It contains ruled red lines, handwritten material in black ink and the remains of a red seal. The top of the first page has a cut-out fluted pattern. Legal record ...Thes two documents deal with the purchase and sale of land near Warrnambool by Thomas Simpson. The first document, called a Grant by Purchase, is dated 1852 and shows that Thomas Simpson purchased from the Crown, Allotment 146 (22 acres two roods) adjoining the property of Wollaston on the Merri River and the Mortlake Road, north of Warrnambool. The cost was 90 pounds. The second document is dated 1853 and shows that Thomas Simpson sold this Merri River allotment of 22 acres to Eliza Bromfield, in conjunction with her husband, John Davenport Bromfield, for the sum of 110 pounds. The property of Wollaston was owned by the Manifold family and in the 1850s was leased to William Simpson, the brother of Thomas who had an adjoining property called Wooramoota. John Davenport Bromfield was a Colac farmer who played a prominent part in the early history of that town. His brother James Astley Bromfield, an early chemist in Warrnambool is important in Warrnambool's history.These two items are of considerable significance because they are amongst the earliest legal documents we have connected to Warrnambool's history and because they concern three early pioneers of the district. Mackay wrote to his daughter, Meta? and his aunt in the 1920’s. G. S. Mackay was born in Sutherlandshire Scotland in 1850. He qualified as a solicitor and came to Australia in 1884 and later to Warrnambool in 1893. He served as a Warrnambool City Councillor and also held a number of important positions within the Presbyterian Church. He was one of the earliest and strongest supporters of the Warrnambool High School. Many of the letters within this book are to his daughter who studied medicine in Glasgow in the early 1900’s. G. S Mackay was prominent in legal, civic and religious life in Warrnambool almost from the time of his arrival in 1893 until his death in 1926. Many of these letters are of a religious nature and as such display that aspect and personal thoughts of Mr Mackay’s personal life. Most of the sittings were conducted by police magistrate Lachlan McLachlan. Notes Philip Barton inherited the book from his father Russell Barton who died in 2002. Russell Barton was a barrister who practised on the Supreme Court Circuit in Bendigo from 1960 - 1975. He was interested in history and it is assumed that he was given the book by the Bendigo Court officials. Donovan and J. K. Byrne "C" Assignment of Lease, Appelant to Responent Legal record ...The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney.
