Ephemera - Business card - Koki Alpine Lodge, Falls Creek, Victoria, 1965
George Shirling arrived in Falls Creek in 1962. He engaged Phil Nowell to build the original Koki Alpine Lodge which opened in 1965 with 14 beds. George operated the lodge with Michael “Baldy” Blackwell as manager. He also graduated in sport psychology in 1981 and was invited to become team psychologist for the Australian Winter Olympic team which went to Albertville, France, in 1992. He later owned the Red Onion Chalet. George credited the success of Koki to “Baldy” Blackwell. “Baldy” and Phil Nowell started the Trackers Mountain Lodge in partnership during the 1980s. In 1971 George sold Koki Lodge to Sigh Doerr. Sigh was a long time resident of Falls Creek, owning and operating Koki Lodge for many years with his wife, Lee. He was Falls Creek CFA Captain from 1995 until 1998 although he served in the Fire Brigade for much longer. Sigh had many involvements in the community. In 2023 the renamed Koki Alpine resort remains a highly popular destination in Falls Creek operated by Doerr Nominees Pty. Order docket books used at Koki Fondue and Carvery Restaurant in Falls Creek during 1975. Shows menu items and price as well as how orders were taken. George Shirling arrived in Falls Creek in 1962. Medal - Australian Cross Country Ski Championships, 1991
This medal commemorates performance in the Australian Cross Country Ski Championships and was awarded to Diana Patterson. Diana Patterson was born in Tasmania and originally pursued a career as a physical education teacher. After making a major career change, she applied to join the Australian Antarctic Division. She applied four times before she was accepted. Diana first travelled to the Antarctic in October 1987. By this time only ten Australian women had spent a winter there. She first worked at Casey Station, before becoming leader at Mawson Station therein becoming the first female leader of an Antarctic base of any nation. After retiring Diana guided tourist expeditions to the Antarctic for many years, as well as continuing work in research and conservation. In 2012 she published her story “The Ice Beneath My Feet: My Year In Antarctica”. Diana Patterson was awarded the Medal of the Order of Australia (OAM) for "service to conservation and the environment”. As well as these outstanding career achievements, Diana has been a Board Member of both the Mt. Buller Alpine Resort Management Board, including a period as Chairman, and also the Falls Creek Resort Management Board. Uniform - Falls Creek Search and Rescue
The Falls Creek Search and Rescue Squad was formed in the mid 1970s. It was partly instigated by Rob Spargo whose family purchased the site where the Falls Creek Hotel is today. The family was instrumental in the establishment and growth of the Falls Creek community and were involved in the foundation of Falls Creek Primary School and Falls Creek Search & Rescue (now Falls Creek SES). Rob was also involved in the start-up of Ski Victoria and has served as a member the Chamber and Resort Management Board. The Falls Creek SES Unit was established in 1981 and includes several members who have served their community with VICSES for more than 30 years.This uniform patch represents an important safety organisation at Falls Creek.A cloth badge with metal studs at each corner. Document - S.E.C. Prepared To Deliver Briquettes To Falls Creek Lodges, 08.03.1961
Bob Hymans Collection Bob (Herman) Hymans (a former member of the Royal Netherlands Navy) was born in Bloemendaal, Holland on 30th September 1922. During World War II he fought against the Japanese in the Dutch East Indies (now Indonesia) and was imprisoned in Changi and on the Burma Railway. After gaining qualifications as a Ski Instructor, Bob arrived in Falls Creek in July 1950. Working as an Instructor and Supervisor at Bogong Lodge, Bob decided his future was in accommodation. He was successful in negotiating an indenture for land from the State Electricity Commission (SEC). It took Bob two years to build his Grand Coeur Chalet but, tragically, it was burned down in August 1961. Bob also built the first Chairlift in Australia. This was a single chairlift and the structure was built from wooden electricity poles. He was constantly full of new ideas and proposals for the village. Bob Hymans die on 7th July 2007. This Collection of documents and letters tells the story of Bob's endeavours to develop Falls Creek into the ski village it is today.This letter is significant because it documents the services supplied by the SEC to the community of Falls Creek.A notice outlining procedures lodgeholder should follow if they wish to access supplies of briquettes to be delivered to Falls Creek by the SEC.Lodgeholders were urged to attend to displays before the weather and access via road deteriorated.falls creek tourist area management committee, winter fuel supplies falls creek -

