The law court buildings on the corner of Russell and La Trobe Streets (Melbourne) were later to house the Supreme Court of Victoria. The law courts were built in 1842. The inscription by Dorothy Rogers [sic] incorrectly describes the builders as Swanson Bros., who instead were the builders of the later Magistrates Court on the same site. The portrait was commissioned after Higinbotham's death in 1893. A committee was appointed to investigate the making of a portrait and they appointed Mr L Bernard Hall, instructor and later director of the National Gallery of Victoria. George Higinbotham (1826-1892) had a distinguished career as a newspaper editor and politican before becoming a Judge of the Supreme Court in 1880 and the third Chief Justice in 1886. Higinbotham was a long serving attorney-general in the 1860s colonial administration. Higinbotham was active in the education, land and constitutional debates of his time. He played a prominent role through his chairmanship of the of the Royal Commission into Public Instruction with regard to the introduction of the free and secular primary school education.The portrait of George Higinbotham is of historic significance as the depiction of an important public figure in 19th Century Victoria. This is an 1886 certificate admitting George Mackay to practise as an attorney, solicitor and proctor in the courts of the colony of Victoria. George Sutherland Mackay (1850-1926) was born in Scotland and educated at the University of Glasgow. He came to Australia in 1884. In 1891 he came to Warrnambool and established a legal practice in Kepler Street. In 1893 he bought the practice of the late James Fletcher and the firm was then known as Fletcher and Mackay. It changed to Mackay and Taylor (later Mackay Taylor) when J.D. Taylor became his partner in the 1920s. In 1999 Tait Solicitors and Mackay Taylor amalgamated to form Tait Taylor and in 2010 the firm’s name became Tait Legal. This certificate is of considerable importance as a significant memento of George Mackay, a prominent lawyer in Warrnambool from the 1890s to 1926.This is a paper certificate pasted on board and set into a brown cardboard frame. The certificate has brown or gold handwriting with some calligraphy, three or four stamps (mostly obliterated), a green duty stamp and the remains of a signature. This painting was presented to the library in December 1930. The painting had been paid for through subscription from Judges of the High Court, the Supreme Court and the County Court as well as both branches of the legal profession. An almost identical portrait is held by both the Melbourne Cricket Club and the National Gallery of Victoria. This portrait is of interest for its subject and artist. Sir Leo Cussen (1859-1933) is probably best known for his role in two consolidations of the Victorian Statute books in 1915 and the mid 1920s. These were immense undertakings and included determining the application of English Law in Victoria. Sir Leo was appointed at Surpem Court Judge in 1906, he was at various times Acting Chief Justice of the Supreme Court of Victoria. In addition, he was trustee of both the Art Gallery (NGV) and the Melbourne Cricket Club, and held various positions with the Melbourne University Law Faculty and the Council of Legal Education. Sir Leo was regarded as one of the finest legal minds of his generation and at his death, Robert Menzies, at this time the Attorney General, said that Sir Leo was "one of the great lawyers of the english speaking world". Sir John Longstaff was one of Australia's best known and well regarded portraitist in the early 20th Century, he won the Archibald prize five times (1925, 1928, 1929, 1931 and 1935).3/4 Lenght portrait in Oils of Sir Leo Cussen, a judge of the Supreme Court, 1906-1933. This bible, similar to so many other 19th Century bibles, was used in the Supreme Court throughout the 19th Century for the swearing in of witnesses. The bible is an important link and artefact of the Court's early years.Black leather embossed bible. Correspondence held by the library has John Denniston Wood (1829-1914), a barrister and politician, presenting the portrait to the Library Committee in 1867. Wood hopes that the painting will "hang there [in the Court] in like manner as the portraits of many of the sages of the law are held in the Courts at Guildhall". Wood also provides information about the painter, Mr Mosely "now deceased", but who was "selected by Sir WIlliam himself" to undertake the commission. Early accounts have the painting hanging in a prominent position in the 'old' Court house at La Trobe and Russell Streets; the portrait was moved down to the library in 1884, when the portraits of Barry, Stawell and Molesworth were also