These books contain reports of the Supreme Court of Victoria in 1960 and 1961. They came from the Ardlie family, members of which have been associated with Warrnambool and legal affairs since the early 1850s. John Ardlie came to Warrnambool in 1852 as the Clerk of Courts and his son William Ardlie was a prominent lawyer in Warrnambool for over 60 years. If it is this William Ardlie’s stamp in these volumes then it was used after his death. The signature is of John Ardlie, also a lawyer in Warrnambool and Port Fairy in the later decades of the 20th century.These volumes are of interest as they are connected to members of the Ardlie family, prominent lawyers and community members in Warrnambool in the 19th and 20th centuries.These are two volumes of law reports of the Supreme Court of Victoria– hard cover books with dark green covers and spines with red and gold bands and gold print. Tait collection: item 25 of 62 This is a 1904 document containing information on the Will and Probate of William Charlesworth. He died in September 1904. He was a chimney sweep and nightman who came to Warrnambool in 1854 and married Sophia Ingham in 1855. They had six children but their married life was stormy because of Sophia’s problem with alcohol. She became notorious for her court appearances and gaol terms and her erratic behaviour in public. William Charlesworth was not able to control the situation and tried several times to get her to leave the town. Sadly she committed suicide in 1891 by throwing herself off the Hopkins River Bridge. William Charlesworth left real estate to the value of £650 and personal estate to the value of £194. The main beneficiaries were Charlesworth’s son, Alfred, his daughter Amelia Charlesworth and his grandchildren, George and Alice Tait. Ernest Chambers, the lawyer concerned with this document, had legal offices in Warrnambool, Port Fairy and Koroit in the late 19th century and the early 20th century. The document was passed down to successive lawyers who occupied the legal premises in Kepler Street and located there in 2014 when it was passed on to the Warrnambool and District Historical Society. This document is of considerable interest as both William and Sophia Charlesworth were well-known residents of Warrnambool in the 19th century. It will be useful to researchers.This is a piece of cream-coloured parchment paper folded in two and containing handwritten material on four sides of the paper. Framed portrait of George Maxwell who was President of the Association for the Advancement of the Blind 1920-1935. It is part of a series of paintings commissioned by the AFB Board to commemorate the work of past presidents of the organisation. Mr Maxwell is turned slightly away from the viewer, and wears a blue suit, white high collared shirt and a blue tie. George Maxwell was President of Vision Australia from 1920 to 1935. After an early teaching career he studied law, was admitted to the Bar and became one of Victoria’s great criminal lawyers and later a Federal Member of Parliament. He took an interest the welfare of blind people from his student days. A detached retina in 1920 led to total blindness nine years later, which gave him a great empathy for those with a similar affliction. Through his contacts he was also instrumental in obtaining the first voting rights for blind Australians. Up until 1902 blind people were unable to vote if they couldn’t write with a pen. George Maxwell was working at that time at the legal firm of Strongman and Crouch one of the partners, Mr. Crouch, was elected as a member of Parliament. When the Commonwealth Electoral Bill was being drafted, Mr. Crouch has a clause added enabling blind people to vote in Federal elections, constituting a world first. But perhaps his greatest achievement was obtaining the pension for legally blind people. Until 1910 only those who met the age and means test criteria were eligible. With the help of his legal and political friends a bill was passed which granted the pension to all persons over 16 years of age who were unable to work due to physical disability or blindness. Until this time these people had to be supported by their families or go to a benevolent institution. This soda syphon (or siphon) was distributed by John Fletcher of Warrnambool, and made by the British Syphon Mfg. Co. Ltd. of London between the 1900s-1930s. It comprises a multi-sided clear glass bottle, an internal glass tube and a metal release valve and spout on the top. It was used to dispense pressurised, effervescent soda water. It was often used as an alternative to water or added to fruit juices and cordials. The text on this bottle states that it remains the property of the retailer, John Fletcher, and must be returned to him. Customers were asked for a deposit on the bottle, which would be refunded when the bottle was exchanged or continued as the deposit on a fresh bottle. Returned bottles would be cleaned and recharged with the gas and sold again. Soda syphon are bottles, glass or metal, with a release valve and spout on the top. The valve lever on the top of the syphon, when