Tait collection: item 37 of 62 This is a document giving details of the Will and Probate of Caroline Manton who died in 1889 and was the wife of Frederick Manton and lived at ‘Tenilba’ in Domain Street, South Yarra. She left personal estate to the value of £536 for the benefit of her husband and children but no other details on her life have been found. The lawyer in the case was Ernest Chambers who had legal offices in Port Fairy, Koroit and Warrnambool at the end of the 19th century and the beginning of the 20th century. This document was in his possession in his Warrnambool office and it was passed down to successive lawyers in the legal premises in Kepler Street, Warrnambool and located in 2014 in the same building, the former legal premises of Mackay Taylor. The portrait of Chief Justice Sir Edmund Herring is significant because of whom it portrays and who painted it. Sir Edmund Herring (1892-1982), had a military career before becoming the Chief Justice of Victoria in 1944. Sir Edmund served as an artillery officer with the British Army in World War One and was awarded the Military Cross. While he returned to the Law between the wars, becoming Kings Counsel in 1936, he continued his military associations through the Australian Militia forces rising to colonel by the start of the Second World War. At the outset of World War Two Herring was appointed as Commander of the Royal Artillery for the Australian Sixth Division. Herring saw service in North Africa and Greece and was in charge of Australian Northern forces in 1942, afterwards working with General Blamey in Papua New Guinea. It was at this time that Herring confirmed the death sentences of 22 Papuans who had been found guilty of murder and treason. Sir Edmund was appointed Chief Justice, straight from his army command in 1944. As Chief Justice he quickly established the Law Reform Committee and after the war oversaw the extension of the Supreme Court buildings, with the creation of new Courts. He was considered an able administrator, but his refusal to appoint Joan Rosanove a Queen’s Counsel throughout the 1950s, did not sit well with many legal practitioners. After his retirement from the Bench, he continued in his many public activities, including trustee of the Shrine of Remembrance and the Australian War Memorial and a member of the Melbourne Grammar School Council, as well as Lieutenant Governor of the State of Victoria a position he held from 1945 to 1972. Herring was also an outspoken social critic, between the wars he had been a member of the White Guard, who were a far right group acting against communism. During the Cold War period of the 1950s, Herring spoke out in favour of the British Empire and the American alliance. The portrait of Chief Justice Sir Edmund Herring is significant because of whom it portrays and who painted it. The portrait of Sir Edmund Herring is the second one that Sir William Dargie (1912-2003), completed of Sir Edmund, his first effort in 1944/45 won the Archibald prize. She died intestate in November 1881 and left property to the value of £363. This property reverted to her sister Agnes Thomson in 1889. No other details have been found on Helen Robertson. The lawyer in the case was George Skinner of Melbourne but the document was one of several stored in legal premises in Kepler Street, Warrnambool and passed on to successive lawyers occupying these premises. This document shows that Mary Irwin of Peterborough, Victoria, died in April 1892 without making a will and the Letters of Administration were granted to her husband, William Irwin. However he died in 1901 without having fully administered Mary Irwin’s estate. In turn the estate administration was passed over to Charles McGillivray of Peterborough and one of Mary Irwin’s sons, William Irwin, residing in New Zealand. This document was drawn up in 1907, fifteen years after Mary Irwin’s death. She left property to the value of £100. No other details on Mary Irwin are available. He had a practice in Kepler Street, Warrnambool with the known dates, 1897 to 1910, with other offices in Koroit and Port Fairy during the same time. He died intestate but had real estate to the value of £510 and personal estate to the value of £142. The beneficiary was his wife, Mary Ann Moloney. The lawyer involved in drawing up this document was William Ardlie, one of the best-known lawyers in Warrnambool in the 19th and 20th centuries. He commenced his business in the 1860s and continued on until the 1930s when he was well in his eighties, making him at the time the oldest practising lawyer in Australasia. The tipstaff is a symbol of office for the court officical responsible for keeping order in the court, also called the tipstaff. This tipstaff dates from 1826 and is marked with the reign of George IV. This tipstaff was unlikely to have been used in the Supreme Court of Victoria, and is probably an item donated to the court in the 20th century.This is the only item of this nature held by the court, the item because of its age would be quite rare. This rarity makes it of state significance, further research needs to be undertaken with regard to national and international (ie. Tait collection: item 49 of 62 This document gives details of the Will and Probate of Charles Wines of Warrnambool. Charles Wines was born in Somerset, England in 1832 and died in July 1900, residing in Lava Street East, Warrnambool, at the time. He and his wife came to Australia in 1852 and settled in the Woodford area, remaining there until about 1880 when they shifted to Mailors Flat. He was married to Hannah and they had a large family, with eleven surviving at the time of his death. He left real estate to the value of £1618 and personal estate to the value of £14 with the chief beneficiaries being his sons, Thomas and George and his wife, Hannah. After his wife’s death