Supreme Court of Victoria Library
Portrait, Sir Leo Cussen, 1930
This painting was presented to the library in December 1930. The painting had been paid for through subscription from Judges of the High Court, the Supreme Court and the County Court as well as both branches of the legal profession. An almost identical portrait is held by both the Melbourne Cricket Club and the National Gallery of Victoria. This portrait is of interest for its subject and artist. Sir Leo Cussen (1859-1933) is probably best known for his role in two consolidations of the Victorian Statute books in 1915 and the mid 1920s. These were immense undertakings and included determining the application of English Law in Victoria. Sir Leo was appointed at Surpem Court Judge in 1906, he was at various times Acting Chief Justice of the Supreme Court of Victoria. In addition, he was trustee of both the Art Gallery (NGV) and the Melbourne Cricket Club, and held various positions with the Melbourne University Law Faculty and the Council of Legal Education. Sir Leo was regarded as one of the finest legal minds of his generation and at his death, Robert Menzies, at this time the Attorney General, said that Sir Leo was "one of the great lawyers of the english speaking world". Sir John Longstaff was one of Australia's best known and well regarded portraitist in the early 20th Century, he won the Archibald prize five times (1925, 1928, 1929, 1931 and 1935).3/4 Lenght portrait in Oils of Sir Leo Cussen, a judge of the Supreme Court, 1906-1933. Document - George Murray Letters of Administration 1883, 1885
No information is available on George Murray except that he was a Melbourne accountant and died intestate in 1885. He left property to the value of £91 and the lawyer, Ernest Chambers, who was at that time at 12 Chancery Lane, Melbourne, was directed to list the creditors of George Murray and distribute the estate accordingly. Mr Chambers was one of George Murray’s creditors. Ernest Chambers later had a legal practice with offices at Warrnambool, Koroit and Port Fairy with the known dates 1897 to 1910. Thomas Goodall was the manager of the Warrnambool office and he was the one who had this document in his possession at that time and it was passed down to succeeding lawyers in the Kepler Street building. Tait collection: item 7 of 62This document is of interest in that it was originally issued by the lawyer Ernest Chambers who later had an office in Warrnambool. This is a piece of parchment containing the 1885 Letters of Administration in the estate of George Murray, a Melbourne accountant. The document is white with black ruled lines and has handwritten material in black ink. The document is folded at the lower edge with a seal of the Supreme Court of the Colony of Victoria. The seal is attached to the document by a green ribbon. There is also a blue stamp of the Master in Equity of the Supreme Court. The document is in good condition apart from some minor staining. ‘In the Supreme Court of the Colony of Victoria in its probate jurisdiction, in the Estate of George Murray, late of Melbourne in the Colony of Victoria, accountant, deceased intestate, Letters of Administration, I certify that no duty is payable on the within Letters of Administration, John W. … (office under section 6), 15/6/85’. george murray, ernest chambers, warrnambool -

Document, Bachelders Anglo American Chemist, 1880s
These three programmes are advertising brochures for the entertainment of R.G. Bachelder’s Anglo-American Christy Minstrels. R.G. Bachelder was an American minstrel performer and showman. He and his company toured Australia in the 1870s and 1880s and for a time his partner was Horace Bent, regarded at the time as Australia’s greatest comedian. The three programmes date from the early 1880s, with the date of Programme One being 1882. The three programmes appear to feature only males with the man attractions being the African- American comedians, Sam Keenan and Alf Moynham and the singer, Beaumont Read. The latter was an American singer and songwriter and is regarded in some circles as the greatest male alto singer ever to appear on the Australian stage. He settled in Australia for a time. Other performers included W. Ball, C.S. Fredericks and T. Bergin. These three programmes are of considerable significance because they are original advertising brochures for Bachelder’s Anglo-American Christy Minstrels, a prominent entertainment company touring Australia in the second half of the 19th century. The items are also of significance because one of them is the brochure for a local Warrnambool concert held in the month of August in the Orderly Room in Kepler Street, Warrnambool This concert was a benefit for the famous alto singer Beaumont Read and was listed as the last performance of the company so it probably can be dated 1883. These are three original programmes for Bachelder’s Anglo-American Christy Minstrels. They date from the early 1880s. Programme One is a yellow sheet with black print and an ornamental border, Programme Two is a faded white sheet with black print and Programme Three is a white/cream sheet with black print and an ornamental border. The three items are somewhat tattered. r.g.bachelder, beaumont read, entertainment in warrnambool, 19th century entertainment in australia -

