Functional object - Typewriter, Remington Typewriter Company, c.1925
This Remington No.12 typewriter is of the typebar, front-strike class. It was made by the Remington Typewriter Company of Ilion, New York, U.S.A. in about 1925. The Model No. 12 was introduced in 1922 and was one of the first 'visible writer' machines, in which the typed characters were visible to the operator. Previous models were of the upstrike class in which the characters were typed on the underside of the platen. To see what had been typed the operator had to raise the platen, meaning the typist was typing blind much of the time. This machine was used by Margaret Ganly née Burn in the 1930s. It was purchased for her by one of the sons of William Pride, a famous saddle maker in Geelong, William was Margaret’s grandfather. The typewriter was donated with original sales receipt and servicing tools. Margaret worked at Dennys for 7 years during the 1930s. The typewriter is accompanied with a story written by Margaret about her time working at the company. Margret married Jack Ganly, a fellow employee of Dennys. The Ganly name was well known within Dennys, with three generations of the Ganly family working at the company. WORKING CONDITIONS & OFFICE WORK DUTIES. Written by Margaret Burn in 2021. Worked at Dennys Lascelles in the 1930s. In the 1930s coming out of the Depression, jobs were hard to come by and had to be clung to by efficiency and subserviency. There was no union to protect workers – bosses could be tough and rough. Dennys Lascelles revolved around fortnightly wool sales in the “season” – September to May. Sale day was always a day of suppressed excitement. Preparation from a clerical point of view was complete and we now awaited the aftermath of the actual wool auction. The building teemed with people. There were country people down to see their wool sold, buyers of many nationalities, or from the big cities, who were coming in and out of the building all day. Their role was to inspect the acres of wool bales displayed on the show floors; however, caterers were present to feed clients, and there was plenty of social interactions on top of business. The office staff did not go home but waited until the first figures came back from the wool sales and the machines went in to action, both human and mechanical, preparing the invoices for the buyers’ firms. This comprised of lists of lot numbers, weights, prices per lb., and the total prices paid. A lot of this was done by old-school typewriters, making this work a big, heavy, tiring job. Before the finished lists could be dispatched, they were collated on an “abstract”. The lists had to balance with the catalogue from which the invoices had been prepared. This never happened automatically. All the paperwork had to be split up amongst pairs of workers and checked until discrepancies were found. This would happen until midnight but occasionally went until 2 or 3 am. Once complete, the invoices could then be rushed off to the buyers’ firms usually in Melbourne, and hire cars took the staff home. It was back on the job the next morning, usually around 8.30. The office hours varied according to the size of the sale and work involved. Some days started as early as 8 and could finish around 5.30. The second phase of work began with the account sales to be prepared for the sellers of the wool. These detailed all the weights, descriptions of wool, brands, and prices. One Sales account could have multitudes of lot numbers, all needing to be individually described. Various charges needed to be deducted such as finance for woolpacks, extra stock, or farmers who were given a loan to live on during the season. Details of how payment was to be made was also noted, whether the seller was to be paid by cheque, to a bank, or credited to their account with the company (which often left the seller still in debt). For a couple of months in the winter, things were quieter when staff took holidays and were sometimes given afternoons off. But there were still weekly skin sales and stock sales around the state. The annual end of June figures to be prepared for a big company like Dennys with branches all around the state also kept the staff busy. In good years there was sometimes a bonus. On sale days there was a bar open for the clients and wool buyers. This added to the excitement for the young girls, who were strictly barred from using it, but somehow managed to sneak a gin and tonic. This is how I had my first ever, before the evening meal. There was also the romantic notion in some minds, with all the influx of males, that some of us might end up on a wealthy station, or be noticed by an exotic buyer. The top section of the typewriter consists of a cylindrical platen on a carriage featuring plated metal fittings. A curved folding paper guide sits behind the platen and moves on the horizontal axis when the user types on the keyboard. A horizontal semicircular type basket with typebar links the top section to the lower keyboard. The ink ribbon is carried between two spools on a horizontal axis, one on each side of the type-basket. At the rear, a paper tray features gold lettering which reads ‘Remington’. At the front, a four-row QWERTY keyboard is found with 42-character keys total. 