This letter book contains the correspondence from the legal firm of William Ardlie in Warrnambool to other legal firms in Melbourne and other parts of Victoria (1951-1957). The correspondence deals mainly with legal matters concerning property transfers, wills, probates and court cases. William Ardlie (1943-1933) was the son of John and Mary Ardlie, pioneer settlers in Warrnambool. In 1865 William Ardlie established his legal practice in Warrnambool, initially in partnership with George Barber. William Ardlie, prominent in community affairs in Warrnambool, practised as a lawyer until the early 1930s and the firm continued on after his death with members of the Ardlie family involved in legal firms in the Warrnambool district until the early 21st century. This letter book is of historical interest because of the letters dealing with the property, wills etc of many residents of Warrnambool and district during the 1950s. It will be a useful research tool. This letter book of 393 pages has a buff-coloured cover which is somewhat stained. 227 pages contain copies of letters written over a period of seven years and the rest of the pages are blank. The pages are of a lightweight strength. This ledger contains material from the legal firm of Mackay and Taylor for the period 1931 to 1946. The material includes receipts, letters and typed summaries concerning the wills and property of Warrnambool and district residents at that time. Scottish-born George Mackay established a legal practice in Kepler Street, Warrnambool in 1891 and in 1893 he bought the next-door practice of the late James Fletcher, with the business then known as Fletcher and Mackay. In the 1920s John Taylor became a partner with Mackay under the name of Mackay and Taylor (later Mackay Taylor). In 1999 Taits Solicitors of Warrnambool merged with Mackay Taylor to form Tait Taylor. Today this business is known as Taits Legal. This ledger is of some importance as it contains much historical information (wills, deeds, property ownership etc) on Warrnambool and district residents in the 1930s and 40s. It will be very useful to researchers.This is a ledger with a black cardboard cover and red binding on the spine. The binding has broken and the covers and sections of the pages are detached. The cover is much stained and rubbed. The pages have been printed with red and blue lines but these have not been used. These items, 1930s bank books belonging to Michael Toohey, a Woodford farmer, come from the estates of the Ardlie family of Warrnambool and appear to have been stored amongst the office material of the prominent Warrnambool lawyer, William Ardlie (1843-1933). He was the son of pioneer Warrnambool settlers, John and Mary Ardlie. William Ardlie established a legal practice in Warrnambool in 1867, initially in partnership with George Barber. Ardlie was a dominant figure in legal and community circles in Warrnambool and continued with his legal practice until the early 1930s. The bank books were issued by the Commercial Banking Company of Sydney. A Warrnambool branch of this bank was established in 1927 when it acquired the Bank of Victoria. The Warrnambool branch of the Bank of Victoria at 92 Liebig Street then became the Commercial Bank of Sydney. In 1958 the bank building was demolished and new premises were built. In 1981 the Commercial Bank of Sydney merged with the National Bank of Australia and traded as the National Bank in the building at 92 Liebig Street until the premises were closed in 1985.These items are of minor interest as mementoes of the Warrnambool branch of the Commercial Banking Company of Sydney..1 A bank book with a hard black cover and pages containing ruled black lines. As written in the note inserted in the front of the bible ,"This Welsh Bible was brought to Australia by John Morgan and his wife Sarah in 1865. With baby daughter Mary, they settled at Allansford, where John took up land"Acme" farm. Their other children Margaret, Jane, Evan, Lewis and Elizabeth were born there." The Memorial card provides the additional information that Sarah Morgan died July 30th 1906 at the age of 68. The date of the Bible 1864 fits with their arrival in Australia in 1865. The Morgan family have been connected to Allansford from that time. This bible has significance social and historical significance as the Bible was common in many family homes. This one written in Welsh shows the connection between the origins of the Morgan family and their new country. Eight of these letter books contain letters written by the Warrnambool lawyer George Mackay. They are mostly letters written to contacts while he was living in Scotland and letters sent from Warrnambool to Scotland to his daughter, Margueretta (Meta) who was studying medicine. Scottish-born George Sutherland Mackay (1850-1926) opened a legal practice in Kepler Street, Warrnambool in 1891 and in 1893 bought the business of the late James Fletcher, with the business known as Fletcher and Mackay. In the 1920s John Taylor became a partner and the firm of Mackay, Taylor & Co. (later Mackay Taylor) continued until 1999 when it merged with Taits Solicitors to form Tait Taylor (now Taits Legal). George Mackay was a Warrnambool Councillor and the first Mayor to hold office for four successive years. He was instrumental in getting the Warrnambool High School established and was the Chairman of the first School Council. Two of