This painting was presented to the library in December 1930. The painting had been paid for through subscription from Judges of the High Court, the Supreme Court and the County Court as well as both branches of the legal profession. An almost identical portrait is held by both the Melbourne Cricket Club and the National Gallery of Victoria. This portrait is of interest for its subject and artist. Sir Leo Cussen (1859-1933) is probably best known for his role in two consolidations of the Victorian Statute books in 1915 and the mid 1920s. These were immense undertakings and included determining the application of English Law in Victoria. Sir Leo was appointed at Surpem Court Judge in 1906, he was at various times Acting Chief Justice of the Supreme Court of Victoria. In addition, he was trustee of both the Art Gallery (NGV) and the Melbourne Cricket Club, and held various positions with the Melbourne University Law Faculty and the Council of Legal Education. Sir Leo was regarded as one of the finest legal minds of his generation and at his death, Robert Menzies, at this time the Attorney General, said that Sir Leo was "one of the great lawyers of the english speaking world". Sir John Longstaff was one of Australia's best known and well regarded portraitist in the early 20th Century, he won the Archibald prize five times (1925, 1928, 1929, 1931 and 1935).3/4 Lenght portrait in Oils of Sir Leo Cussen, a judge of the Supreme Court, 1906-1933. Book, Bridge and how to play it, 1901
This book belonged to the Warrnambool solicitor, Con O’Mahony (1863-1920). In 1883, he won the University of Melbourne Bowen Prize for his essay on the Federation of the Australian colonies. His prize, ten volumes of the ‘Lives of the Chancellors’, is today in the possession of the Warrnambool and District Historical Society. O’Mahony had a legal practice in Warrnambool in the Royal Chambers in Kepler Street at the end of the 19th century and the beginning of the 20th century. He was initially in a partnership with Messrs E.W. Klingender and Murray, then ,when this partnership was dissolved, he continued the business under the name of O’Mahony and later O’Mahony and Murray. He was actively involved in the management of the Warrnambool Mechanics’ Institute and was a member of the Warrnambool Hospital committee. The item here described shows O’Mahony’s interest in bridge-playing, a popular pastime at that time. This book is of some significance as it belonged to Con O’Mahony, a well-known lawyer in Warrnambool in the early 1900s. It also shows the interest in bridge-playing as a pastime during that period. This is a small hard cover book of 112 pages. It was published in 1901(eighth edition) and contains seven chapters on how to play bridge, a scoring table and an index. The last three pages are advertisements for other books on bridge. The cover is yellow with the title of the book, the author’s name and the publisher on the front cover contained within a scroll pattern with four coloured images of the four kings from a pack of cards. The back cover has a list of the British Chess Handbooks published by George Routledge & Sons Ltd. This booklet gives the Rules and Regulations and the Scale of Fees for the Warrnambool General Cemetery as from 1902. The booklet rescinded the Rules and Regulations of 1855 and amongst the 1902 Rules it is noted that no catacombs or wooden structures were allowed by the Trustees. It was also noted that no child under ten was permitted into the cemetery grounds unless under adult supervision. The charge for an adult burial was £1 and ten shillings for a child under ten. The Warrnambool Cemetery is in Otway Road, Warrnambool and was first gazetted in 1853 with Mr Whittet as the first Sexton. This booklet is of considerable interest because it gives the Rules and Regulations and the Scale of Charges of the Warrnambool General Cemetery as laid down in 1902. The Trustees at the time were William Ardlie, a prominent Warrnambool lawyer, Samuel Nettleton, a well-known Warrnambool shopkeeper and J.H.Allan, a member of a pioneering family in the Warrnambool district. This is a small booklet containing the Rules and Regulations of the Warrnambool General Cemetery. It contains four double-sided pages with printed material on all of the pages. The cover is pale yellow and the printing on the front cover has a black edging. There is some silverfish damage on the page edges. Book, Speaking Personally - W Murdoch, 1887/1888
These two important books are part of a series produced in the 1880s but they have widely-different content. One describes the natural history of the Parish of Selborne in the County of Hampshire in England. It was written by the British naturalist and ornithologist, Gilbert White and first published in 1789. Since that time it has been republished over 300 times right up to the present day. It is notable for its charm and simplicity and for its description of a pre-industrial England. The other is by the American author, Walt Whitman, first published in 1871. It is a major work of comparative politics and expounds on the influence of the Louisiana Purchase and the expansion of the American spirit and character. It also denounces the post-Civil War materialism that had spread at that time in America. These books are of interest because of their antiquarian nature but they are mostly of local Warrnambool interest because of their inscriptions. The books belonged to William Hugh McMahon (1862-1936). William McMahon commenced a legal practice in Warrnambool in 1894, firstly in Liebig Street and later in Kepler Street. He was a prominent lawyer in Warrnambool for 30 years and a staunch adherent of the Presbyterian Church. He and his family lived at ‘Glenrye’ at the corner of Ardlie Street and Botanic Road, a site where the St. John of God Hospital was later established. These two accompanying volumes are in the Camelot Series (1887 and 1888). They are hard cover books with red covers and two ornamental patterns on the front cover (stylized urn and fan shapes). The