On 15 December 1994 the former Shire of Eltham ceased to exist following the Liberal Kennett Government local council amalgamations. A new Nillumbik Shire Council was established with unelected commissioners appointed. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. The Advisory Committee was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. The Recommendations of the Advisory Committee were: i. The cafe and take away food premises are as of right uses and are therefore allowable, but that shop and petrol station are unacceptable uses. A community facility is a discretionary use and is acceptable. ii. A development of the type and scale proposed is totally inappropriate for this land and that the Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, café/takeaway food premises, a retail facility and a community facility, with associated advertising signs, be refused. iii. The Eltham Community and Reception Centre was Australia's first public mud-brick building. Commissioned in 1977 by Eltham Shire Council, led by Shire president (and architect) Robert Marshall, architects Whitford and Peck were asked to design a multipurpose facility in mud-brick and timber. New citizens have made their vows, volunteers have been honoured, school children have performed, weddings celebrated and people mourned at funerals. Since 1978 the Eltham Community and Reception Centre at the corner of Pitt Street and Main Road, has provided a beautiful and quintessential Eltham environment for people from all over Melbourne. Recognised as Australia’s first public mud-brick building, the centre was built partly on the site of the parsonage of the former Methodist Church (now the Uniting Church).1 Commissioned by the Eltham Council headed by President Robert Marshall, architects Whitford and Peck were asked to design a multipurpose facility in mud-brick and timber. Following public consultation, it was agreed to build a centre for dances, exhibitions, films, plays or concerts. The results – at a cost of around $620,000 – captured the Eltham rustic style. The building – in soft tones of mud-brick and timber and immense floor-to-ceiling windows – overlooks the Diamond Creek and sporting fields. Eltham’s strong artistic heritage is reflected in the centre. Although the lighting is not ideal for a gallery and labels cannot be placed on walls, the centre hosts the Nillumbik Art Awards and displays around ten to 20% of the Nillumbik Shire Art Collection, usually for around a year at a time.2 On permanent display, close to the entrance, is local artist Clifton Pugh’s White Choughs in the Landscape. Further to the right is the Walter Withers Gallery, named after a local member of the Heidelberg School of artists. As part of the Eltham Gateway opposite the Eltham Hotel, the centre stands on what was once part of the Eltham Town Centre along this section of Main Road, then known as Maria Street. On the same site once stood the house and flour mill owned by Henry Dendy, best known as the founder of Brighton, although he lived longer in Eltham. Beside the drive is a wheel-rim tool with accompanying plaque, illustrating a technology important during the horse-powered age and now almost completely gone, as has the blacksmith’s shop that had housed it nearby. The implement is a platform for fitting iron tyres to the wooden rims of cartwheels. Beneath it is a capsule placed in 1985 to commemorate Victoria’s 150 years, which is to be opened in 2035. Although the plants, forming part of the landscaping by Peter Glass and Denis Edwards, are largely indigenous and other native species, some exotic plants are protected as an important link with the site’s past. Planted at the front around 1920, is a large Peppercorn tree with two joined trunks growing from the base, and close by is a Bhutan Cypress (Cupressus torulosa). Three other Peppercorn trees fringe the drive. The building includes two halls – the larger seating 250 people – and a large foyer overlooking trees and ovals. Both halls have retractable rear walls providing varying spaces as required, and guests can use several external decks. A site for outdoor theatre has been carved out of the natural slope outside the entrance. The Bricklayers Union refused to use the traditional mud-bricks, which weigh more than 22kg. As a result the mud-bricks were redesigned to reduce their weight and were laid back-to-back to produce a wall of normal thickness.3 The centre’s massive timber frame is reminiscent of timber bridge construction, with infill panels of mud-brick.4 In accord with the rustic style are colossal rough-sawn posts, bolts and steel brackets. The combination of mud-brick, exposed feature timber framing and creative design in this centre, characterises Eltham’s innovative buildings and the social movement behind them from the 1940s to the 1970s.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. The main feature of this monument is a ‘tyring disc’, a blacksmith’s implement that was found on this site. This consists of a large iron disc that was used as a platform for fitting iron tyres (like the one shown on top of the platform) to wooden-spoked cart wheels. The local blacksmith and wheelwright worked together to assemble the wheel, which was clamped to the platform placed close to the fire. The red-hot iron hoop, previously forged to the correct size, was lifted with tongs by the blacksmith over the outside of the rim, then hammered down amid flames from the scorching timber. The wheelwright drenched the tyre with cold water as soon as it was in position. A clamp placed on the naff (hub) and screwed down tightly kept the spokes at a constant angle as the tyre cooled. An even pressure from the contracting tyre tightened the joints at each end of the spokes and formed a vice-like grip, which would last for the life