these letter books contain letters written by Ernest Powling. This ledger is Volume One of a series of Copy Title Books that contain certificates of land titles from the Warrnambool district in the late 19th and early 20th centuries. It came from the former premises of the Warrnambool legal firm, Mackay Taylor. This firm originated in the 1890s when George Mackay established a legal practice in Kepler Street, Warrnambool. In 1893 he bought the legal business of James Fletcher, following the death of the latter and the practice became known as Fletcher and Mackay. In 1926 John Taylor became a partner with George Mackay (who died that year) and Mackay, Taylor and Co continued on until 1999 when the firm merged with Tait Solicitors and became Tait Taylor. In 2010 it was renamed Taits Legal. This ledger is of great importance as it contains early certificates of titles of land and property in the Warrnambool district. Located on the corner of Main Road and John Street, the church first served the community as the Eltham Wesleyan Church since 1881. It became the Eltham Methodist Church in 1902, the year it united with the Primitive Methodists. Eltham Wesleyans first worshipped together in the home of William and Mary Crozier, on 24 acres bounded by Mount Pleasant Road and Pitt Street. From there they moved to a slab and bark hut in 1855 (this later served as the first school run by David Clark prior to the building of a new school in Dalton Street) and the members then built a chapel in 1858 on Lot 20, Henry Street (later to become the Rechabite Hall and Eltham Public Hall). The present church on John Street was designed by architects Crouch and Wilson in the Early English Gothic style with biochrome brick window frames, buttress heads and pinnacle. Church member George Stebbing built the church, the foundations were constructed with stone from the walls of the first Eltham State Primary School (No. 209) building which collapsed in 1874 and were purchased by Robert David Taylor. Stebbing was also responsible for building St Margaret’s Church and Shillinglaw Cottage. The Roll of Honour, which presently hangs in the church hall (which also doubles as the Opportunity Shop) lists 27 members of the congregation who served in the First World War, 11 of whom never returned. The red-brick Church Hall was opened in 1931 and in 1971 further additions linked the hall and church, including a foyer, vestry, meeting room and toilets reflecting the Eltham style of that time with its simplicity, extensive clear glass, reused baked clay-bricks from the 1881 church, heavy ceiling beams and compressed straw ceiling. On June 26, 1977, the church became part of the new Uniting Church in Australia consisting of the former Methodist and Congregational and most of the Presbyterian Churches. Following of declining numbers of worshippers, the church merged with the Montmorency Uniting Church on June 23, 1996. In 2023 the Uniting church approved a plan to renovate the church. It is understood that the historic church and the hall will be retained, and the building added in 1971 is to be demolished, to make way for a new purpose-built Opportunity shop. The proposed areas to be demolished include the current foyer, toilets, crèche, etc, including the area between the hall and the former RSL. Works are expected to commence mid to late July 2023. The Society was invited by a church member to take photographs of these areas to document them prior to demolition works commencing. William Ingram with possibly his wife Pamela Thomas and family members. William is second from left with pipe, the others unidentified. The family lived in Birmgham, England. William, a baker died in 1905. William and Pamela had six children; William George Grove (1861-1939), Elizabeth (1865), Evan Thomas (1867-1956), Joseph (1868-1934), Louis (1870-1941) and John (1872-1958). John Ingram learnt his trade from his father but following a quarrel with his father, he ran away and worked his passage to Australia as a ships baker. His elder brother Evan was already in Australia living in Malvern. It was here that he met Ada Key. John and Ada were married in Fremantle, Western Australia. They travelled to England then Cape Town, a family already started. They returned to Melbourne and in 1901 bought land at Research where he worked to establish an orchard and worked at night asa baker in Eltham. The building was designed by Charles Maplestone of Heidelberg, son-in-law to Anthony Beale of St Helena. Maplestone was a prominent architect who came out to Australia with his family in 1852. The foundation stone was laid by Mrs Isabella Maplestone on 11th November 1867. The bricklayers for the church were George Stebbing, H Limmer, H Spicer and a Mr Timm while Thomas Day was the stonemason. Another three years were to pass before sufficient money could be raised for its completion. It was opened by Bishop Perry on 1st November, 1870. The church bell which hung under a tree for 50 years until it was incorporated in the parish hall was brought out from England and presented by Charles Orme. In 1916, the estate of George Martin Pizzey left sufficient money to build the red brick hall, which still stands today (2023) though in January 1969 the hall and bell tower were badly damaged by bushfire. Coincidentally the former home of benefactor, George Pizzey was destroyed in the same fire. Of particular significance