Photocopy of brief biographical notes in respect of the guest of honour, Colonel Sir Edward Dunlop at a Legacy meeting. Legatees met regularly and usually had guest speakers to entertain and inform on different subjects. This document was from a file of information about guest speakers (see also 00812-00822 and 00829-00837). The requirement to be a guest of honour at a Legacy meeting is highlighted in purple. It says: A Guest of honour shall be an individual who by reason of his services to the community and/or the ex-servicemen and his dependants, is unanimously deemed by the Board of Management to be worth of being so described". In this case Sir Edward (Weary) Dunlop was a speaker and his brief biography was included in this Bulletin.A record that the speakers at Legacy functions were from very different walks of life and the subects spoken on were many and varied. 'Home' is a symbol of hopes, dreams, comfort, love, family and future. It is both a place and an idea, nor does it remain in time and space. It can also represent a time of sadness , fear and loss. Through the roller-coaster of the past year, I have used a series of homes belonging to family and friends. Each artwork of home tells a different story about its occupants, their story, and what home mean to them. Sarah CANHAM Sarah has had a life-long love of creative arts and a passion for nature she has pursued in her career. She has a Bachelor Applied Science degree from Charles Sturt University, a Masters of Environment from University of Melbourne, and works in natural resource management and conservation. Studying part time Sarah Canham completed a Bachelor of Visual Arts at Federation University Arts Academy in 2021. Her art is an expression of the awe she has for the natural world, and concerns for the future, including for our indigenous culture, and native flora and fauna in Australia. Booklet - Recipe Book Wodonga District Hospital
The Wodonga Base Hospital was officially opened on 16th January 1954. The first public meeting to discuss plans for a hospital in the district was held on 28th June 1934, but the proposed Bush Nursing Hospital did not eventuate. In 1946 another push began and land on the current site in Vernon Street was set aside. After a lengthy period of fundraising by the local community the hospital was finally realised. By 1975 the Hospital had become increasingly busy with the accommodation having increased to 68 beds, equipment being updated and a range of ancillary services extended. Between 1954 and 1974, the hospital had admitted 41,944 patients and babies born in the hospital totalled 3,996. Extensions to the Hospital were urgently needed to meet the demand on the facilities. The Victorian Government had approved the extensions and provided funds of $772,000. The Committee of Management needed to meet the cost of furnishings and equipment. Once again the Wodonga community were called upon to support their Hospital. This photograph was taken on the 20th June 2004 as part of an event called "Successful Tree Planting!", organised by the Wooragee Landcare Group. It was addressed to all local residents and landholders in the area and involved practical demonstration of techniques suitable for successful planting of native trees and shrubs, as well as information about weed control. In the photograph are illustrated from left to right the following people: Chris Robinson; Tony Prowse; unknown child; Lesley Finedon; Ann Henderson, unknown. Revegetation can improve the condition of remnant vegetation in the area and provide habitat for local animals. Correct species selection, including all layers of vegetation, along with proper weather conditions and adequate site preparation, can maximise the successful outcome. Weed-free conditions and protection from rabbits and kangaroos are two more factors contributing to a quick plant growth. Wooragee Landcare, since its establishment in 1998, has organised a series of events and activities in order to promote weed and pest control, provide assistance and knowledge to landholders and ensure sustainability and protection of natural vegetation. This photograph was taken on the 3rd April 2004 as part of an event called "Spotlight on Fox", organised by the Wooragee Landcare Group. It was addressed to all landholders in the area and involved practical demonstration of techniques suitable for integrated fox control. Camille Velesky, who is illustrated in the photograph, was the presenter; he is a specialist in fox behaviour and has worked for 27 years on pest control. Under the Catchment and Land Protection Act 1994 (CaLP Act) foxes are declared as established pest animals and landowners have the responsibility to take reasonable steps to protect their land from established pest animals. The most commonly used management techniques are baiting, shooting, guard animals, fencing, trapping, canid pest ejectors, above-ground harbour removal, property hygiene and