1 optical discnon-fictionConvict ticket-of-leave register, Toodyay Acc. 721/30 The Swan River Colony, founded in 1829, as a free settlement needed an injection of capital and an increase in population if it was to thrive. In late 1849 a petition signed by prominent settlers, requesting that male convicts be sent to the Swan River, was submitted to the colonial office. This request was welcomed and transportation officially began to Western Australia in 1850. The first convict ship, the Scindian, arrived at Fremantle on June 1 carrying 75 convicts and a small group of Enrolled Pensioner Guards and their families. Eighteen years later the last convict transport, the Hougoumont, arrived with 280 convicts, mostly Irish political prisoners, making a total of nearly 10,000 convicts arriving in the colony. This availability of cheap labour resulted in many convicts being granted their 'ticket-of-leave' before their sentences had expired, which allowed private settlers to employ them. To facilitate the distribution of working men throughout the settlement, hiring depots were established in key town and country areas. Ticket-of-leave men could not leave their assigned district without permission; had to carry their 'ticket' with them at all times and produce it to any official on demand; as well as lodge an official form with the local magistrate on January 1 and July 1 every year which detailed residence, employer and rate of pay. On the positive side, ticket of leave men were able to choose their own employer and even work for themselves. They could also marry with permission of the authorities and even own land. At the end of their sentences, ex-convicts or 'expirees' were given their freedom, although those with life or long-term sentences were often granted Conditional Pardons, which conferred most of the benefits of freedom but did not allow them to return to England. The movement of convicts around the colony is preserved in the many surviving convict registers which are now kept in the State Records Office of WA . These registers list the names of employers and the dates convicts were employed, and detail the rates of pay and any brushes the convict had with authorities. Many of the employers were themselves 'ticket-of-leave' men, expirees or conditional pardon men. One of the convict hiring depots was at Toodyay and two registers from this institution for the period 1862 to 1870 have been archived in the State Records Office at Accession Number 721, volumes 30 and 31. The impact these men had on the infant colony can best be guessed from the statistical data available from official records. In 1850 there were only 5,000 residents in the colony, but at the end of the convict period the number had risen to 25,000. While some convicts emigrated to other parts of Australia after receiving their conditional pardons, the majority stayed in Western Australia. Some had their families join them from the United Kingdom, while others married the young women who came out on the 'Bride Ships'. Thomas Arnott (Also known as Thomas Amott and Monsieur Du Pree) was the Wizard of the South who performed in Ballarat in 1855. A convict who served in Tasmania, he was a magician performing one of the earliest known magic shows in Australia. Thomas Amott was found guilty of grand larceny, and sentenced to transportation for seven years. He sailed to Australia on vessel 'Asia'. The register and conduct record noted that Amott was a Protestant, married, 5’11” tall with a mole on his neck , well behaved in both the Hulks and on the ship. The only disciplinary action noted in his conduct record was a fairly lenient two hours in public stocks for insolence to his assigned master in Hobart. The 'Asia' sailed from Portsmouth on 17 August 1827 and arrived at Van Diemen’s Land (Tasmania) on 07 December, offloading 198 convicts. Amott was assigned to work as a compositor in Hobart for James Ross, a Scottish free immigrant to Van Diemen’s Land in 1822. In April 1833 Amott was granted a ticket of leave, giving him increased freedom of movement in the colony prior to his being granted final Certificate of Freedom at the end of May 1834. He re-married at the Holy Trinity Church Hobart on 02 December 1833. Permission had been sought back in 1830 to marry Catherine (or Caroline) Fitzallen, a convict whose ticket-of-leave was granted in 1831. Michael Davitt was born in Straide, County Mayo, on March 25th 1846 at the height of the Great Famine. He was the second of five children born to Martin and Catherine Davitt. At the tender age of four Michael and his family were evicted from their home and forced to emigrate to Haslingden, Lancashire, England. At the age of eleven while working in a cotton mill, Davitt had his arm so badly maimed in an accident that it had to be amputated. At sixteen, while working for the local postmaster, he began evening classes in Irish history at the Mechanic's Institute. It was at this time that his thoughts began to turn to politics and he joined the Fenian movement in England. The Fenians Joining the Fenians in 1865 he rose through the ranks to become organising secretary for England and Scotland but was arrested in 1870 for arms smuggling and sentenced to fifteen years penal servitude. Thomas Sweeney was born in Tipperary, Ireland, in 1803, the son of an Irish farming family. As a young man, he became embroiled in the continuing struggle against colonial domination and the injustices of the land tenure system and was captured when trying to burn down the farm house of Patrick Guyder at Cullahill in 1823. His sentence to be hanged was commuted to Life Transportation to New South Wales. After 8 years as an assigned convict within the confines of the NSW Colony, Thomas's 1831 Ticket of Leave allowed him to work for himself. His 1838 Conditional