depressed, causes the gas in the syphon to force the water up through the tube and out of the spout. The bottle’s mechanism gives the water an effervescent quality to make bubbly drinks such as sparkling mineral water, soda water and sparkling water. ABOUT JOHN FLETCHER John Fletcher bought the Union Cordial Factory in Koroit Street, Warrnambool that was previously owned by John Davis. Fletcher operated the factory as J Fletcher, John Fletcher and Fletcher’s. He eventually sold his business and stock in 1930 to Ralph Reeves, who may have continued using Fletcher’s supply of drink containers before renewing them with stock showing his own brand. The soda syphon is representative of drink containers used in the later 19th and early 20th century. It also represents the system of returnable, recyclable containers. Soda syphon (or siphon). This is a certificate of indenture, a legal agreement, between George Beattie of Forest Creek, near Castlemaine in the colony of Victoria, and Peter Christian Smith of the same place. Both were miners. Beattie was the vendor and Smith paid twenty-five pounds for a land parcel. The contract was witnessed by John Hedderwick, a law clerk in Castlemaine. There is a record in the Mount Alexander Mail, dated Wed. 22 April 1857, of George Beattie purchasing land for three pounds, sixteen and sixpence in Castlemaine and that it was withdrawn. Records also show that a Peter and Thomas Smith farmed in Sandon near Castlemaine.This item is a useful research tool as it a hand-written record of part of the history of the gold fields region of Victoria.A white paper certificate of conveyance with black print and hand-written details from George Beattie to Peter Smith. This Register of Mortgagees comes from the Warrnambool legal firm of Fletcher and Mackay which resulted from the merger of the firms of George Sutherland Mackay and James Fletcher in 1893. G.S. Mackay was a prominent resident of Warrnambool from 1891 to his death in 1926. In the 1920s Mr J. Taylor became a partner in the firm known then as Mackay and Taylor and the firm later known as Mackay Taylor was in operation until the 1990s at 131 Kepler Street. The Register of Mortgagees with dates ranging from 1908 to 1924 comes from the old Mackay Taylor offices in the Kepler Street building.This Register of Mortgagees is of some significance as it contains information on many families living in Warrnambool in the early 20th century, including those of Burleig, Swinton, Uebergang, Turland, Bates, Wood and Paton. The entries have social significance, showing the typical loans taken out at the time and the prevailing interest rates. This is a small quarto sized ledger containing 166 pages of a register of mortgagees. The pages have been printed with ruled red lines. The cover is bound with a black cover and a red spine. There are pages with alphabetical tabs at the start of the book. The entries are in black ink. There is one loose page which is an old envelope used as scrap paper to record names and amounts owing or paid. This receipt book was used in the law business of the Warrnambool lawyer, George Mackay (1891 to 1893) and the amalgamated firm of James Fletcher and George Mackay (1893 to 1910). George Mackay was a prominent Warrnambool lawyer, active in the civic and community affairs of the town and the firm of Fletcher and Mackay was an important one in Warrnambool over the time covered by the entries in the receipt book. In the 1920s the firm became Mackay and Taylor when J. Taylor joined as a partner and was a well-known legal firm in Warrnambool until the 1990s. The book was found in the old Mackay Taylor offices in Kepler Street. WarrnamboolThis is a ledger with a dark green binding and black tape on the spine. There are 176 pages plus an alphabetical listing at the back. Most of the entries are receipts that have been pasted into the ledger with some additional written material. Nothing is known of Robert Main except that he was a Warrnambool carpenter who had a wife named Jane and he died on 9th August 1880. He left an estate to the value of £35. The Warrnambool lawyers, Bayley and Higgins operated in Warrnambool in the 1880s. Mr Bayley came from Port Fairy and Jabez Higgins, well-known in Warrnambool for his sporting and community interests, purchased the legal practice of Bayley and Higgins with his brother in 1875. Jabez Higgins built the residence, ‘Corio’ in Warrnambool and died in 1886. Referring to the legal history and transfer of land for the Junior Legacy Club Balnarring camp from Legatee Savige. Melbourne Legacy provided camps for junior legatees - the children of deceased servicemen. It started with outings to the property of Legacy founder, Legatee Stan Savige, who had a place in Balnarring. Permanent camp buildings were built in 1930. Lord Somers (Governor of Victoria) also ran a camp in the area and the area became known as Somers. These documents record the transfer of the land to Legacy. Jean-Pierre Trouette was natuarlised in 1862 the year he, his wife Anne (nee Blampied) and her brother Emile purchased land at Great Western and established the