because her father Professor Osbourne had bought 60 acres in 1904. " Gold mining was beginning to die out and Warrandyte was a decaying area. Land was cheap because of the lack of transport and the soil was poor for farming” Audrey said. Audrey first attended school in the city at the Church of England Girls Grammar School and was always a bit rebellious. “If I felt some restrictions were unfair or some judgement unjust, I resented it”. Audrey got into Agricultural Science at Melbourne University and in 1928 was the second women to get such a degree. Audrey married in 1926, and later divorced Leslie Cahn an architect. They had twin daughters whom she left with her parents in Warrandyte while she studied dietetics during the depression. She found employment as a microbiologist at the Kraft/Walker Milk and Cheese Factory in Drouin - she drove home at weekends to see her daughters who were then at boarding school. During the war Audrey was in charge of catering at the Heidelberg Military Hospital – again the appointment of a women caused some unrest. She was in the army for more than 4 years and achieved the rank of General which-made her the most highly-ranked-woman at the hospital. After the war she became a senior lecturer in Dietetics at Melbourne University, again being aware of the limitations her gender brought to promotion possibilities. During her time at the university, she undertook a series of studies in nutritional biochemistry. Of especial note is the analysis of common dietary foods so that the composition and calorific value, the data that was needed for inclusion in Food tables - that professional sports people and weight-watchers so avidly follow today! She was an early proponent of the need to reduce fat intake and to substitute saturated fats with polyunsaturated fatty acids. In the 1950's Audrey and fellow workers established norms for the growth of Australian children to be compared with British and American children. Over 17 years they concluded that Australian children were overweight and inactive - what is new! She bought a cottage in Warrandyte as her home. In 1968 she retired to further develop her other interests as a potter and painter. Audrey was a foundation member of the group of potters that set up Potters Cottage. Audrey died in 2008 aged 102. Laughing Waters Road , the book was launched at Montsalvat in Eltham. On Saturday, January 30, 2016, Nillumbik Council launched this book. The weather was cool; just as well, considering over 500 people attended this very pleasant event where food and drink were plentiful. The Australian Government and Nillumbik Shire Council funded the book and it was designed by Wayne Rankin of North Warrandyte. The dedication page is to our very own Ranger Campbell Beardsell OAM of Parks Vic who taught Jane to be “passionate about the environment of this special place” (p260). FOWSP members Val Polley, Linda Rogan and Ken Crook contributed to the content and photos. David Wandin, Wurundjeri Elder, gave a Welcome to Country and officially launched the book after the Mayor of Nillumbik, Cr Hattam, made introductions. Jane Woollard followed with a brief outline of how she came to write the book (her very first) and read out loud the last paragraph which focuses on reconciliation and shared culture. Animal specimen - Goanna, Trustees of the Australian Museum, 1860-1880
Sand goannas are the second largest species of carnivorous lizards found across mainland Australia. They can grow up to 160cm in length and can weigh as much as 6kg. Their common name is derived from "iguana", since early European bush settlers in Australia likened goannas to the South American lizards. Goannas retain special cultural and historic significance within Australian folklore and Indigenous culture. They were an important traditional native food source and are commonly represented in Aboriginal Dreamtime stories. In some Aboriginal languages, the sand goanna is called "bungarra"; a term also commonly used by non-Aboriginal people in Western Australia. In Pitjantjatjara and other central Australian languages, goannas are called "tingka". This specimen is part of a collection of almost 200 animal specimens that were originally acquired as skins from various institutions across Australia, including the Australian Museum and the National Museum of Victoria, as well as individuals such amateur anthropologist Reynell Eveleigh Johns between 1860-1880. These skins were then mounted by members of the Burke Museum Committee and put-on display in the formal space of the Museum’s original exhibition hall where they continue to be on display. This display of taxidermy mounts initially served to instruct visitors to the Burke Museum of the natural world around them, today it serves as an insight into the collecting habits of the 19th century. This specimen is part of a significant and rare taxidermy mount collection in the Burke Museum. This collection is scientifically and culturally important for reminding us of how science continues to shape our understanding of the modern world. They demonstrate a capacity to hold evidence of how Australia’s fauna history existed in the past and are potentially important for future environmental research. This collection continues to be on display in the Museum and has become a key part to interpreting the collecting habits of the 19th century.Small goanna with a streamlined