In 1993 Eltham Shire Council issued a permit to Michael Muzur, Terry Lant and Andrew McMillan to redevelop the former Montmorency Theatre/Bingo Hall at 41-43 Were Street as an alcohol-free youth entertainment centre. Ron McCormack, retired former JP on behalf of 41 Joint Appellants consisting of local residents and traders successfully lobbied the community and won an Appeal to have the permit cancelled as unsuitable development. The Administrative Appeal Tribunal found that the proposed development came withing the Eltham Planning Scheme definition of an 'amusement parlour' and that the playing of pool an amusement machines would be the focus of the centre and unlikely to attract older age groups. The tribunal was not satisfied the applicants had sufficient knowledge or where with all required for the successful running of this type of operation. With respect to the objectors, the Tribunal did not accept that a responsibly managed and attractive amusement parlour could not coexist near the adjoining residential area and without detriment to the commercial centre. At a Council meeting on June 7, 1994 councillors requested a report outlining criteria to be used to assess planning applications for youth entertainment venues given the Tribunal's view that a poorly managed facility in a small neighbourhood shopping centre, particularly in such close proximity to a residential area would not only have the potential to increase perceived youth problems, but could jeopardise the prospects of future proposals. On 15 December 1994 the former Shire of Eltham ceased to exist following the Liberal Kennett Government local council amalgamations. A new Nillumbik Shire Council was established with unelected commissioners appointed. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. The Advisory Committee was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. This collection of papers have come from the offices of William Ardlie a local solicitor. He was born in Moonee Ponds in 1843 and was admitted as an attorney and solicitor of the supreme Court in 1865. From 1867 to 1878 he was in partnership with George Barber and then continued to practise until his late eighties which made him the oldest practising lawyer in Australia. He was involved in local councils and organisations such as the Hospital and Anglican Church.He was associated with several large homes in Warrnambool including Wyton presently the home of Emmanual College Warrnambool. He died in 1933.His son E L Ardlie also practised as a solicitor from the same offices from 1893. A number of the invoices included relate to the Estate of James drought who was a local policeman and owner of a number of properties and operated in various trades such as George Ramsay manufacturer of stoves and chimneys, J Rogers plumber & gas fitter and Christian & Dodds who were carpenters and joiners. There are a number of documents which relate to the Chinese, many of whom operated market gardens along the Merri River. They were a familiar part of Warrnambool from around 1872 until around 1940. The names mentioned in these documents include Ah Foo,Charles Quing Bow, Andrew Quing Bow Ah Bing Ah Jing Ah Moon and Ah Seong. They were reknown for their supply of fresh vegetables to the people of the town. They leased land from John Moore. These documents are a cross section of the types of documents which were used and are still used in the operation of businesses. They provide a social snapshot of people and the business which they conducted with their solicitors in this case William and E L Ardlie who were a long standing legal firm in the district. Robert Maclellan, appointed Mr. Paul Jerome as an Advisory Committee under section 151 of the Planning and Environment Act 1987 to consider a Convenience Centre and an alternative proposal by Iha Shire of Nillumbik being the Eltham Gateway Community Precinct Concept Plan for the site of the former Shire of Eltham municipal offices at 895 Main Road, Eltham. In summary, the terms of reference for the Advisory Committee required it to: • consider the merits of the Council proposal • examine the merits of both proposals in terms of net community benefit • address the report of the previous Advisory Committee on the Convenience Centre proposal The Advisory Committee inspected the site and considered all the material before It including submissions made by all parties to the previous Advisory Committee and correspondence received by the Department of Infrastructure both before and after that Committee submltted its report. First, the DPP proposal should be rejected because, on its merits, It does not sufficiently satisfy the requirements of the planning scheme which is a statutory document. The planning scheme requires that, before making a decision on the permit applications for the DPP proposal, a range of matters