This ledger contains material from the legal firm of Mackay and Taylor for the period 1931 to 1946. The material includes receipts, letters and typed summaries concerning the wills and property of Warrnambool and district residents at that time. Scottish-born George Mackay established a legal practice in Kepler Street, Warrnambool in 1891 and in 1893 he bought the next-door practice of the late James Fletcher, with the business then known as Fletcher and Mackay. In the 1920s John Taylor became a partner with Mackay under the name of Mackay and Taylor (later Mackay Taylor). In 1999 Taits Solicitors of Warrnambool merged with Mackay Taylor to form Tait Taylor. Today this business is known as Taits Legal. This ledger is of some importance as it contains much historical information (wills, deeds, property ownership etc) on Warrnambool and district residents in the 1930s and 40s. It will be very useful to researchers.This is a ledger with a black cardboard cover and red binding on the spine. The binding has broken and the covers and sections of the pages are detached. The cover is much stained and rubbed. The pages have been printed with red and blue lines but these have not been used. Instead a variety of letters, receipts and typed material have been pasted onto the pages. This is a receipt book issued by the Warrnambool Harbour Board to masters of ships that took on fresh water in Warrnambool Harbour. The Port of Warrnambool was administered by various bodies since the early 1850s with Harbour Masters, Pilots, Boatmen and Customs officials appointed by the Colonial Government. In those times these officials were responsible to the Chief Harbour Master and the Ports and Harbours Department in Melbourne but over the ensuing years the Port of Warrnambool came under different colonial and State Departments and the titles of the harbour officials in Warrnambool changed accordingly. In 1928 the Warrnambool Harbour Board was formed with Captain James Menzies as the Warrnambool Harbour Master. This Board was dissolved in 1937 and Captain Menzies was transferred to Portland where he stayed until 1945. Warrnambool ceased to operate as a port in the early 1940s. This receipt is of maritime interest. The book records the names of several ships in Warrnambool from 1927 to 1937, including the ‘Casino’, ‘Chillagoe’, the dredge ‘Pioneer’, and ‘Kapera’. This is a receipt book used by the Warrnambool Harbour Board. The book has mostly the pink copy of the receipt issued but there are a couple of the original receipts still intact. The receipt book has been printed and the details on the receipts have been handwritten in ink. Establishment and Functions Prior to 1860, the Chief Secretary's Department had been responsible for the administration of the gold fields and associated mining activities. In November 1860 a Commissioner of Mines was appointed and a Department was established under his administration. For the period November 1861 to June 1863, the Postmaster General was responsible for the Mining Department. A Minister of Mines was again appointed in 1863. Responsibilities of the Department of Mines were: 1. Regulation of mining and related public works activities through the issue of miners rights, business and residence licences, mining leases, mineral and other prospecting licences 2. Superintendence of the activities of mining surveyors, registrars, wardens and Mining Boards. 3. Investigation of the state's geological structure, mineral wealth and underground water resources 4. Development of the mining industry 5. Supervision of the safe working of mines, machinery and quarries including checking the credential of mine managers, inspectors and operators 6. Regulation of the disposal of sludge and other waste products 7. Administration of the Victorian Mining Accident Relief Fund. Arising from its initial responsibility for the supply of water on the gold fields, the Department became responsible for rural water supply from the mid 1860s. Statutory responsibility for rural water works during this period rested with the Board of Land and Works. In 1865 the Waterworks Act gave the Board power to construct waterworks, purchase land, levy charges and lease or sell works, while the Public Loans Act 1865 empowered it to provide loans to local water trusts for waterworks. The actual administration of these statutory provisions was undertaken by the Victorian Water Supply Department which operated from 1865 to 1889 as a sub-department of the Department of Mines, from 1889 as a department in its own right, and from 1895 to 1909 as a sub-department of the Department of Mines and Water Supply. For a brief period from 1891 to 1893 the Department of Mines was also responsible for forests and, until 1880, for the Schools of Mines subsequently transferred to the Education Department. In 1895 the Department of Mines and the Victorian Water Supply Department were amalgamated to form the Department of