A photocopy of 7 pages of Chapter 13 from Legatee Donovan Joynt's biography 'Breaking the road for the rest'. Legatee Donovan had received a VC in World War 1. Chapter 13 deals with Legatee Joynt's involvement with Legacy. It covers some of the early years of Legacy's history as he was present at the first luncheon. He mentions it was Mr PW Powell (Pip) that proposed the name Legacy - other accounts attribute the idea to Frank Selleck. It seems Legatee Powell suggested the idea but it was Legatee Selleck that proposed the formal motion and was documented in the minutes. Joynt mentions: "The speaker emphasised that the name Legacy was chosen because it the members of the new organisation had accepted as a legacy the responsibility of seeing that the ideals which their comrades had died fighting for were maintained in Australia." This is a receipt or docket (number 7048) issued by Ross Motors in 1964 for goods supplied to John Wilson of Donovans Road, Warrnambool. Ross Motors were car dealers at 137-149 Fairy Street, Warrnambool in the 1940s, 50s, and 60s. They also repaired and serviced cars. In the 1940s they advertised as the ‘largest garage in the Western District’. The docket was for John Alexander Wilson for the purchase of three items from the garage totalling £2-12-0. This docket is of some interest as an example of one from Ross Motors in the 1960s. This is a buff-coloured docket with black lines printed for the firm of Ross Motors, Warrnambool. Murray Comrie Collection. The Tarnagulla Tennis Club maintained a strong membership right through the late 1890s and well into the 1900s, and the necessity for a second court soon became imperative. Many well-known Tarnagulla residents can be seen in the photograph. Members of the Page, Bool and Comrie families are prominent, and the tall gentleman sitting near the middle of the image is Dr. Donovan, Tarnagulla's resident medico. This photograph is a fair copy created from an older original. In the early 1900s a new Coffee Palace was erected on the first railway land to be leased for private business in Wodonga. This Coffee Palace (later to become Glenburnie Guest House) was situated in High Street opposite the former Customs House which at the time was being used as the Wodonga Police Station. It was built by Mr Denny Donovan and operated by his wife. An article in the Wodonga and Towong Sentinel declared that “No expense has been spared in the erection and fitting up of the Palace, which is intended to supply a long felt want”. The building consists entirely of brick and the rooms are lofty, spacious and well-ventilated. The bedsteads are modern, and will satisfy the most fastidious. The motto of the proprietress is “Cleanliness, civility and attention”. Mr Donovan died in January 1908 and in 1909 the Wodonga Coffee Palace was sold by Mrs Donovan to Mrs P. Egan who advertised hot and cold shower baths with meals at all hours. In 1913 the Wodonga Coffee Palace was taken over by Mrs Cuthbertson and Miss Steele. In 1921 Wodonga Coffee Palace was taken over by Julia Ronan who had successfully conducted the dining rooms at the Wodonga Saleyards for 15 years until those premises burned down. The Wodonga and Towong Sentinel on 10 January 1936 reported that “the business premises formerly conducted by Mrs Ronan have been renovated and refurbished. The new proprietresses are Misses Breen, who have had extensive experience in managing such businesses. The new premises will be known as the Glenburnie Guest House.” Changes of ownership continued with Mrs M.E. Elliot taking over in December 1940, followed by Mrs Stella Victoria Wong in 1945. In 1953 it was again taken over by Mrs E.M. Moran. Items from a photo album (Cat.No. 01588), with the printed funeral service for Lt Colonel Donovan Joynt held on 12 May 1986 (Cat.No. 01596). The newspaper clipping was written by John Lahey as part of the 'Lahey at Large' column he wrote for The Age between 1982-1996. He noted that Joynt 'was the last survivor of the 66 Australians who won Victoria Crosses in World War 1.' and mentions Joynt's work for Legacy, and the Shrine of Remembrance. James Jones was the son of Philip Jones, a Chairmaker, and Ann Jones who settled in East Brighton after the sale of land c1852 in the area of the Henry Dendy Special Survey of 1841. Mary Ann Moore was the daughter of Thomas Moore, a Gardener, and Sarah Harris who also settled in Brighton c1852. James and Mary Ann Jones settled and raised their family in East Brighton now Bentleigh. They sadly lost Martha Jones born 1888 died in 1890 ,and. Baby Ethel May died 1893 and a stillborn baby was buried