are the interior and exterior of the church, the Sunday school and hall with emphasis on pre-World War I fabric (excluding the 1990s additions) and the three coloured glass windows currently suspended in the 1990s entry foyer. In 2011 further alterations were made to the front of the Church. The church is historically significant because it was the oldest public building in the former Diamond Valley Shire, is amongst the oldest buildings in the Shire of Nillumbik and is associated with the early settlement of the Diamond Creek district. The church is historically, socially and spiritually significant because it has been a place of worship for over 150 years and continues to be, an important meeting place in the Shire. The church is aesthetically significant for the three stained glass windows executed by the noted stained glass manufacturers, Ferguson & Urie, as well as the supporting coloured glass windows in the church. The Sunday school & parish hall is architecturally significant because the hall is a well executed and preserved example of the work of noted church architects, North & Williams. It is historically significant because it is connected with local parishioner and Melbourne industrialist, George Pizzey, who bequeathed funds for its construction. George Bird was born in England in 1845 and arrived in Australia in 1856 as a child of assisted migrants. Soon afterwards he came out to Eltham to live with his uncle George Stebbings, working for him as bricklayer's assistant in building, amongst others, Shillinglaw Cottage and the Anglican and Methodist Churches in Eltham. He later purchased 72 acres at the eastern end of Pitt Street (bounded by Eucalyptus Road, Mount Pleasant Road and present-day Rockliffe Street) and established the property ‘View Hill’, which was worked as a mixed farm and orchard (including berries). In 1878 he married Janet Kilpatrick, who had emigrated from Scotland. They had ten children, three of whom died in infancy. The wedding in 1904 of their eldest surviving daughter Sarah (‘Sis’) to Edward Pepper appears to have been quite a society event. George was a staunch Methodist and was a Church Steward and a Sunday School Superintendent in about 1890. Janet died in 1915 and George died in 1920 (though his gravestone says 1921). George's will stated that his property was to be divided between all his children in equal shares. This necessitated subdivision of the View Hill property, which took place progressively between 1922 and 1926. One son, George Hugh Bird, operated a drapery store in Main Road (near Bridge Street) in around 1915. Later, in the 1920s, he ran a greengrocer's shop (also selling confectionery) in Main Road opposite Eltham Station. It was the first shop in Eltham to have plate glass windows. At the same time, his brother Reg had a grocery store on the station side of Main Road. George and Janet are buried together in a family plot in Eltham Cemetery. Several descendants are also buried in the cemetery. David George Clark was the first and longest-serving headmaster at Eltham State School No. 209 (Eltham Primary) in Dalton Street, Eltham. David (then aged 26) and his sister Catherine first established their ‘private’ school which began in 1855 and was held in the Wesleyan Chapel in Henry Street, a slab built, shed-like building on land acquired by the Church in January 1855. Parents lobbied the Government to establish an official school, and a School Inspector came out to investigate. He found that the Clarks were of good moral and religious character (David taught Sunday School at St. Margaret's later on) and gave them his endorsement despite some perceived technical shortcomings. In 1856 a small stone building of 40 feet by 16 feet was erected on the school's present site at the corner of Main Road and Dalton Street. Half of the building was the school, the other half was the residence of David and Catherine and their mother, also Catherine. It appears that they were well respected by the local community: David constantly battled with the authorities to have facilities (such as toilets) at the school improved. As enrolment gradually increased, over-crowding became an issue. As well, David married Elizabeth in 1863. Needing to move out of the schoolhouse, in 1866 the Clarks bought a block of land in Metery Road next to the school and built the house "Shoestring" (which still exists albeit with significant modifications). Catherine retired in 1887 followed by David in 1889 after a period of ill health and was succeeded as Head Teacher by John Brown. George Bird was born in England in 1845 and arrived in Australia in 1856 as a child of assisted migrants. Soon afterwards he came out to Eltham to live with his uncle George Stebbings, working for him as bricklayer's assistant in building, amongst others, Shillinglaw Cottage and the Anglican and Methodist Churches in Eltham. He later purchased 72 acres at the eastern end of Pitt Street (bounded by Eucalyptus Road, Mount Pleasant Road and present-day Rockliffe Street) and established the property ‘View Hill’, which was worked as a mixed farm and orchard (including berries). In 1878 he married Janet Kilpatrick, who had emigrated from Scotland. They had ten children, three of whom died in infancy. The wedding in 1904 of their eldest surviving daughter Sarah (‘Sis’) to Edward Pepper appears to have been quite a society event. George was a