fumigation. Trapping, due to the significant suffering and distress that causes to foxes, has significant animal welfare implications and should be avoided if there is another suitable alternative. The photograph is an example of the type of events and activities organised by Wooragee Landcare to educate and inform local residents and landholders on the most suitable techniques for integrated fox control. The purpose of the excursion was to look at land use on small farms. As part of this, the excursion included a visit to Samaria Farm, run by Sue and Don Matheson. In this photo, taken at Samaria Farm, Don Matheson is discussing the management of his commercial rose garden. Events like this meet Wooragee Landcare's organisational goals of promoting best land management practices, cooperating and engaging with landowners, and providing information on plant management and care. The event was about looking at land use on small farms and as a social get-together for the Group. Wooragee Landcare was also researching how small landholders could run some enterprises around the time of this trip. Samaria Farm is located in northeast Victoria, near Mount Samaria, which is located 130 km northeast of Melbourne. Samaria Farm was owned by Sue and Due Matheson at the time of the trip and had a renowned rose garden, pigs, poultry, alpacas, and goats on their nine-hectare farm. The rose garden consists of 3000 damask roses. Samaria Farm distils the oil from these roses and is the only farm in Australia to do this. Rose oil has historically been used for religious and medical use. 20 kg of rose buds are picked by hand every day, which is then distilled and produced 5 to 8 ml of oil. The entire four-week season produces 80 to 100 ml of oil. Rose water is also created during this process and produces about 300 litres per season. Along with the oil, the Farm also harvests lemons, lime, olives, and oranges. The Farm is currently owned by Utako and Anthony since 2022, with Vicki and Allan Wight being the previous owners. Wooragee Landcare Group was created in 1988. Its core mission is to work towards eradicating animals and pests from the land to protect the natural vegetation and promote revegetation projects. This photograph is a great example of the type of events that Wooragee Landcare Group has organized, while educating the public about the importance of land use management. ... framework of promoting best land management practices for all types ...This photograph was taken at Samaria Farm on Sunday the 5th of September when Wooragee Landcare Group took a bus trip to the Tatong area (near Benalla) to look at land use on small farms. The day trip was organised to observe land use on small farms as well as a social event for the Group. Samaria Farm at the time was a nine-hectare property located in northeast Victoria, near Mount Samaria, 130 km Northeast of Melbourne. The photograph features several pigs believed to be the breed called Large Black. The Large Black Pig breed is a traditional, heritage breed that was first imported to Australia from the UK in the early 1900's. It is believed to have originated from the Old English Hog of the 16th and 17th Centuries. The first reference to them in the Australian Pure Bred Pig Herd Book was in 1912. They are a black pig with lop ears and were prized for their superior milking and mothering abilities and soon became popular with early Dairy Farmers who fed them whey from separated milk as part of their butter making process. They proved economical to keep and, being excellent grazing pigs, were also used to pick up windfall fruit in orchards. Their black colouring also enabled them to withstand the hot Australian summers and avoid sunburn which combined with their hardiness and docile temperament made them highly suitable for free-range pork production, however Large Black pigs tend to get very fat and were not suitable for intensive farming so were often crossed with other breeds for pork production. They are now quite rare as a pure breed having been on the edge of extinction for some time. They were rescued in the early 1990s by a rare breeds farmer in the Yarra Ranges. These days they are also the focus of a small conversation effort with six registered breeders currently in Australia. For biosecurity reasons there are no imports of live pigs or pig semen permitted into Australia. This photograph shows a group of people attending one of the events that Wooragee Landcare Group has organized within the educational framework of promoting best land management practices for all types of land uses and ensuring sustainability, in addition to encouraging community interaction via social events. The Large Black pig breed is significant because of their role in early Victorian farming. They are now quite rare as a pure breed having been on the edge of extinction for some time. These days they are the focus of a small conversation effort with six registered breeders currently in Australia. Frustrated by the lack of support from the agencies that were designed to help them and community attitudes, the group sought to increase representation at agencies management, employment opportunities, accessible information, participation in decisions and change perception of how they should live their lives. Photograph - Axtrack oversnow vehicle Falls Creek Hotel