'SHIFT LOCK' and 'SHIFT KEY' are to the left of the keyboard, 'BACK SPACER' and 'SHIFT KEY' to the right. All keys are circular, white with black lettering. At the top of the keyboard are five circular red keys with the numbers 1-5 displayed behind their respective keys. A Spacebar is found along the front of the keyboard. The typewriter is accompanied by a cardboard box. This box contains the original sales receipt, on blue paper with grey lead handwriting. It also contains spare parts, a spare ribbon stretched between two spools, and cleaning tools such as brushes of differing sizes. Serial Number. Engraved. "LX45395" Gold lettering. This fork is believed to belong to the household of Chiltern writer and historian, W.C. Busse. It displays a level of tarnish indicating it may be comprised of silver or silver plate. It has no evident hallmark to determine its maker or date of manufacture, but may pre-date World War Two as mass production methods and the growing popularity of stainless steel in cutlery and other tablewares saw a reduced reliance on silver in such goods after this period. The handle of the fork appears to display the initials 'WB', potentially indicating it was made to order. Wilfred Clarence Busse was born in Chiltern in 1898. He went to school at Wesley College in Melbourne, studied law at the University of Melbourne and became a barrister. Additionally, after spending time on a Victorian station in his early twenties, he wrote two historical novels about bush life. His first novel was 'The Blue Beyond: a Romance of the Early Days in South Eastern Australia', written in 1928 and published in 1930. Busse's second novel was titled 'The Golden Plague: A Romance of the Early Fifties'. The judges of the Henry Lawson Society's T.E. Rofe competition to advance Australian literature unanimously awarded it the Gold Medal in 1931 for the best historical novel of 1930. Newspaper articles about the award mention the writer's meticulous documentary and oral history research regarding life on the Gold Fields in the 1850s. It became a best-seller. This knife is believed to belong to the household of Chiltern writer and historian, W.C. Busse. It displays a level of tarnish indicating it may be comprised of silver or silver plate. Accessory - Locket
This locket is from the museum's collection of objects relating to Wilfred Clarence Busse. Busse was born in Chiltern in 1898, completed his secondary education as Wesley College in the early twentieth century, and went on to study law at the University of Melbourne. As a lawyer, he spent time in the room of Supreme Court Judge Bernard Cussen (1859-1933). Judge Cussen was popular, known for being just and precise and for completing through statutory consolidation in his spare time. As well as working as a lawyer, Busse wrote historical fiction inspired by his life in Chiltern, these included The Blue Beyond; A Romance of the Early Days in South Eastern Australia" and "The Golden Plague: A Romance of the Early Fifties," which won the T.E.Role gold medal for the best historical novel in 1930 and went on to become a best seller. He was a member of the Chiltern Athenaeum until his death in 1960. The placing of hair in lockets was a common 19th and early 20th century, with Queen Victoria wearing a locket containing a piece of Albert’s hair after his death in 1861. Wearing a loved one’s hair or giving a lock of your hair to someone for wearing, could be a gesture of love and friendship, or of mourning. The tangibility and personal nature of hair made it a common keepsake, especially in cases of high mortality or where family members were separated by oceans without the possibility of air travel. The intention and origin of this locket is currently unknown, but it is likely it was a keepsake of love or mourning, either way, a emotional object. This object artistically significant as an example of late 19th/early 20th century jewellery, and social and spiritual sigifiicance as locket containing a piece of hair, which, regardless of exact intention, imbues it with a strong emotional aura. A small dark metal locket with a decorative leaf pattern on the exterior. This item is part of the Di Reidie collection. Diane Reidie was a much loved volunteer and President of Brighton Historical Society from 1999 until 2016. Originally from New Zealand, Di and her family lived in Male Street, Brighton for many years. A vibrant and energetic person with a zest for life and a gift for bringing people together, Di was a friend to many in the Bayside community and active in local community organisations. Her tireless work as President of BHS saw her named Bayside Citizen of the Year in 2008. As a seller and collector of vintage clothing, she was passionate about fashion history; one of her many enduring contributions to BHS was her extensive work in preserving, developing and promoting the Society's costume collection. In 2018-19, Di donated more than one hundred items from her personal vintage clothing collection to the Society. The collection, which includes clothing, hats, handbags and shoes from local and international designers, is representative of Di's wide-ranging interests, colourful personality, creativity, humour and love of fashion and travel. Di purchased this dress as a vintage item. Elvie Hill (1917-2018) was a Melbourne fashion designer and a longtime Brighton resident. She established her eponymous label and became well-known for her elegant and feminine designs. She dressed some of Australia's best known women, including Lady Sonia McMahon and Dame Pattie Menzies, and was also known for her boutiques in Melbourne (the last store closed in 1991). This children's eating utensil is believed to belong to the household of Chiltern writer and historian, W.C. Busse. The level of tarnish and the mark 'EPNS' may indicate it is electroplated. The blade also contains the maker's mark 'APEX', which was used by John Biggin & Co, Sheffield, United Kingdom. Pushers such as these were a common utensil in Victorian and early twentieth-century households. They were used to help children too young to use knives learn to eat politely at the table - the blunt blade was used to push food onto the fork. This medal from the estate of W.C. Busse is believed to have been awarded to a recipient at the Rutherglen Agricultural Show in 1885. Due to degradation of the embossed markings, it is uncertain what the medal was awarded for or whom it was awarded