Original photo from a scrapbook belonging to Heather Jenkins (nee Cone) who lived as a child in the Police Residence at 728 Main Road, Eltham from 1911 to the early 1920s. (Reported in Newsletter No. 98, Sept., 1994). View looking north up Policeman’s Hill across Main Road towards the Police Station, Police Residence and Courthouse, c.1910 prior to Brougham Street being made. The two rails / gap in the fence would be where Brougham Street now enters Main Road. Also visible are Knapman's Forge adjacent to Courthouse and E.J. Andrew's Store on top of the hill At the upper left can be seen the front of the Evelyn Hotel. On the opposite corner was Watsons Hotel. E.J. Andrew's store with its verandah was on the corner of Franklin Street. Behind the picket fence stands the 1860 Court House and Police residence with the weatherboard clad Police office. The enclosed fence is now the end of Brougham Street, opened to Bible Street in 1926. The Evelyn Hotel (formerly Fountain of Friendship) burnt down in the 1930s when it was being used as a boarding house since 1919. A cow is feeding on the grass verge in street. The photo is identified in white lettering typical of the style of Clark Bros., photographers of Windsor, Melbourne (1894-1914). One of the brothers, John Henry Clark, took many early photos around Little Eltham and moved to Eltham in 1916 where he lived at the bottom of the hill. Typically, he would add “J.H. Clark Photo” to his personal work, but this is not evident. There is however some ghost writing, a cheeky inscription in small white lettering in the grass verge in front of where Brougham Street is, which appears to state: “Heather or Hannah was here”. Perhaps J.H. Clark took the photo during a trip to Eltham and gifted it some years later after moving there as a gift to a young Heather Cone. The Police Station sign: E vii R ELTHAM POLICE STATION HEIDELBERG DISTRICT Edward VII ascended the throne in 1901 and died 6 May 1910. He was succeeded by George V.Heather Cone was the daughter of Constable John Thomas Cone (Badge 3935) the local police officer in residence at Eltham, 1 May 1911 to 9 July 1922. Heather McKnight Jenkins (nee Cone) was born 1911, possibly at the Eltham Police Residence and spent her childhood growing up in the Police Residence. Heather was the daughter of John Thomas Cone, Police Constable, and Charlotte Helena Cone (nee Black) who had married in 1906. Constable Cone was transferred to Eltham Police Station from Lauriston (near Kyneton) in May 1911. He retired from the force around September 1922 most likely as a result of significant health concerns experienced earlier that year from 22 April when he was hospitalised. He died 5 October 1922 at Maria Street at age 60 leaving behind a widow and two daughters; his son having pre-deceased him as a result of effects of the war. He is buried in Melbourne General Cemetery . In his probate it states that he owned a piece of land 200 links frontage to Maria Street and a depth of 241 links. It is believed that this is the land opposite the Police Station which Heather Jenkins referred to as being owned by her father and where he agisted the Police horses. Heather, her sister and mother Charlotte remained in Eltham until at least the 1924 Electoral Roll where Charlotte was listed as Home Duties however by 1925 she was listed at 229 Glenferrie Road, Malvern, occupation, Registrar of Births. In the 1934 (and 1936) Electoral Roll, Heather was a Clerk and her mother Charlotte was the Registrar of Births. in 1952 following her mother’s death she made application for Grant of Probate. Heather remains listed in the 1954 Electoral Roll at 13 Ashburton Road under her maiden name Cone however by the 1963 Electoral Roll she is listed at the same address as Heather McKnight Jenkins long with James Gardiner Jenkins. Neither appear listed in the 1958 Electoral Roll. James Gardiner Jenkins (1892-1975) first wife was Fanny Davison Carrucan (1899-1929), daughter of Denis Carrucan and Jane (nee McAleese). They married in 1925. Fanny died 11 November 1929. In the 1934 Electoral Roll he remained listed at John Street, Eltham, Railway Employee however by 1935 Electoral Roll, James Gardiner Jenkins, Railway Employee, was listed at 229 Glenferrie Road, Malvern and he remained living with Charlotte and Heather Cone when they moved to 13 Ashburton Road, Glen Iris. One of Constable Cone’s first investigations upon arriving in Eltham was the accidental fatal shooting in the head with a pea rifle by young Francis August Capewell, aged 11, of John Sutcliffe Deegan, 14, in Maria Street near the Railway. Constable Cone’s replacement was Constable William Charles Sargeant who commenced in charge of the Eltham Police Station from Thursday, 10 August 1922. Constable William Charles Sargeant, and his wife Elizabeth Agnes Sargeant were based at the Eltham Police Station until his transfer to the Police Station in Burwood Road, Hawthorn. He retired at Hawthorn Police Station in 1931, described by Hawthorn Council in 1927 as in a disgraceful condition and unfit for human habitation (Kathryn Griffin family tree – Ancestry) whereupon they moved to 28 Saunders Street, Coburg. Elizabeth died 16 July 1936 in Fitzroy. William then moved to 6 Queen Street Coburg in 1936 and then 1 Queen Street in 1942 where he died 7 August 1944. McDonald produced this record in the course of his responsibilities as Shire Engineer for Eltham Shire Council.Record of various Shire of Eltham infrastructure works undertaken during the period of 1952-1962 involving bridge and road reconstruction projects, sometimes with Eltham Shire Council Project