This vehicle, an Axtrack is located outside the Falls Creek Museum. It was built by Axel Andre who worked in Falls Creek as a mechanic for several years in the early 1970s. Axel was an engineer by trade. He built this small twin track vehicle for Ivan Spargo at the Falls Creek Hotel and then progressed to building bigger and better models. This included one for Ziggy Doer at Koki and Neville Mashford at Snowland purchased two of them. Some of these machines were also exported to America. Axel Andre later established a company Axtrack Engineering in Melbourne. There are still three of these Axtrack vehicles on the hill at Falls Creek in 2024. The vehicles were used for commercial purposes such as transporting supplies and staff around the mountain. The Spargo family from the Falls Creek Hotel used this vehicle for oversnow transport and it advertised Harvey Wallbanger Happy Hour. Ivan and Joy Spargo relocated from Melbourne to Falls Creek in 1965. They purchased a piece of leasehold land and built Spargo Lodge. This was a dorm style chalet built to accommodate large groups and families. Their son Rob Spargo met his future wife Blanche in 1967 when she was on holiday in Falls Creek. They married and purchased the site where the Falls Creek Hotel is today. The steep gradient of the site was a challenge to build on but was the best location available in the village. In 1970 Rob’s sister Leonie and her husband Glenn joined the business, and they started operating the hotel in 1972. The family played a critical role in the growth of the Falls Creek community and were involved in the foundation of Falls Creek Primary School and Falls Creek Search & Rescue. Rob was also involved in the start-up of Ski Victoria and has served as a member of the Chamber and Resort Management Board. Rob’s eldest daughter Lisa competed with the Australian Ski Team from 1985 to 1989 and has worked as a ski instructor in Australia, Austria & Colorado. In 2010 Lisa and her husband Damien Allport joined the family business and her parents retired to Tawonga South in 2014. Their children are now the fourth generation of the Spargo family living at Falls Creek enjoying the alpine lifestyle and providing outstanding hospitality. Wingrove Cottage built 1858-1859 of hand made bricks is historically significant for its long association with Charles Wingrove, a prominent figure in Victorian local government, as secretary to the Eltham District Road Board and Shire Council from 1858 to 1904, and Shire Engineer and Secretary to the Heidelberg Road Board. The cottage was used as the office of the Eltham District Road Board and Council for many years It is one of the Shire's oldest dwellings, and one of the few surviving 19th century buildings associated with early Eltham and located in the original Eltham Village Reserve. The symmetrical planting of a pair of Pencil Pines (not visible in photo) is also historically and aesthetically significant as characteristic of the early period of planting in the district and because they are a distinctive landscape feature. In October 2002 new owners demolished the outbuildings attached to the rear of the cottage. Community protest at the demolition resulted in Council issuing a Stop Work order. The owner was issued with a court order in September 2003 to develop a conservation management plan and restore the heritage listed property. The owner sold the property in 2005 to Cameron Construction in 2005 who undertook the restoration work. In 2007 a planning application to build two offices and seven dwellings at the rear of the property was ultimately rejected. The cottage is now the main office for Cameron Construction. Published: Nillumbik Now and Then / Marguerite Marshall 2008; photographs Alan King with Marguerite Marshall.; p57 Wingrove Cottage on Main Road beside Eltham Primary School, is one of the Shire’s most important historical buildings and was central to local government for almost 50 years. The cottage was built in stages from 1858 to 1888 for Charles Symons Wingrove JP. He was the Eltham District Road Board’s first paid secretary and later the Shire Secretary when the board became the Eltham Shire Council. Wingrove held those positions, and that of engineer for a time, for 46 years. He was also one of the main figures in the Municipal Association of Victoria. As Eltham’s first paid municipal officer, Wingrove used one room in his 11 – (originally two) roomed home, as the office for the board then the council. Meetings were held there from the late 1850s (as well as