to. It may have been awarded to a member of the Busse family prior to W.C. Busse's birth. Rutherglen is located approximately 18 kilometres from Chiltern. European agriculture and horticulture in the area was well established prior to the discovery of gold in the region in the 1860s. It held its first yearly Agricultural Show in 1880; in the present day it has a sister event focusing on showcasing the region's wines. Wilfred Clarence Busse was born in Chiltern in 1898. This badge was given to William Clarence Busse when he became a lifetime member of the Chiltern Football Club. Football became popualr in Chiltern during the 1860s, with the local team becoming a key part of the creation of a formal competition for the Ovens and Murray region, which came about in 1893. The Chiltern team also participated in the founding of the Chiltern and District Football Association in 1912, where they won their first premiership in 1914. In 1954, the team played in a Grand Final against Greta that had a 43 minute long final quarter. Chiltern was ahead when the fourth quarter should have ended, but the timer did not go off and the game went into overtime, allowing Greta to snatch the win and set in place a decades-long rivalry. Today, the team continues to compete under the nickname the 'Swans' in the Tallangatta and District Football League. Wilfred Clarence Busse was born in Chiltern in 1898. He completed his education at Wesley College in Melbourne then studied law at the University of Melbourne, before becoming a barrister. During his career, he often worked in the chambers of Judge Bernard Cussen (1859-1933) of the Supreme Court. Cussen was popular as a judge and lawyer, known for being just and precise and for completing through statutory consolidation in his spare time. Between 1995 and 2015, ran the vintage and second hand clothing store Hooti Couture at 321 Flatbush Avenue, Brooklyn, and after reading the book Di was inspired to seek out the shop. For many years she drew on it as a source of design inspiration, particularly for print, in her highly successful fashion business. The dress secures with press studs at the centre front for modesty with a full left side opening secured by press studs. Booklet - Elders Centenary Catalogue, Elders Smith & Co. Ltd, 1978
This catalogue was produced by the South Australian wool auctioning company Elders, Smith & Co. Ltd. It accompanied their celebration of a century of wool sales in 1978. The first wool auction in South Australia took place at Elders a century earlier, on the 15th of October 1878. It was covered in detail by The South Australian Register. At the sale, 1976 bales of wool were offered in what was the beginning of the wool storage and brokerage system in South Australia. Elders, Smith & Co. was established in 1839 by Alexander Lang Elder. Born in 1815 in Scotland, he moved to Australia at age 24 and set up Elders in Port Adelaide. Interestingly, the company’s original site is now the South Australian Maritime Museum. Elders’ business partner was Robert Barr Smith. Also born in Scotland, he moved to Australia in 1854 at the age of 30. Smith was an important part of the Company’s first wool sale. Smith made statements at the auction for South Australia to have a proper wool industry; with a purpose-built wool store, auction house and for the state to be able to supply its own products. This was met with a “Hear, hear” from the crowd at the auction. This statement is reflected upon within the catalogue. The catalogue itself also contains images of the company’s first wool auction, an outside image of Elder’s Wool Warehouse in Port Adelaide as well as an image of the Show Floor inside of this Port Adelaide warehouse. The catalogue also contains a quote from Elders’ Wool Manager for Victoria and Riverina, Murray Jewster. He discusses how the company is proud of its history and looking forward to its future in assisting both wool buyers and sellers. The quote also highlights Elders shift from being an Adelaide focused business, growing to span the width of Australia. 4 page booklet. As a seller and collector of vintage clothing, she was passionate about fashion history; one of her many enduring contributions to BHS was her extensive work in preserving, developing and promoting the Society's costume collection. In 2018-19, Di donated more than one hundred items from her personal vintage clothing collection to the Society. The collection, which includes clothing, hats, handbags and shoes from local and international designers, is representative of Di's wide-ranging interests, colourful personality, creativity, humour and love of fashion and travel. Of all the items Di donated to the Society, this four-piece Easton Pearson outfit was her favourite. When she bought it around 1997-98, it was the first time she had spent a large amount of money on clothing, and she thought it only fitting to throw a suitably elegant party at which to wear it. James Cameron's hit movie 'Titanic' had just been released, and upon discovering the recipe book 'Last Dinner On the Titanic: Menus and Recipes from the Great Liner', Di was inspired to host a Titanic-themed party for her friends. Held at her home in Brighton in 1998, the event included a string quartet, an eleven-course meal prepared entirely by Di, and a life boat in the backyard swimming pool.A four piece outfit consisting of a blouse/cardigan, camisole, skirt and wrap. Double-layered silk wrap with an outer layer of silk chiffon. Both ends feature and embroidered band of brown and black cotton, copper wire, and copper glass beads. Camisole of black and copper shot polyester rayon with wide shoulder straps and small shoulder pads. Blouse of brown silk chiffon, with a v-neck and eleven silk-covered buttons and loops at centre front. Patch pockets over front hip and full length sleeves. The neckline