The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. In 1868, with the laying of the foundation stone, a time capsule was placed containing four newspapers of the day (Saturday 25 January, 1868 - The Age, The Argus, The Sun and The Telegraph: St Kilda, Prahran and South Yarra Guardian), the first Annual report of the Victorian Asylum and School for the Blind (1867), 11 coins from the Victorian regency and an illustration of the proposed building at St Kilda Road. An undated note also describes a piece of parchment in the time capsule, which contained a list of names of committee members and relevant people involved in the construction of the building, such as Crouch & Wilson; however no image of this has been located. In 1991, this time capsule was opened as part of 125 year celebrations and the contents were put on display. The capsule was the size of a house brick and buried underneath the foundation stone. It was made of metal and had to be sawn open to reveal the contents. These images are of the items found inside the time capsule. Additionally there are low res images of these items plus some photographs taken on the day: Brian Howe, Minister for Health, holds the time capsule whilst Trent Willard and Janice Johns, current RVIB students, stand by during the raising ceremony; Miss Molly Miller, the oldest surviving student, and Mr Percy Raufer, great grand nephew of Mary-Ann Raufer who was pupil number 6 and enrolled in the school in January 29th, 1866 look at the items found in the time capsule. Speakers were the President of the Conference and Rev J W Grove, Rev T C Rentoul, Mr J W Kitto and Rev R Williams. Handwritten notes, with typed copy, on the chimneys of some of Bendigo's mines. Some were designed on Cleopatra's Needle which is situated on the Thames Embankment in London. Others had flags, horizontal bands, letters or initials in coloured bricks. The 180 mine stack had a pyramid built on the top with a hole on each side placed there as vents for the smoke which issued from them according to the wind. Today none of these chimneys remain. John Hastie Engineer and millwright John Hastie opened small manufacturing works in Greenock in 1845 and 1853 patented the first self-holding steering gear. The firm became known as John, Hastie and Co. Ltd. in 1898 after taking on limited liability status and their main works were at Kilblain Street, Greenock, where they specialised in ships' steering gear. The company also occupied works at Rue End Street, Greenock. Plans of this unit depict a stockyard to the east, with areas for welding; fitting and assembly; flame, cutting and fabrication; and a machine bay. The company was dissolved in 1991. Brown Brothers Brown Bros Rosebank Ironworks made the steering gears for many large ship's, including The Titanic. Andrew Betts Brown the founder was born in 1741 and closely associated with many improvements in marine engineering. He was educated in his native city and served his apprenticeship as an engineer in the locomotive works of the North British Railway Company at St. Margaret's. During his apprenticeship, he attended the evening classes at Watt College. subsequently going to Manchester to study chemistry. He went to London around 1863 and took over an old brewery, which he converted into an engineering works. During his time there he invented an overhead travelling crane, which was used on the construction of Blackfriars Bridge London. He went on to develop plant which used steam and hydraulic power for discharging ships as a result the company was contracted to install this equipment in Hamburg Docks. ​ By around 1870 he continued to construct machinery in London but realised that conditions were more favourable in Edinburgh. He acquired land at Rosebank adjoining the North British Railway Company's line to Granton, and the necessary infrastructure was completed allowing him to finish the Hamburg contract. The works at Rosebank were eventually extended and added to until they became one of the largest engineering works in the East of Scotland. ​ Mr Brown was a member of numerous engineering institutions, the best known at the time being the Institution of Naval Architects. He was also a Fellow of the Royal Society of Edinburgh, a member of the Institute of Mechanical Engineers and of the Institution of Marine Engineers he died in 1906 at the age of 67.An item made by two marine innovators of marine auxiliary machinery, equipment and itemsShip's wheel, brass, attached to brass pillar. Hilary Bennet Mason (born 25/12/1911 in North Melbourne; died 16/3/2008) married Olive Marjory Muridge (B 20/7/1915; D 26/9/2001) on 30 September 1940. They has one daughter, born in 1947. Hilary had a number of occupations in his lifetime. His daughter referred to him as a tram conductor. The family lived at 7 Charles Street, Surrey Hills from c1960, having purchased it from William Stanton (Stan) Philp, a baker, and his wife Eileen. The title originally extended over 2 plots. The Philps sub-divided the land and built a new house for themselves at No 9. No 7 Charles Street had a well under the kitchen window; the house was extended in 1971/72; it was sold after Hilary Mason died in 2011. [REF: Personal communication from the donor; Alan Holt property register and online research.] The handwritten timeline refers to the area having been "called Irish Town as Catholic's were in the majority." Most of the writing is that of Hilary Mason, although some blanks have been filled in by another (unknown) hand. There is also an entry by John Whitford, who moved into a new home on the corner of Charles and Arthur Streets in 1982. The last entry is dated June 1996, when Hilary Mason would have been c 85 years old. Comment in relation to this catalogue entry: "One of the occupation that Mr Mason had was a Radio shop in Bridge Road, Richmond, called Mason's Radio. I worked for Mason's Radio in January 1963 to December 1964. Mr. Mason was a true gentleman, very kind and treated me like a son. Regards M.Zammit." Memories of other residents of the street are recorded.
