Warrnambool and District Historical Society Inc.
Document, Accounts, Early and Middle 20th Century
These pages of accounts are from the firm of Mackay Taylor, Lawyers, a prominent firm in Warrnambool for over 100 years. The Warrnambool legal businesses of George Mackay and James Fletcher merged in 1893 and was known as Fletcher and Mackay. In the 1920s Mr Mackay took J. McD Taylor as a partner and the premises at 131 Kepler Street were built about that time, with the firm being known as Mackay and Taylor. After the original partners died there was a succession of partners with the legal firm continuing as Mackay Taylor until the 1990s. These account sheets from a prominent 20th century legal firm in Warrnambool are of considerable importance as they document the legal records of many Warrnambool and district personalities from the early 20th century. The information contained in the sheets will therefore add to the known history of many local people from the past and will be very useful to researchers. These are handwritten accounts for bills to be paid to Mackay Taylor Lawyers for services rendered. The accounts are described in detail and are written on quarto size paper with the requisite red lines already printed on the pages. There are over 100 sheets and they date from 1938 to 1940. There are also two original Certificates of Title for Eva Willis (1916, portion of land in Cramer Street) and Archie Jackson (1924, portion of land in Cramer Street). warrnambool, warrnambool lawyers -

Harriet (Minnie) Williams was born London, 1857, the daughter of George John Williams (1812-1895) and Jane Mansfield (1812-1895). In September 1885 she was operating Williams’s Drapery Establishment in premises on Main Road owned by R. Wallis who advertised them to let in September 1885. In 1902 she opened Williams’s Cash Drapery Mart at the southwest corner of Bridge Street and Main Road (opposite the Post Office), owned by W.J. Taylor. In 1906 she bought the premises and one quarter acre of land and expanded the business with a re-opening in April 1906. Harriet was also well-known and esteemed as an active worker in Methodist circles and also Superintendent of the Sunday School. Harriet fell ill in August 1907 and died 15 August. She is buried in Eltham Cemetery with her good friend Ada Ford. Evelyn Observer and Bourke East Record (Vic. : 1902 - 1917), Friday 30 March 1906, page 5 ________________________________________ ELTHAM. (FROM OUR OWN CORRESPONDENT.) For over three years Miss Williams has carried on a drapery business in very small and inconvenient premises opposite the Eltham post-office. Recently she bought the building and a quarter-acre of land from Mr. W. J. Taylor. Thus having a free hand, she at once matured plans to enlarge and improve the premises to make them suitable for her growing business. The result being that she consulted Mr Roach, contractor, of Heidelberg, put the matter in his hands, and now he has completed in a very satisfactory manner and up-to-date style extensive improvements. A large addition, of very neat and attractive design, with three large windows, has been built right along the front of the old building, and the counters and inside fittings are very neat and convenient, harmonizing well with the attractive outside appearance. Miss Williams has now got in a large now stock of goods, and is making extensive arrangements for a “reopening week," commencing 2nd April, during which time she will make 10 per cent reduction on all cash purchases in the form of gifts of that value. Miss Williams has gone to considerable expense and liability both, in the enlargement and improvement of the premises and in purchasing additional stock. We therefore trust that the public will stand by her by heartily and en masse patronizing her re-opening effort to show their appreciation of pluck in this advance movement. Postcards were posted or exchanged in huge numbers. Postal authorities in Australia only allowed the private printing of postcards from 1898. At this time the back of the card was reserved for the address and postage stamp, and the front was used for the message and a picture. In 1902 British authorities allowed a "divided back", so that the left side could be used for the message, the right side for the address and stamp, and the whole of the front was devoted to the picture. France followed suit in 1904, Germany and Australia in 1905, and the United States in 1907. - Frost, Lenore; Dating Family Photos 1850-1920; Valiant Press Pty. Robert David Taylor was a farmer who lived in Eltham all his life and died in 1934 at the age of 76. Mr and Mrs Bowman lived in York Street; Taylor was their neighbour. In 1933 he subdivided his land, the plan showing a proposed Grey Street flanked by residential blocks for sale. Mrs Bowman bought one: her family would be able to walk through it and along Grey Street to Henry Street, thus providing quicker access to the railway station. But Taylor retained ownership of Grey Street itself. He fenced it off at each end and charged the Bowmans with trespass when they used it. The matter went to Court. The ruling was that Mrs Bowman could use Grey Street, as she owned land in it, but her husband could not. (Taylor also accused the Bowmans of having broken the fences, but could not prove it.) Taylor had wanted to subdivide his land in 1914. Plans were submitted to Council and were approved, but the subdivision did not proceed. In 1919, Taylor doctored the plans to make it appear that a totally different subdivisional arrangement had been approved. The Titles Office immediately detected fraud, and the Crown charged Taylor with forgery and counterfeiting. But charges were later dropped (reason not recorded). He was an Eltham Shire Councillor between 1911 and 1920. In 1920, Council charged him with illegally felling 91 eucalyptus trees in Eltham Park (60% of them in a healthy condition), presumably to be sold as firewood. He was imprisoned pending trial. Taylor claimed that he had acquired from another man the right to remove timber and sued the Council for wrongful prosecution. The case eventually went to the State Full Court, with judgement given