Reference numbers quoted. It was during this period that a number of significant improvements were made to roads and new bridges constructed within the shire that remain in place as of present day (2022). In many situations, the photos provide a tangible visible record of infrastructure that existed throughout the early days of the Shire. This building is a fine example of a very early small brick country court house which retains its furnishings and has important associations with the early history of the Eltham township. It was used for Eltham Road Board meetings in the 1860s and later to provide additional school accommodation. It is the oldest public building remaining in Eltham and forms an important group in historic and streetscape terms with the adjoining former police residence. The survival of the furnishings (of unknown origins) is of particular significance given the building's age. This building, and the former police residence beside it, were constructed as a result of a petition by five Eltham residents in 1857. The nearest police were at Heidelberg eight miles away or at the Caledonia Diggings 21 miles away. After the construction of the Court of Petty Sessions at Eltham in 1859-60 (which was designed by the Public Works Department and built by a Mr Duncan for a cost of 536 pounds), it was used for a variety of purposes. Eltham Road Board meetings were held there until 1868 when the board was transferred to Kangaroo Ground and as the Road Board Secretary's office, until this was transferred to Wingrove Cottage in 1867. It was used as an overflow for the Dalton Street School in 1875. According to National Trust records, the Eltham Court House is a relatively rare building type. There are only six other known examples of similar small brick country court houses in the state which have small projecting entry porches and a gabled form. Possibly a picnic for returned servicemen from Gallipoli. This photo was taken in front of the Police Paddocks with the police station on the left. Model T Fords parked with soldiers, drivers and locals resting on the police paddock in front of the Queenstown (St Andrews) station. The RACV Volunteer Motor Corps service during World War One was the reason the organisation was granted its Royal prefix. Automobile Club of Victoria members volunteered their time and vehicles to collect returning soldiers and nurses from ships at Princes Pier, Port Melbourne. Trips were also often arranged for convalescing soldiers to country areas for picnics and to “revive spirits”. The soldiers were also picked up from the Austin Hospital in Heidelberg and Mont Park Military Hospital in Macleod. Queenstown (St Andrews) was a common picnic spot. The Evelyn Observer reported on June 9. 1916 "Some 75 returned soldiers visited Queenstown on Sunday, 28th ult., and were hospitably entertained by local residents who had provided refreshments sufficient for 150. Mr. Milne in an appropriate speech welcomed the soldiers, and Mr. Robison suitably responded.” The photo was reproduced page 108 of “The Diamond Valley Story" by Diane H. An article from the Bulletin including the text an address by Legatee Kem Kemsley at a Legacy event on 27 September 1983. He discusses the beginnings of Legacy. He relates the approach made to Sir John Monash to be the first president. It was via Legatee Frank Meldrum who was playing tennis with Monash's son-in-law. It shows the nature of relations between high ranking ex servicemen. Monash suggested Colonel Harold Cohen. Initially Legacy was founded with 'one person from each profession or business who will represent that profession until such time as the Club has established itself on a wider basis.' For example there were 'two solicitors - Downing and Armstrong, Meldrum as dentist, George Worboys as plumber, Dr Gardener as the eye specialist, Doolan and Goodchild as Surveyors, Fred Wickham of the Premier's department who was regarded as very important, Baker from Myer's Emporium, Joynt from the printing world and Blackett the architect.' He also mentions a Police Strike and General Monash set up a special constabulary force. Cohen, Kemsley and many of the early legatees answered the call to help keep peace. By December 1923 there were 54 members of the new Legacy club. The name was under consideration as the Tasmanian club was called Remembrance Club. Pip Powell nominated the name of Legacy to be submitted for consideration, but it was Frank Selleck who moved the formal resolution. By the end of 1924 initial objectives were met. A picnic with widows and children was held at Heidelberg and then Beaumaris, (limited by the few legatees who had motorcars at the time). Following thoses successes Frank Doolan posed the question 'what does Legacy really mean?' and focus changed toward widows and children. Legatee Savige had a property at Balnarring and the first camps were started. For boys there was a Lacrosse team and football team. Also swimming classes and literary and debating classes, which were hoped to be interesting and develop their minds along the proper form of citizenship. Then classes for the widows and later the girls. The article was part of an album of past presidents from 1965 to 1989. The folder included biographical details and obituaries, eulogies and death notices of prominent Legatees. Today’s Panton Hill Hotel was built around 1920. Published: Nillumbik Now and Then /​ Marguerite Marshall 2008; photographs Alan King with Marguerite Marshall.; p61 Panton Hill was originally known as Kingstown, and consisted of only one hotel when the Orams Reef was discovered in 1859. Kingstown was