at more central locations) until Wingrove’s retirement in 1904. The cottage is a rare example of a local government office occupying a Road Board /Shire Secretary’s purpose-designed house. The cottage is also significant because it is the oldest largely intact building from the original Eltham township reserve (south of Dalton Street).1 The township had its origins in the 1848 Nillumbik Parish Plan and was one of the state’s earliest township reserves. The rectangular house of handmade bricks, roofed with grey slate tiles and with a veranda encompassing three sides, is reminiscent of those in the central goldfields including Castlemaine. Its overhanging eaves and gables were unlike houses in Melbourne at the time. Wingrove, who was born in 1827, had been a gold digger and a road surveyor. Impossible to imagine in today’s world, Wingrove was also the Shire of Heidelberg’s secretary and engineer for part of the time that he was secretary in Eltham. Living next door to the primary school was a mixed blessing. Wingrove and his wife Katherine, who had ten children, sent their eight surviving children to the school. But they had occasional disputes with the school authorities when their cattle wandered into the schoolyard. Eltham showed Charles Wingrove its appreciation of his services by giving him two illuminated addresses, one after ten years and the other at retirement. Wingrove died in 1905 aged 76 and was buried in the St Katherine’s Church of England cemetery in St Helena. His grave is surrounded by those of family members including his wife, Katherine and two babies, Henry, 12 months and Isobella, 15 months, who died in the mid-1860s. Cottage ownership passed to his wife, then to daughter Caroline and then to daughter Bessie, a Melbourne University graduate and artist. During the Great Depression their brother Walter was the ratepayer. At one stage the Wingrove property extended to Metery Road and included a small creek. The family ran a small dairy and orchard, with associated farm buildings, which were later removed. In 1949 part of the property was compulsorily acquired by the Eltham Primary School, which infuriated owner Bessie Wingrove. She protested in a letter about this ‘monstrous act of unmitigated tyranny’.2 She was the last Wingrove to occupy the cottage and died in 1955. Wingrove descendants sold the house in 1974 and the property was subdivided. In the 1960s the Eltham Shire named the park opposite the cottage in Wingrove’s honour. The cottage has since had several owners including psychiatrist Dr Daniel Kahans, who practised there. In October 2002 late rear additions which had been substantially altered were demolished contrary to council planning controls. This caused a community outcry and resulted in legal proceedings against the owner. Fortunately the historical significance of the demolished section was not as great as the older front part of the building, which has been retained and was later restored.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. St Margaret’s Church of England was officially opened on December 12, 1861. It is the oldest intact church building in Eltham. At the time it was known as Christ Church until its consecration in 1871, when it was completely free of debt (£1,700 for the church and parsonage) despite the district’s poverty. This was largely due to the free labour and materials, including locally made bricks donated by local artisans and others. The church is historically significant because it is the oldest church in the former Shire of Eltham and has associations with the philanthropist and founder of Brighton, Henry Dendy (who donated the land on which the church is built), the architect Nathaniel Billing and the prominent local builder, George Stebbing. The church is architecturally and aesthetically significant because it is constructed in the Gothic Revival style with several stained-glass windows of various dates and is also a very early use of polychromatic brickwork in Victoria. Billing was one of the first Melbourne architects to employ polychromatic brickwork and an important early architect. The rear wall was intended to be temporary. A major feature of the design is the large buttresses with long, steeply graded upper faces. The overall design is well proportioned with the surface brick patterns relieving an otherwise austere design. The church is spiritually and socially significant because it has been an important place of worship for the people of Eltham for almost 150 years. The land on which the buildings stand was donated by Henry Dendy. Dendy arrived in Melbourne in 1841 after purchasing in England eight square miles at Brighton under the system of "special surveys". After this land passed out of his hands, Dendy moved about Victoria, visited England, then returned to settle in Eltham where he purchased a flour mill. Dendy chaired the meeting held in 1860 “for the purpose of devising such means as