Document, Docket Dr Bright's Phosphodyne, Mid 19th century
This label accompanied a bottle of Dr Bright’s Phosphodyne. It was a form of medicine also known as ozonic oxygen which was developed and patented in 1869 by Dr Charles Bright, a 19th century Resident Surgeon at St Mary’s Hospital London, The medicine claimed to ease ‘indigestion, liver complaints, nervous debility, female complaints, premature decline, local weakness and spermatorrhea’. It was widely sold by chemists throughout Australia in the 19th century and in this case was supplied by the Warrnambool chemist, James Astley Bromfield. He was a significant person in Warrnambool’s history as he produced the 1856 map of the Warrnambool district showing all the original landholders, a seminal resource for historians today. Bromfield had a chemist shop in Warrnambool from 1854 to the late 1880s, initially in Timor Street and then in Liebig Street (number 80 and later number 78). Bromfield was very active in local community affairs. This label is of considerable interest as it shows the use in the 19th century of medicine that today would be labelled ‘quack’. It is of particular interest as it was supplied by James Astley Bromfield’s chemist shop and he is an important early identity in Warrnambool, involved in many activities in the town. He was a Justice of the Peace, a Trustee of the Savings Bank, Chairman of the Western Steam Navigation Company, a Director of the Gasworks and on the committees of the Harbour Committee, the Fire Brigade and the Anglers Protection Society. He was a Warrnambool Councillor (1858-60; 1865-1870) and a Shire Councillor (1875-1883). This is a sheet of paper that accompanied a bottle of Dr Brights’ Phosphodyne medicine. It is buff-coloured with black printed material. It is in two pieces and dog-eared at the edges.warrnambool, dr bright's phosphodyne, james bromfield chemist, warrnambool chemists -

Aeroplane Seat, C 1916
This is the seat from the aeroplane of Basil Watson. Photographs held by the Warrnambool and District Historical Society confirm that this was Watson’s aeroplane seat. He was a pioneer aviator who had built his own plane which was 5.5 metres long with a wingspan of 8 metres. It had a 7-cylinder 50 HP rotary Gnome engine. Basil Watson flew this aircraft to Warrnambool in January 1917, becoming the first person to fly to Warrnambool, coming from Point Cook in one hour 55 minutes – an Australian cross-country flying record at that time. Watson amazed Warrnambool crowds with his dare-devil flying, looping the loop 14 times over the Warrnambool racecourse. He also brought with him the first aerial post to arrive in Warrnambool and the Warrnambool and District Historical Society has the letter he brought written by the Lord Mayor of Melbourne to the Mayor of Warrnambool. Two months after he was in Warrnambool Basil Watson was killed when his plane crashed near Point Cook in March 1917. Parts of the plane were salvaged and the seat was donated to the old Warrnambool Museum in 1918. It remained there until the museum was dismantled in the early 1960s and it was later passed over to the Warrnambool and District Historical Society. The tag on the seat today is an old Warrnambool Museum label. This is a most significant item as it is the original seat from the aeroplane of Basil Watson, an important early aviator in Australia’s history and it is also an early 20th century memento of the many treasures from the old Warrnambool Museum (1883-1963). The seat shows the primitive nature of early 20th century aeroplanes in Australia. This is a metal (galvanized iron) seat with a semi-circular base and a curved back stretching around from one end of the base to the other end. The back has a rolled metal edging on the base and the top. On the sides are two slots with a khaki-coloured cloth strap passing through the slots. This strap has a metal buckle at the end. The metal in the seat is somewhat blotched and discoloured. A luggage label is tied to one of the slots and has a name typed on it.Mr Watsonbasil watson, aviator, old warrnambool museum, history of warrnambool -