in 1900. However, their daughter Elizabeth Ann Jones born 1885 married John Patrick Kennedy born 1885, a the son of Thomas Kennedy , Dairyman deceased, and Jane Donovan early settlers in the Brighton area, at South Melbourne in January 1917 . James Jones and Mary Ann Moore were born in Brighton c1857 and c 1859 into pioneer market gardener families in the area of the Dendy Special Survey of 1841. They married in 1883 and raised their family in East Brighton, now Bentleigh. Sadly infectious diseases took the lives of many infants throughout the Colony of Victoria due to the poor state of water supply and sewerage disposal and locally the swamps of the Elster Creek were a constant breeding ground. Martha Jones born 1888 died 1890 and was interred in the Brighton General Cemetery. In 1893 another daughter Ethel May died and stillborn baby in May1900. Mary Ann Jones died, at age 43years, in January 1903 and in November 1940 Mr James Jones was buried in the family grave. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. In the early 1880s a small circus travelled between Millicent and Mt Gambier, South Australia. After camping overnight they discovered their Bengal Tiger at escaped and disappeared into dense scrub. After searching for hours they continued to Mt Gambier and reported the loss of the tiger to police. Police and local volunteers continued the search for the escaped tiger, but no sighting were made. In the early 1890s sheep in the Tantanoola area started to disappear with the still unsighted tiger being blamed. In 1893 reports of an unusual animal in the Tantanoola area started, with many describing the animal as the missing tiger, or a large dog. One eye witness claimed to have seen the animal carrying a full grown sheep in its mouth. The reports grew in number and exaggeration with sightings from Robe to Bendigo. In the Tantanoola district children were escorted with shotgun guards to and from school, with many homes keeping guns at the ready in case the tiger suddenly appeared. In August 1895 Tom Donovan shot the "Tantanoola Tiger" on Mt Salt Station, around 20 kms south of Tantanoola. The corpse was taken to Marks, a Mount Gambier taxidermist, at which time the animal was identified as an Assyrian or Northern Russian Wolf. Donovan displayed the animal far and wide. Despite the animal's death sheep continued to disappear from properties in the district over many years. It was of particular concern between 1909 and 1910. At that time Herbert Allchurch, an Adelaide detective, was sent to solve the mystery. A few days after his arrival Allchruch went to the front bar of the Tiger Hotel and arrested local rabbit shooter and trapper, Charlie Edmunson, with sheep stealing. After his 1911 trial Edmunson admitted to stealing over 4,000 sheep during the previous 20 years. He was gaoled for six years with hard-labour in January 1911. Edmunson had been selling the skins of the stolen sheep, leaving the carcusses to rot. He earned around five pounds per week during the 1990s and early 1900s, a time when the economy was depressed. It is not known had the animal known as the Tantanoola Tiger came to Australia, but it is believed it survived one of three ships wrecked of the coast between 1890 and 1893, making it to shore along with some of the shipwrecked passengers. It has taken the place of the Bunyip, whom hundreds have seen but none captured. This tiger is supposed to have broken loose from a travelling menagerie in the North-eastern district. At the beginning we should like it roved that such an escape ever took place. Perhaps the showmen were afraid to report the fact to the police; at any rate they did not do so. The first story about the tiger being seen came from the neighborhood of Wangaratta, 60 miles from the place where it is said to have commenced business on its own account. He was followed, but vanished among trees. Next we hear of a strange animal, bigger than a St Bernard's dog, but shorter legged, having appeared at least 150 miles from Wangaratta. Between Lilydale and Wangaratta there is a dividing range 2,000 feet high in the lowest past, besides several large rivers. An finally, the tiger - changed from a panther - is reported as having been seen within the suburban circle, about 8 miles from the general Post Office. They show you footprints, and point to the carcasses of mangled cows and calves. Casts have been taken of the footprints for examination by scientific men, who pronounce them doglike, and yet not doglike, but panther-like, which gives a nervous turn, for the panther may take up killing children and grown-up people.
