On 15 December 1994 the former Shire of Eltham ceased to exist following the Liberal Kennett Government local council amalgamations. A new Nillumbik Shire Council was established with unelected commissioners appointed. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. An Advisory Committee consisting of Dimitry Reed and Margaret Pitt was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. The Recommendations of the Advisory Committee were: i. The cafe and take away food premises are as of right uses and are therefore allowable, but that shop and petrol station are unacceptable uses. A community facility is a discretionary use and is acceptable. ii. A development of the type and scale proposed is totally inappropriate for this land and that the Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, café/takeaway food premises, a retail facility and a community facility, with associated advertising signs, be refused. iii. The land should be rezoned for public purposes and should remain in the community's ownership for community use. Following this, the Minister for Planning and Local Government, the Hon. Robert Maclellan, appointed Mr. Paul Jerome as an Advisory Committee under section 151 of the Planning and Environment Act 1987 to consider a Convenience Centre and an alternative proposal by Iha Shire of Nillumbik being the Eltham Gateway Community Precinct Concept Plan for the site of the former Shire of Eltham municipal offices at 895 Main Road, Eltham. In summary, the terms of reference for the Advisory Committee required it to: • consider the merits of the Council proposal • examine the merits of both proposals in terms of net community benefit • address the report of the previous Advisory Committee on the Convenience Centre proposal The Advisory Committee inspected the site and considered all the material before It including submissions made by all parties to the previous Advisory Committee and correspondence received by the Department of Infrastructure both before and after that Committee submltted its report. The Advisory Committee also held discussions with the following people: • Cr. Robert Marshall • Cr. Margaret Jennings • Cr. Lex de Man • Mr. Dallas Howgate of Dallas Price Properties, also Dallas Price Homes • Mr. Barry Rochford, CEO, Shire of Nillumbik • Ms. Yvonne Rust, Planning Officer, Shire of Nillumbik • Mr. Gregory Burgess, Architect of the Eltham Library and of Council’s Community Precinct Concept Plan • Mr. Jim Connor representing Mrs Thelma Barkway of the Eltham Senior Citizens Club Having considered all the material before it, the Committee arrived at two basic conclusions. First, the DPP proposal should be rejected because, on its merits, It does not sufficiently satisfy the requirements of the planning scheme which is a statutory document. The planning scheme requires that, before making a decision on the permit applications for the DPP proposal, a range of matters must be considered. It follows that consideration of these matters should Influence the decision. These matters include local policies relating to character and amenity. In particular, these policies seek • to conserve and enhance the bushland/country atmosphere, artistic heritage and strong sense of community of the Eltham Town Centre by ensuring that the design and height of any new development is sympathetic to existing buildings • to achieve a pleasing physical environment within the Eltham Town Centre by encouraging a high standard of architecture and urban design • to encourage Improvement to pedestrian amenity through such facilities as open and shattered rest areas and meeting places, crossing facilities, pedestrian arcades, pedestrian links to car parks and pedestrian weather protection • to reduce conflict between vehicular traffic and pedestrian flows, and • to encourage pedestrian thoroughfares It is submitted, as set out In the main body of this report, that the DPP proposal fails substantially to meet these policies and In so doing does not merit the exercise of discretion In Its favour with the Issuing of a permit. This finding is not offset by the investment and employment attributes of the proposal. They do not override the need to comply with the planning scheme. Second, the Council proposal, on Its own merits, substantially meets all statutory requirements applicable to this site with a possible reservation about car parking and traffic management which need further definition and assessment as the concept is refined. The Council proposal, however, has a serious weakness in that Its financial viability has not been adequately tested. The Committee refers to 'financial' rather than 'commercial' viability in recognition that Council owns the land and may enter into a range of agreements and partnerships to realise its concept some of which may be truly commercial and some of which may involve an element of subsidy arising from Council's involvement as a public body acting on behalf of its community. Bogong Village, which was known as “The Junction”, is well recorded. The first tent camp was at the junction of Pretty Valley and Rocky Valley streams in the early 40’s. Further downstream were the sawmill, stables and blacksmith’s forge. Horses were the main mode of transport in the early days. The road to Bogong had reached the lookout spur just beyond Roper’s Spur track just before the 1939 fires. The early forties saw rapid growth of the village, with single and married men’s quarters, workshops, mess huts and administrative offices. The facilities necessary for communal living were quickly in place- a post office, police station, co-op store, medical centre, community hall/theatre, tennis courts and school. Much of the temporary accommodation that housed groups such as the Albion Quarrying Company were in the area now under water.This group of photographs are a pictorial record of the early history of the Kiewa Hydro Scheme, the people who worked in the background supplying administrative support and the workers and their families. The Portland Social Amusement Club was founded in 1897. Taken from Trove. Portland Guardian Monday May 26 1913: Portland Social Amusement Club. The members of the above Club celebrated the 16th anniversary of its foundation on Tuesday evening last, when the usual banquet. and social gathering was held. During the afternoon, a numerous band of the lady members attended at the, Free Library Hall and made the necessary arrangements, so that on arrival at the scene at 8 p.m. those attending were very pleasurably surprised to find most taste fully decorated tables actually groaning with the weight of all those good things which appeal so strongly, it is said, to the