The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. This set of 36 photographs were taken at a Corps Day Parade held at the Army Survey Regiment, Bendigo on the 1st of July 1987. The Parade Commander was CO LTCOL Don Swiney MBE, and the Reviewing Officer was the Colonel Commandant (honorary appointment) of the Survey Corps - COL Clem Sargent (Retd). The Corps Day Parade was held to commemorate the 72nd anniversary of the formation of the Royal Australian Survey Corps. It was an occasion for great celebration at the Regiment. After 45 years in Bendigo, its future was finally secure. At the traditional anniversary parade, the Colonel Commandant COL Clem Sargent praised the efforts of the Regiment and led the soldiers in three cheers for the record production of the previous 12 months. A small card at the back of the picture reads,’ This Picture was a teaching aid used in St. John’s Kinderg S.S and was found in the Church Ruins after the fire in July 1920 by Nancy McC(Absalom). Later framed by Grandma. St. John’s Presbyterian Church was built in 1875 and was burned down July 21st 1920. A volunteer fireman Mr T Spicer discovered the fire and despite the prompt arrival of the fire brigade, after an hour only the walls and tower remained. Some items were salvaged including vestry furnishings and church register. A bible which had been given to the Church in 1895 was rescued by an unknown young man whose identity remained a mystery until1976 when a Mr Stan Williams of Ballarat told his story. The Church was rebuilt in 1922. The event of this fire remains one of the most significant in the history of Warrnambool. Framed print of kookaburra on branch in natural setting. Anecdotal evidence holds that most men returned from Vietnam in the dead of night, hidden from the public. In fact, large numbers actually returned on HMAS Sydney, to a welcome by dignitaries and a parade. The manner of their homecoming affected the way in which veterans recovered from the war, those who did arrive late at night to no fanfare and the seeming indifference of the military had more trouble adjusting to life at home than did those whose return was more public and who had had the benefit of a couple of weeks unwinding on board Sydney before reaching Australia. But the return home was only the beginning of a long period of readjustment. For a long time after the war large numbers of Vietnam veterans felt that many in Australia blamed them, rather than politicians, for the war and the way it had been conducted. Images of the war, many still familiar, of children burned by napalm, of the dead of My Lai, of a South Vietnamese general summarily executing a member of the Viet Cong in the streets of Saigon, had an effect on public opinion and public understanding. The fact that these images related more to the American/Vietnamese experience in Vietnam was less remarked upon. Belonged to the Melbourne Harbour Trust Commissionersarge, wooden, rectangular "Roll of Honour" board for the Melbourne Harbour Trust Commissioners. It was their honourary board for employees who went to the 1st World War. comprised of seven panels with names of people carved into them. The centre panel has "in Memorium' in brass lettering and is raised out from the three panels which flank it on either side. The main lettering across the top of the board is made from brass, and is attached to the wood. A circular brass crest is featured in the centre top of the board, which is flanked by carved gum leaves and nuts. A steam boiler like this one, made in the late 18th century, is often called a colonial boiler. Steam boilers were used in factories throughout Australia, mounted over similar designs of brick furnaces. This boiler is a fire tube type, in which the heat from the fire travels through the tubes and water circulates around them. Another kind of boiler is a water tube boiler, in which the water is inside the tubes and the heat of the combustion surrounds the tubes. The boiler in our collection burned wood as fuel but others of this design could also burn coal, coke, gas and liquid fuels. The boiler was made by T & F Johnson, boilermakers. In 1922 their factory was located at Coventry Street, South Melbourne. They were still advertising their 'Colonial, multi, vertical boilers, all sizes' at the same address in 1934. The connected pressure gauge, made in London by Dewrance, measures 0 to 400 pounds per square inch. John Dewrance is renowned as a pioneer of the steam locomotive in the early 19th century. He founded John Dewrance & Co. in South London in 1844. His son Sir John Dewrance took over in 1879. In 1939 the company became a subsidiary of Babcock & Wilcox, and was eventually owned by Emerson. How the boiler works: - A boiler is about two-thirds filled with water and heat is applied, in this case in the form of burning wood. The heat is transferred through the metal of the boiler to the water. When the water boils the steam rises to the top, and as it escapes from the boiler the steam pressure builds up in the steam space to later be released to do work; drive machinery such as ship and train engines, turbines, presses, wheels, and driving belts to operate looms and saws. The heat associated with the boiler can be used for preserving food, sterilising, factory manufacturing processes, and steaming wood for shipbuildin. Every boiler has several components fitted for safe operation: - - Safety valves - Gauge glass - Pressure gauge - Main steam stop valve - Water check valve - Blowdown valve - Manhole doorThe boiler is a significant item that gives us a snapshot of early Melbourne's industrial history. It is an example of the technological advancement during the Industrial Revolution where steam-driven machinery and motors could perform tasks more efficiently than manual labour. The makers were one of many boilermaker businesses in Melbourne during the early late-19th andearly 20th centuries. The maritime trade and skills of boilermaking are still learned and applied today. The Dewrance steam pressure gauge connected to the boiler was made by the London firms foundered by John Dewrance. He was renowned for developing the steam locomotive in the early 19th century.Boiler; a horizontal cylindrical underfired steam boiler. It is a multi-tubular design and is timber plank-clad, with brass fittings and pressure gauges. The boiler has an iron door at one end with a metal chimney above it. It is installed over a brick-enclosed solid fuel furnace. Two large, wood-mounted pressure gauges are connected to the boiler and have inscriptions. An inscription is on a red, cast iron plaque above the boiler door. The boiler's maker is T & F Johnson, South Melbourne.
