The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. Saunders General Store was opened in 1900, overlapping part of the Mensland and Coultons stores. It was called "The ―Melbourne Store" which referred to it being a branch of their Melbourne store.The shop was burnt down in the early 1930‘s. Arthur Scott Saunders was born in 1864 and died 3-12-1913 (49) in Orbost. He was the son of Thomas Frederick Saunders and Lucy Beard Scott. He was a Storekeeper at Orbost, a member of the early Show Committees, a Rechabite in 1893, and was a member of the Board of Guardians of the Church of England from 1894 to 1913 where he served as secretary and treasurer of the Board. He was married to Agnes Louisa Stuart Morris. She sold the business in 1919 to Mr J. H. V. Dale and left Orbost with her two daughters for East Malvern in April 1927. This is a photograph of the Saunders Family at Orbost 1888-89. It is Arthur and Agnes Saunders with their children, Beatrice, Cyril, Hilda and Vera. Arthur Scott Saunders was born 1864 in Orbost and died 3.12.1913 in Orbost where he is buried. He was the son of Son of Thomas Frederick Saunders and Lucy Beard Scott. This medal was made by Stokes and Martin. Thomas Stokes established a medal-making business in Melbourne in 1856 and from 1867 to 1893 he had a partner, George Frederick Martin. In 1962 the Stokes business became a public company and operates today in Melbourne. The medal was awarded at the Annual Show of the Villiers and Heytesbury Agricultural Association in 1877. One of the earliest agricultural associations in Victoria, the V.& H.A.A., the forerunner of the Warrnambool Agricultural Society, was established in 1854 and the first Warrnambool Show was held in 1855 at the first Royal Archer Hotel in Koroit Street. The Warrnambool Agricultural Show is still held annually. The medal, first prize for the best horse hay rake, was awarded in 1877 to the brothers, Thomas and William Rutledge, sons of Eliza and William Rutledge. The latter was a pioneer settler who came to the Warrnambool/Port Fairy district as the purchaser of the Special Survey, Farnham Park in 1841. His land stretched from Tower Hill to Dennington. William Rutledge Senior was a pioneer breeder of a Lincoln sheep stud, the owner of a mercantile business in Port Fairy, a member of the Legislative Council of Victoria and the pioneer developer of farming land around Tower Hill. His son Thomas (1846-1918) was a Warrnambool Shire Councillor who farmed in the Farnham Survey, living at Werronggurt . He went to the Geelong area at the end of the 19th century. His brother William (1849-1935) also farmed in the Farnham Survey, living at Farnham Park, He later lived at Airlie in Henna Street, Warrnambool and Sherwood on the Hopkins River and had land in the Otway Ranges. He later went to New Zealand.This medal is of considerable significance because of its age and its association with Thomas and William Rutledge and with the Villiers and Heytesbury Agricultural Association.This is a bronze medal with an image of agricultural implements, agricultural produce and farm animals on one side and etched printing on the other side. There is also printing around the edge of the medal. The medal has a small hole at the top for attaching the medal to a cord. Book was awarded to Stephen John Holgate in 1891 for first prize in bookkeeping. Stephen (D.O.B. 09/07/1877) entered the college on 27/01/1890. The original registry notes parent as Stephen Holgate from Miners Rest and Stephen's previously school is noted as 'Home Tuition'. Other family members noted as attending the college are Harold, George, Edward, Robert and Thomas. Archives also hold war memorabilia for Edward and George Holgate.Presbyterian educators placed great value on a classical education matched with diligence in study. Book prizes were highly regarded and academic success admired. In the school’s early years prizes were ordered direct from London and had the school crest embossed in gold on the front or back cover. Many of the prizes given in early years were returned to the school to equip the Weatherly Library when it opened in 1936. The beautiful book was gifted to a Miss M Muir in 1878 for Good Conduct and General Proficiency while a student at F J Thomas' Lyons Street Grammar School (for more information see Golden Heritage p31,40). The Ballarat College (Girls School) register lists a Maggie Muir as enrolling in 1881, the year F J Thomas’ school closed. It seems reasonable to consider Maggie Muir and Miss M Muir as one person. In the early 1880s the Ballarat School of Mines Council introduced a three year course of training under the professors to qualify students in the following professions: 1. Mining Engineering 2. Metallurgy 3. Geology 4. Electricity [45] Each of these courses had an additional, but optional, fourth year of study. The prescribed subjects of study for an Associateship was set out in the Calendar of the Ballarat School of Mines in each year. Any student who passed the prescribed examinations in any of the above courses was issued with a Certificate of Competency, and conferred with the distinction of Associate. By the 1890s the professorial staff had drawn up a curriculum leading to an Associateship of the Ballarat School of Mines. The first two years work was to be common to all courses, but in the third and subsequent years the student wold be devoted to a specialised branch of study. The Associateship was to be conferred in one of another of the following Courses: Agriculture, Civil Engineering, Electrical Engineering, [Geology], Metallurgy and Mining Engineering. All were three year courses except for Agriculture which was two years. Each course was conducted in accordance with a prescribed curriculum and syllabus. During the 1910s there was an expectation that candidates for the Associate course should have attained the age of sixteen, and have received preparatory training equivalent to University Matriculation at least in the subjects of Elementary Mathematics, English Grammar and Composition, or have passed through Junior Technical School. In 1960 an new procedure for admission to graduate status as Associates was introduced to the Ballarat School of Mines where Associateship would be conferred at a public ceremony. After 01 July 1976 graduates of Ballarat College of Advanced Education and Ballarat College of Advanced Education were admitted in major studies relating to mining for Australian accreditation and overseas purposes. This plaque recognises the Wycheproof servicemen from State School No1757 who served in the 1914-1919 War.