of the wheel. Comparison photo: SEPP_0610 - Main Road near Railway Station, c.1911 Shows Luther and Ada Haley’s General Store, Bakery and Tea Rooms opened September 1902 directly opposite present day Arthur Street. This was the first building in what is now Eltham’s present shopping town centre. Haley previously ran the General Store and Bakery on the corner of Main Road and York Street until his lease expired and the premises were bought by Mrs Sarah Burgoyne in 1902. Haley sold the store to Hannah Lloyd in 1917 who operated it until 1920. It then went through a succession of owners until Eric Staff purchased it in 1939. Ray Staff succeeded his father in 1954 and eventually demolished the store in 1965 opening up a new supermarket, the Eltham Big Star Food Centre. That building still stands at 929 Main Road and is the Nongkhai Thai Restaurant. On the eastern (right) side of Main Street is Haley’s Paddock, which was used on occasions for community picnics. Capable of holding 10,000 people, with ample shade and hilly surroundings it was an ideal place for any community gathering such as the State Schools’ Picnic in 1904. It was not until the early 1920s that stores started to appear between Luck and Dudley Streets. Part of a presentation by Peter Pidgeon to the Society, 13 August 2022 showcasing a series of photographs taken by John Henry Clark over the period 1895 to 1930. John Henry Clark was the youngest of three boys born to William Henry Clark (1823-1877) and Maria White (1843-1914). He and his brothers, William Charles Clark (1872-1945), Clement Kent Clark (1874-1912) operated a photography business (Clark Bros.) from 25 Thomas Street, Windsor near Prahran during the period c.1894 to 1914. Following death of Clement in September 1912 and their mother in 1914, the Clark Bros business appears to have dissolved, the premises demolished, and a new house was under construction in 1915. John set up business independently in 1914 operating out of 29 Moor Street, Fitzroy where he is registered in the 1914 and 1915 Electoral Rolls. By 1916 John had relocated to Eltham where he continued his practice as a photographer and took many of the early images around the district of Little Eltham. Around 1930 John changed professions and opened a small cobbler's shop in 1931 near the pond opposite Dalton Street adjacent to the Jarrold family cottage. He never married and continued his profession as a bootmaker from this little shop, maintaining a close relationship with Mrs Jarrold for the rest of their lives. On Saturday September 2, 2023, Russell Yeoman led a group of 22 society members and interested others on a walk following trhe bounadries of the original Shillingalw farm. Commencing at the corner of Panther Place and Library Place, we proceeded up to Shillinglaw Cafe then the Shillinglaw trees at the former Eltham Shire Office site then along Main Road to the fire station then throughh St Laurence Lane and uinder the railway line , along Diamond Street then return via the Diamond Creek trail behind Andrew Park. The actual farm boundary went past the creek and further up the hill. The original farm comprised lot 90 of Holloway’s 1851 subdivision of Little Eltham. Its area was 30 acres lying east of the Diamond Creek and north of Henry Street. Produced by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Pty Ltd as part of the planning process for redevelopment of the former Eltham Shire Office site at 895 Main Road. In 1963 the Shire of Eltham purchased the Shillinglaw property of approximately 2 acres in Main Road, Eltham for the widening of Main Road and as a site for new Council offices. This land, which contained the Shillinglaw Cottage (c1878-80), was the remaining section of the Shillinglaw family holding that originally comprised 30 acres, being Lot 90 of Holloway's 1851 subdivision. Eltham Council intended to demolish this cottage, but through extensive community action it was saved, funds were raised, and it was relocated to the current site adjacent to the Eltham Library. The new Eltham Shire Offices opened in 1965 were designed to ensure retention of the three Italian Cypress trees that were located outside the Shillinglaw Cottage. In 1971 the building was extended at the southern end to provide additional space, including for the Eltham Library and Council's Engineering Department. Renovations were undertaken to the offices during 1987. The Victorian State Government commenced to restructure local government in 1994, which resulted in the establishment of the Shire of Nillumbik and the cessation of the Shire of Eltham. This new Nillumbik Shire Council was headed by government appointed commissioners, who decided in 1995 to put the former Eltham Shire offices on the market. Eventually in June 1996 the property was sold for $1.1 million and the building was subsequently demolished. A planning application for the site was then submitted to Nillumbik Shire Council in September 1996 for construction of a 24-hour service station, convenience store, cafe/takeaway food premises, a retail facility and community facility. There were many objections to this proposed development and in controversial circumstances a planning permit was granted by the Nillumbik Shire Council commissioners. After protracted actions involving a planning panel and a planning advisory committee, established by the Minister for Local Government, the proposal was eventually rejected as not satisfying the requirements of the planning scheme. In December 1997 the purchaser withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract. While there have been a number of possible development proposals considered by subsequent Nillumbik Shire Councils, this site has remained vacant since July 1996. TIMELINE (Prepared by Jim Connor, Eltham District Historical Society- March 2018- Based on press, council and personal records) June 1996 - Eltham Shire offices sold to Dallas Price Homes for $1.1 million. July 1996 - Shire office building demolished against community's wishes. Council claimed building riddled with asbestos. September 1996 - Planning application submitted to Nillumbik Shire Council to construct on the site a 24 hours Shell service station, convenience store, Hungry Jacks café/takeaway food premises, a retail facility and community facility. 