Relates to a series of 5 photos:P000094-P000098 of the front of the Bridge Hotel on the corner of Murray esplanade and Hopwood gardens. These photos, taken about 1976, were before the Port Restoration Scheme renovated the hotel. The Bridge Hotel was built by Henry Hopwood in 1858. This and the Bond Store were Echuca's first 2 brick buildings. Named from Hopwood's nearby pontoon bridge. The building was bought be The Council in 1970. Restored and reopened in 1975.The Bridge Hotel is an important part of Echuca's settlement and development. It was originally built by Henry Hopwood, the European founder of Echuca, in 1859. Hopwood built the hotel to provide accommodation to people using his punts across the Campaspe and Murray rivers that area central to the landscape of the Port. The hotel was situated on the land between both rivers and punts and provided for a variety of levels of accommodation from grand rooms to very basic rooms. At the time of the photos the hotel was 120 years old and became an important part of the Port of Echuca tourism. Mary Shillinglaw born November 5, 1880 at Bundoora, Victoria was the sixth child of Phillip Shillinglaw and Sarah Ann (nee Kidd). She commenced school at Eltham State School No. 209 (Register No. 423) in 1885 at age 4 years. Mary did not marry and spent most of her life at Wattle Brae (Shillinglaw Cottage). In his Will, Phillip Shillinglaw provided that any of his unwed sisters would be able to live at Wattle Brae, rent free. When Eltham Shire Council aquired the property in 1963 to build new Shire Offices, both Mary and her sister Lizzie (also unmarried) were still living at the cottage. Council paid for the women to relocate. Mary moved to Elizabeth House, a nursing home in Ivanhoe but found it very hard to adapt to her new surroundings and living consdtions. She died there only a few months after departing Eltham on October 29, 1963 at age 83 years. Flagstaff Hill Maritime Museum and Village
Book, Young J. Pentland, Manual of Practical Anatomy, Vol. I. Upper Limb, Lower Limb, Abdomen, 1893
This book was used by Dr Angus when studying at Adelaide University. It was donated to Flagstaff Hill Maritime Village by the family of Doctor William Roy Angus, Surgeon and Oculist. It is part of the “W.R. Angus Collection” that includes historical medical equipment, surgical instruments and material once belonging to Dr Edward Ryan and Dr Thomas Francis Ryan, (both of Nhill, Victoria) as well as Dr Angus’ own belongings. The Collection’s history spans the medical practices of the two Doctors Ryan, from 1885-1926 plus that of Dr Angus, up until 1969. ABOUT THE “W.R.ANGUS COLLECTION” Doctor William Roy Angus M.B., B.S., Adel., 1923, F.R.C.S. Edin.,1928 (also known as Dr Roy Angus) was born in Murrumbeena, Victoria in 1901 and lived until 1970. He qualified as a doctor in 1923 at University of Adelaide, was Resident Medical Officer at the Royal Adelaide Hospital in 1924 and for a period was house surgeon to Sir (then Mr.) Henry Simpson Newland. Dr Angus was briefly an Assistant to Dr Riddell of Kapunda, then commenced private practice at Curramulka, Yorke Peninsula, SA, where he was physician, surgeon and chemist. In 1926, he was appointed as new Medical Assistant to Dr Thomas Francis Ryan (T.F. Ryan, or Tom), in Nhill, Victoria, where his experiences included radiology and pharmacy. In 1927 he was Acting House Surgeon in Dr Tom Ryan’s absence. Dr Angus had become engaged to Gladys Forsyth and they decided he would take time to further his studies overseas in the UK in 1927. He studied at London University College Hospital and at Edinburgh Royal Infirmary and in 1928, was awarded FRCS (Fellow from the Royal College of Surgeons), Edinburgh. He worked his passage back to Australia as a Ship’s Surgeon on the on the Australian Commonwealth Line’s SS Largs Bay. Dr Angus married Gladys in 1929, in Ballarat. (They went on to have one son (Graham 1932, born in SA) and two daughters (Helen (died 12/07/1996) and Berenice (Berry), both born at Mira, Nhill ) Dr Angus was a ‘flying doctor’ for the A.I.M. (Australian Inland Ministry) Aerial Medical Service in 1928 . The organisation began in South Australia through the Presbyterian Church in that year, with its first station being in the remote town of Oodnadatta, where Dr Angus was stationed. He was locum tenens there on North-South Railway at 21 Mile Camp. He took up this ‘flying doctor’ position in response to a call from Dr John Flynn; the organisation was later known as the Flying Doctor Service, then the Royal Flying Doctor Service. A lot of his work during this time involved dental surgery also. Between 1928-1932 he was