and sleeve edges are trimmed with copper-coloured glass beads. Full-length double-layered straight skirt with black and copper shot polyester rayon lining and silk chiffon overskirt. The skirt secures centre back with a nylon zip and botton closure. Originally from New Zealand, Di and her family lived in Male Street, Brighton for many years. A vibrant and energetic person with a zest for life and a gift for bringing people together, Di was a friend to many in the Bayside community and active in local community organisations. Her tireless work as President of BHS saw her named Bayside Citizen of the Year in 2008. As a seller and collector of vintage clothing, she was passionate about fashion history; one of her many enduring contributions to BHS was her extensive work in preserving, developing and promoting the Society's costume collection. This jacket originally belonged to Australian singer, actress and philanthropist Olivia Newton-John, who autographed it and donated it to be auctioned at a Leather and Lace Ball for the Austin Health Olivia Newton-John Cancer Centre Appeal on 15 May 2004. Newton-John has long been an advocate for cancer research and awareness, having undergone multiple treatments for cancer, a disease Di also battled for many years. Di's husband David purchased the jacket at the auction for around $1,000, and it has since been much worn by Di and her daughter Kathryn. The nature of the jacket - which is faux-leather, with glued-on diamantés, suggests that it was likely part of a stage costume rather than an item from Olivia Newton-John's personal wardrobe.Black polyester leather look jacket with black polyester lining. The development of stereoscopic photography views or stereographs was immensely popular in the United States and Europe from about the mid-1850s through the early years of the 20th century. First described in 1832 by English physicist Sir Charles Wheatstone, stereoscopy was improved by Sir David Brewster in 1849. The production of the stereograph entailed making two images of the same subject, usually with a camera with two lenses placed 6 cm apart to simulate the position of the human eyes, and then mounting the positive prints side by side laterally on a stiff backing. Brewster devised a stereoscope through which the finished stereograph could be viewed; the stereoscope had two eyepieces through which the laterally mounted images, placed in a holder in front of the lenses, were viewed. The two images were brought together by the effort of the human brain to create an illusion of three-dimensionality. Stereographs were made of a wide range of subjects, the most popular being views of landscapes and monuments and composing narrative scenes of a humorous or slightly suggestive nature. Stereoscopes were manufactured for various price ranges and tastes, from the simple hand-held device introduced by Oliver Wendell Holmes who promoted stereography through articles to elaborate floor models containing large numbers of images that could be flipped into place. The stereograph became especially popular after Queen Victoria expressed interest in it when it was exhibited at the 1851 Crystal Palace Exposition. Like television today, stereography during the second half of the 19th century was both an educational and a recreational device with a considerable impact on public knowledge and taste. The Fine-art Photographers' Publishing Co. published many stereoscopic pictures from many different photographers from around the world under license. They also not only sold these images of various scenes and of famous people of the time but also were retail sellers of the viewers with the subject item having been made in the USA probably by H C White who held the patent for the subject items design from 1895 to 1902.An item that was very popular from the mid 19th century through to the beginning of the Edwardian period. Used for entertainment and also educational purposes and significant as it gives us a snapshot into the Victorian era and its social and domestic societal norms. The diorama of mounted specimens of seaweed was framed by Richard Foster Norton for Thomas Watson and is dated 1860. Watson was the Warrnambool District Surveyor at the time (1860). The inscription on the back of the frame links the artwork to the Pigeon Hill property, which was located on Allansford Road (corner of Staffords Road – north side of the Princes Highway-A1). In the 1860s, the property known as Pigeon Hill was owned by William Wall who was a publican who ran several hotels in Warrnambool and district. In 1860 Wall, was running a hotel in Wangoom, near Pigeon Hill. Further research is required to determine the exact location, but Pigeon Hill could also have been the name for that area and may have had other people living there. Thomas Watson was a member of the local horticultural society. Another possible creator of the artwork is Samuel Hannaford, a biologist with a particular interest in collecting marine flora. Hannaford left Warrnambool in 1857 and went to Geelong, so it is possible he collected the specimens had them framed in Geelong, and then arranged for their return to Watson. The other known seaweed collector was Henry Watts, who lived in Warrnambool in the mid-19th century. The seaweed collection in this box was possibly one of Watts' and could have been prepared for the Victorian Exhibition of 1861, Richard Foster Norton, also known as R.F Norton, was one of only a handful of picture framers in 1850s Melbourne. Norton was born on the 24th of July 1822 in Yelvertoft, Northamptonshire and prior to his arrival in Australia, Norton is listed in England as having the occupation of a painter. It appears that he established his business in Melbourne in 1854 or 1855. Between 1855 and 1865 he operated from 87, then 83, and later 80 Collins Street. In the Argus newspaper, Norton advertised his business as a Print seller, Carver, Gilder and Picture Frame manufacturer, supplying the growing demand for artworks and decorative furnishings in the colony during the Gold Rush. Norton also had a Geelong branch in Market Square, where this work was produced. This framed work is highly significant. Previous research has found that only six frames are in existence that can be attributed to be made Norton, dating from the late 1850’s to the mid 1860’s. Moreover, Thomas Watson the owner of the artwork, is one of the government surveyors of the region during the mid-19th century.Diorama in deep wooden frame, behind glass. Domestic object - Butter knife belonging to W.C.Busse