in favour of Council, on the grounds that any right acquired by Taylor covered only the removal of logs and refuse, not sound green timber. And his position as Councillor precluded him from acquiring the right anyway. Robert David Taylor was also a Trustee of the Wesleyan Church owned land at Lot 20 Henry Street, originally purchased in January 1855 for a chapel and from which David and Catherine Clark first ran their private school, the forerunner of the Eltham Primary School. The land was sold in November 1901 to the Hope of Eltham Tent No. 195 Victoria District Independent Order of Rechabites, for which his brother William John Taylor was a Trustee and became the home of the Eltham Rechabite Hall. In December 1921 it was again sold, this time to the community for use as the Eltham Public Hall, Robert David Taylor being a member of the Committee.Born Digitaleltham cemetery, gravestones, charlotte amelia taylor, eltham district historical society, heritage excursion, lillian jane taylor, richard pinn, robert david taylor -

Newspaper clipping, Supermarket next on old site, Diamond Valley Mirror, Wed. Feb 17, 1965, p5, 1965
In February 1965, Staffs Railway Store, the oldest business premises in the Eltham shopping district was demolished. Formerly a self-service grocery, restaurant and electrical repair shop, the building for many years housed Eltham’s only ‘family’ grocer and feed store. Earlier it had appeared to have been the town’s bakery. The building had been purchased in late March 1939 by Mr Eric N. Staff. At the time of E.N. Staff’s purchase there were huge bakers’ ovens located at the rear and the building also had a well and four toilets for employees. When the ‘pictures’ came to Eltham with the opening of the Eltham Public Hall across the road in 1941, Mr E.N. Staff extended the business and opened a milk bar and sweet shop. Further extensions re-established the tea rooms of days gone by. Mr E.N. Staff conducted business for about 15 years before handing over the reins to his son, Ray Staff. When his son Ray took over, the milk bar and tea rooms were closed for several years but the milk bar and was later re-opened and subsequently became a greengrocers and later again, a restaurant. The tea rooms section was converted to an electrical repair shop about 1955. Electoral Roll records for 1967 record Raymond Charles Staff at 929 Main Road, Eltham, grocer, and in 1968 at Lot 4, Hillcrest Avenue, Eltham, taxi truck operator. So it would appear that Ray continued to run the business for approximately two years after the original store was demolished and a new supermarket was built. Today, 929 Main Road is the Nongkhai Thai Restaurant and is precisely where the original Staffs store stood. Even though the facade has been modified at eye level with new larger windows, the upper facade is identical to that of the new Eltham Big Star Food Centre of 1965/66. But how did the original building, the oldest premises in the 1965 era shopping centre come about? On August 12th, 1902 at the Eltham Courthouse, appearing before T. Smallman, Esq,. Police Magistrate, and Messrs. W. Duncan and W.J. Taylor, Justices of the Peace is Luther Haley, baker. Wilfred Henry Johnston, by his agent Stanley Ernest Elder had applied for a warrant of ejectment under the Landlord and Tenant Act 1890 against Luther Haley from the bakery premises at the corner of Main Road and York Street. From the evidence presented we learn that Mrs Burgoyne of Eltham had purchased the property some months earlier from Mr Johnston, which consisted of a store and bakery establishment at Eltham occupied by Mr. Luther Haley, and whose lease expired some little time back, and up to the present time, Mr. Haley was not prepared to leave. He informed the court that he is unable to secure at Eltham a suitable house in which to carry on his business, but was building a place near the railway station which he expected to be done in about three weeks time, and he is then prepared to give up possession of the premises he now occupies. Mr Smallman informed the defendant, Luther Haley, that he will have to quit the premises in three weeks from the present date, and that a warrant of ejectment would be issued. However he also informed Mr Haley that he would order the warrant to lie in the office for three weeks from that date. The premises under construction referred to by Luther Haley in court were situated on the western side of Main Road, near the railway station slightly opposite present-day Arthur Street. It was opened around September 1902 as a General Store, Bakery and Tea Rooms. This was the original building in the present-day shopping precinct. At the time the only thing nearby was the railway station. Luther Haley’s business appeared to prosper and he would have catered to not only the locals abut also day visitors by train on Sundays coming up from Melbourne, offering fresh baked produce, tea rooms and summer drinks. The fields across Main Road running between present day Arthur Street and Luck Street were known as Haley’s Paddock and at times were used for community festivities and picnics. A newspaper report on the annual State schools picnic held at Haley’s Paddock on March 11, 1904 described it as “quite close to the railway station, and is quite capable of holding comfortably 10,000 people. With its ample shade and hilly surroundings, it is an ideal place for any gathering.” Luther Haley successfully ran his general store, bakery and tea rooms until 1917 when he and his family departed the district and moved to Westgarth Street in Northcote where he changed careers and became a publisher. It was then taken over by Hannah Lloyd and became known as Lloyd’s Railway General Store from 1917 to 1920. From then it had a succession of owners, one as short as two months until March 31, 1939 when the Grocery Business formerly carried on by Mr. T.K. White of Eltham for the previous eight years was purchased by Mr Eric N. Staff of Research and became known as E.N. Staff’s Railway Store. The ownership timeline for the store is as follows: Luther Haley Sep 1902-1917 Hannah Lloyd 1917-c.Feb 1920 Messrs J.R. & N.E. Lee 1920-Sep 1922 A. & E.