may be expedient for the establishment of a Church of England in the township of Eltham”. He became chairman and treasurer of the church committee. Unlike the establishment of many early churches in Victoria where a vicar was appointed to a parish and later a permanent church was constructed, the population at Eltham initiated action to build a church. The nearest church at that time was at Heidelberg and the Eltham settlement was part of the parish of St Johns Heidelberg. Isolation and the tedious, time consuming journey between Heidelberg and Eltham resulted in the Eltham community taking its own action. The original vicarage (Dendy House) at the rear of the church is also an important part of the cultural significance of this place because it is connected to the church and the development of the Eltham area. Together, the church and the vicarage are aesthetically significant because they form a significant streetscape feature. The mud-brick community hall designed by Robert Marshall was added in 1978. In 2014 the original temporary rear wall was removed as part of a modern extension designed by Architects Atelier Wagner and constructed by Conrad Construction and Management. The church and vicarage are on the Register of the Heritage Council of Victoria and the National Trust of Australia – Victoria. The church is important as an early example of polychrome brickwork by the notable architect Nathaniel Billings. It is also notable for its historic associations with the early settlement of the Shire of Eltham and its connection with Henry Dendy, Brighton’s founder.2 Henry Dendy, who lived in Eltham much longer than at Brighton, chaired the original meeting which planned the church, and he donated the half-acre (0.2ha) site. Dendy had arrived in Melbourne in 1841 after buying eight square miles (20.7sq km) at Brighton while in England. After this land passed out of his hands, he eventually settled in Eltham where he bought a flour mill, west from the corner of Main Road and Pitt Street (then called Brewery Lane). The vicarage was named Dendy House after him. The Eltham settlers were unusual in initiating the establishment of a church. Usually in Victoria a vicar was appointed to a parish and then a permanent church was constructed. But then, the nearest church was at Heidelberg, which was a tedious and time-consuming journey. St Margaret’s builder was a local, George Stebbing, who also constructed the former Methodist, later Uniting, Church at John Street and the Shillinglaw Cottage near Eltham’s Central Park. It is believed the first Anglican Bishop of Melbourne, Bishop Perry, dedicated the church. After the ceremony he joined in the festivities at the nearby pub and a bill was sent to the parish for teas taken there by the bishop with other participants. The first vicar was the Reverend Robert Mackie from 1864 to1866. St Margaret’s Church was originally called Christ Church until its consecration in 1871, when it was completely free of debt (£1700 pounds for the church and parsonage) despite the district’s poverty. This was largely due to the free labour and materials, including local bricks, donated by local artisans and others. St Margaret’s Church is in the Gothic Revival tradition with a buttressed nave, paired lancet windows, porch and bell-cote. It was the first polychromatic brick church in Australia, using softly contrasting coloured brickwork.3 Billing was one of the first architects to introduce polychrome brickwork into Melbourne. His original drawings for St Margaret’s survive in a folio of his architectural work. However the church’s brickwork is more subdued than in his drawings. About half the windows – those in clear glass with gold borders – are original. The stained glass windows were made much later, but the one behind the altar is thought to be the oldest in the Diamond Valley. It was to be temporary until the congregation could afford to extend the church. In the early 1960s the original cedar pews were replaced by blonde timber pews and the originals were sold to restaurants and to private individuals. Eminent local sculptor Matcham Skipper created a crucifix for the church. A major addition was made in 1978, when the weatherboard hall was replaced by a mud-brick hall. Made of local material, it was designed by local architect and a former shire president Robert Marshall. The mud-brick hall reflects the style of building in Eltham of the late 1970s and for which Eltham is well-known. Perhaps because its earthy tones blend with the surrounding environment, the hall sits well with the church building. St Margaret’s membership has included economist and ABC chairman, Richard Downing; political commentator, diplomat and academic, William Macmahon Ball; Eltham civic leader, Charles Wingrove; artist, Peter Glass; and Eltham’s first postmaster, Frederick Falkiner.