The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. Handwritten extracts, with typed copies, from the Bendigo Advertiser Monday July 24th, 1933. First erected for 20 years. Mr. Cook performs Opening. Approx. 400 people attended the opening on Sat 22nd. Expected that when run in, the ore will be crushed for 2/6 per ton. Consists of 10 heads, 1000 lbs each. Boxes are of Homestake pattern with wooden horses of special timber and iron guides. Copper plate tables of ample area provided. Floors are of concrete and so graded that all washings - -. Expected later to expand to 30 head. A 114 H P Ruston-Hornsby crude oil engine is provided with a friction clutch to facilitate easy starting and will be capable of driving the battery when it is extended. THE JACKET This jacket has been tailored to flatter the wearer’s figure. It also has elements that keep it in good shape and condition, preserve it from soiling and give it a longer life: - the hooks and eyes that join the jacket to the skirt allow the outfit to be made in two pieces but fit close to the body without exposing undergarments - the seams for the metal stays have been cut and stitched to allow maximum movement of the wearer and still keep a trim figure - the discreet breast pocket allows the wearer to keep a handkerchief, coins or other small items close at hand - the lining includes removable padded shields to absorb underarm perspiration - the lining has two cotton loops attached for hanging up to air and freshen it - new cuffs have been attached over the original sleeves that have buttonholes but no buttons. The buttons may have been used to replace missing buttons on the front of the jacket or perhaps to repair worn cuffs The amber coloured satin jacket is fully lined, has turned-back cuffs, a band collar, and looped, coffee-coloured braid trim. A row of closely spaced, round bronze buttons with a floral motif form a decorative closure most of the way down the front of the jacket, below which are metal hooks and eyes that finish at the waist. Underneath the cuffs there is a closely fitted cuff with a row of three button holes but no buttons. The jacket lining has vertical metal stays spaced around the midriff, sides and back. There is an absorbent, removable pad hand-stitched to the underarm section of each sleeve opening. A small satin pocket is stitched discreetly onto the lining above the chest on the right-hand side. The Olivetti company was founded in Italy in 1908.This particular typewriter is a Olivetti Lettera 22, oblique front stroke and portable manufactured after 1950. The 1950s and 1960s was a time when British manufactured goods were still purchased by many Australian consumers. The later 1960s onwards, there was a shift, mainly in the cities, to European made goods. The invasion of Japanese manufactured goods was relatively slower, especially in rural areas. The demand for long lasted and dependable merchandise was in the rural area still the most important criteria. The ease of setting up this typewriter and its compact mobility was its major benefit to trades people and travelling professionals, e.g. rural doctors, other medical professionals, accountants, lawyers and educators. This item facilitated the growing numbers of professional nomads requiring a relatively light office stationery package e.g. travelling novelist, writer, businessman and academics. This typewriter needed no electrical or battery power to operate it. Outback Australia, where at this point in time, was still relatively isolated from a good available electrical power reticulation and battery power, and therefore could not be totally measured as a highly efficient office environment.Although this typewriter was purchased from a business in Penrith, Sydney, N.S.W., it is significant that it travelled easily to the Kiewa Valley, demonstrating the mobility of certain sections of the community. This typewriter was designed by an Italian industrial designer, Marcello Nizzoli, in line with the art deco style of the 1930s and the colour and flexibility of the vibrant 1950s. The underlying theme of manufacturing in the 1950s was to produce equipment that was more efficient than what was inherited from the earlier period of 20th century. Improvements were made to this Olivetti typewriter by Giuseppe Beccio by reducing the number of parts made from 3,000 to 2,000. This reduction of parts and therefore cost of production was the major principle of the Japanese manufacturing juggernauts of the post World War II era. Efficiency and low costs material was becoming prime factors in the success of rural industries from the 1960s. Competition from overseas producers was starting to affect rural industries and the removal of the large range of tariff protection, especially rural products, required not only a shift of farm management but a more efficient cost savings modus operandi. This Olivetti Lettera 22, oblique front stroke portable (weighs 4kg) mechanical typewriter has a coral coloured plastic casing. The keys are made of black hardened plastic with white lettering, numbers and symbols (imperial fractions, and pound). It has a QWERTY keyboard as opposed to the Italian QZERTY. It has a lever to move the ribbon between black, neutral (for mimeograph stencils)and red colours (a red key is provided for highlighting specific words,letters or symbols) . This machine is fitted with only a black ribbon. It has a black rubber paper rollers and chromed metal parts on the carriage way. It has four rubber feet underneath the main body. On the left side of the roller there is a lever to adjust the roller from fixed (when mobile) through 1,2 and 3 line space gradients. From the vantage point of the colonised, the term 'research' is inextricably linked with European colonialism; the way in which scientific research has been implicated in the worst excesses of imperialism remains a powerful remembered history for many of the world's colonised peoples. Here, an indigenous researcher issues a clarion call for the decolonisation of research methods. In the first part of the book, the author critically examines the historical and philosophical base of Western research. Extending the work of Foucault, she explores the intersections of imperialism, knowledge and research; en route she provides a history of knowledge from the Enlightenment to postcoloniality. The second part of the book meets an urgent demand: people who are carrying out their own research projects need literature which validates their frustrations in dealing with various Western paradigms. Good luck dolls usually given to engaged couples but occasionally give to Japanese soldiers prior to deploying.Takasago dolls or, in English, Darby and Joan dolls. They are a set, the brighter one being an old lady, the other an old man. They were used as engagement presents, but during the war, they were sometimes (actually maybe rarely) given to soldiers as good luck charms, or ‘mamori’. They were said to be lucky as they contained the stitching (sewing) of 1000 ladies, ‘senninbari’ (a thousand ‘peoples’ needles). So mate, the original theory is probably correct. The soldier would have wrapped these dolls in water proof paper (made using persimmon tannin or kakishiba).He would have kept them around his waist in a waist band, called an obi or perhaps a ‘haramaki’ (a knitted stomach band).Anyway the dollls should remain together. I’m wondering if there are any messages inside? But if they are completely stitched closed, then they should remain that way. Pru Sanderson, in her groundbreaking ‘City of Kew Urban Conservation Study : Volume 2 - Development History’ (1988), summarised the periods of urban development and subdivisions of land in Kew. The periods that she identified included 1845-1880, 1880-1893, 1893-1921, 1921-1933, 1933-1943, and Post-War Development. These periods were selected as they represented periods of rapid growth or decline in urban development. An obvious starting point for Sanderson’s groupings involved population growth and the associated economic cycles. These cycles also highlighted urban expansion onto land that was predominantly rural, although in other cases it represented the decline and breakup of large estates. A number of the plans in the Kew Historical Society’s collection can also be found in other collections, such as those of the State Library of Victoria and the Boroondara Library Service. A number are however unique to the collection.The Kew Historical Society collection includes almost 100 subdivision plans pertaining to suburbs of the City of Melbourne. Most of these are of Kew, Kew East or Studley Park, although a smaller number are plans of Camberwell, Deepdene, Balwyn and Hawthorn. It is believed that the majority of the plans were gifted to the Society by persons connected with the real estate firm - J. R. Mathers and McMillan, 136 Cotham Road, Kew. The Plans in the collection are rarely in pristine form, being working plans on which the agent would write notes and record lots sold and the prices of these. The subdivision plans are historically significant examples of the growth of urban Melbourne from the beginning of the 20th Century up until the 1980s. A number of the plans are double-sided and often include a photograph on the reverse. This plan shows a subdivision with two sections: the ‘Boulevard Section’ and the ‘Riverside Section’. The first of these sections bordered Burke Road between Kilby Road and the farm beside the Yarra. Kilby Road, Munro Road, Burke Road and Old Burke Road bordered the 102 lots in the Boulevard Section of the plan. The streets within the Section included Walbundry Avenue, Inverness Way, Riverside Avenue, Cascade Street and Kyora Parade. These street names, at least in this subdivision plan linked the two Sections of the subdivision. At a later date, the City of Kew decided to alter the