surgeon at the Curramulka Hospital, Yorke Peninsula, South Australia. In 1933 Dr Angus returned to Nhill where he’d previously worked as Medical Assistant and purchased a share of the Nelson Street practice and Mira hospital from Dr Les Middleton one of the Middleton Brothers, the current owners of what was once Dr Tom Ryan’s practice. Dr L Middleton was House Surgeon to the Nhill Hospital 1926-1933, when he resigned. [Dr Tom Ryan’s practice had originally belonged to his older brother Dr Edward Ryan, who came to Nhill in 1885. Dr Edward saw patients at his rooms, firstly in Victoria Street and in 1886 in Nelson Street, until 1901. The Nelson Street practice also had a 2 bed ward, called Mira Private Hospital ). Dr Edward Ryan was House Surgeon at the Nhill Hospital 1884-1902 . He also had occasions where he successfully performed veterinary surgery for the local farmers too. Dr Tom Ryan then purchased the practice from his brother in 1901. Both Dr Edward and Dr Tom Ryan work as surgeons included eye surgery. Dr Tom Ryan performed many of his operations in the Mira private hospital on his premises. He too was House Surgeon at the Nhill Hospital 1902-1926. Dr Tom Ryan had one of the only two pieces of radiology equipment in Victoria during his practicing years – The Royal Melbourne Hospital had the other one. Over the years Dr Tom Ryan gradually set up what was effectively a training school for country general-practitioner-surgeons. Each patient was carefully examined, including using the X-ray machine, and any surgery was discussed and planned with Dr Ryan’s assistants several days in advance. Dr Angus gained experience in using the X-ray machine there during his time as assistant to Dr Ryan. Dr Tom Ryan moved from Nhill in 1926. He became a Fellow of the Royal Australasian College of Surgeons in 1927, soon after its formation, a rare accolade for a doctor outside any of the major cities. He remained a bachelor and died suddenly on 7th Dec 1955, aged 91, at his home in Ararat. Scholarships and prizes are still awarded to medical students in the honour of Dr T.F. Ryan and his father, Dr Michael Ryan, and brother, John Patrick Ryan. ] When Dr Angus bought into the Nelson Street premises in Nhill he was also appointed as the Nhill Hospital’s Honorary House Surgeon 1933-1938. His practitioner’s plate from his Nhill surgery states “HOURS Daily, except Tuesdays, Fridays and Saturday afternoons, 9-10am, 2-4pm, 7-8pm. Sundays by appointment”. This plate is now mounted on the doorway to the Port Medical Office at Flagstaff Hill Maritime Village, Warrnambool. Dr Edward Ryan and Dr Tom Ryan had an extensive collection of historical medical equipment and materials spanning 1884-1926 and when Dr Angus took up practice in their old premises he obtained this collection, a large part of which is now on display at the Port Medical Office at Flagstaff Hill Maritime Village in Warrnambool. During his time in Nhill Dr Angus was involved in the merging of the Mira Hospital and Nhill Public Hospital into one public hospital and the property titles passed on to Nhill Hospital in 1939. In 1939 Dr Angus and his family moved to Warrnambool where he purchased “Birchwood,” the 1852 home and medical practice of Dr John Hunter Henderson, at 214 Koroit Street. (This property was sold in1965 to the State Government and is now the site of the Warrnambool Police Station. ). The Angus family was able to afford gardeners, cooks and maids; their home was a popular place for visiting dignitaries to stay whilst visiting Warrnambool. Dr Angus had his own silk worm farm at home in a Mulberry tree. His young daughter used his centrifuge for spinning the silk. Dr Angus was appointed on a part-time basis as Port Medical Officer (Health Officer) in Warrnambool and held this position until the 1940’s when the government no longer required the service of a Port Medical Officer in Warrnambool; he was thus Warrnambool’s last serving Port Medical Officer. (The duties of a Port Medical Officer were outlined by the Colonial Secretary on 21st June, 1839 under the terms of the Quarantine Act. Masters of immigrant ships arriving in port reported incidents of diseases, illness and death and the Port Medical Officer made a decision on whether the ship required Quarantine and for how long, in this way preventing contagious illness from spreading from new immigrants to the residents already in the colony.) Dr Angus was a member of the Australian Medical Association, for 35 years and surgeon at the Warrnambool Base Hospital 1939-1942, He served as a Surgeon Captain during WWII1942-45, in Ballarat, Victoria, and in Bonegilla, N.S.W., completing his service just before the end of the war