Great Western wineries. Unless a person was a Victorian citizen they could not own freehold land and run a business. This certificate testifies to Trouette's legal status and entitlement to establish the Great Western vineyards. At the Intercolonial Exhibition in Melbourne in 1866 his wines were noticed and was noted also in 1867. Minutes of the Ballarat School of Mines Council (10 nov. 1870) state that a letter be sent to Sir Redmond barry acknowledging with thanks the copy of his address and stating that the COuncil had determined upon ordering 100 copies at at present buyt that the Coucnil had postponed the printing of a larger number till the constitution and some other matters are prepared so as to be printed with that. The Ballarat Mining Board moved a motion to start Australia's first school of Mines at Ballarat. This document shows the resolutions of the Mining Board, and make reference to the Ballarat School of Mines Trustees, Redmond Barry, Rivett Henry Bland and Somerville Livingston Learmonth. This caveat was to prevent forgeries (signatures) from ocurring. Hand writing experts can clearly distinguish forgeries because by using nibs, the "natural" and distinctive hand inflections whilst forming the signiture cannot be replicated by forgers.This item is significant to the Kiewa Valley because it details that even in the rural sector,(Kiewa Valley) the legal requirements of the day had to be adhered to. This was even at a time when in the rural areas a "man's word and handshake" was his bond", especially between neighbours or others in a small rural region. This however was not the case for Government Departments , banks and the hospital. Between the 1950s and 1970s, road safety was redefined as a medical and social problem, rather than a moral and legal one. This was a time before seat belts. The Road Safety Colouring Competition was a free colouring competition for children, organised by Commonwealth Oil Refineries Ltd., started in August 1954 with the , aims of teaching road safety. There were 1,000 prizes, valued at £1,200. The winner would receive a £100 bursary and a free plane trip with one parent to Canberra to receive the prize from the Federal Minister for Transport, Senator.G. McLeay. This booklet is the one used by the children in Orbost in 1958. This booklet was designed to promote road safety awareness, with messages and activities specifically considered for children. Its aim was to teach road safety in a fun, but educational way. This item was an important educational tool. Victoria became a separate colony of the United Kingdom on 1 July 1851; however it took until 1864 for a workable system of weights and measures administration to be introduced. Standard of weights and measures were obtained and issued to local authorities to administer in their local areas. These standards were numbered, as were the Crown stamps used by inspectors to indicate that trade weights and measures had been checked and found to be legal to use in the day-to-day businesses of local traders. The purpose for this map being created or the date when it was made has not been established. It appears to be documentation relating to a legal dispute by a landowner named O'Hagan and the Shire of Bacchus Marsh. Features identified on the map are allotment 5, section 16, Parish of Korkuperrimul, a 'cultivation paddock', a section of the Werribee River, the path of a section of a 'Main Channel', and a barrier or filled in section across the Werribee River called 'Lee's Filling'. Tait collection: item 36 of 62 This document contains the details of the Will and Probate of David Williams of ‘Morgrugyn’ farm near Woodford. He was born in 1804 and died in 1889. He was a pioneer settler in the Woodford area, arriving, according to the Pioneer Honour Board, in 1842. His son, Ivor, was Secretary of the Grasmere Cheese and Butter Factory for some time and Secretary of the Warrnambool Cheese and Butter Factory in 1888. David Williams left real estate to the value of £1540 and personal estate to the value of £1075. The chief beneficiary was his eldest son, David but other sons and grandsons also benefited. His wife, Mary, was left £300, a house to live in rent free during her lifetime, two cows and the right to graze them on the farm, six silver spoons, her bed and bedding, washstand and ware, a dressing table, a table in the dairy and ‘all the crockery and cooking utensils she may require’. The lawyer drawing up this document was James Fletcher who had an office in Port Fairy in the 1870s and an office in Koroit Street, Warrnambool, in the 1880s. In the 1890s and early 1900s he was in partnership with George Mackay. This document was in the possession of the lawyer Ernest Chambers who had drawn up the Williams will. It was then passed down to successive lawyers occupying legal premises in Kepler Street until it was located in 2014 in the Kepler Street building last used as legal premises by the firm of Mackay Taylor. This document is of considerable interest as it contains the will and probate details of a prominent 19th century farmer in the Woodford district.