the estate was to be divided equally amongst the surviving children. The lawyer involved in drawing up this document was Ernest Chambers. He had legal offices in Warrnambool, Koroit and Port Fairy at the end of the 19th century and the beginning of the 20th century. The document was in his possession and was then passed down to successive lawyers occupying the legal premises in Kepler Street. His death place is given as Tower Hill. A William Osborne is listed as a Wangoom farmer in 1856, a farmer at ‘Thompson’s Old Farm’ in Allansford in 1866 and a farmer at Winton Farm on the Allansford Road near Shipley in 1869 but these references may be to William Osborne’s father as there is mention of a William Osborne, Junior at that time. William James Osborne left real estate to the value of £560 and personal estate to the value of £81 to his wife, Hannah. The lawyer who drew up this document was Ernest Chambers who had legal offices in Warrnambool, Koroit and Port Fairy at the end of the 19th century and the beginning of the 20th century. Correspondence held by the library has John Denniston Wood (1829-1914), a barrister and politician, presenting the portrait to the Library Committee in 1867. Wood hopes that the painting will "hang there [in the Court] in like manner as the portraits of many of the sages of the law are held in the Courts at Guildhall". Wood also provides information about the painter, Mr Mosely "now deceased", but who was "selected by Sir WIlliam himself" to undertake the commission. Early accounts have the painting hanging in a prominent position in the 'old' Court house at La Trobe and Russell Streets; the portrait was moved down to the library in 1884, when the portraits of Barry, Stawell and Molesworth were also commissioned. Sir William a'Beckett was the first chief justice of the colony of Victoria, having previously had a busy career at the Sydney bar. The portrait is of historic signifcance because of its subject Sir William a'Beckett and its long association with the Court. It is not known why the document has been drawn up in Melbourne and also makes reference to Warrnambool lawyers but it is presumed that some or all of the beneficiaries of the will lived in the Warrnambool district at the time. Charles Spencer left personal estate to the value of £689 to his wife, Emily, and children. Mentioned in the document are the lawyers J.S.Tait and Henry Parrington who were partners in a law firm in Warrnambool at the end of the 19th century (going under the name of Higgins and Parrington). The document has been passed down to successive lawyers occupying legal premises in Kepler Street and it was located in this building in 2014. The Letters of Administration for this estate was granted to Henry Parrington. The personal estate comprised £689 which had been lent to Spencer Smith on the security of land in the Parish of Wangoom, County of Villiers the repayment of which is secured by an indenture of mortgage dated 1st June 1892. Henry Phillips left personal estate to the value of £521 and the beneficiaries were his wife, Emma and their children. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. Elizabeth Avis- Box 1835-1913 was born in Sussex, married William Box in 1854 and arrived in Melbourne in 1855. William’s parents George and Mary Box and his siblings sailed with them. William & Mary at first leased land in the area of the ‘Dendy Special Survey Brighton 1841’ and then purchased the property with the pioneer cottage 1868 & 1869. William & Elizabeth established a market garden and raised 13 children. 1888 they built a larger 2nd house in front of the original cottage. William died in 1902 and Mary sold 9 acres in 1908 to W. .Snowden Anderson – it later became Joyce Park where the reconstructed Box Cottage Museum now stands. After Elizabeth died her daughters Ada and Violet lived on the 1 acre property until 1917 when August Reitman, a potter and monumental mason, leased the house and land. He established his pottery business and purchased the property in 1935. The business moved in 1953 but continued to use the cottage as a workshop/ storeroom until it was sold to Lewis Timber P/L in 1970. Elizabeth & William Box settled in the pioneer Cottage in Jasper Road East Brighton 1868 and established a market garden whilst raising their 13 children. This Cottage was reconstructed in Joyce Park, Ormond 1984 and is the home of City of Moorabbin Historical Society. Tait collection: item 45 of 62 This is a document giving details of the Letters of Administration following the death of Jessie Wall (nee Wood) who died intestate in Warrnambool in 1897 at the age of 53. She lived in the area in north Warrnambool known as Spring Gardens and left real estate to the value of £400 and personal estate to the value of £484. The estate was granted to her husband, Joseph Wall. The lawyer concerned with this document, Ernest Chambers, had legal offices in Port Fairy, Koroit and Warrnambool at the end of the 19th century and the beginning of the 20th century. He was in possession of this document and it was passed down to successive lawyers occupying legal premises in Kepler Street. It was located in this building in 2014.This document is of some significance as it contains details of the Letters of Administration of Jessie Wall who was a 19th century resident of Warrnambool. Her husband’s father was an important early settler in Warrnambool. The document will be useful to researchers.This is a cream-coloured piece of parchment paper folded in two with handwritten material on two pages (brownish-black ink). One of the pages has hand-ruled black lines on the edges of the page. A seal of the Supreme Court of Victoria is attached with green ribbon and there is also a red stamp of the Master in Equity of the Supreme Court. The document is a little stained but the writing is legible.
