In 1993 Eltham Shire Council issued a permit to Michael Muzur, Terry Lant and Andrew McMillan to redevelop the former Montmorency Theatre/Bingo Hall at 41-43 Were Street as an alcohol-free youth entertainment centre. Ron McCormack, retired former JP on behalf of 41 Joint Appellants consisting of local residents and traders successfully lobbied the community and won an Appeal to have the permit cancelled as unsuitable development. The Administrative Appeal Tribunal found that the proposed development came withing the Eltham Planning Scheme definition of an 'amusement parlour' and that the playing of pool an amusement machines would be the focus of the centre and unlikely to attract older age groups. The tribunal was not satisfied the applicants had sufficient knowledge or where with all required for the successful running of this type of operation. With respect to the objectors, the Tribunal did not accept that a responsibly managed and attractive amusement parlour could not coexist near the adjoining residential area and without detriment to the commercial centre. At a Council meeting on June 7, 1994 councillors requested a report outlining criteria to be used to assess planning applications for youth entertainment venues given the Tribunal's view that a poorly managed facility in a small neighbourhood shopping centre, particularly in such close proximity to a residential area would not only have the potential to increase perceived youth problems, but could jeopardise the prospects of future proposals. An article about Legacy and its work when it first approached the public for donations. It was in a folder of documents about the history of Legacy. Appears to have been mostly compiled by Legatee Cyril Smith as he has many hand written notes on miscellaneous pieces of paper (some are envelopes addressed to him). The notes were typed up into a summary of the History of Legacy. Also documents relating to the first time Legacy approached the public for donations in September 1956, including newspaper articles that were reprinted, a schedule of information that was approved to be released to the press, and a list of potential donors that was circulated to Legatees in the hope they could contact the ones they knew personally or professionally. The call for public donations was partially due to the purchase of the Dureau building and the need to modify the building for Legacy's needs. The documents from this folder have been added in seperate records (see 01262 to 01281). The folder was part of an attempt to capture history of Legacy, generally from the 1950s.The documents provide an insight into the working of Legacy, especially in the 1950s. The July 1973 appeal's target was $500,000, which with government subsidies aimed to pay for a nine-story building alongside stage one - a combined ten-storey teaching, research and medical centre. The new block was planned to provide the Austin Hospital with 218 additional beds, eight extra operating theartres and a comprehensive range of medical, diagnostic, therapeutic and anciliary services. The hospital conducted a door knock appeal in the Heidelberg and Eltham districts on Sunday July 22. This photo forms part of a collection of photographs gathered by the Shire of Eltham for their centenary project book,"Pioneers and Painters: 100 years of the Shire of Eltham" by Alan Marshall (1971). The collection of over 500 images is held in partnership between Eltham District Historical Society and Yarra Plenty Regional Library (Eltham Library) and is now formally known as the 'The Shire of Eltham Pioneers Photograph Collection.'