average man, and perhaps we may also add, woman also. At any rate, he would indeed be hard to please, who was not fully satisfied with all that was placed before him on that eventful evening. The attendance this year overtopped that of previous years, as over 80 ladies and gentlemen took part in what must be considered as one of the most successful of the many 'successful gatherings that have taken place. This 16th anniversary was the 431st ordinary gathering that had occurred, and, as the President (Mr. F. A.Row) justly said, it would appear that the Club, which many years ago was given but six months live, had proved the falsity of the attempted prophecy. After the principal business of the gathering had been transacted, the usual Club dinner speeches were made. The President gave "The King," which after being duly honored, was followed by the principal toast of the evening, "The day we celebrate." To Mr D. McDonald the toast of the Absent and Foundation members was entrusted, and as usual, that veteran discharged his duty well. II i cferred to the fact that of the 34 foundation members who started the Club in 1897,only five were present that evening. Mr W. T. Bennett, as one of the five referred to, responded, and hoped that in the glorious future that appeared before Portland, the Club, which had been started in the days of its adversity, would flourish in a like manner. Mr Grant proposed the toast of "Our Visitors." and in the name of the Club welcomed them to this the most important gathering of the year. Mr J. R. Woods responded in his usual happy way, and acknowledged that, until he had been the Club's guest during the years of his mayoralty of the town, he had no idea that it had enrolled among its members the number of ladies and gentlemen that it had or that its functions were upon the scale that he had since found to be the case. Mr G. H. .ennett upheld the claims of the ladies, especially those belonging to the Club. He evidently spoke with much feeling, and. waxed more than usually poetical in his eulogy of the graces and skill of the gentler sex. He rather upset the equilibrium of three of the younger portion of the gentlemen present by asking them to respond, but they all managed to "upstand" and make their acknowledgments. Mr T. F. Cruse was particularly happy in proposing the toast of. "The President and Members of Committee," who, he claimed, had done so much towards the success of the Club, and were deserving of the best that the members could give. Mr T. E. C. Henry, upon the invitation of the .President, responded,-end pointed out that [whilst it might appear that the work of the committee was light, it was not so in reality, as any member who desired a seat upon the Board would soon find out after.his or her election. The singing of Auld Lang Syne brought this portion of the entertainment to a close. In the dance which followed, some opportunity to view the ladies' dresses was afforded, and it could then be easily seen that the anniversary gathering of the Club was considered by the lady members at least, if not .by others, to be important enough to demand special treatment in the matter of dress. Many elaborate and beautiful costumes graced the scene, and everyone appeared to thoroughly enjoy themselves. The function was kept going merrily until about 2 a.m.; when the break up occurred. During the gathering telegrams of con gratulation were received from Mr W. B. Shevill and also from Mr Jno. Homers, both old members, the former a foundation one. Mr. Adde Andress Matiess John COOPER was a WW1 soldier from Chiltern and served with the 21st Battalion. He enlisted in 1916 at 21 years of age. He had previous experience pre WW1 in the local based Militia Unit at Chiltern. He was awarded the Military Medal for Bravery in the Field whilst in France on the 3/4/1917. He was wounded in France with a gun shot wound to the upper left arm. He was the son of Mr. and Mrs. William Cooper. He then went on to serve after WW1 with the local based Militia unit (44BN) and was appointed as the Officer in Charge at the rank of Captain. His employment prior to WW1 was that of a Sleeper Cutter for the railway. WW1 Circa 1914-1918 Sent to Chiltern resident Mrs. Wm Fuge Cornishtown via Chiltern. WW1 The Great War 1914-1918Buff coloured WW1 Greeting Postcard "To My Dear Sister". Item has an internal card within an attached lace envelope. The card contained within has a number of commonwealth flags around the edges as a border and the card has the wording "Happy Birthday Greetings". Internal lace overlay is made of silk and has embroidery around the edges with small red roses and green stems and a larger embroided pansy flower in the middle of purple and yellow colours, with two small bordering elderflowers of light blue colouring. France October 14th 1917 Card reads as follows: Dear Ethel, your letter to hand 12th August and pleased to hear you are all well. Wishing you and all the compliments of the season I remain your loving brother Bert. Address annotated on the card : Mrs Wm Fuge Cornishtown Via Chiltern Victoria Australia. There was Billiard parlour down that end of town in the early 50’s. in Carstairs Ave. Rosmary Kavadis father (John Kostantinidis) owned it and it held 2 big tables 12 x 6 and the main games played were snooker and billiards. On the corner of Cairstairs Ave opposite Robin Hood Inn. The cafe Duckin, Mr and Mrs Kostantinidis bought it and on the side of that cafe down a verandah was the Billiard Room. It was very popular and a lot of the locals would play there. Rosemary was about 5 - 7 years old and had to stand on a fish box to play. It was very popular and next door was the Bamboo Coffee Shop run by Mr and Mrs Varney The'Duckin' became Peels bait shop Dot and Con Coucoulas took over the Bamboo and turned it into a motel not sure on the year and then bought the Duckin and demolished it. It was after Tween Lakes was built in 1959, as that was the first motel on the Esplanade.The first 20 units and restaurant were built in 1959 with firsts guests on Dec. 22nd.1959. An article about Ivanhoe Grammar School students who were involved in the school's 'activities week' where the student undertook community service. Legacy found six houses in need of painting and 66 boys were given the task. The Legacy widow, Mrs Drowley of Fairfield appreciated their work and provided tea and scones. Otherwise it was at no cost to her. Pictured were Neil Gaule, Matt Campbell, Con Markidis, Neil Jordan, Peter Augustes and Bruce Permezel. The article was cut from the newspaper and pasted into a scrapbook. For many years Legacy kept scrapbooks of press clippings that related to their work and publicity.
