This is one of a series of photos donated by Arthur Lyons. From 1907 a cab service operated from near the railway gates in Union Road. It was established and maintained by Mr C Fraser until c1916. George Rea either took over then or set up in opposition; he retired in 1945. Fred Lyons initially worked for George until he set up his own business. In time he changed over to a motor vehicle and continued his service until 1960. Frederick Adolphus Lyons (1891-1980) was born in Surrey Hills, son of Thomas and Catherine Lyons. He married Elizabeth Ruby Hall in 1918. They lived just around the corner at 55 Sunbury Crescent. The Lyons’ home in Sunbury Crescent was called ‘Knopshambury’ - this was probably a misspelling of Knockshanbally in Co Kilkenny, the birth place of Fred’s father, Thomas Edmund Josias Lyons (1846-1915). Arthur Lyons was born in Surrey Hills on 12 Jun 1920. He became a motor mechanic / welder and lived at 55 Sunbury Crescent. The donation was made while he was in hospital. He died shortly afterwards (23 Sep 1990). Donation was finalised by a neighbour, Mrs Florence Ann Armitstead, wife of Glen Victor Armitstead. Glen was a local hairdresser. They moved to 11 Sunbury Crescent after their marriage in 1939. Bendigo Advertiser '' The way we were'' from 2000. Busy: the Frank Brown Brick factory, Back Creek, circa 1900. Frank M. Brown was born in 1857. He began his working life as an apprentice pattern maker with A. Roberts & Sons, iron founders, in Wills Street, Sandhurst. He later became foreman of Horwoods Foundry in Vine Street. He formed a foundry partnership with Thomas R.J. Carter in 1887 as Carter & Brown. In 1889 he left Carter to start his own City foundry in Wattle Street. In 1892 Brown established a steam brick works opposite 208 Sheepwash Road (now Sternberg Street) which continued to operate until about 1916. Dr Janice Newton has had a long term interest in Indigenous Studies and Aboriginality, and has published papers linking Aboriginality to the counterculture and to artists and musicians. She has published a paper commenting on Ballarat's response to the death in 1896 of King Billy, the so called 'last of his tribe'. The West Bendigo Cricket Club has operated for over 100 years with their home ground being the Ken Wust Oval at Quarry Hill. A Committee manages the club which plays men's competition in the Emu Valley Cricket Association and the women in the Bendigo District Cricket Association.Four black and white photographs of the West Bendigo Cricket Club who were Premiers in the Protestant Young Men's Cricket Association in Seasons 1948, 49, 50, 51. The ‘Thornton Estate’ was the final subdivision of ‘Thornton’ in Studley Park Road. Thomas Cubitt Balmain originally owned Thornton, next to John Carson’s ‘Clutha’. Before its final subdivision, the Thomson family owned it. The Estate was a subdivision of 15 residential allotments running between Studley Park Road and Stevenson Street. The allotments faced these streets as well as Thornton Street, which the vendor undertook to make. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney.
