The Percy Uebergang family lived at Tooram Park, Allansford from 1912 until 1992. Percy and Myrtle Uebergang's children were twins, Ray and Joyce born in 1926 who lived at Tooram Park until their deaths, Ray in 1986 and Joyce in 1992. Neither Ray nor Joyce married and following the death of her brother Joyce set up the Ray and Joyce Uebergang Foundation which supports the local community. This photograph is part of the collection of items given into the care of the Cheese World Museum. The Uebergang family purchased Tooram Park in 1912. It was part of the original Tooram run which was taken up in 1839/40 by John McMahon Allan. Allan held the property until 1860 after which it passed through several owners including John Orlebar, Thomas McLeod Palmer, Owen family. Tooram was famous for the cheese from its large dairy herd. The herd was hand-milked. Palmer employed Indian labour to undertake this task. In 1883 Palmer was charged with the manslaughter of an Indian worker but was acquitted. This case was extensively reported in the Warrnambool Standard. The Standard also featured a number of articles about Tooram [22 June 1882, 17 March 1883 to 15 May 1993, 30 October 1886, 22 October 1897, 11 May 1926, 8 June 1931]. The property remained in the Uebergang family until after Joyce's death in 1992. Tooram is significant as it was one of the earliest runs taken up in the Warrnambool area. It was divided up following its sale in 1897. Tooram cheese was renowned. Initial court cases for the Western district were held and controlled for some time by Rutledge in Port Fairy. The first courthouse was built around 1854 and was in service until the stone building was built next to it in 1870. These two implements were used until around 1970 when heating was installed in the courthouse. They were decommissioned by Mr Ellis Roberts, Public Works Department Inspector.These implements have a strong connection to a public building which has a long association with the town and surrounding area. The courthouse of 1863 was the scene of an infamous murder of Constable O’Boyle in front of the fireplace. Shovel has barley sugar twisted handle with eight sided domed top. It is flared at the bottom to hold the spade which is attached with two metal rivets. Spade contains a number of holes cut into oval shape in centre and has fluted side edges. The tongs consist of two parts held together below a short handle with a metal rivet and two metal discs. This letter book contains the correspondence from the legal firm of William Ardlie in Warrnambool to other legal firms in Melbourne and other parts of Victoria (1951-1957). The correspondence deals mainly with legal matters concerning property transfers, wills, probates and court cases. William Ardlie (1943-1933) was the son of John and Mary Ardlie, pioneer settlers in Warrnambool. In 1865 William Ardlie established his legal practice in Warrnambool, initially in partnership with George Barber. William Ardlie, prominent in community affairs in Warrnambool, practised as a lawyer until the early 1930s and the firm continued on after his death with members of the Ardlie family involved in legal firms in the Warrnambool district until the early 21st century. This letter book is of historical interest because of the letters dealing with the property, wills etc of many residents of Warrnambool and district during the 1950s. It will be a useful research tool. This letter book of 393 pages has a buff-coloured cover which is somewhat stained. 227 pages contain copies of letters written over a period of seven years and the rest of the pages are blank. The pages are of a lightweight strength. These documents concern a legal case involving the Town Of Warrnambool, Elizabeth Granter and James Harris. The lawyer in the case was William Ardlie. The son of John and Mary Ardlie, pioneer settlers in Warrnambool, William Ardlie was a prominent lawyer in Warrnambool from the late 1860s to the early 1930s and was active in community affairs. Elizabeth Granter, involved in the financial side of the legal case, was the wife of James Granter, another prominent Warrnambool identity of the 19th century. Granter was a quarryman and a road contractor and he and other members of his family seem to have been involved in other legal battles with James Harris, an employee of the Warrnambool Tramway, also involved in the financial aspects of the legal case. These three documents are of minor interest as an example of the legal cases undertaken by the well-known Warrnambool lawyer, William Ardlie. These are three 1888/1889 documents related to the legal practice of William Ardlie. Item One is a document listing the details of a court case involving Elizabeth Granter, James Harris and the Town Council of Warrnambool and is a sheet of paper with the details of the case written on both sides of the paper in black ink. The back page has a green stamp to the value of one penny. Item Two is a letter from Charles Hider, the bookseller, in regard to an item received by H.A.C. Macdonald, the Town Clerk of the Town of Warrnambool. The handwriting is in black ink. Item Three is a letter from the Warrnambool Tramway Department to Mr Ardlie regarding the request of James Harris for a small sum of money. This letter is a sheet of paper folded in two and written in black ink on one of the four sides. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. The context in which the hat was made and worn assists in establishing its potential historic significance. 