urn pattern is repeated on the spines. ‘The Natural History of Selborne’ has 366 pages (a Preface and Chapters on the Natural History of Selborne, a Naturalist’s Calendar and Observations on Various Branches of Natural History) and ‘Democratic Vistas’ has 175 pages (a Preface and 12 Chapters). The latter has the remains of a label stuck to the front cover. This item is a souvenir of the Bi- Centenary of Australia (1988) It features the new Parliament House in Canberra which was opened in May 1988 and cost more than one billion dollars to build and contains four thousand seven hundred rooms. This item came from the estate of a well known Warrnambool lawyer and is retained as a high quality souvenir of the Bi-Centenary of AustraliaCircular ceramic plate. This book, a de-luxe copy, was given to John Dwyer as the Chief President of the Australian Natives Association from 1938 to 1940. The Australian Natives Association (A.N.A.) was established in Melbourne in 1871 as a benefit society. Originally membership was restricted to white men born in Australia. The A.N.A. was influential in Australian politics, especially in the 1890s when it campaigned vigorously for Federation. In 1993 it merged with Manchester Unity I.O.O.F. to form Australia Unity, for many years the largest benefit society in Australia. The annual Victorian Conference of A.N.A was held in Warrnambool in 1931. John Beynon Dwyer (1904-1999) came to Warrnambool in 1937 and assumed control of the legal practice in Kepler Street of Desmond Dunne, retiring in 1984. J. B. Dwyer was a long-serving City Councillor (1937-1975) and was awarded an O.B.E. for municipal service in 1966. This book is of considerable importance as it was a presentation copy given to John B. Dwyer, a prominent Warrnambool lawyer, when he retired as Chief President of the Australian Natives Association in 1940. This is a soft-cover book of 92 pages. It is a de-luxe edition with a green leather cover with gold printing on the front. The inside of the covers has a green and yellow mottled pattern The leather on the spine is very worn and the book’s cover is scuffed. There are some insert title pages in yellow and blue thick card. Certificate, George Mackay, 1886
This is an 1886 certificate admitting George Mackay to practise as an attorney, solicitor and proctor in the courts of the colony of Victoria. George Sutherland Mackay (1850-1926) was born in Scotland and educated at the University of Glasgow. He came to Australia in 1884. In 1891 he came to Warrnambool and established a legal practice in Kepler Street. In 1893 he bought the practice of the late James Fletcher and the firm was then known as Fletcher and Mackay. It changed to Mackay and Taylor (later Mackay Taylor) when J.D. Taylor became his partner in the 1920s. In 1999 Tait Solicitors and Mackay Taylor amalgamated to form Tait Taylor and in 2010 the firm’s name became Tait Legal. This certificate is of considerable importance as a significant memento of George Mackay, a prominent lawyer in Warrnambool from the 1890s to 1926.This is a paper certificate pasted on board and set into a brown cardboard frame. The certificate has brown or gold handwriting with some calligraphy, three or four stamps (mostly obliterated), a green duty stamp and the remains of a signature. Victoria the Golden, Strutt, William 1825-1915, Victoria the golden : scenes, sketches, and jottings from nature, 1850-1862, c.1895
"Victoria the Golden" documents life in Victoria between 1850 and 1862 as viewed by artist William Strutt. Momentous events in the Colony’s history such as Separation Day (1 July 1851), the sitting of the first Legislative Council (13 November 1851), the death of Burke (June 1861) and the Black Thursday bushfires (6 February 1851) are depicted. In 1907 the Premier of Victoria Thomas Bent purchased "Victoria the Golden" from Strutt for £120 and presented it to the Library. The album depicts events in chronological order with what Strutt considered “fidelity to nature and accuracy”, so that present day Victorians may view the sketches “as records of what we may now look upon as the dim past in the rapidly progressive history of Victoria”. Victoria the Golden is celebrated as one of the Parliament’s great treasures. It is a testament to William Strutt’s skill as a draughtsman and contains over 100 assorted images which were executed between the years of 1850-1862. Strutt’s particular talent was to be able to step back and record each event with particular care to detail. Many of the pieces contained within this album are littered with notes, such as the correct resting position of a corporal’s sword or details about the cloth and cut of a subject’s jacket. Strutt also notes in one of his many sketches of the new Legislative Council chamber at Spring Street that the President, Sir James Palmer, is seated ‘a little too high’ (page 30). Throughout the album, Strutt’s illustrations bring to life the diverse nature and peoples of the new colony. His range of subjects is comprehensive and includes parliamentarians, lawyers, wives and daughters, merchants, labourers, police and military officers, indigenous communities, farmers, miners, prisoners and explorers. The everyday and the extraordinary are depicted with each turn of the page. 44 leaves heavy card, approximately 1mm thick. Sketches, watercolours and prints of varying sizes and papers are glued onto the pages. Full leather binding in blue leather with title and decorative border in gold. There are four raised bands on the spine, with gold decoration on the bands and at the head and tail of the spine. Marbled end papers and flyleaves. Gold on the edges of the book block. Card pages have a sheet of mottled blue paper on recto. Album leaf connection is a guarded system with stiff stubs and cloth hinges. Each page has a sheet of glassine paper attached at the binding edge to protect the images. Many pages stamped with "Parliament of Victoria" verso. Printed in gold, recto: "VICTORIA THE GOLDEN/ SCENES,/ SKETCHES,/ AND JOTTINGS FROM NATURE./ BY/ Wm.