must be considered. It follows that consideration of these matters should Influence the decision. These matters include local policies relating to character and amenity. In particular, these policies seek • to conserve and enhance the bushland/country atmosphere, artistic heritage and strong sense of community of the Eltham Town Centre by ensuring that the design and height of any new development is sympathetic to existing buildings • to achieve a pleasing physical environment within the Eltham Town Centre by encouraging a high standard of architecture and urban design • to encourage Improvement to pedestrian amenity through such facilities as open and shattered rest areas and meeting places, crossing facilities, pedestrian arcades, pedestrian links to car parks and pedestrian weather protection • to reduce conflict between vehicular traffic and pedestrian flows, and • to encourage pedestrian thoroughfares It is submitted, as set out In the main body of this report, that the DPP proposal fails substantially to meet these policies and In so doing does not merit the exercise of discretion In Its favour with the Issuing of a permit. This finding is not offset by the investment and employment attributes of the proposal. They do not override the need to comply with the planning scheme. Second, the Council proposal, on Its own merits, substantially meets all statutory requirements applicable to this site with a possible reservation about car parking and traffic management which need further definition and assessment as the concept is refined. The Council proposal, however, has a serious weakness in that Its financial viability has not been adequately tested. The Committee refers to 'financial' rather than 'commercial' viability in recognition that Council owns the land and may enter into a range of agreements and partnerships to realise its concept some of which may be truly commercial and some of which may involve an element of subsidy arising from Council's involvement as a public body acting on behalf of its community. Eldest daughter of Edna and Bon Barrie, born on 03 November 1943 in Melbourne, Victoria, Memoirs of Wendy Barrie, recalling the early formative years of life in Melton: In 1949 I started school at Melton State School no 430 and was driven the 2½ miles to there by my parents at first. Later we walked home in the afternoons or were picked up by car as we made our way home along the Western Highway. In 1956 I went to Bacchus Marsh High School. There were 4 students in grade 6 and 3 of us went to the High School. The students from Melton, Melton South and Toolern Vale State Schools went by bus to Bacchus Marsh High School as far a fifth form. My parents drove me to the pick up point and during the five years of travel to High School. The bus travelled via Toolern Vale and later went through Exford and through Parwan. On the return journey in the afternoon the bus went in the reverse direction. The bridge at Exford was an old narrow wooden one, and the students had to get off the bus and walk across, with the driver crossing in the empty bus for safety reasons. There was a travelling allowance paid to parents and it was estimated from the distance the crow flies, a straight line. We lived a Ferris Lane, just where the Harness Racing entrance is now situated about 2 ½ miles by road to school too close to qualify for the subsidy. While at State School Melton we would walk home in a group with the Nixon and Gillespie children, along the main road over the bridge near the Shire Offices and down a hill. I was being dinked on Joyce Gillespie’s bike while holding onto the seat, toppled off the bike striking my chin and teeth on the bitumen and cracking my jaw. I was about 9 years old and stayed a couple of days in the Quamby Hospital in Bacchus Marsh, it seemed like and eternity at the time and quite traumatic being separated from my family. I can remember contemplating how I could get out of the window and run away but realised it was too far to walk home. Often we would cut across the Common on our way home from school picking up stray golf balls and collecting them from the creek when it dried out. We were warned about not accepting lifts from strangers passing along the Melbourne/ Ballarat Road. The only danger we faced was being swooped by the magpies particularly on the open ground on the Common. We were also fairly cautious when the Gypsies camped on the Common in the area just about opposite the small reservoir. “Mum” grandma Myers loved to have us call in on our way home, and usually would cut a slice of Jongebloed’s bread and spread it with home made butter. Sometimes we waited there until we were collected by car, usually driven by our mother. Margaret Nixon and Joyce Gillespie were a few grades ahead of me and Barbara Nixon was born just two months earlier than