staunch Methodist and was a Church Steward and a Sunday School Superintendent in about 1890. Janet died in 1915 and George died in 1920 (though his gravestone says 1921). George's will stated that his property was to be divided between all his children in equal shares. This necessitated subdivision of the View Hill property, which took place progressively between 1922 and 1926. One son, George Hugh Bird, operated a drapery store in Main Road (near Bridge Street) in around 1915. Later, in the 1920s, he ran a greengrocer's shop (also selling confectionery) in Main Road opposite Eltham Station. It was the first shop in Eltham to have plate glass windows. At the same time, his brother Reg had a grocery store on the station side of Main Road. George and Janet are buried together in a family plot in Eltham Cemetery. Several descendants are also buried in the cemetery. Nicholes, Photographer was first listed on the north side of Heidelberg Road, Alphington in 1904 and again in 1905. By 1906 he was still listed but with no profession. From 1907 on he was listed as a bicycle agent. On July 23, 1878, George Bird married Janet Kilpatrick (born Ayrshire) at Northcote by Presbyterian minister, Duncan Fraser. The witnesses were daughters of the minister. George gave his profession as farmer. Around 1880 or possibly earlier he acquired the property known as View Hill at the top of Pitt Street, Eltham between Pitt Street and Mount Pleasant Road and what is now Eucalyptus Road. George and Janet developed an orchard and farm around the View Hill home and had 10 children, three of whom died young. George Bird is listed in the 1977 history of the Eltham Methodist Church as Steward and trustee in the early years. In the 1950 history he is mentioned as Sunday School Superintendent. In the early 1900s, Janet regularly went to the church by horse and jinker. Janet died September 2, 1915, age 60 of endocarditis and bronchial pneumonia. At about this time, three children had married (Sarah, George and Ada) and four were living at home. However, Edwin joined the AIF in August 1915 and Ellen married in 1916 leaving two sons, Arthur and Reg, to look after their father and the property although some of the married children may have lived at View Hill for some time. From Edwin's letters, Hilda Pepper, a cousin on their mother's side) stayed with the family for some time to help. In later years, George developed glaucoma and became blind. He died December 6, 1920, aged 75 years, of diabetes mellites. Both Janet and George are buried at Eltham Cemetery, but the gravestone incorrectly gives 1921 for the death of George. The estate was divided into equal portions and distributed to the surviving members with Arthur and Ted Pepper being Executors. Ada Janet Lowe received a portion above what is now Rockliffe Street and Sis Pepper (Sarah Ann nee Bird) the portion below Rockliffe Street. Ernest Pepper built in the 1930s on the Pepper block at the Pitt Street end. George's share was along Wattle Grove and Arthur received the portion at the eastern end. Presumably the other two received portions including the top of the hill and slopes down to Pitt Street, Mount Pleasant Road and Wattle Grove. Read's (at the corner of Pitt Street and View Hill Crescent) was the first additional house brought in on wheels by a Mr Walkenden. Bushfires rage in Victoria, Snowy: Three dead MELBOURNE, Wednesday.—Three people died today in a bush» fire which raged through North Eltham, about 15 miles from Melbourne. The victims were three men. A fourth man is feared to be dead. Another bushfire. sparked off by the heatwave sizzling over south-eastern Australia, is burning out of control in the Kosciusko State Park, in the Snowy Mountains. Firefighters fear that if it reaches pine forests up the Yarrangobilly River, they will be powerless to stop it. The three victims of the North Eltbam fire were trapped by flames in a valley. Their bodies were found only a few yards apart. They were named by police tonight as Mr. George Crowe, 78, of North Eltham, William John Ewers, 64, and John Laurence Coleman, 31, both of Eltham. The other two have not been identified. They are believed to be a man aged about 40 and an 18-year-old youth. At least 12 homes were destroyed by the fire, the worst in Victoria since 1962, when eight lives were lost and hundreds of homes burnt down at Warrandyte. At one time the township of Eltham was threatened, but a cool change swept in from the south and held back the wall of flames. More than 100 dogs, worth about £4,000, died when the fire raced through two kennels in Short Street, Eltham. and Upper Glen Park Road, North Eltham. A trickle of water Residents ran into the streets as the blaze raced towards their houses. Others frantically dug firebreaks around their homes. Mrs. Sue Recourt wept when firemen arrived while she was vainly trying to stop the flames with a trickle of water from the garden hose. A stack of firewood was blazing, but the firemen managed to save the house and rescue four goats. Many homes in Eltham were saved after flames had crept to within feet of their fences. Students at North Eltham State School had to be evacuated when the blaze threatened the building. Fire fighters were severely hampered by lack of water and narrow roads. The blaze, which began in above century heat, turned toward Wattle Glen, where two houses were gutted. Then the flames