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. On 15 December 1994 the former Shire of Eltham ceased to exist following the Liberal Kennett Government local council amalgamations. A new Nillumbik Shire Council was established with unelected commissioners appointed. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. An Advisory Committee consisting of Dimitry Reed and Margaret Pitt was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. The Recommendations of the Advisory Committee were: i. The cafe and take away food premises are as of right uses and are therefore allowable, but that shop and petrol station are unacceptable uses. A community facility is a discretionary use and is acceptable. ii. A development of the type and scale proposed is totally inappropriate for this land and that the Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, café/takeaway food premises, a retail facility and a community facility, with associated advertising signs, be refused. iii. The land should be rezoned for public purposes and should remain in the community's ownership for community use. Following this, the Minister for Planning and Local Government, the Hon. Robert Maclellan, appointed Mr. Paul Jerome as an Advisory Committee under section 151 of the Planning and Environment Act 1987 to consider a Convenience Centre and an alternative proposal by Iha Shire of Nillumbik being the Eltham Gateway Community Precinct Concept Plan for the site of the former Shire of Eltham municipal offices at 895 Main Road, Eltham. In summary, the terms of reference for the Advisory Committee required it to: • consider the merits of the Council proposal • examine the merits of both proposals in terms of net community benefit • address the report of the previous Advisory Committee on the Convenience Centre proposal The Advisory Committee inspected the site and considered all the material before It including submissions made by all parties to the previous Advisory Committee and correspondence received by the Department of Infrastructure both before and after that Committee submltted its report. The Advisory Committee also held discussions with the following people: • Cr. Robert Marshall • Cr. Margaret Jennings • Cr. Lex de Man • Mr. Dallas Howgate of Dallas Price Properties, also Dallas Price Homes • Mr. Barry Rochford, CEO, Shire of Nillumbik • Ms. Yvonne Rust, Planning Officer, Shire of Nillumbik • Mr. Gregory Burgess, Architect of the Eltham Library and of Council’s Community Precinct Concept Plan • Mr. Jim Connor representing Mrs Thelma Barkway of the Eltham Senior Citizens Club Having considered all the material before it, the Committee arrived at two basic conclusions. First, the DPP proposal should be rejected because, on its merits, It does not sufficiently satisfy the requirements of the planning scheme which is a statutory document. The planning scheme requires that, before making a decision on the permit applications for the DPP proposal, a range of matters must be considered. It follows that consideration of these matters should Influence the decision. These matters include local policies relating to character and amenity. In particular, these policies seek • to conserve and enhance the bushland/country atmosphere, artistic heritage and strong sense of community of the Eltham Town Centre by ensuring that the design and height of any new development is sympathetic to existing buildings • to achieve a pleasing physical environment within the Eltham Town Centre by encouraging a high standard of architecture and urban design • to encourage Improvement to pedestrian amenity through such facilities as open and shattered rest areas and meeting places, crossing facilities, pedestrian arcades, pedestrian links to car parks and pedestrian weather protection • to reduce conflict between vehicular traffic and pedestrian flows, and • to encourage pedestrian thoroughfares It is submitted, as set out In the main body of this report, that the DPP proposal fails substantially to meet these policies and In so doing does not merit the exercise of discretion In Its favour with the Issuing of a permit. This finding is not offset by the investment and employment attributes of the proposal. They do not override the need to comply with the planning scheme. Second, the Council proposal, on Its own merits, substantially meets all statutory requirements applicable to this site with a possible reservation about car parking and traffic management which need further definition and assessment as the concept is refined. The Council proposal, however, has a serious weakness in that Its financial viability has not been adequately tested. The Committee refers to 'financial' rather than 'commercial' viability in recognition that Council owns the land and may enter into a range of agreements and partnerships to realise its concept some of which may be truly commercial and some of which may involve an element of subsidy arising from Council's involvement as a public body acting on behalf of its community.