213 objections and petition of over 1400 signatures received. Minister for Planning and Local Government orders an independent investigation into valuation and sale. 9 October 1996 - Permit granted by Nillumbik Shire Council commissioners, in controversial circumstances. A Planning Special Committee consisting of 3 commissioners and 3 community representatives considered 32 community objections. One commissioner declared a potential conflict of interest so only 2 commissioners were able to vote. After hearing all objections, the community representatives moved a foreshadowed motion to refuse a permit. The commissioners then closed the meeting, formerly opened a council meeting (for about a minute) and approved the application. October 1996 - Community members appealed planning decision to Administrative Appeals Tribunal. November 1996 -Minister for Planning and Local Government Robert McClelland calls appeal in and directs MT to refer this 'major policy issue' to the Governor in Council. February 1997 - Planning panel (Dimity Reed and Margaret Pitt) established to consider submissions. March 1997 - New council elected with five councillors. April 1997 - Three of the five new councillors vote to fight Commissioner's decision to grant a permit. April 1997 - Planning panel (Dimity Reed and Margaret Pitt) conducts hearings at Nillumbik Shire offices. June 1997 -Planning panel rejected Dallas Price Homes proposal as being 'totally inappropriate' for the site and recommends the site be rezoned for 'public purposes'. July 1997 - Dallas Price Homes threatened to sue Council and individual councillors. October 1997 - Report released of an Advisory Committee (Paul Jerome) established by the Minister for Planning and Local Government. Committee considered Dallas Price Homes proposal and an alternative concept plan proposal by Council for a gallery, workshop, offices and cinema community-based development. Advisory Committee recommended Dallas Price Homes proposal be rejected as not satisfying the requirements of the planning scheme and recommended further testing of the financial viability of Council's proposal. December 1997 - Dallas Price Homes withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract, which expired on 28th November and was not renewed by either side, after previously being extended twice pending a decision by the Minister. Council had to pay developer $58,000 for demolition costs. February 1998 - Dallas Price Homes application rejected by Planning and Local Government Minister. October 1998 - Nillumbik Councillors suspended and an Administrator appointed (until March 1999). The demolition of the former Shire of Eltham offices and proposed sale and development driven by the Commissioners for Nillumbik Shire Council brought the community together in substantial protest at the infrigement of ratepayers democratic say in local government and ciommunity assets combined with protests about inappropraite development of Eltham's Gateway. The institutions of law and order in Colonial Victoria included the police, courts and prisons. The 1852 report of the Snodgrass Select Committee appointed to "identify the policing needs of the colony” noted there existed seven independent police forces that did not co-operate or regularly communicate. Following the committee's report all these police entities were merged into the Victoria Police, founded on 8 January 1853, to implement law and order responsibilities throughout the Colony of Victoria. The Eltham Courthouse (1860) and adjacent Police Residence (1859) formed a justice precinct established in the immediate aftermath of the 1852 police inquiry and the effects of the gold rush. The physical presence of these buildings, in the centre of the early Eltham township, defined centralised control over law and order. In the early days the Police Constable in charge would conduct his duties travelling around the district by horse; a stable was located at the rear of the residence. At times the horse would be grazed on the paddocks across the road. Horseshoes were forged by the blacksmith beside the Courthouse on the high side of “Policeman’s Hill”. Along with the stable, there was a two-cell bluestone lockup where prisoners were held awaiting trial in the adjacent Courthouse. Their meals were usually provided by the policeman’s wife or from the hotel just up the road. With the arrival of the railway in 1902 the town centre gradually shifted towards the railway station. The Police Station and operations were moved into the town centre in 1961 to a renovated house in Pryor Street, which was later replaced by the current Police Station. From 1961-1981 the residence was occupied by the Vermin and Noxious Weeds Destruction Section of the Department of Crown Lands and Survey. Prior to August 1967 the former Police Station was dragged to the rear of Police Residence to make way for the construction of a driveway and access from Main Road. The building was placed on the site of a former Scullery and modified for Lands Department use. In 1981 the Shire of Eltham took over management of the former Police Residence in Eltham. It remained unoccupied for a period whilst its future was discussed in Council. It was then used for a community job creation scheme until 1985. In 1985 the Shire of Eltham Parks and Environment occupied