me. Our mothers were great friends for over 6o years, born in the same month three years apart. They lived within a few days of the same age as each other at the time their deaths. Dad and George Nixon attended Melton school at the same time. Sarah nee Hornbuckle Nixon and my grandfather Frederick Myers Snr were at school together at the same in the 1880s. The Nixon family lived in Keilor Road just past the Toolern Creek near the turnoff. Tom and Ann Collins lived on the southern side of the Western highway and Keilor road intersection. Jim and Ruby Gillespie’s house was further long Keilor road on the right. They backed onto the Myers who lived on the north side of Western Highway east of Myers Gully (Ryans Creek). The Bridge over the Toolern Creek as very narrow and as truck traffic increased there were accidents. One truck took out the side railing and plunged upside down into the bank and into the shallow water. Another fatal accident happened between a car and a truck right in front of the Myers house. Grandfather Fred had been a bike rider all his life, as far as the Riverina in his younger years, wryly made the comment about the drivers the speeding along the Ballarat Road were setting out to kill themselves. The road was busy particularly after the Races at Ballarat when the crowds were hurrying home to Melbourne. Train travel had changed very little from the time my mothers generation to mine. The timetable meant the usual rush to Melton South by bike in her case and if she was running late the train pulled up on the crossing. I was driven to the Station from home past Keith and Mary Gillespie’s house near the Ferris Road rail crossing to Bridge road to Melton South for the 7.32 train. While attending Sunshine High School in 1961 I would meet up with three other students, two of whom I knew from Bacchus Marsh High School days. We usually got into the same compartment on the train, it was a typical country train with a corridor along the side and compartments with a door, roof racks and sometimes heated metal containers for the feet in the winter. Some of the trains came through from Horsham and Ballarat, and the Overland from Adelaide passed through in the evening, we could hear it in the distance from the Ferris Lane home. The carriages had 1st and economy class compartments showing photographs of county scenes and holiday destinations. The engine was the large A class diesel. They are still running to Bacchus Marsh 50 years later, due to the need for the greatly increased number of commuters travelling to work in the city. Sometimes the carriages were pull by a Steam engine, these were a problem in the summer time because the sparks caused fires along the train lines and then quickly spread into the dry grass, crops and stubble. The Motor Train left Spencer Street at 4.23 pm and was the best train for me to catch. Ferris Road was a designated stop and train pulled up on the road crossing. It had steps at the door and rungs to hold while alighting to the ground. The ballast along the tracks was rough and uneven and awkward to land on. The train was painted blue and yellow with the letters VR pained on the front. This saved may parents the afternoon trip to collect me from the Station. On the walk home on the gravel road I would pass Uncle Tom and Aunty May’s house before reaching home. Melva Gillespie was studying at Sunshine Technical School and we sometimes both got off the train at the same time. On other occasions the Motor Train was replaced with a diesel engine with carriages, it was also required to stop and the driver had to be notified in advance. This meant getting into the guards van a Rockbank. It was more difficult alighting from the carriage as the gap was greater and more precarious to swing out and land on the ground. A few times in my last year of study at Melbourne Teachers College in Grattan Street Carlton. I managed to catch the 2.30 pm train to Serviceton, it was express to Melton and was very quick trip. The last train, was the 5.25 pm diesel to Ballarat and I usually caught this train to Melton South Station. On one occasion after being held up on the tram in Bourke street I had to make a mad dash to the platform chasing the train as it was just moving off and yelling to the guard, fortunately I was noticed and the train ground to halt. I scrambled into the end door and took most of the journey home to recover. After the last year at High School I continued to travel on the train, 2 years to Prahran Technical School changing at North Melbourne. There were a lot school children travelling to private schools and some at the primary level and mainly from Bacchus Marsh. Rockbank children also travelled by train from the beginning of their high school years, quite a few went to Sunshine High School. During my third year of teacher training I travelled to