Wilfred Clarence Busse, born in Chiltern in 1898, His family moved to the region during the gold rush and continued to reside in the area, purchasing land adjacent the Murray River. Busse completed his secondary education at Wesley College in Melbourne then studied law at the University of Melbourne. Busse went on to become a barrister, often in the chambers of Sir Leo Finn Bernard Cussen (1859-1933) a judge of the Supreme Court of Victoria. He worked most of his life in Chiltern as a Barrister and Solicitor and gained the unofficial title of historian of Chiltern, leaving behind several manuscript histories and a scrap book. Busse was an avid fictional writer and in 1930 he published two novels. Time spent on a Victorian station in his early twenties, as well as careful documentary research, informed the writing of his historical novels of bush life. "The Blue Beyond; A Romance of the Early Days in South Eastern Australia” and "The Golden Plague: A Romance of the Early Fifties." "The Golden Plague” won the T. E. Role gold medal for the best historical novel which went on to become a best seller. Busse often drew inspiration for his novels from his younger years living Chiltern. His passion for the region lead him to write “The History of Chiltern” which was published in a serial form in the Chiltern Federal Standard from 1922-1923. Wilfred Clarence Busse was a member of Chiltern Athenaeum (where this object is now held) up until his death in 1960, he is buried in the Barnawartha Cemetery. Likely Silverplate due to the intensity of the tarnishing of the metal, with indecipherable hallmarks on the handle, the method of production and the maker mark are unclear. The delicate swirling fernlike motif on this particular butter knife appears to be stylised in either Art deco the decorative arts and craft style favoured in Europe between 1880-1930's and less representational than examples of Australiana flora captured in silversmithing from the 1850's onwards produced in Australia. It is likely that those producing silverware at the time would be drawing on the decorative arts movement while incorporating elements of the natural beauty in the flora of their newfound environment into the silverware they produced.Wilfred Clarence Busse was of social significance to Chiltern, he helped to document the cultural story of the area in his published works "The Golden Plague" and "The Beyond Blue" by recounting his own upbringing in a bush lifestyle. He was a respected Barrister and was the unofficial historian of the Chiltern Athenaeum for many years. This butter knife represents a window into the domestic life of this person who was well loved in the area, and it continues its relationship to Busse as well as Chiltern by being held within the very collection he helped to maintain in his life. Domestic objects tell us the story about how people lived, objects of daily use hold particular meaning in that they can tell us the story of an individual, we feel closer to their life and habits, it humanises and connects us across time. Picker
Wool picking machine designed to separate locks of wool before it is carded and spun. The picker opens the wool’s locks which makes it easier to send the fleece through a carding machine. It does this by teasing the fibres (which can also be done by hand just by pulling the lock structure apart), but a picker does this in bulk and much quicker than what can be done by hand. It is possible to spin fibres directly after the picking stage; however, it is usually more desirable to card and blend them with other fibres. Typically, at a textile mill, a picking machine can separate enough lengths of fibre for a full day’s work after just a single hour. It will also help to remove any vegetation matter or other any unwanted elements that may be present in the wool. The quality of the casting on this machine suggest that it was made locally, either in Australia or New Zealand. Mike Leggett, the donor of the machine, acquired it from New Zealand where the seller said it had been used by his father to pick wool to make hand stuffed horse saddles. Mike attempted to used it a couple of times to pick alpaca hair, but the speed of the attached motor caused damage to the fibres. The motor is thought to be an added attachment, sometime around the 1960s judging by its age, while the machine itself is thought to be dated around the 1920s. The machine works by inserting wool through the rollers. Initially there was a conveyor belt feeder system which was powered by the handle on the side. This conveyor belt has been removed however, most likely due to age and deterioration. Wool is now fed through the initial teeth and is met by a spiked rotating drum which works to separate the fibres. The separated fibres would then complete a loop of the drum before being dispatched somewhere below, around where the motor presently sits, at a rapid rate of speed. Typically this wool will be collected in a closet or large catchment area, as can be seen from the 8:47 minute marker in the linked video (link - https://www.youtube.com/watch?v=kMjx-t3tH3A). It is not apparent how the wool is collected with