street names. Walbundry, Inverness, Riverside, Cascade and Kyora were all renamed as ‘Drives’ (e.g. Kyora Drive). The subdivision plan is of interest in that it names High Street in Kew as Doncaster Road. It also shows the location of the wooden church that was later removed to Yarraville on the corner of Kilby Road and High Street. The plan predates later developments such as the S. E. Memories of an old miner: I think your photo depicting what could have been the very last miner in Bendigo may be that of an old timer who sunk a shaft in the Flora hill area (now Hyett Estate?) in about 1950. He was known to us as ''old Tim''. The shaft was close to an existing mine drive which children of the day referred to as ''the Devil's Den''. We regularly assisted him with the windlass winding and panning. The site consisted of a small clearing, similar to the one depicted, occupied by a small tent, the shaft and windlass. Ash KEATING Among fifteen finalists this artwork won the 2012 Guirguis New Art Prize, a prestigious national acquisitive biennial art prize administered by Federation University Australia. The Guirguis New Art Prize (GNAP) is a national acquisitive $20,000 contemporary art prize which presents a selection of Australia's most exciting contemporary artists with works that explore and embrace new ways of artistic expression, utilising existing mediums and new technologies in innovative ways. Initiated and generously supported by local Ballarat surgeon Mr Mark Guirguis, this prestigious art prize is administered by the Federation University Australia (FedUni). As a local philanthropist and art collector, in developing the Prize, Mark Guirguis' aims were to celebrate the significance of the arts to communities and to Ballarat, emphasising contemporary art and 'living' culture, and to highlight FedUni's Arts Academy. Artist Ash Keating works across a conceptual, site-responsive and often collaborative art practice that incorporates painting, sculpture, installation, video, performance and public interventions, and has referenced a wide range of social and environmental issues within his art. Frequently working beyond the gallery, and often harnessing community narrative and energy, his work also draws upon myth, ritual and ceremony. 'West Park Proposition', 2012, is a three channel and screen video installation, utilising multiple camera video documentation of an endurance painting intervention undertaken on the morning of 01 September 2012 on the east facing wall of a newly built tilt-slab industrial building, situated on the direct edge of the current urban and rural boundary in Truganina, Victoria. The multi-screen work documents an endurance guerilla-style action painting intervention and ritualised painting performance in which a symbolic violence is enacted against a storehouse of commodity production and consumption. Upon winning the award artists Ash Keating said; “The work was made near Ballarat on the Deer Park bypass. It is an aesthetic comment about the way these new tilt-slab industrial buildings spring up without caring for the environment." The work, which took eight hours to create, was about reclaiming the space from “cost-effective architecture” without any aesthetics. The inaugural judge for the Prize, Jason Smith, Director, Heide Museum of Modern Art (MoMA) said, "Selecting the winner of this inaugural GNAP was exhilarating and excruciating: exhilarating because the seriousness of each artist's enterprise, and their uncompromising resolution of concepts, has created an inaugural exhibition of exceptional power. This first GNAP is a survey of some of the most poetic and provocative imaginations working in Australia today. Selecting one winner from such a show in which each of these artists has in some way transformed my thinking about the world was the excruciating part. Ash Keating's work West Park Proposition, 2012 kept drawing me back in the several hours I spent viewing the works. It simultaneously affirms the political and critical role of the artist as a key agent of change and action, and someone who reminds us of the beauty and resilience of humanity and nature in the face of unrelenting change. This drill once belonged to Goodall and Sons, who were blacksmiths in Terang. The smith was called upon to do a variety of work. In the early 1900s he was often the nearest person to be able to perform an engineer’s services for many miles around. The Dawn Ball-bearing Post Drill no. 611 is described in McPherson’s Catalogue as a “drilling machine with adjustable automatic feed, with improved Dawn coupler and ball-bearing thrust’. The heavy design of the flywheel enables it to maintain momentum” and is “fitted with pulleys for belt drive if desired” The hand crank drives an automatic feed to work off a cam-follow system opposite a large wheel. Made by Dawn Manufacturing Co. Australia 1920-1950. DAWN MANUFACTURING CO. Dawn Manufacturing Co. was founded