The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. This set of 36 photographs were taken at a Corps Day Parade held at the Army Survey Regiment, Bendigo on the 1st of July 1987. The Parade Commander was CO LTCOL Don Swiney MBE, and the Reviewing Officer was the Colonel Commandant (honorary appointment) of the Survey Corps - COL Clem Sargent (Retd). The Corps Day Parade was held to commemorate the 72nd anniversary of the formation of the Royal Australian Survey Corps. It was an occasion for great celebration at the Regiment. After 45 years in Bendigo, its future was finally secure. At the traditional anniversary parade, the Colonel Commandant COL Clem Sargent praised the efforts of the Regiment and led the soldiers in three cheers for the record production of the previous 12 months. A small card at the back of the picture reads,’ This Picture was a teaching aid used in St. John’s Kinderg S.S and was found in the Church Ruins after the fire in July 1920 by Nancy McC(Absalom). Later framed by Grandma. St. John’s Presbyterian Church was built in 1875 and was burned down July 21st 1920. A volunteer fireman Mr T Spicer discovered the fire and despite the prompt arrival of the fire brigade, after an hour only the walls and tower remained. Some items were salvaged including vestry furnishings and church register. A bible which had been given to the Church in 1895 was rescued by an unknown young man whose identity remained a mystery until1976 when a Mr Stan Williams of Ballarat told his story. The Church was rebuilt in 1922. The event of this fire remains one of the most significant in the history of Warrnambool. Framed print of kookaburra on branch in natural setting. Anecdotal evidence holds that most men returned from Vietnam in the dead of night, hidden from the public. In fact, large numbers actually returned on HMAS Sydney, to a welcome by dignitaries and a parade. The manner of their homecoming affected the way in which veterans recovered from the war, those who did arrive late at night to no fanfare and the seeming indifference of the military had more trouble adjusting to life at home than did those whose return was more public and who had had the benefit of a couple of weeks unwinding on board Sydney before reaching Australia. But the return home was only the beginning of a long period of readjustment. For a long time after the war large numbers of Vietnam veterans felt that many in Australia blamed them, rather than politicians, for the war and the way it had been conducted. Images of the war, many still familiar, of children burned by napalm, of the dead of My Lai, of a South Vietnamese general summarily executing a member of the Viet Cong in the streets of Saigon, had an effect on public opinion and public understanding. The fact that these images related more to the American/Vietnamese experience in Vietnam was less remarked upon. Belonged to the Melbourne Harbour Trust Commissionersarge, wooden, rectangular "Roll of Honour" board for the Melbourne Harbour Trust Commissioners. The main lettering across the top of the board is made from brass, and is attached to the wood. A circular brass crest is featured in the centre top of the board, which is flanked by carved gum leaves and nuts. The Fred Moore trophy is held on Australia Day long weekend. This trophy commemorates the losers, ie the highest score of the day over 12 holes. It began in 1967, and continues.