due to suffering from a heart attack. During his convalescence he carved an intricate and ‘most artistic’ chess set from the material that dentures were made from. He then studied ophthalmology at the Royal Melbourne Eye and Ear Hospital and created cosmetically superior artificial eyes by pioneering using the intrascleral cartilage. Angus received accolades from the Ophthalmological Society of Australasia for this work. He returned to Warrnambool to commence practice as an ophthalmologist, pioneering in artificial eye improvements. He was Honorary Consultant Ophthalmologist to Warrnambool Base Hospital for 31 years. He made monthly visits to Portland as a visiting surgeon, to perform eye surgery. He represented the Victorian South-West subdivision of the Australian Medical Association as its secretary between 1949 and 1956 and as chairman from 1956 to 1958. In 1968 Dr Angus was elected member of Spain’s Barraquer Institute of Barcelona after his research work in Intrasclearal cartilage grafting, becoming one of the few Australian ophthalmologists to receive this honour, and in the following year presented his final paper on Living Intrasclearal Cartilage Implants at the Inaugural Meeting of the Australian College of Ophthalmologists in Melbourne In his personal life Dr Angus was a Presbyterian and treated Sunday as a Sabbath, a day of rest. He would visit 3 or 4 country patients on a Sunday, taking his children along ‘for the ride’ and to visit with him. Sunday evenings he would play the pianola and sing Scottish songs to his family. One of Dr Angus’ patients was Margaret MacKenzie, author of a book on local shipwrecks that she’d seen as an eye witness from the late 1880’s in Peterborough, Victoria. In the early 1950’s Dr Angus, painted a picture of a shipwreck for the cover jacket of Margaret’s book, Shipwrecks and More Shipwrecks. She was blind in later life and her daughter wrote the actual book for her. Dr Angus and his wife Gladys were very involved in Warrnambool’s society with a strong interest in civic affairs. Their interests included organisations such as Red Cross, Rostrum, Warrnambool and District Historical Society (founding members), Wine and Food Society, Steering Committee for Tertiary Education in Warrnambool, Local National Trust, Good Neighbour Council, Housing Commission Advisory Board, United Services Institute, Legion of Ex-Servicemen, Olympic Pool Committee, Food for Britain Organisation, Warrnambool Hospital, Anti-Cancer Council, Boys’ Club, Charitable Council, National Fitness Council and Air Raid Precautions Group. He was also a member of the Steam Preservation Society and derived much pleasure from a steam traction engine on his farm. He had an interest in people and the community He and his wife Gladys were both involved in the creation of Flagstaff Hill, including the layout of the gardens. After his death (28th March 1970) his family requested his practitioner’s plate, medical instruments and some personal belongings be displayed in the Port Medical Office surgery at Flagstaff Hill Maritime Village, and be called the “W. R. Angus Collection”. The W.R. Angus Collection is significant for still being located at the site it is connected with, Doctor Angus being the last Port Medical Officer in Warrnambool. The collection of medical instruments and other equipment is culturally significant, being an historical example of medicine from late 19th to mid-20th century. Dr Angus assisted Dr Tom Ryan, a pioneer in the use of X-rays and in ocular surgery. Manual of Practical Anatomy, Vol. I. Upper Limb, Lower Limb, Abdomen, D.J. Cunningham, Pub 1893,Young J. Model ship, Cutty Stark
The last remaining and most famous of all the clipper ships, Cutty Stark, is today preserved for posterity in a dry dock in Greenwich, UK. Launched in November 1869 at Dumbarton on Clyde she was considered the fastest ship of the day. Designed and constructed by Hercules Linton and William D Scott, she was built to carry tea from China and beat the Thermopylae. Her fastest recorded speed was 12.5 knots by sailing 363 miles in 24 hours. The dimensions of both ships were very similar: length 64.7m (212 feet), Beam 11 =m (36 feet), Depth of hold 6.4m (21 feet). Tonnage: Cutty Stark: 921, Thermopyalae 948. With many centuries of shipbuilding it was difficult to find good oak in England. The oak frames occupied excessive space in the cargo hold. A composite building technique was sued with the hull being made out of wooded panelled iron frames. Cutty stark was built with an elm keel and teak planking. Her last passage carrying tea was in 1877. in 1895 she was sold to a Portuguese owner. in 1883, the Cutty Stark joined the Australian wool trade, loaning wool from ports, including Melbourne, bound for the UKLarge model of the Cutty Stark in a "Handcrafted/ Mr Robert McFeeters/ Vermont 19"98" "Display Case/ Mr Ivan Nemanic/ Montrose 1990" "Cutty Stark/ Buil 1869/ Glasgow/ -