'Bailliere's Victorian Gazetteer and Road Guide containing the most recent and accurate information as to every place in the Colony' (1870), describes the village of Vaughan as being located on the road from Daylesford to Castlemaine. In 1870 the Vaughan was deemed to be entirely a gold mining area, gold having been discovered in the district in 1853. Intriguingly the entry in the Gazetteer claims that the electoral division of Vaughan began at the junction of the Middleton Creek and the Loddon River, so perhaps the cap might have belonged to a member of a significant local family. In 1870, Vaughan had a population of about 1000 persons and included almost 300 dwellings. Articles from newspapers, published on Trove refer frequently to a Mr Middleton as a litigant in court cases before the Vaughan Court in the 1860s. By the 1870s, the Mt Alexander Mail, in an article on ‘Mining: The Pioneer Wheel’ describes the success of Mr Middleton and his Middleton’s Reef Gold Quartz Mining Company, which had built the largest water wheel in the Colony. The wheel was 20’ in diameter and 2’ wide. Quartz mining as practiced by companies such as Middleton’s had become necessary after the exhaustion of alluvial quartz mining deposits in the 1860s. So we can probably establish a link between the cap and a significant mining identity in the period in which the article was made. The historical significance of the cap is only one part of the story. Caps such as the Middleton example can also be items of aesthetic significance as they were typically, examples of women’s work, using published patterns in magazines such as the Ladies Home Magazine. While women might follow or adapt a published pattern, their choice of materials reflected what was available locally. The fine hand stitching on this example is evidence of high quality domestic needlework. The maker crafted the cap from five triangular pieces of cotton cloth, each piece lined with a faded yellow net. The net provides some stiffening for the cap and has a functional purpose in that it anchors the hand-stitched, looped design of yellow silk ribbon that decorates the surface of the cap. Gentleman’s smoking (lounging) cap believed to have been made in c.1860-69. The conical hat is made of a dark green cotton fabric embroidered with narrow ribbon of a paler green silk. The unlined rimless hat is made of four pieces of fabric. There is no evidence of the hat at one stage featuring a tassle. This telescope was amongst various items collected from a sea dive in Port Phillip Bay. The diver was the caretaker of the Port Lonsdale Lighthouse, who dived on various wrecks in the bay during the 1960's. After the caretaker's death, his son sold off many of the shipwreck artefacts. The telescope was purchased from the caretaker's son in the 1990's by a previous owner of the Marine Shop, Queenscliff, Victoria. Many companies were making scientific instruments in Liverpool. Between 1730 up too today, they manufactured spectroscopes, telescopes, microscopes, barometers, photometers, cameras, ophthalmoscopes, and electrical equipment such as electric lamps. Liverpool was a major centre for the production of scientific items rivaling Glasgow and London from 1850 to 1920. This telescope appears to be of quality manufacture but the origins can only be surmised at based on the gold embossing to the leather surrounding the main brass tube as being associated with Liverpool England. There is no maker or owners mark, so again there is no sure way to determine the year of manufacture or maker. There were many opticians and scientific instrument makers working in and around Liverpool from 1730 through too today. Also the possibility the telescope could have been made outside Liverpool overseas should not be overlooked and may have been made as a souvenir item from Liverpool from the mid to late 20th century. The size and type of telescope is a traditional type that was used for many sporting activities in the mid to late 19th century for deer stalking, bird watching, or used generally. I believe the item dates from sometime around the early to late part of the 20th century as the use of the liver bird mark became popular in 1911. It began appearing on many manufactured items of the period up too today, denoting that these items were made by companies operating in or around Liverpool England. If the item had been made by a notable firm it would have been engraved with the makers name city of origin, or owner as was the accepted practice for these items. The writer has been unable to determine if any specific company had had exclusive use of the liver bird logo as it was widely used and was not copyrighted until the Liverpool football club successfully won a court case giving them the sole rights to the trademark in 2012.The item is also an example of the shipwreck artefacts gathered along the southwest coast of Victoria. It is also a sample of scientific instruments used up to the mid 20th century.Victorian style gentleman's three draw brass telescope with machine milling surrounding the end of each tube and around the objective end. The three tube draw has no split and all three cartridges are held within the main brass tube wrapped in leather with rope bindings at both ends 5 cm in length and beginning 7 cm from the objective end. The last 2.8 cm makes up the remainder of the brass tube which has a sliding brass sunshade. The eyepiece is flat and has a protective slide over the lens aperture. Two relay lenses are missing on the ends of the second and third tube. The Eltham Court House is Eltham's oldest public building. It was classified by the National Trust in 1977. In 1857 five Eltham residents petitioned the licensing magistrates of the Heidelberg district asking for better police protection, including from itinerant gold prospectors who turned to crime when their quest was unsuccessful. In response the Eltham Courthouse was constructed in 1860. Over the years it has also been used for other activities, including for electoral polling purposes, inquests, early meetings of the Eltham Roads Board and even as an