This property, a house and shop in Sussex Street next to the Shire Hall, had formerly been owned by her father, Thomas Austin, who was forced to sell it after being declared insolvent. Jane Austin mortgaged the property for £20 in 1878. When Thomas Austin left Linton in 1882, his daughter sold the property to Benjamin Dodd, who in turn sold it in 1887 to John Angus.Approximately A3-size sheet of blue paper which has been folded twice. Printed and handwritten documentation of the 'Equitable Mortgage' arrangement entered into by Jane Graham Austin with the Bank of New South Wales in December 1878. The release of the mortgage, in October 1882, is also documented. This ledger appears to have been a mortgage document held by the law ...This ledger appears to have been a mortgage document held by the law firm of Mackay Taylor and Co. with the evidence for this the presence of two loose sheets of paper in the ledger with that firm’s letterhead. Mackay Taylor was established in 1893 with the merger of the firms of George Sutherland Mackay and James Fletcher, independent practising lawyers at the time. The new firm became Fletcher and Mackay and later changed to Mackay and Taylor when J. McD. Taylor became a partner in the 1920s and the business was at 131 Kepler Street, with a new building erected in the late 1920s. The legal business closed in the 1990s with the mortgage section of the firm becoming Mackay Taylor Securities in 1990 (later Southern Securities). The ledger was recovered when the building was being cleared out and Percy Eccles, a real estate agent, handed it to the Warrnambool and District Historical SocietyThis ledger has considerable significance as an example of a law firm’s business activities in the mid 20th century. Document - Charles Spencer Letters of Administration 1898, 1899
Tait collection: item 47 of 62 This is a document giving details of the Will and Letters of Administration following the death in 1895 of Charles Spencer of Brooklands, Birchanger, Essex, England. It is not known why the document has been drawn up in Melbourne and also makes reference to Warrnambool lawyers but it is presumed that some or all of the beneficiaries of the will lived in the Warrnambool district at the time. Charles Spencer left personal estate to the value of £689 to his wife, Emily, and children. Mentioned in the document are the lawyers J.S.Tait and Henry Parrington who were partners in a law firm in Warrnambool at the end of the 19th century (going under the name of Higgins and Parrington). The document has been passed down to successive lawyers occupying legal premises in Kepler Street and it was located in this building in 2014. The Letters of Administration for this estate was granted to Henry Parrington. The personal estate comprised £689 which had been lent to Spencer Smith on the security of land in the Parish of Wangoom, County of Villiers the repayment of which is secured by an indenture of mortgage dated 1st June 1892. [Ref: PROV. VPRS28/P0002, 73/750 Charles Spencer Grant of Administration] This document has no known local relevance except for the involvement of two Warrnambool 19th century lawyers. Further investigation has shown the personal estate mentioned in this will comprised £689 as a mortgage secured loan to a local resident, Spencer Smith.This is a cream-coloured piece of parchment paper folded in two and containing handwritten material on four pages which have black ruled lines on the edges. The 1899 document gives details of the Will and Letters of Administration of Charles Spencer, of Brooklands, Birchanger, in the County of Essex in England. The blue seal of the Supreme Court of Victoria is attached with a green ribbon and there are two red stamps of the Master in Equity of the Supreme Court. Document, Indenture A Bostock Esquire to Messrs Aitkin & Bostock( Ernest), 1865
