The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. A photo of Legacy President Neville visiting group of young legatees at a gymnastics class in Footscray. There are 12 boys, of various ages, in gymnastics gear, some holding books or certificates. Legacy clubs ran classes for junior legatees for many years. It was part of providing for the children of their deceased comrades. The skills they learned were show cased in an annual demonstration usually at the Melbourne Town Hall. It appears to be photo taken professionally, as there are several photos of different classes (see 00862 - 00867) perhaps to record Legacy classes for promotion purposes. Many were published in the September 1953 newsletter. The Parade Commander was CO LTCOL Don Swiney MBE, and the Reviewing Officer was the Colonel Commandant (honorary appointment) of the Survey Corps - COL Clem Sargent (Retd). The Corps Day Parade was held to commemorate the 72nd anniversary of the formation of the Royal Australian Survey Corps. This photograph shows Nelson Burn reading a telegram from the queen to his grandmother, Mrs Paul Hocking, on her 100th birthday. Her husband, James Hocking, was the first watchmaker in Orbost. He had been a lay preacher at Wangaratta and Yan Yean before coming to Orbost. He was an 1891 Rechabite and an Orbost Shire Councillor. Eliza Ann Hocking (nee Eddy) was born on 16.7.1856 at Blackwater Hall in England, She had arrived in Australia on the sailing boat "Poocia" on 8-7-1880. The voyage following the Cape route took about 7 weeks. For a time, with her husband, she lived at Chewton, on the gold fields, before coming to Orbost. She was a foundation member of the Methodist Ladies’ Guild in 1912. She lived in Salisbury Street, Orbost. She died on 9.4.1957. Colin Nelson Burn, born 7.7.1921, was her grandson, son of Robert Alfred Burn and Edith Jane Hocking. He began Sta-Brite' Painting and Decorating Services in Salisbury Street, Orbost. He served in the forces during World War II. He was a Life member of the Snowy Rovers Football Club. He joined the Orbost Fire Brigade on 1-5-1946. He died 1.2.2015. This is a set of 36 photographs taken at the combined Officer, Warrant Officer and Sergeant’s Mess Summer Ball held at the Army Survey Regiment (ASR), Fortuna Villa on the 25th of February 1995. The Summer Ball was one of the last large scale formal functions held at Fortuna Villa before ASR’s closure the following year. Photos of personnel and their guests was taken on their arrival near the Pompeii Fountain in the gardens at the front of the main building. The Ball and Dinner was held at the rear of Fortuna Villa in temporary 20’ x 30’ Army tents set up on the roadway in front of the transport compound. SERCO contract staff provided the catering and the ASR’s Other Ranks performed stewarding and kitchen hand duties. This photograph of Prime Minister Hon RJ Hawke’s visit to the Army Survey Regiment was taken at Fortuna, Bendigo in March 1990. This occasion was one of several events held to commemorate the 75th anniversary of the formation of the Royal Australian Survey Corps. The one-hour visit was a rare opportunity for RA Svy to demonstrate to its Prime Minister the unit’s important role as Defence’s map production agency, its technical equipment, and its economic importance to Bendigo. It was also an opportunity to take him through historic Fortuna Villa. This occasion is covered in more detail in page 143 of Valerie Lovejoy’s book 'Mapmakers of Fortuna – A history of the Army Survey Regiment’ ISBN: 0-646-42120-4. A small card at the back of the picture reads,’ This Picture was a teaching aid used in St. John’s Kinderg S.S and was found in the Church Ruins after the fire in July 1920 by Nancy McC(Absalom). Later framed by Grandma. St. John’s Presbyterian Church was built in 1875 and was burned down July 21st 1920. A volunteer fireman Mr T Spicer discovered the fire and despite the prompt arrival of the fire brigade, after an hour only the walls and tower remained. Some items were salvaged including vestry furnishings and church register. A bible which had been given to the Church in 1895 was rescued by an unknown young man whose identity remained a mystery until1976 when a Mr Stan Williams of Ballarat told his story. The Church was rebuilt in 1922. The event of this fire remains one of the most significant in the history of Warrnambool. Framed print of kookaburra on branch in natural setting.