"Charles E. Turner was an artist who exhibited at the Royal Academy in London, and specialised in landscape and marine views. Having served in the Royal Air Force in the First World War, reaching the rank of Captain, Turner worked as a war artist during 1939-45. Turner painted pictures of the Queen Mary and Queen Elizabeth for Cunard, which were made into a series of popular postcards. He also designed for Churchill Cigar Boxes, and, alongside paintings demonstrating his first-hand experience of combat, produced illustrations for Illustrated London News and Sphere magazines. Many of his oil and watercolour paintings of the two World Wars are preserved in the collection of the National Maritime Museum, London, and at the Imperial War Museum, London." Red Ensign, Surgeons' Banner, 1850 (estimated)
Red Ensign 1801 design. - The British red ensign was altered in 1801 to include the change to the design of the Union Jack. British legislation required, with a few exceptions, that all merchant shipping throughout the British Empire fly the British Red Ensign, without any defacement or modification. The ensign is sometimes referred to as the red duster. The Royal Navy stopped using the Red Ensign in 1864. This red ensign was used by the Surgeons of the Kyneton District Mounted Rifles to indicate their location. The Banner is a large red ensign mounted on a 10 foot long polished wooden pike. The Banner was used by the Kyneton District Mounted Rifles, later The Royal Volunteer Cavalry Regiment (Prince of Wales Hussars), then Prince of Wales Victorian Light Horse, ancestor units of the modern day 4th /19th Prince of Wales’s Light Horse Regiment. In the binding is the inscription ‘Kyneton Prince of Wales Light Horse’ and three names: Surg-Major S Smith MRSLE, Dr McMillan, and Maj Thirkettle. These surgeons played a significant role in the military and civil affairs of Kyneton. Dr McMillan Dr McMillan was the first surgeon but left KPWLH 2-3 months after its formation and little else is known of him. Surgeon-Major Samuel Smith 1836 Born, Scotland 1857 Surgeon to the Hon. Hudson Bay Company. Ship “Prince Arthur” from London to Moose Fort, Hudson Bay. June 13 – Aug. 24 1857. 1858 Appointed Medical Officer of large immigrant ship to Port Phillip 1859 Appointed Assistant District Coroner, Castlemaine 1859 Appointed to Castlemaine Hospital 1862 Appointed first resident surgeon and manager of Kyneton Hospital Foundation member of Kyneton District Mounted Rifles 1874 Appointed Surgeon-Major Kyneton Volunteer Prince of Wales Light Horse Conducted a private practice in Kyneton. 1909 Died 8 November 1909, aged 73 years Samuel Smith was a Life Governor of Castlemaine Benevolent Asylum, a member of St Andrews Presbyterian Church, a Mark Master Mason of the Edward Coulson Lodge No 17, Kyneton. He also had a notable collection of stuffed native birds and animals of which he had great knowledge. Major Thirkettle 1855 Major Thirkettle arrived in Kyneton Established a timber merchant and ironmongery business in Kyneton with Robert Burton. 1857 By 1857 he was practising as an architect. His house is still standing in Yaldwin St, West Kyneton. 1860 Joined the Prince of Wales Light Horse 1863 Joined Rifle Volunteers and appointed Captain. On their disbandment he was made Honorary Major. 1864 Won Queen’s prize for rifle shooting. Major Thirkettle was noted for his skill with woodwork. He won many prizes and orders of merit for his models of yachts It is believed likely that he made the wooden pike with its metal head (now missing). He was Tyler of the Zetland Lodge, also Secretary of the MUIOOF and Bowling Club. 1904 Died in Kyneton, aged 75 years Protection for medical services The Surgeons’ Banner indicated the location of the Regimental Aid Post. The use of this device in the 1860’s overlapped the adoption of the Red Cross which became the symbol for the protection of sick and wounded soldiers. In 1864 twelve European nations signed a treaty stating that in future wars they would care for all sick and wounded military personnel, regardless of nationality. They would also recognise the neutrality of medical personnel, hospitals and ambulances identified by the emblem of a red cross on a white background. The treaty was called the Geneva Convention. This Convention was concerned only with soldiers wounded on the battlefield. Over the years, however, it has been expanded to cover everyone caught up in conflicts but not