the residence. Council improved the driveway but later added a second rear access from Brougham Street due to the dangerous nature of the Main Road entrance. Additionally, a rear toilet facility between the Police Residence and the relocated former Police Station, which was doubling up as a lunchroom. Council also commenced discussions to re-establish a replica Police Station. Around November 1986 the former Police Station was demolished; believed to have been suffering termite damage. About 1989, after some years of discussion, a replica Police Station was built, based on photographs, to act as a lunchroom and meeting room for the Parks and Environment staff and volunteers doing community service. In 1996 Eltham District Historical Society held discussions with Nillumbik Shire Council commissioners throughout the year regarding a home for the Society. A proposal was put forward by the Society in October to occupy the former Police Residence. In March 1997 Eltham District Historical Society gained access to former Police Residence and on July 12, 1998, moved into its Local History Centre. In July 2018, Eltham District Historical Society gained access to the replica Police Station (which had been used as a music library and storage for the Eltham Concert Band) for use as part of regular heritage tours for schools and community-based groups. Belle Vue property in Livingstone Road, Eltham was once owned by Society member Jo McCormick. Jo was a valued member of our committee and dear friend of many of our members until her death in 2009. Belle Vue is the farmhouse of a property that is now a significant part of suburban Eltham, just a short distance north of the town centre. Originally purchased by pioneer Eltham farmer Henry Stooke, the present-day old farmhouse sits within an extensive suburban residential area. The history of the property is largely based on a heritage assessment prepared by consultant Lorraine Huddle for Nillumbik Shire Council. Additional information from our Society records reveals Belle Vue farm comprised about 56 ha (140 acres) extending northerly from the northern boundary of Holloway’s 1851 Little Eltham subdivision. On the present day map the southern boundary was just north of Elsa Court and Grove Street. The western boundary was the Diamond Creek and extended northerly to Main Road where it turns easterly towards Research. It was traversed by the main road to Kangaroo Ground and beyond and from 1912 by the railway to Hurstbridge. From 1895 the farm was owned by William Williams and his wife Mary Ann. In 1914 -15 they built a new house now known as Belle Vue. They sold the land in 1920 and residential subdivision began soon after that. Belle Vue remains today on a substantially subdivided and very much reduced size residential lot in Livingstone Road. The house and many old trees on the site were subject to a heritage overlay under the Nillumbik Planning Scheme. The Rose Series P. 4284 post card Taken from near what would be present day CLC car park looking southwest across Diamond Street, present-day Andrew Park to the railway station and developing Eltham shopping precinct. Arthur Street visible, Pryor and Luck Street not evident. Sunnybrook, the Taylor home is visible at the top of the hill in Bible Street. Only three residences visible in Arthur Street on the southern side, two of these are the David Harbison Rest Home at 10 and 12 Arthur Street (built and opened in November 1919), present day site of Eltham Mall. There are none on the north side of the street. Based on 1945 aerial view there are 8 buildings on the northern side between Main Road and Bible Street which and given the extent of commercial development on Main Road, it is estimated this image is circa 1925. Luther Haley was the first to build an open a baker and General Store in this location next to the railway station in 1902. However, it took nearly twenty years until the early to mid-1920s when a period of significant growth in the Eltham shopping centre happened with many businesses relocating their operations from the original town centre of Maria Street in Little Eltham as well as new businesses opening. Other stores/buildings noted (L-R) are: Stationmaster's House built circa 1910 Eltham Hardware Store opposite the railway station first opened on Main Road opposite the Railway Station around late 1922. An advertisement placed in the Hurstbridge Advertiser advised that the Hardware Store had just opened with a varied stock of Saws, Hammers, Nails, Shovels, Screw Drivers, and every article required in a house or on a farm. People were also encouraged to try their Jams, Pickles, Sauces, Cups and Saucers, etc. Newsagency with 'Leader' advertising on awning - E. J. Andrew opened his newsagency shop opposite the station in March 1923, advertising for sale stationery, school requisites and periodicals. Bird Brothers Cash Grocer & Fruiterer opposite the railway station offering summer drinks and confectionery a specialty with a full Stock of groceries of the best quality always on hand at city prices opened December 1921 William Capewell's Butcher shop at the corner of Dudley Street. Capewell previously had a small shop in front of the station opposite Luck Street. He enlisted in the AIF during WW1 and returned home in 1919. He re-applied for a slaughtering license in February 1920 and was advertising by October 1922 supplying all districts. Not visible (or not yet identified) but in business by October 1922 were: J.H. Fraser, Carpenter and Builder at Luck Street opposite the station George A. Danslow, Hairdresser and Tobacconist opposite the railway station Miss Barber's 'Blue Gum' Soda Fountain opened October 1922 opposite the railway station (hidden behind Stationmaster's House). It was so named due to its proximity to a tall Blue Gum tree G.H.
