(Victorian Government, 07 December 1945). Tom Kennedy, Jnr, and his wife, Lucy, lived at 109 Pakington St Kew. Tom Kennedy Jnr. died 02 November 1963. Lucy Kennedy died 28 November 1987. Moule, Hamilton, and Derham) appeared for plaintiffs before Mr. Justice Macfarlan in the Practice Court yesterday, to ask for an order for the committal of Shepherdly to prison, or alternatively, for an order that plaintiffs be at liberty to Issue a writ of attachment against him for contempt of court in soliciting or endeavouring to obtain the custom of plaintiffs' customers. The affidavits set out that Shepherdly was employed by plaintiffs from March I3, 1928. until June 6. 1930. An Interlocutory injunction had been granted pending trial of the action for a permanent injunction. Shepherdly, who appeared in person yesterday, said that he had a sick wife and two children. He had not served any of the customers referred to since the granting of the injunction. He had passed them over to another man for whom he was working. Mr Justice Macfarlan - In doing that you have committed a breach of the injunction, and I have no alternative but to order that you be sent to gaol. I will make an order that you be committed to prison until further order of the Court. I will direct, however, that the order be not executed until Tuesday next. If you can then satisfy the Court that you have ceased to serve, or take any part in serving, the customers of Kennedy and Sons, the order will not be executed. This bottle was used in the pharmacy business of H.O.Wilkinson. He had a chemist’s shop in Liebig Street, Warrnambool (number 119 Liebig Street today) early in the 20th century. The dates found for this business are from 1906 to 1914. Wilkinson also had pharmacies in Melbourne and Maryborough. His cough mixture, Wilkinson’s Pectorine, selling at two shillings and sixpence a bottle, was advertised as ‘the finest preparation for the cure of stubborn coughs and colds’. This bottle is of considerable interest as it is one of the few items in our collection associated with an early 20th century Warrnambool chemist, H.O.Wilkinson. This bottle came from the Warrnambool aerated waters factory of Charles and Frederick Flett, with the business known as Warrnambool Cordials Pty Ltd. This business had been established by Joseph Lescai in the 1920s. He had a fruit shop near the corner of Lava and Fairy Streets and then moved further north in Fairy Street. His cordial business flourished and was bought by a company of local businessmen before being sold to Thomas Hill in the 1930s. In the early 1940s Warrnambool Cordials Pty Ltd was purchased by Charles and Frederick Flett. Their father, William was originally a tinsmith in Timor Street and the two sons continued on his plumbing business until the 1950s as well as operating the cordial factory. In the 1960s Frederick sold the cordial business to Thomas McKenzie and it became McKenzie’s Cordials. This bottle is of interest as a memento of the Flett brothers cordial business in Warrnambool in the 1940s, 50s and 60s. Warrnambool Cordials Pty Ltd was a prominent business in Warrnambool for 40 years.This is a clear glass bottle with a rounded base and a circular body tapering to a narrower neck with a moulded glass open top. J S Rowley operated a cordial factory on the corner of Timor and Banyan Streets from the 1860’s through to the sale of the business in 1897. They produced a number of different products : cloves, kola champagne, ginger beer, lemonade, lithia water, hop beer, orange bitters to mention some. These bottles came from the Warrnambool aerated waters factory of Charles and Frederick Flett. They were sold under the name of Warrnambool Cordials Pty Ltd. This business was first established in the 1920s by Joseph Lescai who had a fruit shop in Fairy Street, Warrnambool (his brother James also had a fruit shop in Liebig Street). Joseph Lescai began to make cordials and moved his business to another location in Fairy Street. His cordial business was sold to a company of local businessmen who employed a cordial maker. This bottle was used in the pharmacy of the Warrnambool chemist Francis Bloore. It contained a mixture made up for Archdeacon Thomas Bennett who was the Anglican Vicar of Christ Church, Warrnambool from 1912 to 1915. As Captain Bennett he was the chaplain of the 22nd Battalion in World War One from 1915 to 1917. He became Archdeacon of Warrnambool in 1917 and held this position until 1937. He spent much time on his return assisting returned World War One soldiers and their kin in the Warrnambool area. He was the first President of the Warrnambool Returned Soldiers League. Francis Bloore, born in Ballarat in 1874, came to Warrnambool about 1912. In 1914 he leased a newly-built shop at the corner of Liebig Street and Raglan Parade and continued on the business until the late 1930s. This bottle is of great interest as it is one of the few items we have in our collection associated with the pharmacy business of Francis Bloore. The bottle is also associated with an important Warrnambool Anglican Church identity, Archdeacon Bennett. This is a glass bottle with a rectangular-shaped body with rounded edges, a circular-shaped neck and a circular moulded top with an opening. It has a cork stopper. The top of the bottle is chipped. The label on the front of the bottle is partly torn away and very stained with most of the handwriting and some of the printing indecipherable. This bottle came from the Warrnambool aerated waters manufacturer, John Fletcher. This factory was commenced in the mid 19th century by John Davis. As a young boy John Fletcher worked in the cordial factory of John Rowley in Banyan Street, Warrnambool and then worked for John Davis at his Union Cordial Factory for many years. In 1885 he succeeded John Davis in this business. Fletcher’s business continued until1930 when it was bought by another soft drinks manufacturer, Ralph Reeves. John Fletcher manufactured aerated waters, soda, tonic water, lemonade, ginger ale, hop beer, hop bitters, sarsaparilla and cordials. This bottle is of interest because it is a John Fletcher bottle and he was a prominent soft drinks manufacturer in Warrnambool for over 40 years. This is a clear glass bottle. It has a round base and a rounded body tapering in the neck to a round moulded open top. The stopper or seal is missing. Dross Drossou established a cordial factory in Orbost in the 1930s. He sold his cordial manufacturing business to Phillips and Stone, a Bairnsdale company, in 1948. Glass bottles were refillable until the 1960s, creating a demand for their collection and onsale back to beverage manufacturers via ‘bottle merchants’. A deposit on the bottles was added to all sales as they left the factory. The returned bottles were washed and the old label removed. The inside was cleaned by pushing the bottle onto a revolving brush. The reusing of the bottles went on until the bottle was broken or the top became chipped.This bottle is an example of a product manufacture by a local industry no longer existing.Drossou lemonade bottle.