overflow classroom. This type of localised solution is characteristic of the self-reliance preserved in Eltham today. The court house is an important symbol of the spirit which makes Eltham distinctive as a community. The Eltham Courthouse is historically significant because its construction was intended to emphasise the centralised control over law and order in the Colony of Victoria in the wake of the 1852 Snodgrass committee report on the Victorian police force and the resulting Police Regulation Act (1853). The nature of the Court House planning and use of architectural devices make the building's function easily interpreted. The arrangement of rooms, with public entry and clerical rooms to the rear, and the use of raised floor levels throughout these spaces to signify relative rank is easily perceived. The distinction in entries, public, magistrate and person-in-custody, and the existing court furniture enhances appreciation of this building. The Eltham Court House is one of only two intact examples in the state of this simple design with projecting entry. The building is of architectural significance because it retains intact early features. These include use of handmade bricks, simple decoration, roof trusses, timber ceiling boards, original windows, doors and associated hardware and a collection of court furniture. Additions to the court house have been done in a manner which did not interfere with the fabric of the original building. Typical cases heard before the Court of Petty Sessions included financial debt, straying livestock, theft, assault, drunkenness, public disorder, truancy, motor vehicle offences, unregistered animals and failing to have children attend school, or be vaccinated. The courthouse operated for over 120 years before it closed in 1985. In April 2021, Nillumbik Shire Council authorised restoration of the building and furnishings. The extensive works required for the total restoration of this highly valued heritage building was undertaken by Ducon Building Solutions and other specialist contractors. In 1857 five Eltham residents petitioned the Heidelberg district licensing magistrates. They pointed out that Eltham had two hotels, a population of about 1000, and many strangers employed on the public roads. Yet the nearest police were at Heidelberg eight miles (12.8km) away, or at the Caledonia Diggings 21 miles (33.7km) away.1 Subsequently the courthouse and then the police residence, near the corner of Main Road and Brougham Street, were built in 1859/60. The courthouse is Eltham’s oldest public building and the National Trust classified it in 1977. It ceased operation in 1984 and has since been used by local groups. There are only six other known examples of similar small brick country courthouses in Victoria . For £536, a Mr Duncan built the courthouse – a neat, narrow, oblong building with handmade orange bricks. Its gabled roof and porch are covered with brown slate tiles and it has 12-paned windows. Inside, the roof is peaked and the courthouse is still ventilated by oblong slits near the ceiling. Most of the fine carved timber and upholstered furniture is original. The original prisoners’ door, now permanently closed, led from the police station to the dock. Builders, Langridge Wright and Witney built a timber police station (since demolished) and a brick residence to its north,2 for £1150/7/-. Built around the same time were the lock-up behind the residence, also later demolished, and the two-storey orange brick stables. The former police residence also has a brown slate roof and handmade bricks. The front veranda roof is made of corrugated iron, as is the roof of the back weatherboard extension. The application for police protection was approved within a few months and police operated from a cottage rented at ten shillings a week and owned by William Jarrold. This was probably the one at the corner of Main Road and Dalton Street called Jarrold or White Cloud Cottage. In 1858 a second constable was appointed to Eltham following a fight at the hotel. The timber police office a replica of which was built in the early 1990s is at the building’s side. The lock-up was demolished following the relocation of the police to a new station in about 1952. The residence has been used as the Eltham District Historical Society centre since 1997. Records show court cases were held at Eltham before the courthouse was built, but the location is unknown. Some court cases were not very different from those today. In 1891 a man was charged with being drunk while in charge of a horse and was fined ten shillings. The courthouse was used for other purposes during its long history. It was probably used as a polling place as indicated by old photographs of election-day crowds outside. The Eltham Road Board met there from the early 1860s until 1868 when the Board transferred to Kangaroo Ground. During the same period the Road Board Secretary used the courthouse as an office until 1867 when it was transferred to his home at Wingrove Cottage. The courthouse was also used as an overflow classroom for the Dalton Street school in 1875. The two buildings can further link us with Eltham’s early days through Police Department correspondence. The first constable-in-charge was George Reid. In 1860 a letter to The Argus newspaper signed ‘A Sufferer’ declared the Eltham police were not active enough in their duties. The writer suggested that the ‘very snug’ police quarters were too comfortable, and he detailed various incidents including one of an alleged break-in to the Road Board Secretary’s home. But the Board Secretary, C S Wingrove, wrote to the Police Department refuting The Argus letter saying he had received full co-operation from Sen. Constable Peter Lawler.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century.