The Bostock, Manifold and Aitkin families were all pioneering families in the Western District of Victoria almost from the time of settlement. They leased and owned vast tracts of land and operated businesses around the district, often associated with the farming industry. This document is dated 5th July 1865 and is an assignment of stock by way of mortgage. Augustus Bostock is the mortgagor with James William Manifold Aitkin and Ernest Bostock as mortgagees. At various times they were involved in running businesses together, in particular the Aitkin and Bostock store and flour mill. Three of the Bostock men were married to three of the Aitkin sisters. The amount in question is £2157/3/2 and surety is 8000 sheep and their increase, presently running at Coomete. The penciled in details on the document refer to Robert Brand Paterson who was later in business with Aitkin This is one of a number of documents which relate to the Bostock family who were one of the most important pioneering families of the Western District. They owned and leased various properties around Warrnambool and were involved in many aspects of social and business life. The document itself is indicative of its time and provides an insight into the details and terms of such documents at the time.Large grey coloured, lined hand written document over four pages. Augustus Bostock was the 9th child of Robert & Rachael Bostock of Vaucluse Epping Forest, Van Diemen’s Land. He was only 4 years old when his mother died. He was inspired by his father to seek his fortune in the Western District of Victoria. He arrived around 1850. He married Margaret Aitkin in July 1865. Augustus owned several properties in the district and leased others. He sat on the court of Warrnambool, Mortlake or Hexham as required. He resided at Marramook in Hawkesdale and later moved to Vaucluse in Hopetoun Road Warrnambool, where he died in 1920 at the age of 87. He was involved in many aspects of life in the Western District, racing, cricket, and social activities to name a few. This letter is written from Marramook to Australian Mortgage Land and Finance and the contents are about classing sheep and the relevant prices. This is one of a number of documents which relate to the Bostock family who were one of the most important pioneering families of the Western District. They owned and leased various properties around Warrnambool and were involved in many aspects of social and business life. It is an interesting insight into the types of work and difficulties faced by early Australians and in the context of the Document VC000860 regarding demands for money from the National Bank written a month earlier.Cream lined paper hand written in black ink. Crown Portion 3 of Eltham, Parish of Nillumbik, County of Evelyn, Lots 26, 26A and 26B were part of the Greensborough Railway Station Estate. The land detailed is bounded by present-day Rattray Road, Reichelt Avenue, Wooded Way and Ryrie Court, Montmorency. Originally purchased in September 1913 by George William Miller, signwriter of Greensborough and Harry Frederick Miller, the land was sold to Mrs Margaret Barr Honeyman, 24 June 1918 on mortgage for £400, deposit paid £150. In February 1920, Mr Honeyman called for the title and paid off the loan early, settlement occuring 11 October 1920. Contents: 1. Handwritten payment plan (Sep 1913 to Mar 1923) for Lots 26, 26A and 26B being parts of Crown Portion 3, Parish of Nillumbik, County of Evelyn on the plan of subdivision making up the Greensborough Railway Station Estate situated on Rattray Road; purchased for £179.2.0 with a deposit of £18.0.0. 2. Receipt: From Messrs G.W. and H.F. Miller for £11.15.8 being instalment and interest, 9 Sep 1913 3. Invoice: To Messrs G.W. and H.F. Miller for £11.12.0 being instalment and interest due 15 Sep 1914 4. Contract of Sale: George William Miller and Harry Frederick Miller to Mrs. Margaret Barr Honeyman, in respect of sale of Lots 26, 26A and 26B for £400.0.0, 24 June 1918. Deposit of £150.0.0 balance to be paid half yearly instalments of £15 with interest at 5% per annum added. 5. Letter: Percy J. Russell, Solicitor to G.W. Land Victoria title documents vol 339 folio 763A and 764 relating to the property Nettalie on the corner of Balaclava and Orrong Rds. These documents detail the history of the land dealing relating to Nettalie and the neighbouring estate Harleston listed as parcels 209a and 209b. These dealing include grants of land, mortgages and conveyance (transfers). The documents include photocopies of handwritten notes of the title history date 1870; a partial copy of an instrument of conveyance dated 1863 and the original titles of the land owned at various times by William Noall, Alfred Shaw, Alfred Desailly and Sir Frederick Grimwade. The file also includes four pages of handwritten, undated and unattributed working notes with property description, calculations and a rough plan (96mm x 94mm) of the ground floor of the building for the valuation. Also included in the file is a two page duplicate copy of a typed letter, dated 08/10/1970 from W V Scott to William and Lasica Co Solicitors containing the valuation of the relevant property and rental details.