this machine. Red and green machine with four green legs currently attached to a wooden pallet with wheels for easy movement. The green legs lead up to a red central circular barrel from which many attachments are present. Also present on the wooden pallet is a small black motor which is attached by a rubber belt to the central drum inside the red barrel. The belt spins the wooden drum via a dark red circular plate attached to the side of the drum. On the other side of the red barrel, a green handle extends for turning the picker’s conveyor belt feeder system. Two green walls extend forward from the central red barrel, guarding either side of where the conveyor belt would have been. At the start of these walls is a wooden cylinder, which the conveyor belt would have wrapped around, followed by two interlocking gears which rotate and accept the fed wool. The red roof extends over the central cylinder from here, securing the wool inside and protecting hands from the heavily spiked internal wooden cylinder which rotates and separates (picks) the wool. Extending over the top of this red roof is a green handle which reaches to the back of the machine (not pictured). Here it accepts a weight to ensure pressure is always present for the initial feeder interlocked gear teeth. There are two large gear cogs on the rubber belt side of the machine and 3 small gear cogs on the handle side of the machine, all coloured green. A green handle is also present at the rear of the machine, below the location from which the weight is hanging. A power cable extends from the motor and there are two adjustable metal rods on the top of the machine, the purpose of these rods is presently unknown. Black texter. On top of drum. Legal record - Transcript of High Court Appeal Philip Cooney v John Thomas Burns, 1921
The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. A vibrant and energetic person with a zest for life and a gift for bringing people together, Di was a friend to many in the Bayside community and active in local community organisations. Her tireless work as President of BHS saw her named Bayside Citizen of the Year in 2008. As a seller and collector of vintage clothing, she was passionate about fashion history; one of her many enduring contributions to BHS was her extensive work in preserving, developing and promoting the Society's costume collection. In 2018-19, Di donated more than one hundred items from her personal vintage clothing collection to the Society. The collection, which includes clothing, hats, handbags and shoes from local and international designers, is representative of Di's wide-ranging interests, colourful personality, creativity, humour and love of fashion and travel. Di purchased these 1890s shoes around 1990 and recalled wearing them to approximately three events before she donated them to BHS in 2019. Di enjoyed the novelty and conversation they would inspire due to their unusual appearance by modern standards. The shoes are indicative of Di's playful approach to clothing and life. The decorative preserved mink pelt with head featured on the vamps of these shoes is typical of Victorian era interest in and prevalent use of preserved animals for decorative purposes in clothing, millinery and household adornment. This fashion reflected social positioning of oneself as being affluent, educated and worldly. Following the death of Queen Victoria's husband Prince Albert in 1861, the Queen's approach to mourning his death influenced social conventions for the public, with the wearing of black becoming a significant aspect of Victorian fashions. The shoes were made by Kendal Milne & Co, a large department store on Deansgate, Manchester. It has traded under various names and owners since it opened in 1832; it traded as Kendal Milne & Co from 1862-1919, and continued to be known by this name for many years after. The store is currently owned by the House of Fraser department store chain and is known as House of Fraser Manchester.Black silk linear quilted uppers of single piece construction with feature centre front vamp seam. Horsehair wadding can be seen along the side of the forefoot where the upper is coming away from the leather soles. Approx 4.5 cm plain black silk covered heel with leather top piece missing from right shoe. Both shoes feature the head of a small preserved mink with glass eyes. The toppling of the vamp features a decorative strip of mink fur. Wilfred Clarence Busse, born in Chiltern in 1898, His family moved to the region during the gold rush and continued to reside in the area, purchasing land adjacent the Murray River. Busse completed his secondary education at Wesley College in Melbourne then studied law at the University of Melbourne. Busse went on to become a barrister, often in the chambers of Sir Leo Finn Bernard Cussen (1859-1933) a judge of the Supreme Court of Victoria. He worked most of his life in Chiltern as a Barrister and Solicitor and gained the unofficial title of historian of Chiltern, leaving behind several manuscript histories and a scrap book. Busse was an avid fictional writer and in 1930 he published two novels. Time spent on a Victorian station in his early twenties, as well as careful documentary research, informed the writing of his historical novels of bush life. "The Blue Beyond; A Romance of the Early Days in South Eastern Australia” and "The Golden Plague: A Romance of the Early Fifties." "The Golden Plague” won the T. E. Role gold medal for the best historical novel which went on to become a best seller. Busse often drew inspiration for his novels from his younger years living Chiltern. His passion for the region lead him to write “The History of Chiltern” which was published in a serial form in the Chiltern Federal Standard from 1922-1923. Wilfred Clarence Busse was a member of Chiltern Athenaeum (where this object is now