body and textured scaly skin in different shades of olive and brown. It has a long neck and a long tail which narrows towards the tip. The goanna has four short, stocky legs which meet with large, curled claws. The Gang-gang Cockatoo can be found throughout much of south-eastern Australia. They reside in mountainous forests and open woodlands, often in small groups or larger flocks at sources of food and water. They eat mainly seeds from native trees and shrubs along with wattles, eucalypts and hawthorns. The Gang-gang Cockatoo is also known to incorporate berries, nuts, fruits and insects to their diet. The sound made by this type of Cockatoo is often described as a rasping screech which resembles the sound of a rusty hinge being moved.This type of call is made when the bird is in flight. These birds also fond of attention and can pick their own feathers if they are bored. The name "gang gang" derives from a New South Wales Aboriginal language, either the Ngunnawal or Wiradjuri. This specimen is part of a collection of almost 200 animal specimens that were originally acquired as skins from various institutions across Australia, including the Australian Museum in Sydney and the National Museum of Victoria (known as Museums Victoria since 1983), as well as individuals such as amateur anthropologist Reynell Eveleigh Johns between 1860-1880. The beak is hooked and a pale bone colour. The neck and torso of the cockatoo is patterned with orange and black stripes. The feathers of the underparts and back are slate-grey with an edging of pink and yellow. Rejoined unit 27.5 1940. 14.6.1940 hospitalised with a throat infection. Rejoined unit 16.6.1940. 27.7.1940 transferred to 6th Division ASC. From here he served in Ammunition and Composite Coy’s in 6th Div ASC and graded Group 2 Mechanic MT. 24.3.1941 embarked for Greece. 5.6.1941 reported as missing. 15.12.1941 officially reported as POW in Stalag V111B. 17.5.1944 as part of a POW exchange he embarked from Barcelona to Algiers then Alexandria arriving on 2.6.1944. He is admitted to No 5 NZ GH with Dyspepsia and discharged on 9.6.1944. 28.8.1944 embarked for Australia as a medical casualty. 29.9.1944 arrived Sydney. Hospital again with Dysentry and is medically down graded to D. 6.12.1944 marched out to GDD for discharge. 18.2.1945 discharged from the Army. A document in his records that he supplied details states his POW No 24198. He was captured on 1.6.1941 on Crete and they were on rear guard action at their post when the Island capitulated. It also details living conditions, clothing issue, food, sanitary, treatment, parcels etc. Ref Reg No's 3768, 3569, 3570, 3571, 3572, 3573. A4 certificate, yellowed, folded 8 times. T & C Clark & Company Limited, based at Shakespeare Foundry, was founded in 1795 by Thomas and Charles Clark and grew to be one of the largest iron foundries in Wolverhampton. The firm was the pioneers of Enamelled Cast ironware and the founder Charles Clerk went on to became mayor of Wolverhampton in 1860 after also serving as a Councilor, Alderman, and later Chief Magistrate. The company exhibited many products at the International Exhibition of 1862 at South Kensington, alongside the gardens of the Royal Horticultural Society. The company was also awarded the silver medal for its products at the International Paris Exhibition in 1878. The company's product range included thousands of items, both domestic and industrial. T & C Clark pioneered the use of enamelled cast ironware, after taking out a patent in 1839 guaranteed to be free of lead or arsenic. In the late 1940s and 1950s the company produced acid-resisting enamelled cast iron boiling pans; steam-jacketed pans; stills; square and rectangular tanks; open and closed mixing vessels; flanged pipes; bends and tees; laboratory equipment; small scale plant; evaporating bowls; beakers; sulphonates; and glass-lined mild steel tanks for beer, mineral water, and food. The company is listed as enamelled chemical plant manufacturers in Kelly's 1962 Wolverhampton Directory, but within a few years, the company had ceased trading. The cooking pot is significant because it demonstrates one of the social norms founded by early settlers to this region. That close ties to "Mother England" and the "establishment" was still very strong. The social and family values from the British way of life was ingrained in colonial society until well past Australian Federation in July of 1900. It was not until the friendly "American soldier" invasion during World War II that the Empire mindset was slowly being eroded away. Longmore’s was a manufacturing chemical pharmacy of many over-the-counter preparations, including Sulphur Hair Restorer, Strengthening Tonic, Blood and Liver Pills, Asthmacur (for asthma) and Hoyle’s Miraculous Oil (for miracles unknown), He was a native of New South Wales, but his father, Mr. Joseph Longmore settled in Melbourne in the late 1850s. Mr Longmore was educated at the Melbourne Grammar School, and leaving early, he studied and qualified as a chemist. Argus “12 October 1921, Mr. Francis Longmore, chemist of Bourke Street was at his business on Saturday but he had a chill which developed into pneumonia, and he died yesterday morning. The funeral will leave from his residence Wontravell, Gower Street, Kensington. He was a widower, his wife having died a year ago and he leaves a grownup family of 2 sons and 6 daughters. Carlisle Francis Longmore and his certificate number as a pharmacist was No. 1440; he qualified as a pharmacist at his final exam in Victoria on 11 September 1905. Book, Jamie Callister, The Man Who Invented Vegemite, 2012