a quartz mining centre and many old mine shafts remain in the area. Orams Reef was one of the first reefs with a rich find of gold in the area. The Hotel Francais, which had been operating in 1861, was well situated on the way to Queenstown (later St Andrews). So was Herr Hirt’s Hotel and store at Smiths Gully. The Kingstown hotel, known as the Frenchman’s and in 1864 as the Hotel de France, was run by a Monsieur Emile Hude and his wife Jeanne, and known for its good food. They hosted social events, business conventions and debates, attracting patrons from as far as Melbourne. The hotel’s name was changed to Panton Hill Hotel in 1905. In 1883 Charles Caudwell built another hotel nearby, possibly in Long Gully Road,3 which it is thought, was burnt down early last century. Today’s Panton Hill Hotel, built around 1920, is the only one of the cluster of buildings in the main road, not to date from around the turn of last century. It was severely damaged by fire in 2003, then underwent extensive alterations. It is the township’s only hotel and is an example of a modest hotel building exterior, constructed early last century. In its early days the hotel also housed the first post office, newsagency and store. Orams Reef yielded a total of £100,000, and fossikers also found alluvial gold in the creeks and gullies, but there is no record of the total value of their finds. Gold greatly increased the Panton Hill population, which peaked between 1865 and 1885. On holidays large sports meetings were held with wood chopping contests and foot races and the day would end with a ball. Miners came from various countries to seek their fortune, including many from China. The Chinese became unpopular however, and gradually left the district, although some stayed and grew and sold vegetables.5 Panton Hill was named after Joseph Panton, who in 1862 was appointed Police Magistrate for the Woods Point, Heidelberg and Yarra districts. Panton was an outstanding man, who in 1852, was Commissioner of Crown Lands and Assistant Commissioner of Goldfields at Bendigo. In 1874 he was promoted to Chief Magistrate for the Melbourne Police. Panton was also an artist, becoming president of the Victorian Arts Society in 1888, and in 1913, president of the Royal Geographical Society. Despite Panton Hill’s prosperity, it still lacked many services as poor roads made access to Melbourne difficult. A horse-drawn mail coach travelled to Melbourne until 1890, when the railway came to Heidelberg. The nearest doctor was at Yarra Glen or Heidelberg, and the Indian hawker Singh’s annual visit was very welcome. A miner’s shack opposite the school was used as a post office. Today’s general store and post office in the main road dates from early last century, and has changed considerably. While most people searched for gold, the more enterprising ones established farms to feed the diggers. Farmers grew wheat, barley and oats, and sent animal skins to the Eltham tannery, to make furs in Melbourne. As gold became scarce from around 1880, miners took up farming on 19 to 20 acre (8ha) allotments. The first settlers in Cherry Tree Road included Purcell, Smith, Owens, Hughes and Shillinglaw. By 1900 all the land had been taken up around Panton Hill and Hurstbridge. The orchards in Panton Hill and the wider district, particularly of apple and pear, were very successful, and made Panton Hill a cohesive and successful community. About 1914 the Moores built the first cool-store and refrigeration plant at their orchard in Cherry Tree Road. Many settlers planted vineyards and made high quality wine, but in 1922 the blight destroyed them.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. The Eltham Court House is Eltham's oldest public building. It was classified by the National Trust in 1977. In 1857 five Eltham residents petitioned the licensing magistrates of the Heidelberg district asking for better police protection, including from itinerant gold prospectors who turned to crime when their quest was unsuccessful. In response the Eltham Courthouse was constructed in 1860. Over the years it has also been used for other activities, including for electoral polling purposes, inquests, early meetings of the Eltham Roads Board and even as an overflow classroom. This type of localised solution is characteristic of the self-reliance preserved in Eltham today. The court house is an important symbol of the spirit which makes Eltham distinctive as a community. The Eltham Courthouse is historically significant because its construction was intended to emphasise the centralised control over law and order in the Colony of Victoria in the wake of the 1852 Snodgrass committee report on the Victorian police force and the resulting Police Regulation Act (1853). The nature of the Court House planning and use of architectural devices make the building's function easily interpreted. The arrangement of rooms, with public entry and clerical rooms to the rear, and the use of raised floor levels throughout these spaces to signify relative rank is easily perceived. The distinction in entries, public, magistrate and person-in-custody, and the existing court furniture enhances appreciation of this building. The Eltham Court House is one of only two intact examples in the state of this simple design with projecting entry. The building is of architectural significance because it retains intact early features. These include use of handmade bricks, simple decoration, roof trusses, timber ceiling boards, original windows, doors and associated hardware and a collection of court furniture. Additions to the court house have been done in