commissioned. Sir William a'Beckett was the first chief justice of the colony of Victoria, having previously had a busy career at the Sydney bar. The portrait is of historic signifcance because of its subject Sir William a'Beckett and its long association with the Court. Tait collection: item 23 of 62 This paper contains details of the Will and Probate papers of John Joseph Flahavin who died in December 1902. He was a farmer at Kirkstall but no further details on him have been found. He left real estate to the value of £100 and personal estate to the value of £5 to his wife Margaret Flahavin. She died in the June of the following year before her husband’s will had been finalized. The lawyer in the case, Ernest Chambers, had legal offices in Warrnambool. Port Fairy and Koroit at the end of the 19th century and the beginning of the 20th century. This document in his possession passed to successive lawyers occupying the legal premises in Kepler Street and were located there in 2014 and passed on to the Warrnambool and District Historical Society. This document is of some interest as it concerns a Kirkstall resident in the early 1900s. It will be useful to researchers.This is a cream-coloured piece of parchment paper folded in two (1903). It has handwritten material on three sides of the paper. Tait collection: item 25 of 62 This document contains details on the will and probate of Joseph Kelson, a farmer from Kirkstall who died in April 1906. He was a contractor who died at the age of 46 leaving a widow, Margaret (nee Flahavin) and eight children. The two oldest boys took over the contracting business and Joseph’s brother, David, supported the family during their time of need. Joseph Kelson left personal estate to the value of £460 with the chief beneficiary being his widow Margaret. Ernest Chambers, the lawyer who drew up this document had a legal practice in Warrnambool, Koroit and Port Fairy at the end of the 19th century and the beginning of the 20th century. He had possession of this document and it passed down to successive lawyers who occupied the Kepler Street legal premises and it was located in this building in 2014 and passed on to the Warrnambool and District Historical Society. This document is of interest as it gives details of the will and probate of Joseph Kelson who lived in the Warrnambool area during the late 19th and early 20th centuries. He left real estate to the value of £200 and personal estate to the value of £43. The beneficiaries were his daughter Harriet Jones, his son Frederick Augustus Jones and his grandson, Claude Eagle. No other information has been found on Frederick Jones, Senior. This document was in the possession of Ernest Chambers who had legal offices in Warrnambool, Port Fairy and Koroit at the end of the 19th century and the beginning of the 20th century. It was then passed down to successive lawyers occupying the legal premises in Kepler Street and located in 2014 in the same building, the former offices of Mackay Taylor. It was then passed on to the Warrnambool and District Historical Society. This is a cream-coloured piece of parchment folded in two containing handwritten material on the Probate of Frederick Jones of Nirranda, 1911. Two of the pages have ruled black lines. Tait collection: item 25 of 62 This is a 1904 document containing information on the Will and Probate of William Charlesworth. He died in September 1904. He was a chimney sweep and nightman who came to Warrnambool in 1854 and married Sophia Ingham in 1855. They had six children but their married life was stormy because of Sophia’s problem with alcohol. She became notorious for her court appearances and gaol terms and her erratic behaviour in public. William Charlesworth was not able to control the situation and tried several times to get her to leave the town. Sadly she committed suicide in 1891 by throwing herself off the Hopkins River Bridge. William Charlesworth left real estate to the value of £650 and personal estate to the value of £194. The main beneficiaries were Charlesworth’s son, Alfred, his daughter Amelia Charlesworth and his grandchildren, George and Alice Tait. Ernest Chambers, the lawyer concerned with this document, had legal offices in Warrnambool, Port Fairy and Koroit in the late 19th century and the early 20th century. The document was passed down to successive lawyers who occupied the legal premises in Kepler Street and located there in 2014 when it was passed on to the Warrnambool and District Historical Society. This document is of considerable interest as both William and Sophia Charlesworth were well-known residents of Warrnambool in the 19th century. The beneficiaries of her will were her husband, Francis and her three children, Sarah, James and Doris.