Flinders Street to RMIT for ceramics classes and Grattan St Teachers College located in the grounds of Melbourne University. There were many teachers being trained at the Secondary Teachers College due to the baby bulge creating a great shortage of teachers. Sunshine High School was very well represented amongst the different courses in Primary, Secondary and Art and Crafts. I attended Melbourne University lectures, studying a Fine Art subject. Bernard Smith was the most notable of the lecturers. he replaced Professor Joseph Bourke who had taken leave for the years. In 1962 he published the art book “Australian Painting”. The secondary art and craft student teachers from the College were in the majority, taking this subject and were well regarded due to their practical art and craft methods and their teaching round experience. In December 1964 I graduated as a Trained Secondary Teacher – Art and Crafts. The graduating ceremony was held at Wilson Hall. I received my appointment to work at Maryborough High School. Uncle Max and Aunty Rosemary Myers arranged my accommodation. Uncle Max was a teacher at the Maryborough Technical School fat the time. The appointment was suddenly changed when just before the school year was about to start when I received notification that I was now required to move to Warracknabeal High School. I was subject to a bond for the three years of training and three years of teaching and was under an obligation to comply with the directive of the Education Department. My father stood as guarantor when I was accepted as student at the Melbourne Teachers’ College, thus enabling me to receive my teacher training, and a 5 pounds a week allowance for expenses. After teaching for two years at Warracknabeal High School I was fortunate enough the gain a transfer to Sunshine West High School, returning to live at home in Melton and travelling by car to work with a fellow colleague, Jock Smith who lived at Station road Melton. I completed bond obligation and resigned at the end of the year. The employment regulations at that time did not allow the option of leave of absence for, indefinite overseas travel. I returned to Australia in October 1969. Visiting Arthur Hart the Principal of Sunshine High School he arranged with the Education Department for my re-employment at Sunshine High School until the end of the year. In 1970 I was transferred, and returned to Sunshine West High School where I worked for the next three years. In January 1968 I sailed on the “Oriana” to South Hampton with two teaching friends from Warracknabeal High School on a travelling and working holiday. Doreen Kiely, a former Bacchus Marsh High student and fellow train traveller from Bacchus Marsh, was already working in London, had arranged our accommodation at the London Travellers Club Hotel, Braham Gardens, Earls Court SW5. We based our stay at this address in London and travelled around Scotland, Ireland and England. In the summer we took a four month trip around the Continent and the Mediterranean. I registered with The Royal Borough Of Kingston Upon Thames as a Supply teacher, and worked at Chessington School form autumn to spring the following year and living with Mrs Rose Gillies at Kinross Avenue, Worcester Park, Surrey. In the spring of 1969 visiting Norway, Sweden and Finland joining an organised camping group to the Artic Circle, entered Russia at Leningrad (St Petersburg) Moscow, Minsk, to Poland and Czechoslovakia. In August returning to Worcester Park for the flight to Montreal to stay with cousin Lynette and husband Jurgen. A side trip was taken to Toronto, Niagara Falls and New York. The flight home from Montreal to Melbourne took 52 hours. A ½ day break in Vancouver before boarding the Qantas boeing 707 via San Francisco, Honolulu, Fiji, Sydney to Melbourne. It is recognized as the minute book and cash receipt book of the period 1922-1926 when the Memorial Park Committee, who it seems were part of the Shire of Eltham Soldier's Memorial League, was requested to raise funds for building the Shire of Eltham War Memorial Tower at Kangaroo Ground. History tells us that the tower, which is currently being refurbished, was officially opened by the Governor General of Australia, Lord Stonehaven on 11.11.26. The ladies invited to the first meeting at the Shire Hall did so on 21st September 1922. The minutes book reads: Present: Mesdames Bell, Bourchier, McMahon, Gosling, Cockcroft, Wraight, E Coutie, R Rogers, A Jones, AH White, Davies, Everitt and the Misses Lacey, Harris, N Weller, Gosling, Bell and D and G J Bourchier. These people became the Kangaroo Ground Memorial Bazaar Committee along with others named at further meetings. They conditionally accepted the role of raising funds, their condition being that the Bazaar Committee be given representation on any committee empowered to deal