Cyril Percy Callister, a chemist by training, became a food technologist and the inventor of the well known spread 'Vegemite'. A Ballarat School of Mines (SMB) student around 1910, Callister then went to Melbourne University where he obtained his B.Sc. in 1914, M.Sc. in 1917 and D.Sc. in 1931. With Sir David Rivett in 1931 he secured the royal charter for the Royal Australian Chemical Institute, becoming president of the Society of Chemical Industry of Victoria in 1935-36. Vegemite, a yeast based spread, and perhaps one of most famous trademarks in Australia, was discovered around 1922 by Cyril Percy Callister. He was hired by the Fred Walker Company (a Melbourne based manufacturer later known as Kraft) as a laboratory assistant to develop a yeast extract spread. It took some years but by 1954 the special Vegemite song 'Happy Little Vegemites' demonstrated the popularity of the spread. Callister was also known for packing cheese in a can to preserve it and developing Kraft processed cheese. he son of a school teacher and postmaster he was born at Chute on 16 February 1893 and died on 5 October 1949. His brother Reginald Clive Callister (1889-1971) was also a student of SMB. Before the invention of woven baskets, people used tree bark to make simple containers. These containers could be used to transport gathered food and other items but crumbled after only a few uses. Weaving strips of bark or other plant material to support the bark containers would be the next step, followed by entirely woven baskets. The last innovation appears to be baskets so tightly woven that they could hold water. Depending on soil conditions, baskets may or may not be preserved in the archaeological record. Sites in the Middle East show that weaving techniques were used to make mats and possibly also baskets, circa 8000 BCE. Twined baskets date back to 7000 in Oasisamerica. Baskets made with interwoven techniques were common at 3000 BCE. Baskets were originally designed as multi-purpose vessels to carry and store materials and to keep stray items about the home. The plant life available in a region affects the choice of material, which in turn influences the weaving technique. Rattan and other members of the Arecaceae or palm tree family, the thin grasses of temperate regions, and broad-leaved tropical bromeliads each require a different method of twisting and braiding to be made into a basket. The practice of basket making has evolved into an art. Artistic freedom allows basket makers with a wide choice of colours, materials, sizes, patterns, and details.Before the advent of plastics (1907), the is now used for many different types and styles of storage container rattan, wicker or cane was used to make containers with a lid for the storage of linens etc. The subject item was probability used at the end of the Victorian era and into the Edwardian period around the 1900s as a household storage facility. Fishers Guilds are not only vital economic groups for Nrat-Tuan, but also for the whole Imperium, since the water planet is the major source of foodstuffs for Irusaqu, who cannot produce enough crops on what Is a relatively barren, planet. The various fishing crafts are most responsible occupations, entailing great care for the environment and the food chains. Fishing is carried out by means of either mirrors or nets, both being about equally popular. Mirror-faceted fabrics have always been used by Nrati-Tuan fishermen to dazzle and bemuse the creatures they are trying to catch, (the mirror may also have some predictive power). Research indicates that this odd technique is surprisingly effective. And the harvests are unfailingly good. Contact with the humans of Irusag, when the Imperium was first founded, brought the technique of netting to Nrat-Tuan. The Netleader heads the Netter Guild, which does not limit itself to the merely traditional fishing net, but works with a complex and sophisticated membrane technology, which has, in recent years, revolutionised the whole netting industry. A vintage 1929 Chatterbox collection of puzzles, poetry and stories for children with black lined illustrations and coloured plates throughout.A vintage 1929 hardcover children's book with the title Chatterbox printed in white lettering at the top of the front cover which has a green coloured background with an illustration in a large circle showing a boy wearing a white jumper in front of trees. The publisher details are printed at the bottom. Red tape binds the covers on the spine. The faded yellow coloured back cover has an advertisement for 'Allenbury's' The Progressive System of Infant Feeding, which was a similar composition to mother's milk. The manufacturer details are added at the bottom. Inside the front cover are black and white printed advertisements for 'Ovaltine' Tonic Food Beverage and "Blackbird" Fountpens. The coloured frontispiece illustration inside depicts an Indigenous American First Nations Indian riding a horse with his family and rest of the tribe in the background. The title of the picture is 'The Wilderness Road'. The title page has the title plus Funded by J. Erskine Clarke, M.A and publisher details with a black lined illustration of children, a woman with children at her knee reading and flowers. There are further coloured plates in the collection. The book contains plenty of puzzles, poetry, and stories for children. Pp. 316. Document - Report, Paul Jerome, Advisory Committee on a Proposed Convenience Centre and an Alternative Shire Proposal - Eltham Gateway Community Precinct Concept Plan - 895 Main Road Eltham, October 1997