Pardon allowed him to finally break free of that colony and move to the Port Phillip District to start a new life as a free man.In June 1842, while living on the Yarra in Boroondara, Thomas applied to purchase 110 acres in the Parish of Nillumbik. He called his farm 'Culla Hill' after the place in Tipperary where he had been captured in 1823. Both William Weire and Frederick Strange were originally sentenced to be transported to Van Dieman’s Land from England making the painting likely to be a portrait of a convict by a convict. Gaining his ticket of leave for good behaviour in 1841, Strange became recognised for his portraiture and landscapes although he also remains known for his mysterious demeanour. He rarely signed his works which is the case with the portrait of William Weire. Having served his time, William Weire was granted unconditional freedom and successfully worked his way into influential local Launceston business and society circles ahead of leaving for Geelong in 1848 and being made the first Town Clerk for the newly formed Town of Geelong Council in 1850. He oversaw an incredible period of the earliest development of the Town of Geelong including the first migrant arrivals and the dramatic change that came with the discovery of gold in Victoria in the 1850s. The ex-convict turned Town Clerk was to read the formal welcome address to HRH Alfred the Duke of Edinburgh and Princess Alexandra on the occasion of Geelong’s first royal visit. There is also a metallic clip at the waist-band and a metallic stud below the row of buttons. There are four button-up pockets on the front of the jacket. Two of these are breast pockets and the other two sit directly beneath these. There is also an interior pocket on the lower right section of the jacket. The lower right exterior pocket is missing its button. There is a spare button in the right breast pocket. All of these pocket buttons are of the same type as the decorative dark brown metallic buttons. There is also a spare unit patch in the bottom right pocket. The two cuffs are buttoned up with one decorative dark brown metalic button each. There are two identical brass badges on either collar. They depict a crown in the centre with the rising sun surrounding it and ribbons below with the words "Australian Commonwealth Military Forces". There are two identical brass badges on the shoulder edges of the epaulettes depicting the word "Australia". There are two buttons that fasten the epaulettes to the jacket near the neck which are of the same type as the decorative dark brown metallic buttons. There are two identical felt unit patches on either section of the upper arms. They have a light blue border surrounding a navy blue rectangle above a white rectangle. There is also a felt chevron just above the cuff on the right arm. This depicts three blue stitched arrows on a khaki/green background. There are also two labels stitched to the interior of the right breast pocket. Ther are two white rectangular labels that are stitched to the interior of the right breast pocket. Allwood - built in 1894 by Henry Hurst’s relatives, stands near the site of his house, which was demolisherd in the 1940s. Until 1924 Hurstbridge was known as Allwood. The building, one of the district's oldest is situated back from the corner of Arthurs Creek Road and Main Road. Covered under Heritage Overlay, Nillumbik Planning Scheme Published: Nillumbik Now and Then /​ Marguerite Marshall 2008; photographs Alan King with Marguerite Marshall.; p17 Hurst, who was a surveyor, came to Melbourne in 1852 by default, as on the way to Sydney he contracted typhoid and was off-loaded in Melbourne. Deciding to settle near Melbourne, he selected some land near the present Eltham railway station and was one of the first to grow crops there.2 But disaster struck again, when his shack was looted and burned, while he was carting goods for sale to nearby goldfields. It was then that Hurstbridge’s first settler, Cornelius Haley, asked Hurst to manage his 160 acres (65ha) grazing property and 9000 acres (3443ha) of leased land where the present Hurstbridge stands. Hurst proved equal to the tough conditions and he and his brother, Fred, cut a track with a bullock team from the property to Romsey, where Haley had selected some land. Hurst also put up a bridge across the creek near his house, after which Hurstbridge was named. He ran the property helped by two ticket-of-leave men and others, several of whom were sailors who had abandoned ship in search of gold, and were working there temporarily. In 1866, only 14 years after coming to Australia, Hurst met an early tragic death. One day a bushranger named Burke came to the house and demanded a horse. Hurst thought the bushranger might be an officer in search of runaway sailors3 and anyway, did not like the look of him, so he refused. A tussle followed and apparently Hurst shot first.4 He was shot and died five hours later from loss of blood. Later, troopers found Burke, who was subsequently hanged. The event is recorded in the Old Melbourne Gaol. The government offered the family £500 but the family refused it as ‘blood money’. Hurst’s father, Robert, even signed a petition against the bushranger’s death, claiming one life did not replace another. Hurst’s family continued to live in the district and saw a rise in their fortunes. They bought Haley’s cattle station and built the present Allwood House, using the original home as an orchard packing shed. The present Victorian style timber house had several outbuildings including a blacksmith’s shop. The property passed on to William Gray, an orchardist and nurseryman, who married Hurst’s grandniece, Frances. The business boomed from the early 1900s when it supplied most of the orchards in the area. Gray was Eltham Shire’s President for two terms and was asked to stand for parliament, but his wife’s illness and other family commitments prevented him from doing so. Then several calamities drove the family to bankruptcy. During World War One, Gray lost more than one million pounds on trees shipped overseas, which the Lloyd’s company had refused to insure. Other factors, including the Great Depression, ruined the family’s fortunes. The land was reduced from more than 640 acres (256ha) to 50 acres (20ha) and the older members married and left. After Mr Gray died, the house was leased, until his daughter Sheila Ferguson and her husband Gordon settled there in 1951, after buying it from other family members. However in 1975 the Shire designated the property as a passive recreation reserve. The Ferguson family sold most of the land, leaving the house on 0.6 hectares.