actually taking an active part in the fighting. The Surgeons’ Banner complements the Colours of the Kyneton District Mounted Rifles, also held by the Unit History Room, in presenting the colonial period of the Regiment’s history. Provenance It is believed that the Banner was manufactured in Britain and brought to Australia by Samuel Smith. After the disbanding of Colonial units, the Banner was in the care of the Shire of Kyneton until presented to the 4/19 Prince of Wales’s Light Horse Regiment on 14 September 1986 on the occasion of the Regiment exercising its right of freedom of entry to the city. There are many examples of Regimental and King’s/Queen’s Colours held by various organisations. However A Surgeons’ Banner such as this is rare, if not unique, in Australia. Functional object - Spirit Level
This item was given to the Historical Society in 1972, with the donor indicating that the spirit level belonged to the Henty family. The Hentys of Portland are regarded as the first permanent settlers in the State of Victoria (1834). Stephen Henty, with his brother Edward, was involved in the whaling industry in Portland. He also had shipping interests, operating a regular Western District shipping service (‘Champion’, ‘Lady Bird’, ‘Western’, ‘Edina’ etc) and a property ‘Cadnook’, near Harrow. Stephen Henty had close connections with Warrnambool not only because of his shipping interests but also because he was the brother-in-law of an early Warrnambool Harbour Master, Captain Frank Helpman. A spirit level was an essential tool for early settlers as they often built their own homes and constructed the roads nearby, needing to ascertain if what was being constructed was on level ground. It does not seem possible to establish whether this item belonged to the Henty family or to a Henty property. But in the Historical Society collection we have a piece of sheet music which includes the handwriting ‘Mrs Smalpaige, Cadnook’, ‘S. J. Henty’ and the date ‘8th August 1859’. Also the Warrnambool Art Gallery has an authentic Henty piano dating from 1837 and Stephen Henty’s wife died in Hamilton in 1906 so it is possible that the spirit level came to us from a Henty family descendant living nearby via Mr N. Kelly. If the Henty provenance can be proved then this item is of high significance. This is an unvarnished wooden spirit level, apparently home made, with a bubble in the centre. The top has been attached with eight screws, now much rusted. There appears to be some letters in the bubble area but they have not been deciphered “Hentys spirit level, oldest in Australia” is written in ink on the back of the objectspirit level, henty brothers portland, warrnambool, henty family -

A black and white portrait of an unknown man taken by John William Lindt.A black and white portrait of an unknown man taken by John William Lindt. John William Lindt was born in Germany in 1845. At 17 he took a working passage to Australia on a Dutch sailing ship. Taking up work as an itinerant piano-tuner, he traveled amongst towns in Victoria and New South Wales before settling in Grafton in 1863 where he became assistant and apprentice to photographer Conrad Wagner. After a brief return to Germany in 1867 Lindt took over management of Wagner’s studio in 1869. He married Wagner’s daughter, Anna on 13 January 1872. Over 1873-1874, using the slow and laborious wet-plate collodion process, John Lindt produced photographs of the local indigenous people both in their environment conducting actual traditional ceremonies in the Clarence River district, and in his studio. Twelve of this series is included in his 1874 album Australian Aboriginals. John Lindt moved to Melbourne in 1876 where he worked for Batchelder & Co. before opening his own opulent studios at number 7 at the top of Collins Street opposite the Treasury, in 1877. John Lindt's business of this period was wide-ranging, and included portraits, records of Melbourne public buildings and streetscapes, the Botanical Gardens, and Port Melbourne. He was a welcome photographer of members of parliament and other Melbourne personalities, their society and cultural life including the theatre, and was known as a ‘rich man’s photographer’ for those whose families he grouped informally on the lawns in front of their mansions, with servants at the rails of the upstairs balconies. He continued with landscape, producing folios Fernshaw and Watt River Scenery, Victoria ( c.1878-82), Scenery on the Ovens and Buckland Rivers, Victoria (c.1878–82) and Lorne, Louttit Bay and Cape Otway Ranges (1883). Sales of his Black Spur scenery amounted to approximately 25,000 copies printed from the original negatives between 1882 and 1892.