in Coburg, Melbourne, in 1917 by the four Blake brothers, who were all engineers. After World War I Dawn was supplying drills Australia wide and the company was growing at a healthy rate. During the depression they remained busy, with employees working 60-80 hour weeks. Dawn was contracted to supply vices and clamps to the Australian Defence Department and munitions factory during the World War II. In 1959 the company was taken over by G.N. Raymond Group, then in 1973 the Siddons Ramset Limited acquired Dawn. In December 1991, Dawn became a unit of the United States owned Stanley Works Pty. Ltd. In November 1998 Dawn became 100 per cent Australian owned. HENRY GOODALL & SONS Henry Goodall (1870-1936) was proprietor of garages as H. Goodall & Sons Pty. Ltd., at both Terang (McKinnon and High Streets) and Mortlake (Dunlop Street). His business was in operation in at least in 1916 and perhaps well before, considering the date of the tyre bender and its use for wagons with wooden wheels. It was still in operation in 1953, chasing up debtors in Mount Gambier Court. Amongst the employees of H. Goodall & Sons Pty. Ltd. was Ernie Entwistle, a blacksmith (a soldier who died in 1916 ) and Alfred Hodgetts, radio expert (killed in a fatal accident in 1943, when he was in his early 30s ). Henry Goodall was involved in the community as a Justice of Peace, a deputy coroner, President of the Mortlake Hospital, trustee of the Soldiers’ Memorial Hall, and as a prominent Freemason. He and his wife had two sons (Charles and John) and one daughter (Mrs. Chas. Newton, of Skipton). The drill is locally significant as it was used by a local company in Terang and Mortlake in their blacksmith, wheelwright and garage business. Diamond Doves reside in Oceania and Northern America. They are often seen gathering in small groups and foraging on the ground near a source of water. Diamond Doves are granivores. Their diet includes seeds of herbs and grasses. The sound made by the dove is a slow "coo" often repeated twice. These birds are renowned for their ability to find their way home over large distances which has resulted in the use of these birds as messengers throughout history. This specimen is part of a collection of almost 200 animal specimens that were originally acquired as skins from various institutions across Australia, including the Australian Museum and the National Museum of Victoria, as well as individuals such amateur anthropologist Reynell Eveleigh Johns between 1860-1880. These skins were then mounted by members of the Burke Museum Committee and put-on display in the formal space of the Museum’s original exhibition hall where they continue to be on display. This display of taxidermy mounts initially served to instruct visitors to the Burke Museum of the natural world around them, today it serves as an insight into the collecting habits of the 19th century. This specimen is part of a significant and rare taxidermy mount collection in the Burke Museum. This collection is scientifically and culturally important for reminding us of how science continues to shape our understanding of the modern world. They demonstrate a capacity to hold evidence of how Australia’s fauna history existed in the past and are potentially important for future environmental research. This collection continues to be on display in the Museum and has become a key part to interpreting the collecting habits of the 19th century.The Diamond Dove is a small pigeon with red rings around their eyes. It stands on a wooden perch with an identification tag tied around one leg. The upper part of the body is a brown grey and the belly of the dove is a cream colour. This bird has distinctive white spots on the wings. This particular specimen is a grey coloured Diamond Dove. Prior to the digital revolution the only medium by which cartographic information could be reproduced and distributed on mass was via printed media. The final negatives (repromat) used to produce the printed products were the culmination of a complex cartographic process and were therefore carefully preserved and stored. Preservation of the so-called final negatives enabled subsequent reprinting with minimal cartographic intervention. Since the arrival of the Land Headquarters Cartographic Company at Fortuna in 1942 the repromat for all products produced by the Australian Survey Corps were carefully stored. With the disbandment of the Army Survey Regiment in 1996 the Defence Imagery and Geospatial Organisation (DIGO) inherited that repromat archive. It was immanent that the support for film based printing was ending so on 25 October 2004 a review was required to determine the way ahead for the repromat and paper maps stored in the DIGO Map Libraries. Most of these maps were produced by the Royal Australian Survey Corps. This report is the result of that review. The report recommends the disposal of the repromat and the retention of single map copies.