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. As Sweeney was one of the district’s first settlers, the property is registered by the National Trust. Thomas Sweeney was born in 1802, son of impoverished tenant farmers in Tipperary County, Ireland. He became a ploughman, then at 21 he was sentenced to hang for setting on fire the house of Patrick Guyder at Gullshill. It is said the arson was due to a dispute over undelivered guns to a social justice guerilla group, the White Boys, of which Sweeney was a member. But the sentence was commuted to life transportation to Australia in 1823.1 Apparently in Sydney he became a servant to James Chandler at Botany. Soon James Chandler leased his farm and became a catechist on the Hawkesbury River, so Sweeney was reassigned to a former convict, John Brown, at Liverpool. Later Sweeney was assigned to George Brown of Lake Illawarra. In 1831, Sweeney was granted a ticket-of-leave and bought a boat to carry goods between Illawarra district and Sydney Town. He married his first wife who had come to Australia as a free woman. However she drowned after bearing him a daughter. In 1838, one month after he had received a conditional pardon, Sweeney married a blacksmith’s daughter, Margaret Meehan, newly arrived from Ireland. They then moved to Port Phillip and squatted on the south side of the Yarra River, about seven miles (11km) from Melbourne. Around 1842, Sweeney bought 110 acres (44.5ha) in the parish of Nillumbik for £110. He built a slab hut 12 x 10 feet (3.6m x 3m) and then his homestead, Culla Hill, a typical Tipperary style cottage, now known as Sweeney’s Cottage. It was here that many generations of Sweeneys lived for almost 100 years. Culla Hill became a social centre for the district and the Catholic community used it as a church. Sweeney was apparently on good terms with a tribe of Aborigines living on the river nearby, who helped him build his house.2 Sweeney proved himself a civic-minded leader. In 1844, he led a call for a bridge over the Plenty River. He was on the first school board and supplied the first grain for Eltham’s mill. Sweeney profited during the gold rush, not by gold digging, but by providing supplies for nearby fields and others as far away as Beechworth.3 Thomas Sweeney died in 1867 and was buried at the Eltham Cemetery, leaving two sons, five daughters, and 300 acres (121.4ha), as well as Culla Hill. Culla Hill – by then reduced to 75 acres (30ha) – was sold out of the family in 1939, then renamed Sweeneys. The present Sweeneys Lane, running diagonally through the original holding, was the track to the house. Part of the original cottage remains as a small section of today’s house. The dining-family room fronted by a veranda is original, and although there have been some changes, the cedar door and most of the small 12-paned wooden-framed windows are original. The walls are made of the original hand-made brick. After buying the property in 1952 Mr and Mrs Burston demolished a dilapidated slab hut, a three-roomed detached kitchen and cellar, as materials needed to restore them were very difficult to obtain so soon after the war.4 However the barn remains almost in its original condition. It is believed to have been built from stone quarried on the property. Now roofed with iron sheets it was probably originally thatched. During WW1 soldiers communicated with family in Australia. When they were not required 'in-the-field' they occupied themselves with souvenirs and art work. This includes his ration book and tickets, and artwork consisting of 2 leaves, a fan and Xmas Card all attached to a white piece of paper. This collection may have been attached to the paper by family in Australia or by Percy before his return.Pte. Percy Sutton No. 3942 served in France in WW1. He joined the army on 3rd August 1915, aged 19 years and 5 months and was in the 8th Battalion. He was a railway employee, son of Margaret Sutton of William St, Wodonga. He was 5 feet 7and a half inches tall and a Methodist. He was discharged on 13th April 1919. He was born on 27th January 1897, the son of George and Margaret (nee McIntyre) Sutton. He returned to Wodonga. He died on 29th May 1971 at Mt Beauty in the Kiewa Valley. Attached to white paper a collection of souvenirs from WW1. It includes a Ration book and tickets, 2 gum leaves with French coloured ribbons, a fan inscribed with 'Forget me Not' and a 'Christmas Greetings' Card.On the Ration book - "Sutton, P. Pte. He performed on the University's historic Erard Grand Concert piano on stage in Founders Hall, describing it as "absolutely amazing.' The instrument was 93 years old and hadn't been played for more than eighty years. An audience of 500 were entertained with pieces by Schubert and Bach for the first half of the program and Waltzes, Mazurkas, and Polonaises by Chopin after the interval. A feature of the show is Lola's celebrated Spider Dance which was acknowledged many years ago by the crowd throwing gold nuggets onto the stage.