held) up until his death in 1960, he is buried in the Barnawartha Cemetery. The floral motif on this particular spoon appears to be stylised in the decorative arts and craft style favoured in Europe between 1880-1920 and less representational than examples of Australiana flora captured in silversmithing from the 1850's onwards produced in Australia. It is likely that those producing silverware at the time would be drawing on the decorative arts movement while incorporating elements of the natural beauty in the flora of their newfound environment into the silverware they produced. This spoon seems more likely to have been produced in Europe and imported to the colony. The hallmarks on the handle DON and BP indicate it may have been produced from English electroplating silver which is a more cost effective product than solid silver, most likely produced by Cooper Brothers, Don Plate Works, established in Sheffield in 1866 who distributed silverware in Europe, America and the colonies well into the 1950's.Wilfred Clarence Busse was of social significance to Chiltern, he helped to document the cultural story of the area in his published works "The Golden Plague" and "The Beyond Blue" by recounting his own upbringing in a bush lifestyle. He was a respected Barrister and was the unofficial historian of the Chiltern Athenaeum for many years. This spoon represents a window into the domestic life of this person who was well loved in the area, and it continues its relationship to Busse as well as Chiltern by being held within the very collection he helped to maintain in his life. Domestic objects tell us the story about how people lived, objects of daily use hold particular meaning in that they can tell us the story of an individual, we feel closer to their life and habits, it humanises and connects us across time. Helen Malvira Mackenzie (1865-1956) married Charles Ansell Smith (c1861-1934). He was baptised 23 April 1861 in Tintinhull, Somerset - son of William Maxwell & Louisa Claudina Smith (nee Ansell). His father was curate of the church at the time. Helen Malvira (or Malvena) MacKenzie, known as Nellie, was the second daughter of the John Mackenzie J.P., of Westernport, and Wilcannia, N.S.W., and great granddaughter of the late Admiral Pasco, R.N. They lived at 'Devon', 3 Vincent Street from at least 1910 but perhaps earlier until 1915. Charles Ansell and Helen Malvina Smith’s children: 1. This photograph is part of the Caulfield Historical Album 1972. This album was created in approximately 1972 as part of a project by the Caulfield Historical Society to assist in identifying buildings worthy of preservation. The album is related to a Survey the Caulfield Historical Society developed in collaboration with the National Trust of Australia (Victoria) and Caulfield City Council to identify historic buildings within the City of Caulfield that warranted the protection of a National Trust Classification. Principal photographer thought to be Trevor Hart, member of Caulfield Historical Society. Most photographs were taken between 1966-1972 with a small number of photographs being older and from unknown sources. All photographs are black and white except where stated, with 386 photographs over 198 pages. From: Glen Eira Heritage Management Plan 1996 by Andrew Ward In 1856, John Allee, a builder from Brighton, purchased C.A. 37 on the south-west corner of Glenhuntly and Kooyong Roads. The land comprised just over 45 acres. By 1863, Francis John Sidney Stephen, a lawyer and cousin of J. Wilberforce Stephen, owned most of lot 37. By 1866, Stephen had a built a "small mansion" named ''Burreel". It was a brick house and Stephen lived there until 1882. By 1884, Mrs Buxton of Hillside Terrace, East Melbourne, had purchased the property. Richard Buxton, a gentleman was listed as occupant and the house described as "brick, eight rooms". NAV was £300. Richard Buxton continued residency in 1887 however in 1888, George Allen, music seller, became occupant. At that time the house had thirteen rooms on twenty-three acres of land. Twelve people lived there and NAV was £920. In 1900, Daniel Luxton, stock and sharebroker and the Honourable John Taverner, M.H.A. leased the property. Fourteen people lived there. Mrs Buxton continued as owner. By 1910, ownership had passed to Mrs Mary Neate, who converted the house to a nursing home. The land had been subdivided by 1913 and sold by ''Buxtons Estate". Burreel Avenue, Baxter, Buxton and Hoddle Streets were created. "Burreel" was rated to Burreel Avenue and stood on lot 13 with frontages to Burreel Avenue and Kooyong Road of 198' and 214'. The house had ten rooms. NAV was £60. Mary Neate, a nurse, continued as owner/ operator of ''Burreel" nursing home in 1927. At that time there were sixteen rooms and fourteen residents. NAV was £100. Mrs Neat remained there until 1947. In 1948, the house was turned into apartments. In the 1980's, the Alexander family purchased it and restored it to a private residence.Burreel 331 Kooyong Road, ELSTERNWICK VIC 3185 - Property No B4950 National Trust https://vhd.heritagecouncil.vic.gov.au/places/65648 This is a large and substantially intact example of the grand villas of nineteenth century Melbourne. The bulk of the house most probably was built in 1866-1868 for Francis John Sidney Stephen, a prominent and highly regarded Melbourne solicitor and a member of an illustrious legal family. Stephen conducted a lucrative private practice and in 1845 was appointed first solicitor to the City of Melbourne; a position he held until his death in 1895. He took an active part in the development of Caulfield and was Shire President in 1874 and 1877. He was a resident at Burreel from 1868 to 1882. The house has evolved in stages, the rear wings possibly remaining from a house built during the 1850s. The existing ornate cast iron verandah was