with the memorial in proportion to the amount of money raised by the bazaar'. This particular box of brass drawing pins would have been used before the introduction of cheaper polished chrome drawing pins manufactured in Asia. The box construction and label would suggest that supply of this boxes contents could have been in the early 1950's. Drawing pins or push pins were first invented in 1900 by Mr Edwin Moore. The need for a secure fastener to accommodate temporary signs and notes for domestic and commercial environments sprang up from the need to cope with an increasing faster method of presenting information on removable surfaces such as temporary notice boards. In the 1950's and later the increase in the pace of "living" brought about many time saving written communication notices. This temporary method of providing fast temporary notices is being surpassed by the computer age and mobile telephone "applications". The information spectrum of the computer age has made many "hands on" (drawing pin) applications go to the "dodo" level. This box of drawing pins is very significant to the Kiewa Valley and its region because it demonstrates that the pace in rural regions especially those that were once semi remote regions has moved at the same pace as the bigger towns and cities. Differences are still noticeable, such as the requirement of drawing pins for temporary signs and mail box commercially important "sales" notifications. The pressures that produce the "rat" syndrome, that is pressure by increased population levels infringing upon the individual's day-to-day existence is still not present in rural areas such as the Kiewa Valley. Drawing pins are still a requirement for leased accommodation (which are usually short term accommodation) for the personalisation of "home" wall decorations and shopper's "notice and information boards"This small box, similar to a "match box" (thumb activated slide, top open, cardboard container), holds brass drawing pins. These brass pins are also known as brass tacks, thumbtacks or push pins. The top of the brass tack has a "domed head" with the manufacturer's logo stamped on it. The number "2" on the bottom right of the label is the "weight" of the drawing pin. William Thomas George was born in Birmingham in 1884 and was a tin plate worker. He and his wife Ellene had a son Leslie Thomas George. The firm W T George & Co was formed sometime later. In 1939 his firm produced ship lamps. The Patent Number GB546575 on the lamp's plate was assigned to Leslie Thomas George in 1941 for improvements in, or relating to, ships' lanterns. From that time the patent number was affixed to their namufactured Meteorite lights. The ship navigation lamp is important as an example of the evolution of marine safety technology. Countries began passing laws and regulations in the 1830s that required ships to show navigation lights at night or in poor weather. From the late 1840s colours were standardised; red for portside of the vessel and green for starboard, a white masthead light, and a white light at anchor. By 1914 the International Convention for the Safety of Life at Sea was formed and continues, with decisions and notifications on improvements and changes.. Lamp; Portside ship's lamp is rounded in the front with two flat sides coming to a point at the rear. Glass has circular ridging. Metal handle with lid and clasp. The reflector has red colouring. Reitman’s cement products factory at 306 Jasper Road, Ormond prior to demolition. The current Editor gives information obtained from further recent research . An Article by Tom Sheehy, past President and Historian, February 1979 “The Vineyards of Moorabbin”. The ‘Brighton Estate” began when Henry Moor brought Vine cuttings from Camden NSW 1848 and they were productive after 3 years. Many Vineyards then appeared from Port Phillip Bay to East Boundary Road and produced 2/3 of the annual Victorian grape crop. On arrival as a convict in 1830 his occupation is bricklayer and he can ‘ read and write’. Water flooded Joyce Park, the grounds of the Cottage and a little seeped into Grace Lewis Room in December 2009 when a water main at the neighbouring Bowling Club burst, but little damage occurred and the Glen Eira Council will install drainage pipes between Box Cottage and the Bowling Club. In January, 2 brush tailed possums had taken up residence in the Barn and after failed attempts by Helen and Dennis to move them, Glen Eira Council relocated them. An article ‘Re-visiting some ‘Box Cottage’ Facts recounts the discovery of the ‘Cottage’ in a shed on the property purchased by Mr Laurie Lewis from the Reitman family in 1977. Thankfully Mr Lewis appreciated such a find and donated it to the City of Moorabbin, and together it was dismantled and re-constructed in Joyce Park, Ormond in 1988 – 100 yards from the original site.