a manner which did not interfere with the fabric of the original building. Typical cases heard before the Court of Petty Sessions included financial debt, straying livestock, theft, assault, drunkenness, public disorder, truancy, motor vehicle offences, unregistered animals and failing to have children attend school, or be vaccinated. The courthouse operated for over 120 years before it closed in 1985. In April 2021, Nillumbik Shire Council authorised restoration of the building and furnishings. The extensive works required for the total restoration of this highly valued heritage building was undertaken by Ducon Building Solutions and other specialist contractors. In 1857 five Eltham residents petitioned the Heidelberg district licensing magistrates. They pointed out that Eltham had two hotels, a population of about 1000, and many strangers employed on the public roads. Yet the nearest police were at Heidelberg eight miles (12.8km) away, or at the Caledonia Diggings 21 miles (33.7km) away.1 Subsequently the courthouse and then the police residence, near the corner of Main Road and Brougham Street, were built in 1859/60. The courthouse is Eltham’s oldest public building and the National Trust classified it in 1977. It ceased operation in 1984 and has since been used by local groups. There are only six other known examples of similar small brick country courthouses in Victoria . For £536, a Mr Duncan built the courthouse – a neat, narrow, oblong building with handmade orange bricks. Its gabled roof and porch are covered with brown slate tiles and it has 12-paned windows. Inside, the roof is peaked and the courthouse is still ventilated by oblong slits near the ceiling. Most of the fine carved timber and upholstered furniture is original. The original prisoners’ door, now permanently closed, led from the police station to the dock. Builders, Langridge Wright and Witney built a timber police station (since demolished) and a brick residence to its north,2 for £1150/7/-. Built around the same time were the lock-up behind the residence, also later demolished, and the two-storey orange brick stables. The former police residence also has a brown slate roof and handmade bricks. The front veranda roof is made of corrugated iron, as is the roof of the back weatherboard extension. The application for police protection was approved within a few months and police operated from a cottage rented at ten shillings a week and owned by William Jarrold. This was probably the one at the corner of Main Road and Dalton Street called Jarrold or White Cloud Cottage. In 1858 a second constable was appointed to Eltham following a fight at the hotel. The timber police office a replica of which was built in the early 1990s is at the building’s side. The lock-up was demolished following the relocation of the police to a new station in about 1952. The residence has been used as the Eltham District Historical Society centre since 1997. Records show court cases were held at Eltham before the courthouse was built, but the location is unknown. Some court cases were not very different from those today. In 1891 a man was charged with being drunk while in charge of a horse and was fined ten shillings. The courthouse was used for other purposes during its long history. It was probably used as a polling place as indicated by old photographs of election-day crowds outside. The Eltham Road Board met there from the early 1860s until 1868 when the Board transferred to Kangaroo Ground. During the same period the Road Board Secretary used the courthouse as an office until 1867 when it was transferred to his home at Wingrove Cottage. The courthouse was also used as an overflow classroom for the Dalton Street school in 1875. The two buildings can further link us with Eltham’s early days through Police Department correspondence. The first constable-in-charge was George Reid. In 1860 a letter to The Argus newspaper signed ‘A Sufferer’ declared the Eltham police were not active enough in their duties. The writer suggested that the ‘very snug’ police quarters were too comfortable, and he detailed various incidents including one of an alleged break-in to the Road Board Secretary’s home. But the Board Secretary, C S Wingrove, wrote to the Police Department refuting The Argus letter saying he had received full co-operation from Sen. 20th Eltham Community Festival and last under the auspices of the Shire of Eltham. The Grand Parade focussing on the theme "Echoes of Eltham - Celebrating the visions of Eltrham from the past and into the future" was headed by Jock Read on his horse Lofty who had been filmed in an Anzac Day Parade on an earlier horse which had featured in the television show Matlock. The parade travelled north along Main Street to just past the Post Office then back south to Panther Place. The parade commentary was provided by Plenty Valley FM 88.6 with guest commentator, Shire President Cr. John Graves. Following the parade is video footage from a helicopter of Alistair Knox Park, displays along Main Road and activities in Alistair Knox Park and the Rugby oval along with stationary engines, helicopter joyrides, Eltham People's Choir, music entertainment. Scenes also from the Diamond Valley Railway at Eltham Lower Park and finishing with the fireworks display. At the end of the video is a promotional video for Dynavision Video Production, a local video production company that produced the video and Diamond Photos (Kodak Express). One of the highlights of the festival was a tree planting ceremony in Alistair Knox Park to celebrate 123 years of the Shire of Eltham led by Shire President Cr.