probably built between 1882 and 1888 during the residence of Richard Buckhurst Buxted, a notable boom period auctioneer and real estate agent. George Allan, the founder of Allan's music store, was another important occupier from 1888 to 1991. Bureel's essentially residential quality has been retained and the interior has been well preserved. The significance of this building does not rest in any single unusual outstanding architectural feature, or in its association with a particularly prominent member of society in the past, but rather in the consistent integrity of both the interior and exterior, which results in the survival of an outstanding example of this type of residential building and its associations with two notable citizens. TROVE : The Age (Melbourne, Vic. : 1854 - 1954) Tuesday 13 December 1887 p 5 Article " ROUGH ON RATS" POISON.' . PROSECUTION UNDER THE POISONS ACT. At the St. Kilda police court, on Friday, W, A. Stokes, chemist, Carlisle-street, Balaclava, was prosecuted under the Poisons Statute on the charge of selling to one Mrs. Hannah Charlton a poison without having made and signed the entry required by the act. A second charge of selling to Mrs, Hannah Charlton a poison without having obtained the signature of the purchaser to an entry as required by the act was also preferred against the defendant. Both cases were taken together. Mr, Donovan appeared to prosecute, and Mr. Cole for the defence. Senior-constable Connell deposed that he knew the defendant. On the 24th of October last an inquest was held at East St. Kilda relative to the cause of the death of a man named Charlton. A packet bearing the label " Rough on Rats," which was found. in the deceased's bedroom, was produced at the inqiry, and afterwards handed over to Mr. Blackett, Government analytical chemist for analysis. The verdict of the jury was that the deceased died from the effects of arsenical poisoning. Hannah Charlton, a widow, residing in South Yarra, said in September last she purchased a packet of "Rough on Rats" from the defendant's assistant. Witness was not asked her name, place of abode, occupation or for what purpose the poison was required; neither did she observe the assistant make any entry in a book, She did not attach her signature to any document, and was not asked to do so. The packet was purchased for the purpose of poisoning rats. Cuthbert Robert Blackett, Government analytical chemist, stated that Constable Ballantyne handed him the packet produced. Witness made an analysis of the contents, and found it composed of arsenic, slightly coloured with a carbonaceous matter. The mayor announced that there was a doubt in the minds of the magistrates as to whether the defendant could be held guilty under the law, but they thought the prosecution had attained its object by making known the fact that "Rough on Rats" is a poison. According to Christine Erratt, due to the goldrush in the 1850's, there was increased wealth in the colony and an influx of immigrants from Europe to Australia who brought with them silversmithing skills which began ‘the golden age’ of Australian silver', Erratt says that 'Australia's unique flora has been portrayed in the decorative arts since the early colonial times of the last decade of the 18th century. The use of Australian flora to decorate silverware is of particular interest and diversity'. It is likely that those producing silverware at the time would be drawing on the decorative arts movement while incorporating elements of the natural beauty in the flora of their newfound environment into the silverware they produced. The death of Dr. James Stokes, M.R.C.S., L., occurred at his home, 43 Ebden Street, Elsternwick, on Saturday at the age of 90 years. TROVE : The Age (Melbourne, Vic. : 1854 - 1954) Tuesday 13 December 1887 p 5 Article " ROUGH ON RATS" POISON.' . PROSECUTION UNDER THE POISONS ACT. At the St. Kilda police court, on Friday, W, A. Stokes, chemist, Carlisle-street, Balaclava, was prosecuted under the Poisons Statute on the charge of selling to one Mrs. Hannah Charlton a poison without having made and signed the entry required by the act. A second charge of selling to Mrs, Hannah Charlton a poison without having obtained the signature of the purchaser to an entry as required by the act was also preferred against the defendant. Both cases were taken together. Mr, Donovan appeared to prosecute, and Mr. Cole for the defence. Senior-constable Connell deposed that he knew the defendant. On the 24th of October last an inquest was held at East St. Kilda relative to the cause of the death of a man named Charlton. A packet bearing the label " Rough on Rats," which was found. in the deceased's bedroom, was produced at the inqiry, and afterwards handed over to Mr. Blackett, Government analytical chemist for analysis. The verdict of the jury was that the deceased died from the effects of arsenical poisoning. Hannah Charlton, a widow, residing in South Yarra, said in September last she purchased a packet of "Rough on Rats" from the defendant's assistant. Witness was not asked her name, place of abode, occupation or for what purpose the poison was required; neither did she observe the assistant make any entry in a book, She did not attach her signature to any document, and was not asked to do so. The packet was purchased for the purpose of poisoning rats. Cuthbert Robert Blackett, Government analytical chemist, stated that Constable Ballantyne handed him the packet produced. Witness made an analysis of the contents, and found it composed of arsenic, slightly coloured with a carbonaceous matter. The mayor announced that there was a doubt in the minds of the magistrates as to whether the defendant could be held guilty under the law, but they thought the prosecution had attained its object by making known the fact that "Rough on Rats" is a poison.