Mines and Water Supply. This bank deposit book was used for financial deposits made between1932 and 1936. The funds were deposited into the Emergency Account of the Warrnambool Harbour Board, lodged at the Warrnambool Branch of the Commercial Banking Company of Sydney Limited (CBC). James Menzies, Pilot and Harbour Master from 1929, would have used this deposit book when he was appointed as Acting Secretary of the Warrnambool Harbour Board in 1932. He held this office until the Board ceased in 1936. Warrnambool’s CBC Manager during this time was L E Whitney; he was Manager from 1924 to 1939. The Commercial Banking Company of Sydney Limited opened in 1893. On January 1, 1927 the CBC amalgamated with the Bank of Victoria. In 1981 the CBC merged with the National Bank of Australasia Limited and on January 1, 1983 the bank started using the abbreviated name of the National Australia Bank (NAB). Warrnambool Harbour Board The Warrnambool Harbour Board was constituted by Order of Council on May 29, 1928, under the Harbour Board’s Act of 1927, taking over from the Ports and Harbours Branch of the Public Works Department of Victoria. The Board was then the only body with power to manage and control the whole Port, including shipping, facilities upkeep and improvements of the port. The work it carried out involved dredging, building of port facilities and drafting of port regulations, and collecting taxes, tolls, rates and charges. The Board was officially dissolved on June 30, 1936, at which time the Public Works Department again had control. The Warrnambool Harbour Board had rented out the Lighthouse Keeper’s Quarters from the 1920s until 1936, when the Board closed down. However, rentals continued with other currently unknown landlords until Flagstaff Hill Maritime Village opened in 1975 and began renovating the Cottage, in stages. This financial record book is significant for its association with the historic financial records of the Warrnambool Harbour Board and relates to the maritime history of Warrnambool, in particular with the Port of Warrnambool.Warrnambool Harbour Board Emergency Account Book containing deposit receipts and blank forms for the Commercial Banking Company of Sydney Limited. Rectangular book has buff coloured card covers, white pages with pre-printed text and lines and black tape binding on left side. Inscriptions stamped on front cover, receipts and unused, pre-printed pages. Approximately half of the pages have been filled in, and the deposit slips removed, leaving the receipt end attached to the book. There are two lose receipts stapled into the book. Hand written receipts date from 21 JAN 1932 to 25 JULY 1936. Stamped "WARRNAMBOOL HARBOUR BOARD / EMERGENCY ACCOUNT" "WARRNAMBOOL VIC" "EMERGENCY ACCOUNT / WARRNAMBOOL HARBOUR BOARD" Also, each receipt has the bank's stamp with its details and the date on it. Interpreting from the details that can be read it is believed that on 6/3/1912 Mr. M. Norton paid by cheque the sum of 5 Pounds 19 Shillings and 5 Pence, of which 5 Pounds 3 Shillings and 11 Pence was for a Summons possibly issued on 23/2/1912, while 15 Shillings and 6 Pence was the charge for the costs of the Summons. This is not a document issued by a Court of Law so use of the word 'Summons' is confusing to us at this stage. Was it just standard practice to send out a bill and call it a Summons, or was Mr. Norton late in paying and so had to pay an extra charge after being 'summoned' a second time. Could this receipt be part of a 'promissory note' exchange, payment for which had to be summoned? Another thing that can't be explained at this stage is the use of the symbol % after the amount of money written in figures, just after the Pence amount. The symbol for Pence in those days, and until decimal currency, was d as can be seen from the Duty Stamp. In 1912 and before did % also stand for Pence when the money amount was written by hand, or could it have been a shorthand way of indicating something like 'portion of amount'? This receipt is very intriguing and so we will endeavour to try to fully understand the information it contains. If any person can provide information that may assist us, then please contact the Sunshine & District Historical Society. The receipt is significant to our Society because it was issued by Sunshine Harvester / Hugh V. McKay more than 100 years ago. It also appears to contain information that at this stage is not fully understood, such as the use of the % sign, and why the word summons is used. Of further interest, but perhaps not surprising for the times, is that only Mr. is printed on the receipt. It appears that they never expected to issue these type of receipts to females.Very light tan coloured paper receipt No.1773 issued on 6/3/1912 by Sunshine Harvester / Hugh V. McKay to Mr M. Norton. The receipt has fire damage on the left side and so some details are missing. Details are hand written in ink in the spaces provided.