raced towards Hurstbridge to the north. Firemen battling desperately, controlled the fire late this afternoon. On that day one pilot up in a spotter plane said afterwards: "It seemed at times that half the State was on fire." This time, for three days on end, Gippsland men, women and children had moments of conviction that their towns would have blackened into anonymity before the weekend was out. The week began with horror at Eltham on the North-eastern edge of Melbourne. Eltham today is something of an artists' colony. Oil painters, water colourists, potters and sculptors proliferate. A number of University folk have emulated the example of Professor MacMahon Ball who pioneered the way by moving to Eltham and carving a home out of the bush in the thirties. Innermost Eltham is barely 14 miles from the G.P.O. Farthest Eltham stretches miles beyond. It served to illustrate the tragi-ludicrous truncation of Victoria's fire control. Part of Eltham is under the protection of the Melbourne Fire Brigade. But this responsibility ceases at some invisible and incomprehensible line — apparently determined by the meanderings of the water mains. At this point everybody's property throughout the rest of Eltham is dependent on the Country Fire Authority. Half an hour before midday on Wednesday, a fire suddenly started on the West side of Upper Glen road on the edge of Eltham. Before the fire brigade could arrive, it was burning on a widening front through timber and high grass north of Eltham. Two wind changes in rapid succession saw the fire leaping Diamond Creek. With a freshening wind it struck home after home in three streets. More than one of them exploded suddenly as if hit by an incendiary bomb. There is no piped gas in the Eltham area, hence many housewives use bottle gas. The flames outside caused the bottles to explode. Altogether twelve homes were completely incinerated and four more were badly damaged. Thirty prize dogs perished. About three hours after the fire started it raced suddenly down a gully hillside trapping an elderly man. Two other men apparently raced to the rescue. Flames caught the three men within yards of each other, not 200 yards off the Upper Glen Park Road where safety lay. They were burned to death. Next evening an angry and convincing secretary of the Fire Brigade Union, Mr. W. M. Webber, came on television and appealed to the people of Victoria to end the ridiculous and dangerous dualism in fire-fighting control. The Eltham fire, he said, had precisely illustrated the situation. The Metropolitan Fire Brigade area touched Eltham, but where the fire had gutted and killed, was just outside its area. Mr. Webber said his union had constantly urged one authority for the State with a complete reorganisation of fire protection. On Wednesday the union had repeated its call for an inquiry into fire protection in Victoria to the Chief Secretary, Mr Rylah. "No matter how close the liaison between the two organisations, there are always divided sections of thinking," Mr. Webber told viewers. "I don't know how much tragedy the com-munity can take before it demands that it is properly protected." Rumours that differences in gauge between taps and hose nozzles (as between the two authorities) accentuated the damage were denied by fire chiefs who said that all appliances were now carrying adaptors so that hoses could be linked to mains everywhere. But there is grave concern in the Metropolitan Fire Brigade's higher councils at the action of several Federal authorities with projects in and around Melbourne. They are installing non-standard equipment without reference to the State authorities or any dovetailing of appliances and equipment. Public alarm was not diminished by the publication on Friday and Saturday of a heart tearing letter from the young widow of John Lawrence Coleman, 31 year old father of two, who had died in the flames apparently trying to rescue the old man trapped in the gully. By that time, a Vast area of Gippsland was in flames and the troops had been sent in to back up the overworked and often helpless fire-fighters. By Saturday, the Leader of the Opposition, Mr. Stoneham, who has previously demanded a Royal Commission into fire-fighting arrangements, repeated his demand. To add to the Chief Secretary's worries he was publicly rebuked for allegedly implying on television that lives had been lost at Eltham because people went to the wrong place at the wrong time. In a letter to the Press, Professor MacMahon Ball pointed out that two of the men involved were experienced bushmen who had gone "to help an old man in great danger fully aware of the danger to themselves". As Victoria faced its sixth day of total State-wide fire ban, it looked likely that even official resistance was not going to silence the demand for one central authority to control the fire fiend. At the moment, the 400 square miles where two million Victorians live in Greater Melbourne are divorced from the rest of the State in planning, communications, equipment and control of personnel. No one doubts the whole-hearted co-operation and willingness to back each other up of the M.F.B. and the C.F.A., both at top-level and among the firemen themselves. However, when a city straggles so deeply into the country side, the absence of a single authority, to oversee and analyse the fire threat as a whole, suggests suicidal policy of divide and fuel.
