... Legal record... of Lease, Appelant to Responent Legal record Transcript of High ...The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. Architects Surveyors Engineers Legal record Architects Surveyors ...This ledger came from the office of John William Crawley, Junior, a surveyor, engineer and architect in private practice in Warrnambool and the engineer for the Shire of Warrnambool from 1895 to 1935. He had succeeded his father, John who had been engineer for the Shire of Warrnambool from 1874 to 1895. Lorenzo, the brother of John Junior, was Shire Secretary from 1904 to 1947. Rolf Crawley, the son of John William Crawley Junior, succeeded him as the Shire of Warrnambool engineer and served from 1935 to 1968. Thus the Crawley family recorded a total of 132 years of service to the Shire of Warrnambool which existed from 1863 to 1994. The ledger gives details of the accounts for engineering services for the years 1925 to 1935 from the office of John William Crawley Junior who for some of this time had his son Rolf in the office as an assistant engineer. This ledger is of interest, firstly because it is a work document that belonged to John Crawley, Junior in his capacity as an engineer in private practice and as the engineer of the Shire of Warrnambool in the 1920s and 30s and secondly because the entries in the ledger contain information on many prominent residents of Warrnambool and district during that time. It will be useful to researchers. This is a hard cover ledger of 151 pages with a black cover with red leather edging on the corners and on the spine. There is gold lettering on the spine. The pages have printed red lines and alphabetical tabs inserted in the first few pages. The ledger contains handwritten entries in black ink. There are some loose sheets among the pages. Ledger J.W. certificate, July 3, 1858
This is a certificate of indenture, a legal agreement, between George Beattie of Forest Creek, near Castlemaine in the colony of Victoria, and Peter Christian Smith of the same place. Both were miners. Beattie was the vendor and Smith paid twenty-five pounds for a land parcel. The contract was witnessed by John Hedderwick, a law clerk in Castlemaine. There is a record in the Mount Alexander Mail, dated Wed. 22 April 1857, of George Beattie purchasing land for three pounds, sixteen and sixpence in Castlemaine and that it was withdrawn. Records also show that a Peter and Thomas Smith farmed in Sandon near Castlemaine.This item is a useful research tool as it a hand-written record of part of the history of the gold fields region of Victoria.A white paper certificate of conveyance with black print and hand-written details from George Beattie to Peter Smith. Document - Miles Staunton Probate 1895, 1898
Tait collection: item 46 of 62 This is a document giving details of the Will and Probate of Miles Staunton (called Miles Stanton in the Will and Myles Staunton in the official Victorian death records). He died at Tower Hill in 1898 at the age of 72. He was a farmer in the Koroit district and left real estate to the value of £2799 and personal estate to the value of £128. The chief beneficiaries were his wife and children. Miles Stanton was unable to write and signed his will with a cross. The lawyers involved, Fletcher and Mackay and Ernest Chambers, had legal offices in Warrnambool at the end of the 19th century. The document, with others, was passed down to successive lawyers occupying the legal premises in Kepler street (Fletcher and Mackay, later Mackay Taylor) and located in this building in 2014. This document is of some interest as it gives details of the Will and Probate of Miles Staunton who was a 19th century farmer in the Koroit district.This is a white piece of paper folded in two to make four pages. Three of the pages have ruled margins in red and there is handwritten material on four pages in black ink. There is no proper seal attached but there is a hand-drawn circular sketch representing the seal of the Supreme Court of Victoria. This Register of Mortgagees comes from the Warrnambool legal firm of Fletcher and Mackay which resulted from the merger of the firms of George Sutherland Mackay and James Fletcher in 1893. G.S. Mackay was a prominent resident of Warrnambool from 1891 to his death in 1926. In the 1920s Mr J. Taylor became a partner in the firm known then as Mackay and Taylor and the firm later known as Mackay Taylor was in operation until the 1990s at 131 Kepler Street. The Register of Mortgagees with dates ranging from 1908 to 1924 comes from the old Mackay Taylor offices in the Kepler Street building.This Register of Mortgagees is of some significance as it contains information on many families living in Warrnambool in the early 20th century, including those of Burleig, Swinton, Uebergang, Turland, Bates, Wood and Paton. The entries have social significance, showing the typical loans taken out at the time and the prevailing interest rates. This is a small quarto sized ledger containing 166 pages of a register of mortgagees. The pages have been printed with ruled red lines. The cover is bound with a black cover and a red spine. There are pages with alphabetical tabs at the start of the book. The entries are in black ink. There is one loose page which is an old envelope used as scrap paper to record names and amounts owing or paid. This book is a diary (1926 and 1927) which appears to contain summaries of letters written to clients of the Warrnambool legal firm, Mackay and Taylor. The summaries give the name of the recipient(s) and the content of the letter. The numbers next to the summaries may refer to the number of the client or the number in the letter book. George Mackay who died in 1926 set up the original legal firm in Warrnambool in 1891 and merged with James Fletcher in 1893 to form the Fletcher and Mackay business. In the early 1920s J. Taylor joined the business then known as Mackay and Taylor. This business with other partners survived in Kepler Street until the 1990s. This book has some significance as it contains the names of many residents of Warrnambool and district during the 1920s and gives some indication of their dealings with their lawyers. It also shows the system used at the time to record the transactions of law firmsThis is a ledger with a black cover and red binding (foolscap size). The Warrnambool legal businesses of George Mackay and James Fletcher merged in 1893 and was known as Fletcher and Mackay. In the 1920s Mr Mackay took J. McD Taylor as a partner and the premises at 131 Kepler Street were built about that time, with the firm being known as Mackay and Taylor. After the original partners died there was a succession of partners with the legal firm continuing as Mackay Taylor until the 1990s. These account sheets from a prominent 20th century legal firm in Warrnambool are of considerable importance as they document the legal records of many Warrnambool and district personalities from the early 20th century. The information contained in the sheets will therefore add to the known history of many local people from the past and will be very useful to researchers.These are handwritten accounts for bills to be paid to Mackay Taylor Lawyers for services rendered. The accounts are described in detail and are written on quarto size paper with the requisite red lines already printed on the pages. There are over 100 sheets and they date from 1938 to 1940.