On 15 December 1994 the former Shire of Eltham ceased to exist following the Liberal Kennett Government local council amalgamations. A new Nillumbik Shire Council was established with unelected commissioners appointed. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. An Advisory Committee consisting of Dimitry Reed and Margaret Pitt was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. The Recommendations of the Advisory Committee were: i. The cafe and take away food premises are as of right uses and are therefore allowable, but that shop and petrol station are unacceptable uses. A community facility is a discretionary use and is acceptable. ii. A development of the type and scale proposed is totally inappropriate for this land and that the Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, café/takeaway food premises, a retail facility and a community facility, with associated advertising signs, be refused. iii. The land should be rezoned for public purposes and should remain in the community's ownership for community use. Following this, the Minister for Planning and Local Government, the Hon. Robert Maclellan, appointed Mr. Paul Jerome as an Advisory Committee under section 151 of the Planning and Environment Act 1987 to consider a Convenience Centre and an alternative proposal by Iha Shire of Nillumbik being the Eltham Gateway Community Precinct Concept Plan for the site of the former Shire of Eltham municipal offices at 895 Main Road, Eltham. In summary, the terms of reference for the Advisory Committee required it to: • consider the merits of the Council proposal • examine the merits of both proposals in terms of net community benefit • address the report of the previous Advisory Committee on the Convenience Centre proposal The Advisory Committee inspected the site and considered all the material before It including submissions made by all parties to the previous Advisory Committee and correspondence received by the Department of Infrastructure both before and after that Committee submltted its report. The Advisory Committee also held discussions with the following people: • Cr. Robert Marshall • Cr. Margaret Jennings • Cr. Lex de Man • Mr. Dallas Howgate of Dallas Price Properties, also Dallas Price Homes • Mr. Barry Rochford, CEO, Shire of Nillumbik • Ms. Yvonne Rust, Planning Officer, Shire of Nillumbik • Mr. Gregory Burgess, Architect of the Eltham Library and of Council’s Community Precinct Concept Plan • Mr. Jim Connor representing Mrs Thelma Barkway of the Eltham Senior Citizens Club Having considered all the material before it, the Committee arrived at two basic conclusions. First, the DPP proposal should be rejected because, on its merits, It does not sufficiently satisfy the requirements of the planning scheme which is a statutory document. The planning scheme requires that, before making a decision on the permit applications for the DPP proposal, a range of matters must be considered. It follows that consideration of these matters should Influence the decision. These matters include local policies relating to character and amenity. In particular, these policies seek • to conserve and enhance the bushland/country atmosphere, artistic heritage and strong sense of community of the Eltham Town Centre by ensuring that the design and height of any new development is sympathetic to existing buildings • to achieve a pleasing physical environment within the Eltham Town Centre by encouraging a high standard of architecture and urban design • to encourage Improvement to pedestrian amenity through such facilities as open and shattered rest areas and meeting places, crossing facilities, pedestrian arcades, pedestrian links to car parks and pedestrian weather protection • to reduce conflict between vehicular traffic and pedestrian flows, and • to encourage pedestrian thoroughfares It is submitted, as set out In the main body of this report, that the DPP proposal fails substantially to meet these policies and In so doing does not merit the exercise of discretion In Its favour with the Issuing of a permit. This finding is not offset by the investment and employment attributes of the proposal. They do not override the need to comply with the planning scheme. Second, the Council proposal, on Its own merits, substantially meets all statutory requirements applicable to this site with a possible reservation about car parking and traffic management which need further definition and assessment as the concept is refined. The Council proposal, however, has a serious weakness in that Its financial viability has not been adequately tested. The Committee refers to 'financial' rather than 'commercial' viability in recognition that Council owns the land and may enter into a range of agreements and partnerships to realise its concept some of which may be truly commercial and some of which may involve an element of subsidy arising from Council's involvement as a public body acting on behalf of its community.
