The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. This insulator disk for the high voltage carrying electrical cables was manufactured in 1964 and used by the SEC Vic (Kiewa Hydro Electricity Scheme) from that date until late 1900's. It was used to connect high voltage cables to their "towers" going from various Hydro Generators to and from power "stations". During this time period, high quality "cable" insulators were manufactured in Japan. In an earlier time they would have been sourced from Europe or England. After the 1950's the sourcing of electrical hardware was being influenced by the lower costs obtainable from Japan. Later on other Asian sources also became available.The need for a mountainous and a large area of operational requirements, such as the SEC Vic Kiewa Hydro Electricity Scheme, to distribute the electricity produced in the Victorian Alps to the major users required power transmission lines to "carry" high above the sometimes inaccessible land mass electricity generated at the power stations to the various sub stations along the valleys and ranges to flatter populated regions. The significance of this insulation "high voltage" disk to the Kiewa Valley region relates to the impact of modern technology (at that time) upon a mainly rural environment. These power lines are a stark visual "show" of the impact that the "Scheme" has on the mostly rural landscape of the Kiewa Valley and what a boost of "modern" equipment into the area has taken place. The "Hydro Scheme" had facilitated the transition of a semi rural area to an advanced rural region within a shorter time frame, than would have taken under "normal" evolutionary time. The speed of information of all "new technology" had a relatively slow assimilation rate before the SEC Kiewa Hydro Scheme came to those living in the then quieter rural communities. This high voltage (330 KV) insulation disk is made from non conductive porcelain stoneware. It is highly polished brown in colour and has a clip fastening for the high voltage cable to be attached to. This disk was hit by lightning and the burn marks are quite noticeable. The top metal connector has a "mushroom" extension jutting below the semi cone like insulation disk. Also four circular ridges or grooves (old 78 rpm disc recording style).Cable bell on top of insulation disk "4K " next to it the international symbol for electricity (triangle containing one horizontal line under one V line and one vertical flame like line.) These photographs are copies of original paintings by the Australian marine artist A V Gregory (1867-1957), also known as Arthur Victor Gregory. Gregory lived and worked in South Melbourne. He took over the Gregory Studio owned by his father, George Frederick Gregory, painting actively between 1899 and 1932. He usually signed his works as ‘A V Gregory’. Some of his original works have been sold for thousands of dollars. These mounted photographs, by A.V. Gregory, show both steam and sailing ships sailing in the Tea Race from China to London in 1872. The information included with the photographs has the following text: “Tea Clippers “ Well done Cutty Sark, by Bobbie Burns The CUTTY SARK and THERMOPYLAE. The start of the 1872 Tea Race from China to London. The “Cutty Sark” first away, followed closely by the “Thermopylae”, finally parting after several days’ company. On this race the “Cutty Sark” lost her rudder in the Indian Ocean, putting her hopelessly out of the race, and enabling the “Thermopylae” to pass her and reach London on 11th October, 115 days out, the “Cutty Sark” limping home seven days later. The credit of the race was given to the “Cutty Sark” by the shipping world. Copies of the pictures may be had from A.V.
