On the way they stopped to play with friends at a bark mill located on Percy Street. Thomas decided to feed the machine located in the mill and after he got distracted both his hands became caught. John went to help his brother and his arm also got caught. A doctor had to perform amputations. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. There are 12 boys, of various ages, in gymnastics gear, some holding books or certificates. Legacy clubs ran classes for junior legatees for many years. It was part of providing for the children of their deceased comrades. The skills they learned were show cased in an annual demonstration usually at the Melbourne Town Hall. It appears to be photo taken professionally, as there are several photos of different classes (see 00862 - 00867) perhaps to record Legacy classes for promotion purposes. Many were published in the September 1953 newsletter. The Corps Day Parade was held to commemorate the 72nd anniversary of the formation of the Royal Australian Survey Corps. These photos comprise inspections of the Regiment’s four squadrons, presentations of the Defence Force Service Medal in recognition of 15 years of efficient remunerated service to SSGT Phil Meagher and SGT Wayne Rothwell; and formal group photos of each of the four Squadrons, Officers, and Warrant Officers/Sergeants. This photograph shows Nelson Burn reading a telegram from the queen to his grandmother, Mrs Paul Hocking, on her 100th birthday. Her husband, James Hocking, was the first watchmaker in Orbost. He had been a lay preacher at Wangaratta and Yan Yean before coming to Orbost. He was an 1891 Rechabite and an Orbost Shire Councillor. Eliza Ann Hocking (nee Eddy) was born on 16.7.1856 at Blackwater Hall in England, She had arrived in Australia on the sailing boat "Poocia" on 8-7-1880. The voyage following the Cape route took about 7 weeks. For a time, with her husband, she lived at Chewton, on the gold fields, before coming to Orbost. She was a foundation member of the Methodist Ladies’ Guild in 1912. She lived in Salisbury Street, Orbost. She died on 9.4.1957. Colin Nelson Burn, born 7.7.1921, was her grandson, son of Robert Alfred Burn and Edith Jane Hocking. He began Sta-Brite' Painting and Decorating Services in Salisbury Street, Orbost. He served in the forces during World War II. He was a Life member of the Snowy Rovers Football Club. He joined the Orbost Fire Brigade on 1-5-1946. He died 1.2.2015. This photograph was taken at the Curriculum and Technology in Schools workshop held in Bendigo, Victoria in October 1987. The Melbourne cable tramway system operated between 1885 and 1940.Former Melbourne cable tram bell used for fortnightly and annual meetings of Ringwood Apex Club, mounted on timber base with metal shields showing presidents for each year from 1966 to 2003. Ringwood Apex Club closed in 2003-04.This dinner gong, formerly a Melbourne cable tram bell, was donated by inaugural secretary Wal Hodgson 21.10.67. This set of 36 photographs were taken at a Corps Day Parade held at the Army Survey Regiment, Bendigo on the 1st of July 1987. The Parade Commander was CO LTCOL Don Swiney MBE, and the Reviewing Officer was the Colonel Commandant (honorary appointment) of the Survey Corps - COL Clem Sargent (Retd). The Corps Day Parade was held to commemorate the 72nd anniversary of the formation of the Royal Australian Survey Corps. It was an occasion for great celebration at the Regiment. After 45 years in Bendigo, its future was finally secure. At the traditional anniversary parade, the Colonel Commandant COL Clem Sargent praised the efforts of the Regiment and led the soldiers in three cheers for the record production of the previous 12 months. This occasion was to commemorate the 80th anniversary of the formation of the Royal Australian Survey Corps. The Parade Commander was CO LTCOL Duncan Burns, and the Reviewing Officer was the Deputy Chief of the Defence Force MAJGEN G.D. Carter AM. Photos of personnel and their guests was taken on their arrival near the Pompeii Fountain in the gardens at the front of the main building. The Ball and Dinner was held at the rear of Fortuna Villa in temporary 20’ x 30’ Army tents set up on the roadway in front of the transport compound. SERCO contract staff provided the catering and the ASR’s Other Ranks performed stewarding and kitchen hand duties. This occasion was one of several events held to commemorate the 75th anniversary of the formation of the Royal Australian Survey Corps. The one-hour visit was a rare opportunity for RA Svy to demonstrate to its Prime Minister the unit’s important role as Defence’s map production agency, its technical equipment, and its economic importance to Bendigo. It was also an opportunity to take him through historic Fortuna Villa. This occasion is covered in more detail in page 143 of Valerie Lovejoy’s book 'Mapmakers of Fortuna – A history of the Army Survey Regiment’ ISBN: 0-646-42120-4. Print, Relic from St John’s Fire, Pre 1920
A small card at the back of the picture reads,’ This Picture was a teaching aid used in St. John’s Kinderg S.S and was found in the Church Ruins after the fire in July 1920 by Nancy McC(Absalom). Later framed by Grandma. St. John’s Presbyterian Church was built in 1875 and was burned down July 21st 1920. A volunteer fireman Mr T Spicer discovered the fire and despite the prompt arrival of the fire brigade, after an hour only the walls and tower remained. Some items were salvaged including vestry furnishings and church register. A bible which had been given to the Church in 1895 was rescued by an unknown young man whose identity remained a mystery until1976 when a Mr Stan Williams of Ballarat told his story. The Church was rebuilt in 1922. The event of this fire remains one of the most significant in the history of Warrnambool. Framed print of kookaburra on branch in natural setting. The bird is coloured blue, green and tan. Background is in muted greens. The light wooden frame is covered in fabric in pinks and green. A patterned metal edge sits atop the fabric. On back of picture, ‘ From Grandmother to Nancy on her 5th Birthday, Aug 20th 1920. This is a relic of the burning of St John’s Church July 21st 1920. Drawing - St. Stephen’s Presbyterian Church, Caulfield
Two copies of a sixteen page booklet titled First Fifty Years, detailing a brief history, researched by John Watson, of St. Stephen’s Presbyterian Church, Balaclava Road Caulfield, between 1910-1960. The booklet includes several images, including two photographs, one of the interior of the church, the other of the interior of the main hall. There is also a set of six portrait photographs of the ministers of St. Stephen’s from 1913-1960. There is also a photograph of the front view of the first church and a sketch by Haddon and Henderson architects of the design for the present, 1960, church dated to the early-mid 1920s. There is a list of names of office-bearers for the year 1960. That list has been photocopied and is included in the file.
